CITY COUNCIL REPORT SUBJECT: Second Amendment to the Adaptive Architects Professional Services Agreement MEETING DATE: August 26, 2025 TO: Mayor and Council FROM: Jason Earp, Development Services Director REVIEWED: Reyes Medrano Jr., City Manager PURPOSE: The Development Services Department is requesting the approval of the Second Amendment to the Professional Services Agreement between the City of Tolleson and Adaptive Architects, Inc. for professional services related to architectural design for the Tolleson Aquatics Center. The amendment extends the term of the agreement and establishes a new annual aggregate compensation amount for additional services. BACKGROUND: The City of Tolleson originally entered into a Professional Services Agreement with Adaptive Architects, Inc. on December 13, 2022, to provide architectural design services for the future Tolleson Aquatics Center. The agreement was previously amended to accommodate expanding project needs. As the design approaches completion, designer input and services will be needed during construction. DISCUSSION: While under construction, the design team will assist City staff with shop drawing review, request for information (RFI) responses/reviews, special inspections, and other design-related questions. The Second Amendment extends the term of the existing agreement from June 30, 2025, to June 30, 2026. The estimated cost of these services is $182,300. This cost is based on estimated involvement in the construction process. These continued services are essential to maintaining project continuity and ensuring that the construction reflects the expectations of the design process. The amendment also updates the City Attorney’s notice address. All other provisions of the original agreement remain unchanged and in full effect. BUDGET IMPACT: Funding for the additional services is available in the approved Development Services Department budget. The not-to-exceed amount of $182,300 has already been accounted for, and no further fiscal impact is expected with this amendment. RECOMMENDATION: Staff recommends that the City Council approve the Second Amendment to the Professional Services Agreement with Adaptive Architects, Inc.
