CITY COUNCIL REPORT SUBJECT: Ordinance No. 622 N.S.– Amending Penalties for Abandoned, Junk, and Stored Vehicles MEETING DATE: June 24, 2025 TO: Mayor and Council FROM: Rudy Mendoza, Public Safety Director/Police Chief REVIEWED: Reyes Medrano Jr., City Manager PURPOSE: The Police Department requests the adoption of Ordinance No. 622 N.S. to strengthen enforcement of City Code provisions related to abandoned, junk, and stored vehicles. BACKGROUND: Section 6-7-11 of the Tolleson City Code previously classified violations involving abandoned or improperly stored vehicles as a class two misdemeanor. These penalties, which included a maximum fine of $300 and up to 90 days in jail, have not proven sufficient to deter repeat violations or long-term code noncompliance. DISCUSSION: This ordinance elevates the penalty for violations under Section 6-7-11 to a class one misdemeanor. The revised provision allows the court to impose up to six months of imprisonment, a fine of up to $2,500, and/or up to three years of probation. The new penalty falls in line with the penalties for the majority of the criminal city ordinances and now includes probation as a potential penalty, whereas it was not previously an option. Additionally, the ordinance clarifies that each day a violation continues is a separate offense, reinforcing the importance of timely compliance with City Code. The update supports citywide efforts to improve neighborhood appearance, public safety, and enforcement consistency, particularly where vehicle storage contributes to blight or code violations. BUDGET IMPACT: There is no direct fiscal impact. Enforcement will be carried out using existing resources within the Tolleson Police Department’s Code Enforcement Division.
