RESOLUTION NO. 2365 A RESOLUTION OF THE TOWN OF WICKENBURG, ARIZONA, DESIGNATING VARIOUS ROADWAYS GENERALLY DESCRIBED AS SOUTH KELLIS ROAD, TURTLEBACK LANE, VIA TORTUGA DRIVE, CAMINO COBRE DRIVE, CAMINO DE ALEGRE, PORTIONS OF ARROYO VISTA DRIVE AND AMARANTH DRIVE AS SHOWN ON THE ATTACHED EXHIBIT “A” IN WICKENBURG, ARIZONA, TO BE ESTABLISHED AS A PRIMITIVE ROAD AND AUTHORIZING THE TOWN MANAGER TO PLACE WARNING SIGNAGE ALONG THE ROADWAY WHEREAS, pursuant to A.R.S. § 28-6706, the Town Council finds that the roadway described in the attached Exhibit “A” and generally described as South Kellis Road, Turtleback Lane, Via Tortuga Drive, Camino Cobre Drive, Camino De Alegre and portion of Arroyo Vista Drive and Amaranth Drive do not (1) conform to the Maricopa/Yavapai County road standards, (2) has inconsistent or irregular width, (3) has a variable surface from native material, rock, gravel or substandard pavement, (4) has poor or non-existent drainage, (5) was established prior to June 13, 1990, (6) is not regularly maintained by the Town and/or Maricopa/Yavapai County, and (7) is not designated as a state or county highway; and WHEREAS, the Town Council finds that the public interest will be served by the designation of the roadway described in Exhibit “A” as a primitive road pursuant to A.R.S. § 28-6706, and the placement of signage to warn the public of the primitive road designation. Maintenance is to consist only of chip sealing, crack sealing and sealcoating roadways. Maintenance does not consist of repaving any surfaces within the roadway network. NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF WICKENBURG, ARIZONA, that the roadway described in Exhibit “A” shall be designated a primitive road by the Town of Wickenburg and that the Town Manager shall place signage on the roadway in locations adequate to warn the public of the designation as a primitive roadway, as follows: “PRIMITIVE ROAD, CAUTION, USE AT YOUR OWN RISK. THIS SURFACE IS NOT REGULARLY MAINTAINED.” PASSED AND ADOPTED BY THE MAYOR AND COUNCIL OF THE TOWN OF WICKENBURG, ARIZONA, THIS 7TH DAY OF JULY 2025.
