RESOLUTION NO. 2375 A RESOLUTION OF THE COMMON COUNCIL OF THE TOWN OF WICKENBURG, ARIZONA, VACATING, ABANDONING, AND EXTINGUISHING ALL OF ITS RIGHT, TITLE, AND INTEREST IN THE ROADWAY DEDICATED BY THAT DEDICATION OF STREET AND UTILITY EASEMENT MARICOPA COUNTY RECORDER NUMBER 19530051543, AND RE-RECORDED AT MARICOPA COUNTY RECORDER NUMBER 19770190328, EXCEPT RETAINING ALL EXISTING UTILITY EASEMENT RIGHTS; ALL RELATED TO THE REAL PROPERTY GENERALLY LOCATED AT 880 WEST PALO VERDE DRIVE, 886 WEST PALO VERDE DRIVE, AND 890 WEST PALO VERDE DRIVE, WICKENBURG, ARIZONA 85390; AND PROVIDING FOR REPEAL OF CONFLICTING RESOLUTIONS. WHEREAS, the Town of Wickenburg (the “Town”) is a beneficiary of that certain Dedication of Street and Utility Easement dedicated to and accepted by the Town on January 14, 1953 and recorded January 26, 1953 with the Maricopa County Recorder, Docket 1063, Page 379 (Maricopa County Recorder Number 19530051543) (the “Street and Utility Easement”), and re- recorded on July 8, 1977, Docket 12308, Page 28 (Maricopa County Recorder Document Number 19770190328), which crosses a fifty-foot strip of land more particularly described in the attached Exhibit A; and WHEREAS, the property owners of the land abutting and underlying the Street and Utility Easement, Ryan S. Spellins and Jessica N. Spellins, Lester F. Armstrong and Jeanne W. Armstrong, Trustees of Armstrong Family Trust dated September 10, 1999, and Kevin P. Armstrong and Leah C. Armstrong, have requested that the Town abandon the roadway dedicated by the Street and Utility Easement; and WHEREAS, the Town of Wickenburg is authorized to vacate and abandon roadways pursuant to A.R.S. §§ 9-240(B)(3)(e), 28-7202, 28-7205, 28-7210, and 28-7213; WHEREAS, the Town will not abandon or change the existing utility portion of the Street and Utility Easement; and WHEREAS, the Mayor and Common Council of the Town of Wickenburg (the “Town Council”) hereby determines that the roadway is no longer necessary for public use as a roadway and wish to make clear the Town’s intent to abandon all rights, title, and interest related to the roadway, while reserving and continuing all easements for existing sewer, gas, water or similar pipelines and appurtenances, and electric, telephone and similar lines and appurtenances. Resolution 2375 2 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF WICKENBURG, ARIZONA, AS FOLLOWS: SECTION 1. The Recitals above are hereby incorporated as if fully set forth herein. SECTION 2. The Town Council hereby abandons and vacates only the roadway dedicated by the Street and Utility Easement and specifically described in Exhibit A, attached hereto and incorporated herein by this reference. The Town Council specifically does not abandon or vacate the utility easement dedicated by the same Street and Utility Easement. SECTION 3. The Mayor, the Town Manager, the Town Clerk and the Town Attorney are hereby authorized and directed to take all steps necessary to cause the abandonment of the roadway dedicated by the Easement while retaining the utility easement dedicated by the same Street and Utility Easement and to take all steps necessary to carry out the purpose and intent of this Resolution. This Resolution shall be effective upon recording. BE IT FURTHER RESOLVED, that all resolutions and parts of resolutions in conflict with this Resolution are hereby repealed. Amy Brown, MMC Town Clerk EXHIBIT A TO RESOLUTION NO. 2375 The whole of that fifty (50) foot strip, more particularly described as follows: A part of the Northeast Quarter of the Southwest Quarter of Section 11 Township 7 North Range 5 West of the Gila and Salt River Base and Meridian, Maricopa County, Arizona; an access roadway of twenty five (25) feet on either side of center line running from the northerly boundary of Palo Verde Drive, which is the southerly boundary of Lot #23, to the northerly boundary of Lot #23 Vista Del Rio Estates, further described as follows: Beginning at the Southeast corner of the Northeast Quarter of the Southwest Quarter of Section 11, Township 7 North Range 5 West, thence South 89 degrees 26 minutes West along center line of Palo Verde Drive 800.10 feet to the point, thence North 00 degrees 26 minutes West 25 feet to the northerly boundary of Palo Verde Drive and the TRUE point of beginning, thence with twenty five (25) feet on either side of the center line of said easement, North 00 degrees 22 minutes West 639.33 feet to the northerly boundary of Lot #23, Vista Del Rio Estates.
