Dear Mr. Wallace:
We thank you for the opportunity to present this preconstruction and design services proposal to be performed
for the Wickenburg Community Center located at 160 N Valentine St, Wickenburg, AZ. The proceedings will
detail our understanding of the project and preconstruction services scope to be provided by Caliente
Construction, Inc. based on the July 16, 2025 job walk and conceptual sketch/scope of work provided via email
on July 7, 2025. We anticipate utilizing the 1GPA JOC program.
UNDERSTANDING OF THE PROJECT SCOPE:
It is our understanding that this project will consist of renovating the existing 10,400-square-foot community
center. The existing building was constructed in 1971 utilizing wood roof trusses and joists, CMU bearing walls
and concrete columns.
PRECONSTRUCTION SERVICES (PROVIDED BY CALIENTE CONSTRUCTION, INC.):
• Design: Review packages at schematic design (30%), design development (60%) and construction
documents (100%). Please reference Arrington Watkins proposal for documents included within each
review. The project will be divided into 2 tiers as noted below. Design will also be completed in two
phases. Phase 1 will be completion of documents through schematic development. Phase 2 has been
provided as an add alternate for completion through 100% construction documents.
o Tier 1: Essential Upgrades to structural, mechanical, plumbing, and electrical systems.
Structural:
• Repair of wood trusses at Assembly Room (preference to replace)
• Replace damaged purlins
• Replace damaged roof sheathing
• Re-slope and replace roofing system
• Replace failing patio structures

Removal of the existing stage to support adaptable programming and event
configurations. Stage to be replaced by a portable platform system, purchased as
furnishings.
Conversion of the existing stage area into a Banquet Room
Renovation of the existing kitchen into a catering kitchen. Coordination of procurement
and selection of kitchen equipment by Wickenburg. Coordinate with Wickenburg’s
kitchen equipment vendor.

Renovation of Banquet Room

• Coordination:
Caliente will assist the owner in establishing the project scope and provide expert advice in the owner’s
best interest. We have included design services from Arrington Watkins architects. We will establish bi-
weekly virtual owner’s meetings with the Town of Wickenburg and be providing constructability
suggestions, cost analysis, critical material lead times, and value engineering as the scope is developed.
• Cost Estimating:
As part of these services, we have included conceptual estimates at each deliverable milestone. We are
anticipating (2) GMP’s. The first for procurement of long lead materials and the second will be for the
balance of construction.
• Exclusions:
o All exclusions noted within attached consultant’s proposals.
o All in-person meetings. Majority of meetings will be conducted virtually. In-person meetings as
required for coordination.
o Permitting fees.
o Kitchen design consultants.
o Replat, rezone or ALTA survey.
o Traffic study.
o ACM and lead investigation for façade and site.
o Title reports.
o Legal descriptions for utility easements.
o Commissioning.
o LEED.
o Geo-technical services. We do not anticipate a requirement for this unless paving is added to the
scope. If required based on phase 1 programming we will add into phase 2 design fee.
o Landscape design. We do not anticipate landscape design but if required for tier 2 upgrades at
patio we will need to add into the scope. If required based on phase 1 programming we will add
into phase 2 design fee.
o Off-site utilities design/extension.
o FF&E design and procurement services and fees.

understanding of the project.

DESIGN AND PRECONSTRUCTION COSTS:
The above-mentioned services for the phase 1 schematic development are proposed to be performed for two
hundred thirty-nine thousand and three hundred twenty dollars ($239,320.00) over a 2-month period following
a fully executed contract or purchase order and notice to proceed. The phase 2 construction document
development are proposed to be performed for four hundred two thousand and one hundred seventy-six
dollars ($402,176.00) over a 4-month period following a fully executed contract or purchase order and notice to
proceed. Rates are per the 1GPA agreement. We have included a design contingency for changes or additional
services requested not included in this proposal.

