CITY COUNCIL REPORT SUBJECT: Empire Southwest Cooperative Purchasing Agreement MEETING DATE: August 26, 2025 TO: Mayor and Council FROM: Jamie McCracken, Utilities Director REVIEWED: Reyes Medrano Jr., City Manager PURPOSE: The Utilities Department is requesting approval of a Cooperative Purchasing Agreement (CPA) with Empire Southwest, LLC dba Empire Machinery for the purchase of Caterpillar generator equipment and related accessories. BACKGROUND: The City of Tolleson is permitted, under Section 3-5-7 of the Tolleson City Code, to utilize cooperative contracts for the procurement of equipment and services. Sourcewell entered into Contract No. 092222-CAT with Caterpillar, Inc. on December 6, 2022, which provides for electrical energy power generation equipment, related parts, supplies, and services. Empire Southwest, LLC, an authorized Caterpillar dealer, has agreed to provide such equipment to the City under the terms of this cooperative contract. This CPA establishes the City’s ability to purchase necessary generator equipment for Utilities operations to ensure reliable backup and emergency power capacity. The agreement is effective upon execution and extends through November 22, 2026. DISCUSSION: This CPA provides the Utilities Department with the ability to procure Caterpillar generator equipment and accessories on an as-needed basis. Purchases will be made through individual purchase orders, referencing both the Cooperative Contract and the CPA. The agreement also provides for inspection, acceptance, and cancellation rights to ensure that the City receives equipment in compliance with all specifications. The CPA supports the City’s need for dependable power generation equipment to maintain essential utility operations and ensure continuity of services during outages or emergencies. BUDGET IMPACT: The CPA authorizes expenditures not to exceed $150,000 per fiscal year (July 1 – June 30) for Caterpillar equipment and accessories. Purchases will be made within approved budgetary limits. RECOMMENDATION: Staff recommends approval of the Cooperative Purchasing Agreement with Empire Southwest, LLC dba Empire Machinery.
