• Previous approval by Town Council
o December 16, 2024 for 6 months
o Conditions of approval had screening devices on temporary toilets stored
outside
o Coordination with staff for compliance
o Non-compliance noted during entirety of operation

Current Request

• Request to extend patio services for alcohol sales/consumption
outdoors
• Would increase seating capacity by approx. 78 persons (35 current)
• Building code requires 1 restroom per 40 occupants
• Additional restroom facilities are needed to comply with adopted
building code for increased occupancy

Findings and Concerns

• Temporary toilets are generally acceptable for events ≤7 days
• Six months use not compliant with health, safety, or building code
• Would increase seating capacity by approx. 78 persons (35 current)
• Building code requires 1 restroom per 40 occupants
• Additional restroom facilities are needed to comply with adopted
building code
• Staff recommends denial of the request to extend the premises until a
permanent restroom is added or the duration of the request is reduced
to ≤7 days
