CITY COUNCIL REPORT SUBJECT: Ordinance No. 625 N.S. – Adoption of the City of Tolleson Supplemental Building and Zoning Code Amendments 2025 MEETING DATE: June 24, 2025 TO: Mayor and Council FROM: Michael Young, Fire Chief REVIEWED: Reyes Medrano Jr., City Manager PURPOSE: The Fire and Police Departments request the adoption of Ordinance No. 625 N.S. to amend and modernize Tolleson’s Building and Zoning Codes by adopting the “City of Tolleson Supplemental Building and Zoning Code Amendments 2025” and “Swimming Pool Program Procedures & Standard Details.” BACKGROUND: To enhance safety, streamline enforcement, and align with the latest national code standards, the City has prepared comprehensive updates to key building and zoning provisions. These include changes to mechanical systems, property maintenance, fire safety, energy storage, and hazardous materials, as well as pool safety regulations. The proposed ordinance formally adopts two documents, Exhibit A and Exhibit B, which have been declared public records in accordance with A.R.S. § 9-802. DISCUSSION: Ordinance No. 625 N.S. includes: • Adoption of the City of Tolleson Supplemental Building and Zoning Code Amendments 2025 (Exhibit A), which: o Updates to the 2024 editions of the International Mechanical, Property Maintenance, and Fire Codes. o Implements detailed provisions for ammonia refrigeration, emergency responder systems, and hazardous material documentation (HMMP and HMIS). o Introduces new gate access requirements and clarified enforcement standards for fire apparatus access and fire hydrant placement. o Sets fire safety inspection expectations, air replenishment standards, and enforcement tools for high-risk occupancies. • Adoption of the Swimming Pool Program Procedures & Standard Details (Exhibit B), including residential pool barrier, enclosure, and inspection requirements Penalties: Violations are subject to civil penalties ranging from $250 to $2,500. Offenders with three or more violations within a 24-month period may be classified as habitual offenders and subject to criminal prosecution with penalties of up to six months in jail, $2,500 in fines, and/or probation. Civil enforcement options are also authorized Emergency Clause: To ensure timely enforcement of life safety standards, this ordinance is declared an emergency and will take effect on July 1, 2025. BUDGET IMPACT: No additional fiscal impact is anticipated. Enforcement and implementation will be managed by existing personnel in the Fire and Police Departments.