Wickenburg Community Center
Dear Mr. Rockwood,
Thank you for the opportunity to provide a proposal for architectural services for the renovation of the
Wickenburg Community Center. This proposal is being submitted to Caliente Construction in response to
our meeting with Todd Wallace on Tuesday, July 17. During that meeting, a concept plan was developed
by Todd, and a walk-through of the facility was conducted to evaluate the existing building conditions and
discuss potential scope items.
Scope of Services: As described in the attached documents.
Professional Fee:
A spreadsheet is attached showing the breakdown of the overall fee by phase and supplemental
tasks.
An allowance has been included for conventional reimbursable expenses ($4,000).
An Owner’s allowance has not been included but is recommended.
Upon approval of this proposal, Arrington Watkins will draft a service contract.

DESIGN SCOPE OF WORK
Wickenburg Community Center
General Description
The proposed architectural services encompass the renovation of the existing Wickenburg Community
Center, located at 160 N. Valentine Street in Wickenburg, Arizona 85390. Originally constructed in
1971, the facility is a single-story structure of approximately 10,400 square feet, utilizing wood roof
trusses and wood joists, with CMU (concrete masonry unit) bearing walls and concrete columns.
As discussed during the on-site walk-through and planning session with Todd Wallace on July 17, this
proposal has identified work in three tiers of improvements. This tiered approach is intended to
identify the priorities for the project and assist in the development of cost estimates for various parts
of the work. This will, in turn, support the Town management and Town Council as they make decisions
about funding. Design documents will include work in all tiers.
Tier 1 focuses on essential upgrades to structural, mechanical, plumbing, and electrical
systems to bring the building into compliance with current life safety and building codes.
Suggested changes will improve operational efficiency and protect the public’s investment.

Structural repairs – Based on the visual assessment and recommendations provided by
Kimley-Horn, which identified existing structural deficiencies and outlined necessary
improvements

Our scope will include architectural design, coordination with structural and MEP consultants,
documentation for cost estimation and budgeting, and preparation of construction documents for each
tier, as directed.
Project Phases
The Scope of Work will consist of the phases as outlined in the Contract with the following
clarifications:
Schematic Design: 8 weeks
o Confirm the program with Town staff.
o Create conceptual design approaches.
o Civil site survey.

o Utility locating services (by Caliente Construction).
o Develop space plan alternatives.
o Meet with key Town staff, to review the progress of the schematic design.
o Select a preferred scheme and develop the preferred schematic design for approval by
key Town staff.
o Work with Caliente Construction to coordinate estimate.
o Make a presentation to the Town Council.
Deliverable: Schematic documents, including preliminary site plan, floor plan, code plan,
interior and exterior elevations, two sections, specification table of contents, and one
conceptual rendering. M,P,E, structural, and security sketch plans and system narratives.
Design Development: 8 weeks
o Develop construction drawings to 60%.
o Develop preliminary specifications.
o Develop interior and exterior color and finish palette options for review by key Town
staff.
o Create computer-generated renderings for review and approval by key Town staff.
Deliverable: 60% construction drawings and draft specifications. Presentation materials and
rendering. Permit submittal.
Construction Documents and Bidding: 8 weeks
o Develop construction documents necessary to finalize a Building Permit and required by
the Contractor to construct the project.
o Participate in regular coordination meetings.
o Provide a complete finish schedule.
o Building Permit:
Submit plans to the Building Official for review.
Pick up redlines, if required by plan reviewer.
Resubmit documents for approval.
Provide Owner with all revised information.
o Support the Contractor during the sub-bidding process by answering Requests for
Information.
o Conversion of electronic files to CAD for Town use (one time event).
Deliverable: Final plans and specifications for Town review and approval. Permit submittal.
Construction Phase Services: 48 weeks
o Shop drawing and submittal review.
o Request for Information review and response.
o Issuing ASI’s as required
o Site visits for meetings and coordination with the general contractor (up to 8 site visits).
o Attendance virtual meetings when appropriate.
o MP&E site inspections that may be required for commissioning and Final Punch list
documentation.
o Issue Substantial Completion letter.
Design Team Responsibilities
The Architect will be required to retain and be responsible for the following engineering
disciplines. Detailed proposals by each consultant are available for review if requested.

