CITY COUNCIL REPORT SUBJECT: Resolution No. 2615 - Tohono O’odham Nation Intergovernmental Agreement MEETING DATE: August 26, 2025 TO: Mayor and Council FROM: Rudy Mendoza, Public Safety Director/Police Chief REVIEWED: Reyes Medrano Jr., City Manager PURPOSE: The Police Department is requesting approval of an Intergovernmental Agreement with the Tohono O’odham Nation and adoption of Resolution No. 2615 to provide police dispatch, property, and records management services for the Nation’s Police Department at the West Valley Casino and Resort. BACKGROUND: Arizona Revised Statutes §§ 11-952 and 13-3872 authorize public agencies to enter into intergovernmental agreements for joint or cooperative actions. The Tohono O’odham Nation has requested to contract with the City of Tolleson to provide essential police support services at the West Valley Casino and Resort, which is under the jurisdiction of the Nation’s Police Department. DISCUSSION: The Intergovernmental Agreement formalizes the provision of police dispatch services, records management, and property and evidence administration by the City of Tolleson to the Tohono O’odham Nation. The initial term of the agreement will begin on October 1, 2024, and continue through September 30, 2025. It will automatically renew for two additional years unless either party provides notice of non-renewal. Renewal is contingent upon the Nation providing written notice of available funding by March 31 of the preceding fiscal year. Tolleson will dispatch officers from the Nation or their subcontractors in response to calls for service originating from the West Valley Casino and Resort. In addition to dispatch, the City will manage records related to police reports written by Nation officers and provide property and evidence services, including the collection, storage, chain-of-custody tracking, and destruction of relevant materials. The City will also support crime information systems access and compliance as the designated Holder of Record for the National Crime Information Center (NCIC) and Arizona Criminal Justice Information System (ACJIS), pursuant to a required agreement. The agreement establishes a cost allocation framework whereby the Nation is responsible for 9% of the total annual cost of Police Department dispatch services. For fiscal year 2025, this results in a service cost of $299,463.52, payable in quarterly installments. The agreement also outlines procedures for equipment, staffing, training, scheduled system downtimes, and data sharing protocols, ensuring a secure and cooperative operating relationship between both agencies. BUDGET IMPACT: There is no negative budget impact to the City of Tolleson. All service costs provided under the agreement will be fully reimbursed by the Tohono O’odham Nation, in accordance with the terms of the Intergovernmental Agreement. RECOMMENDATION: Staff recommends that the City Council approve the Intergovernmental Agreement with the Tohono O’odham Nation and adopt Resolution No. 2615. ATTACHMENTS: 1.
