RESOLUTION NO. 2630 
 
A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF TOLLESON, 
ARIZONA, APPROVING AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE 
CITY OF PHOENIX, THE CITY OF TOLLESON, MARICOPA COUNTY, AND THE 
ARIZONA DEPARTMENT OF TRANSPORTATION FOR THE INSTALLATION, 
MAINTENANCE, AND OPERATION OF FIBER INFRASTRUCTURE ALONG 
MCDOWELL ROAD FROM 83RD AVENUE TO 91ST AVENUE AND ALONG 91ST 
AVENUE FROM MCDOWELL ROAD TO LOWER BUCKEYE ROAD. 
 
WHEREAS, the City of Tolleson (the “City”), the City of Phoenix, Maricopa County, and 
the Arizona Department of Transportation desire to enter into an Intergovernmental Agreement 
(“Agreement”) for the installation, maintenance, and operation of fiber infrastructure along 
McDowell Road from 83rd Avenue to 91st Avenue and along 91st Avenue from McDowell Road 
to Lower Buckeye Road; and 
 
WHEREAS, the fiber infrastructure will support traffic signal coordination, intelligent 
transportation systems, and regional connectivity, and will define the responsibilities of each 
participating agency for construction, ownership, maintenance, and operation within their 
respective jurisdictions. 
 
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF 
TOLLESON, ARIZONA, as follows: 
 
Section 1. The recitals above are hereby incorporated as if fully set forth herein. 
 
Section 2. The Intergovernmental Agreement between the City of Phoenix, the City of 
Tolleson, Maricopa County, and the Arizona Department of Transportation for the installation, 
maintenance, and operation of fiber infrastructure along McDowell Road and 91st Avenue is 
hereby approved substantially in the form attached hereto as Exhibit A and incorporated herein 
by reference. 
 
Section 3.  The Mayor, City Manager, City Clerk and City Attorney are hereby authorized 
and directed to take all steps necessary to cause the execution and delivery of this 
Intergovernmental Agreement and to take all steps necessary to carry out the purpose and intent 
of this Resolution.