TERMS AND CONDITIONS
Exhibit “A”
Arrington Watkins Architects, LLC (ARRINGTON WATKINS) shall perform the services outlined in this agreement
under the following terms and conditions.
Payment
Invoices: Invoices will be submitted monthly by Arrington Watkins for services and reimbursable expenses
Retainers: Any retainers shall be credited on the final invoice.
Payment Date: Invoices are due and payable within thirty (30) days after the date of invoice.
Past Due Amounts: Any invoice not paid within thirty (30) days after the date of invoice shall be considered past
due.
Interest on Past Due Balances: Interest will be charged at the rate of 1.5% per month on any past due
balances. In the event any portion of an account remains unpaid ninety (90) days after billing, the Client shall pay
the cost of collection, including reasonable attorney’s fees.
Suspension of Services: If the client fails to make payment when due, Arrington Watkins may, without waiving
any claim or right against the Client and without liability whatsoever to the Client, suspend the performance of
service.
Payments Withheld: Payment of invoices is in no case subject to unilateral discounting or set-offs by the Client,
and Payment is due regardless of suspension or termination of this Agreement by either party. Payments to
Arrington Watkins shall not be withheld, postponed, or made contingent on the construction, completion or
success of the project or upon receipt by the Client of offsetting reimbursement or credit from other parties.
Notice to Proceed:
This Agreement constitutes the Client’s Notice to Proceed with Services.
Schedule
Arrington Watkins acknowledges the importance to the Client of the Client’s project schedule and agrees to put forth
reasonable efforts in performing the services with due diligence under this Agreement in a manner consistent with
that schedule.
Scope of Work
The Client and Arrington Watkins have agreed to a list of Basic Services that Arrington Watkins will provide to the
Client on the Scope of Services section of the Agreement.
Additional Services
If Client desires work to be performed beyond the Services described in this Agreement, Client must authorize the
Additional Services in writing or electronically. Payment for Additional Services will be on a time and materials basis
at the rates listed on the Agreement.
Professional Standards
Services provided by Arrington Watkins under this Agreement will be performed in a manner consistent with that
degree of care and skill ordinarily exercised by members of the same profession currently practicing under similar
circumstances.
Probable Construction Cost
In providing opinions of probable construction costs, the Client understands that Arrington Watkins has no control
over costs or the price of labor, equipment or materials, or over the Contractor’s method of pricing and that the
opinions of probable construction costs provided are to be made on the basis of Arrington Watkins’ qualifications and
experience. Arrington Watkins makes no warranty, expressed or implied, as to the accuracy of such opinions as
compared to bid or actual costs.
Ownership and Use of Documents
All reports, plans, specifications, computer files, field data, notes, and other documents and instruments prepared by
Arrington Watkins as instruments of service shall remain the property of Arrington Watkins. The client may use such
documents and work product in connection with this Project.
Hidden Conditions and Hazardous Materials:
It is acknowledged by both parties that Arrington Watkins's scope of services does not include any services related to
asbestos or hazardous or toxic materials.
Risk Allocation (Limitation of Liability)
To the fullest extent permitted by law, the Client agrees to limit the liability of Arrington Watkins’ and its sub-
consultants to the Client and to all construction contractors and subcontractors on the project to the sum or $50,000
or Arrington Watkins’ total fee for services rendered on the project, whichever is greater. Such claims and causes

include, but are not limited to negligence, professional errors or omissions, strict liability, breach of contract or
warranty.
Dispute Resolution:
In an effort to resolve any conflicts that arise during the design or construction of the project or following the
completion of the project, the Client and Arrington Watkins agree that all disputes between them arising out of or
related to this Agreement shall be submitted to nonbonding mediation unless the parties mutually agree otherwise.
Termination or Suspension
Either the Client or Arrington Watkins may terminate this Agreement at any time with or without cause upon giving the
other party ten (10) days prior written notice. The Client shall within thirty (30) calendar days of termination pay the
Design Professional for all services rendered and all costs incurred up to the date of termination.
Assignment: Neither party to this Agreement shall transfer, sublet, or assign any rights under or interest in this
Agreement, including but not limited to monies that are due or monies that may be due, without the prior written
consent of the other party.
Insurance:
During the term of this Agreement, Arrington Watkins agrees to provide evidence of insurance coverage as indicated
below.

Complete Agreement:
This Agreement comprises the final and complete agreement between the Client and Arrington Watkins. It
supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written,
relating to the subject matter of this Agreement.

