RESOLUTION NO. 2026-13 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF FOUNTAIN HILLS, MARICOPA COUNTY, ARIZONA, APPROVING AN INTERGOVERNMENTAL AGREEMENT WITH THE STATE OF ARIZONA ON BEHALF OF THE SUPERIOR COURT OF ARIZONA, IN AND FOR THE COUNTY OF MARICOPA (“SUPERIOR COURT”) WHEREAS, the Town desires to coordinate with the Superior Court to coordinate certain jury services for the Town of Fountain Hills Municipal Court; and WHEREAS, the Town and Municipal Court have historically entered into this relationship; and WHEREAS, the County of Maricopa, through its Superior Court, has the recourse and ability to provide such services. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, as follows: SECTION 1. That the Town, through its Mayor and Council, hereby approves the Intergovernmental Agreement (“the Agreement”), in substantially the form attached hereto as Exhibit A. SECTION 2. Pursuant to the terms of the Agreement, the Town hereby authorizes the expenditure of $300 per year, and a cumulative total of not more than $500. And XX/100 ($500). SECTION 3. July 1, 2026 This resolution shall become effective thirty (30) days after its passage and adoption by the Town Council of the Town of Fountain Hills, Arizona, and its approval by the Mayor and attestation by the Town Clerk. FOR THE TOWN OF FOUNTAIN HILLS: ATTESTED TO: Mayor Town Clerk REVIEWED BY: APPROVED AS TO FORM: Town Manager Town Attorney CERTIFICATION [INSERT WHEN NECESSARY] I, Bev Bender the duly appointed Clerk of the Town of Fountain Hills, Arizona, do hereby certify that the above and foregoing Resolution No._________ was duly passed by the Mayor and the Council of the Town of Fountain Hills, Arizona, at a [INSERT TYPE OF MEETING] held on [INSERT DATE OF MEETING], and the roll call of the vote thereon was ______ Ayes, ______ Nays, and that the Mayor and ______ Councilmembers were present thereat. __________________________________________________ Bev Bender, Town Clerk Town of Fountain Hills EXHIBIT A TO RESOLUTION NO. 2026-13 AMENDMENT TO INTERGOVERNMENTAL AGREEMENT FOR JURY SERVICES On or about June 12, 2024, the Town of Fountain Hills, Town of Fountain Hills Municipal Court, and the Superior Court of Arizona in Maricopa County entered into an intergovernmental agreement for Jury Services (“IGA”). approved by the Town Council as Resolution 2024-21 The Town of Fountain Hills Municipal Court and the Superior Court of Arizona in Maricopa County agreed to amend paragraph 6 of the IGA to replace in totality subsection B, item (iii) as follows: iii. If the Town of Fountain Hills Municipal Court requires any virtual private network (VPN) services (also known as RAS accounts), the Town of Fountain Hills Municipal Court shall be charged a set up charge of $50.00 per user, and a monthly charge of $8.00 per user. The fee for services rendered by Superior Court to the Town of Fountain Hills Municipal Court shall be payable on or after July 1st, within 30 days of receipt of billing, for services rendered during the previous 12-month period. Each party will establish and maintain its own budget according to its established rules and procedures. This Amendment renews the Jury Services IGA for the Town of Fountain Hills Municipal Court for an additional two-year term, from July 1, 2026, through June 30, 2028, with the terms and conditions of the IGA entered on or about June 12, 2024. In accordance with Paragraph 4 of the IGA, the Superior Court may increase the cost per summons at the time of renewal to reflect an increase in actual costs. Effective July 1, 2027, the cost per summons will be $4.35. All other costs shall remain the same. As such, paragraph 6, subsection B, item (i) is amended as follows: i. A fee of $4.35 for each summons printed and mailed by the Superior Court on behalf of the Municipal Court. All other provisions of the IGA shall remain in their entirety.
