Cooperative Purchasing Agreement MEETING DATE: September 23, 2025 TO: Mayor and Council FROM: Jason Earp, Development Services Director REVIEWED: Reyes Medrano Jr., City Manager PURPOSE: The Development Services and Utilities Departments are requesting approval of a Cooperative Purchasing Agreement between the City of Tolleson and Kimley-Horn and Associates, Inc. for on-call civil engineering services related to the development of the City’s centralized water treatment plant. BACKGROUND: The Arizona Department of Administration entered into a competitively procured contract with Kimley-Horn and Associates, Inc. for on-call civil engineering and final engineering design services. This contract allows cooperative use by other public entities, including the City of Tolleson, pursuant to Section 3-5-7 of the Tolleson City Code. This Cooperative Purchasing Agreement provides Tolleson access to Kimley-Horn’s professional engineering services to support the City’s Well Site No. 9 and the broader development of a centralized water treatment plant, including well equipment, storage tank, booster pump station, onsite treatment, and ancillary infrastructure. DISCUSSION: The Agreement is effective through February 7, 2026, unless terminated earlier in accordance with its terms. It is structured as an indefinite delivery and indefinite quantity contract, meaning services will be provided on an as-needed basis, subject to City-issued purchase orders. The availability of Kimley-Horn’s on-call engineering expertise will assist the City in advancing critical water infrastructure improvements and ensuring regulatory compliance as Tolleson continues to expand and modernize its utility systems. BUDGET IMPACT: Compensation under this Agreement shall not exceed $900,000 per fiscal year. RECOMMENDATION: Staff recommends approval of the Cooperative Purchasing Agreement between the City of Tolleson and Kimley- Horn and Associates, Inc. for on-call civil engineering services, and authorization for the City Manager to execute and deliver said Agreement.