This proposal has been prepared based on our understanding of the project as described in the Project
Understanding and Scope of Services sections. We look forward to partnering with your team for a
successful project.
PROJECT UNDERSTANDING:
Project summary

Improvements to the existing Community Center
•
The project is planned as optional 3 tiers including the following
o
Tier 1 – Focus on essential upgrades to structural, mechanical, plumbing and electrical
– No Dibble scope
o
Tier 2 – Renovation and reconfiguration of interior spaces – No Dibble scope
o
Tier 3 – Includes improvements to outdoor spaces that will expand the center’s
capacity and flexible use and community event
•
All of the civil work in this proposal is related to Tier 3 including:
o
Screen wall at east terrace with outdoor space
o
Covered entry and connecting sidewalk to north Banquet Room
o
Enclose patios creating new lobbies at main and east entrance
•
The existing site is currently developed with a community center and associated site.
•
Adjacent developments include Highway 93 and large washes to the north and east
commercial development to the west and south and a Wickenburg public library to the
southwest.
Grading & Drainage
•
Minor improvements to the site are limited to behind the back of curb adjacent to the building
within previously improved areas. Therefore, no additional retention is anticipated
•
Off-site flows are not expected (floodplain base flood elevation is within adjacent washes)
Existing/proposed utilities:

New utility services are not anticipated
•
Utility relocations are not expected
•
Off-site utility improvements are not expected
Adjacent roadway infrastructure:
•
Adjacent roadway are fully developed and not expected to be improved.

Minor improvements to provide an ADA accessible path from the ADA spaces to the building
may be required and included

Parcel summary
•
Replat/Lot Combo/Easements new or abandonment are not expected. Property is already
made up of several parcels owned by the Town of Wickenburg and are note expected to be
combined. A portion of the site is owned by ADOT and therefore it’s anticipated structures
cannot be built on that portion of the site.
CONDITIONS:
•
Architect will provide electronic files (AutoCAD) of the proposed site and building
improvements for use as the basis of the civil design
•
The Client will provide a Geotechnical Report with recommendations for pavement sections
and percolation rates to complete the civil design for this project.
•
Submittals will be made via pdf documents and printing if required will be done by others or
reimbursed at cost to Dibble
•
Submittal and review fees will be paid by Owner/Architect at the time of submittal
•
Client will provide a Title Report including Schedule ‘B’ items
•
Site plan changes received less than two weeks prior to SD (30%), or DD (60%) submittal
deadlines will not be incorporated until the next submittal in order to allow Dibble to perform
our typical QA/QC process on these submittals prior to making our submittal.
•
Site plan changes made after DD phase will require additional services request.
•
Plan changes received less than two weeks prior to the CD submittal will require additional
time and additional fees to incorporate into the civil plans to allow Dibble to perform our
typical QA/QC process on this submittal prior to making our submittal.
•
Wall design is anticipated to be performed by the project structural engineer under separate
proposal.

Meetings and construction phase site observations are as noted in each section. Should the
required meeting attendance exceed the expected number of meetings additional
compensation will be requested.

ADDITIONAL SERVICES:
If the Consultant/Engineer is required to perform services in addition to those outlined in the Scope of
Services, by reason of substantial changes ordered by the Owner or Architect or for any reason
beyond the Consultant’s/Engineer’s control, they are to receive compensation for such services.
Compensation for additional services not included in the Scope of Services for the basic services shall
be based on time expended. Additional services must be approved by the Owner prior to the start of
such work.
Invoices will be submitted monthly based on the percentage of the survey and civil engineering
services that are complete. These invoices will be due and payable upon receipt and will be
considered past due if not paid within seven days after Client’s receipt of payment from the Owner.

