First Amendment to Haydon Companies Design-Build Agreement

PURPOSE: 
The Development Services Department is seeking approval of the First Amendment to the Design-Build 
Agreement between the City of Tolleson and Haydon Companies, LLC. This Amendment will cover final design, 
specifications and construction estimate for the Pedestrain Bridge on 91st Avenue south of Van Buren Street. 
 
BACKGROUND: 
In January 2023, Staff solicited for a Design-Build contractor for the Pedestrian Bridge at 91st Ave.  Two (2) 
submittals were received and Staff conducted interviews of both teams. On May 1, 2023, Haydon Building Corp 
was notified of their selection as the City's contractor for this project. The project was placed on hold while the 
Aquatics Center relocation was underway as the location was being investigated. Staff worked with the DB team 
to develop a conceptual design of the bridge. 
 
DISCUSSION: 
With conceptual design complete, Staff would like to move forward with final design, specifications and 
construction costing to prepare for construction. This amendment is the result of a developed scope and fee 
for these services. Upon completion of the design, a guaranteed maximum price for construction will be 
developed by the team and presented to Council for approval. 
 
BUDGET IMPACT: 
The City shall pay the Contractor an amount for the services at the rates set forth in the Fee Proposal. Funds for 
this agreement are available in the approved budget under the appropriate accounts designated for capital 
improvement projects through the Pedestrian Bridge line. The total amount for this stage is $713,561. 
 
RECOMMENDATION: 
Staff recommends the City Council approve the First Amendment to the Design-Build Agreement between the City 
of Tolleson and Haydon Companies.
