CITY COUNCIL REPORT SUBJECT: Ordinance No. 623 N.S. - Requiring Maintenance of Parking Lots MEETING DATE: June 24, 2025 TO: Mayor and Council FROM: Rudy Mendoza, Public Safety Director/Police Chief REVIEWED: Reyes Medrano Jr., City Manager PURPOSE: The Tolleson Police Department requests the adoption of Ordinance No. 623 N.S. to amend the City Code and require property owners and responsible parties to maintain parking lots in addition to existing maintenance requirements for sidewalks, streets, and alleys. BACKGROUND: Section 8-2-3 of the Tolleson City Code currently requires the maintenance of sidewalks, streets, and alleys adjacent to properties. However, it does not explicitly include private parking lots within that requirement. This has led to inconsistencies in upkeep and enforcement. DISCUSSION: Ordinance No. 623 N.S. amends Chapter 8, Article 8-2, Section 8-2-3 of the Tolleson City Code to formally include parking lots as areas that must be maintained in a clean and safe condition by property owners or other responsible parties. The amendment clarifies that maintenance requirements apply not only to public rights- of-way but also to private parking areas serving businesses and other properties. The ordinance supports the City’s commitment to neighborhood cleanliness, public safety, and consistent enforcement of property standards. It also aligns parking lot maintenance expectations with those already established for adjacent sidewalks and alleys. Violations of the ordinance are classified as a class one misdemeanor, and are punishable in accordance with A.R.S. §§ 13-707, 13-802, and 13-902, including up to six months imprisonment, a fine of up to $2,500, and/or probation. Each day a violation continues constitutes a separate offense. BUDGET IMPACT: There is no direct fiscal impact. Enforcement will be handled by the existing staff and resources within the Tolleson Police Department’s Code Enforcement Division.