TERMS AND CONDITIONS
Energy Systems Design, Inc. referred to herein as ESD, shall perform the services outlined in this agreement for the stated fee arrangement.
Any agreement, which is not accepted within ninety (90) days, is void as to fees quoted unless specifically reconfirmed in writing by ESD.
Fee: The total fee, except stated lump sum, shall be understood to be an estimate, based upon the Scope of Services, and shall not be
exceeded without written approval of the Client. Where the fee arrangement is based upon an hourly basis, or extra work is required due
to a change in project scope, the hourly rates shall be those that prevail at the time services are rendered. Current calendar year rates for
this agreement are as follows:

Printing, deliveries, subcontractor fees, and other reimbursable expenses will be charged at cost plus 15%.
In-house plotting will be billed @ $1.00/sf and mileage @ $.62/mile.
Dispute Resolution: All disputes, including claims and counterclaims, shall be resolved by mediation, followed by, if necessary, binding
arbitration, both according to the rules of the American Arbitration Association. In the event suit is brought (or arbitration instituted) or an
attorney is retained by any party to this Agreement to enforce the terms of this agreement or to collect any money due hereunder, or to
collect money damages for breach hereof, the prevailing party shall be entitled to recover in addition to any other remedy, reimbursement
for reasonable attorneys’ fees, court costs, costs of investigation and other related expenses incurred in connection therewith.
Billings/Payments: Invoices for ESD’s service shall be submitted, either upon completion of such services or on a monthly basis. Fees shall be
payable within 45 days after the invoice date, or 10 days after Client receives payment from the Owner, whichever occurs first. If the invoice
is not paid promptly within 45 days, ESD may without waiving any claim or right against the Client, and without liability whatsoever to the
Client, terminate the performance of the services. Retainers shall be credited on the final invoice. Late Payments: Accounts unpaid 60 days
after the invoice date may be subject to a monthly service charge of 1.5% on the then unpaid balance (18% annual rate) at the sole
discretion of ESD. In the event any portion or all of an account remains unpaid 90 days after billing, the Client shall pay all costs of collection,
including reasonable attorney fees.
Indemnification: The Client and ESD mutually agree, to the fullest extent permitted by law, to indemnify and hold each other and each
other’s employees, agents, consultants, and anyone whose acts may be attributable to them harmless against any and all damages,
liabilities, injuries, claims or costs, including reasonable attorneys’ fees and defense costs, arising from their own negligent acts in the
performance of their services under this Agreement, but only to the extent that each party is found responsible for such damages, liabilities
and costs on a comparative basis of fault by a court or arbitrator of competent jurisdiction provided the process of mediation did not
provide resolution.
Risk Allocation: In recognition of the relative risks, rewards and benefits of the project to both the Client and ESD, the risks have been
allocated such that the Client agrees that, to the fullest extent permitted by law, ESD’s total liability to the Client for any and all injuries,
claims, losses, expenses, damages or claim expenses, including any attorneys’ fees, costs, expert witness fees and costs, and other costs of
defense arising out of this Agreement from any cause or causes, shall not exceed five times ESD’s fee or $250,000, whichever is more. It is
intended that this limitation apply to any and all liability or cause of action however alleged or arising, unless otherwise prohibited by law.
Termination of Services: This agreement may be terminated by the Client or ESD should the other fail to perform its obligations herein. In the
event of termination, the Client shall pay ESD for all services rendered to the date of termination and all reimbursable expenses. If any
provision of this Agreement is declared void or unenforceable, such provision shall be deemed severed from this Agreement; and the
remaining portions of the Agreement shall remain in full force and effect.
Ownership of Documents: All documents produced by ESD under this agreement shall remain the property of ESD and may not be used by
the Client for any other endeavor without the written consent of ESD. Any use, reuse or CADD adaptation of documents produced by ESD,
on behalf of the Client without the express written consent by ESD for the specific purpose intended will be at the Client’s risk and full legal
responsibility. Each party hereto agrees to do all such things and take all such actions and to make, execute and deliver such other
documents and instruments as shall be reasonably requested to carry out the provisions intent and purpose of this Agreement
Guarantees and Warranties: ESD shall not be required to execute any document that would result in its certifying, guaranteeing or
warranting the existence of conditions whose existence ESD cannot ascertain. ESD does not, either by entering into this Agreement or
otherwise, make any warranty, either express or implied, as to any findings, recommendations, evaluations, assessments, observations,
plans, specifications, pre-qualification efforts, performance verifications, or advice of ESD. Owner/Client acknowledges that Owner/Client
has worked in collaboratively with ESD concerning ESD’s provision of services pursuant to this agreement and has been active in all decisions
concerning such services.
Access to Site: Unless otherwise stated, ESD shall have access to the site for activities necessary for the performance of the services. ESD will
take precautions to minimize damage due to these activities but has not included in the fee the cost of restoration of any resulting damage.
Notices: Any notice to any party under this Agreement shall be in writing and shall be effective on the earlier of (i) the date when received
by such party, or (ii) the date which is three (3) days after mailing by certified or registered mail.
Governing Law: This agreement shall be deemed to be made under and shall be construed in accordance with and shall be governed by
the laws of the State of Arizona and for this purpose each party hereby expressly and irrevocably consents to the jurisdiction of said court.

