ORDINANCE NO. 622 N.S. AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF TOLLESON, ARIZONA, AMENDING THE TOLLESON CITY CODE, CHAPTER 6 TRAFFIC CODE, BY AMENDING ARTICLE 6-7 ABANDONED, JUNK AND STORAGE OF VEHICLES, SECTION 6-7-11 PENALTY; PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES; PROVIDING FOR SEVERABILITY; AND ESTABLISHING PENALTIES. WHEREAS, the Mayor and City Council find it necessary to amend the Tolleson City Code to clarify and strengthen enforcement provisions related to abandoned, junk, and stored vehicles within the City limits; NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF TOLLESON ARIZONA, as follows: Section 1. The Tolleson City Code, Chapter 6, (Traffic Code), is hereby amended by amending Article 6-7 (Abandoned, Junk and Storage of Vehicles), Section 6-7-11 (Penalty) to read as follows (additions in ALL CAPS; deletions in strikeout): CHAPTER 6: – TRAFFIC CODE ARTICLE 6-7: – ABANDONED, JUNK AND STORAGE OF VEHICLES § 6-7-11 – PENALTY. (A) Every owner, tenant, lessee, occupant or other person who fails, neglects or refuses to abate the aforementioned nuisance as provided IN ARTICLE 6-7 shall also be guilty of a class two misdemeanor and upon conviction thereof may be punished by a fine of not more than $300 or imprisonment for not more than 90 days, or both a fine and imprisonment CLASS ONE MISDEMEANOR. UPON CONVICTION, SUCH PERSON MAY BE PUNISHED BY IMPRISONMENT FOR UP TO SIX (6) MONTHS, A FINE NOT TO EXCEED TWO THOUSAND FIVE HUNDRED DOLLARS ($2,500), AND/OR PROBATION NOT TO EXCEED THREE (3) YEARS. (B) Each day that a violation is permitted to exist CONTINUES shall constitute a separate offense. The imposition of any sentence PENALTY shall not exempt the offender from compliance with the requirements of this chapter. Section 2. Providing for Repeal of Conflicting Ordinances. All ordinances, parts of ordinances and resolutions in conflict with the provisions of this Ordinance, or any part of the City Code adopted here by reference, are repealed to the extent of such conflict. If any provision of this Ordinance is for any reason held by any court of competent jurisdiction to be unenforceable, such provision or portion hereof shall be deemed separate, distinct, and independent of all other provisions and such holding shall not affect the validity of the remaining portions of this Ordinance. Section 4. Providing for Penalties. Every owner, tenant, lessee, occupant, or other person in violation of this Ordinance shall be guilty of a class one misdemeanor. Upon conviction, such person may be punished by imprisonment for up to six (6) months, a fine not to exceed two thousand five hundred dollars ($2,500), and/or probation not to exceed three (3) years. Each day that a violation continues shall constitute a separate offense. The imposition of any penalty shall not exempt the offender from compliance with the requirements of Chapter 6. Section 5. The Mayor, City Manager, City Clerk and City Attorney are hereby authorized and directed to take all steps necessary to carry out the purpose and intent of this Ordinance.