Dear Matt,
Thank you for requesting a proposal to provide structural engineering services for
the subject project. The Project consists of the renovation and repair of the
existing community center located at 160 North Valentine Street in Wickenburg,
Arizona. The existing, approximately 10,400 SF, single-story building was
constructed in 1971 and consists of a plywood over wood purlin and wood truss
roof assembly supported by CMU bearing walls and concrete columns. A
structural condition assessment was performed in July of 2024 by Kimley-Horn.
The report was provided for our review and includes reference to existing as-built
drawings. We anticipate that these drawings will be made available for our
review.
The proposed scope of work is structured into three tiers, each identifying
different levels of improvements. It is anticipated that all three tiers will be
included in the Project and that is the basis for this fee proposal. The expected
structural items noted in each tier of the architectural scope are as follows:
Tier 1 (focused on essential structural upgrades related to life safety)
•
Repair and/or replace existing wood trusses in the assembly room.
•
Replace damaged 2x purlins.
•
Replace damaged roof sheathing.
•
Re-slope and replace roofing system.
•
Replace failing patio structures.
Tier 2 (involves renovation of interior spaces)
•
Removal of existing stage with conversion of space into a banquet room.
•
Renovation of existing kitchen into a catering kitchen with new equipment.
•
Addition of potential new storage.
•
Addition of operable partitions/dividers at banquet rooms.
•
Addition of new audio/visual systems.

The Project will be delivered utilizing a collaborative Design-Build process and
include periodic work-plan meetings with the design team.
Our scope of work will include the following:
•
One site visit to observe the existing structure and correlate our
observations with the structural concerns noted in the existing structural
condition assessment report.
•
Design and detailing of the primary gravity and lateral-force-resisting
framing and foundations for new structure(s) included in each tier.
•
Design and detailing of custom wood roof truss repairs or design of new
replacement trusses or joists.
•
Design and detailing of the enclosed patio perimeter walls and trellis
structure(s).
•
Design and detailing of operable partition supports and attachments to
primary structure.
•
Support of the mechanical equipment, if provided to us prior to submitting
for permit (to include housekeeping pads, isolated slabs, rooftop units,
etc.).
•
Support of the kitchen equipment, if provided to us prior to submitting for
permit.
•
Site and landscaping support structures limited to light pole/flagpole
foundations, CMU site walls, trash enclosures, and mechanical screens.
Concrete retaining walls are assumed to be a part of the Civil Engineer’s
scope.
•
Interior wood or cold-formed steel partition walls (studs, jambs, headers),
ceilings, and soffits where designs exceed the typical architectural details
and SSMA tables. It is anticipated that all typical conditions will be
captured in the architectural drawings.
•
Submission of all documents to the authority having jurisdiction (AHJ) and
responding to comments to secure a building permit for construction.
Arrington Watkins Architects (Client) and Buehler Engineering, Inc. (Buehler)
agree as set forth below:
SECTION 1: BUEHLER’S SCOPE OF SERVICES
Buehler shall provide for the Client, in accordance with this Agreement, structural
engineering services for the Project described above. Buehler anticipates orderly
and continuous progress of the Project and shall provide these services in
accordance with generally accepted professional practices for the intended use
of the Project.

1.1 Buehler’s Scope of Work consists of providing construction drawings and
supporting calculations for the following:
•
Primary structural framing for the structure(s) described above.
•
Repair details for primary structural framing as described above.
•
Structural design criteria and loading information as required for
delegated design of elements by Specialty Contractor(s). See Section 3
for additional information regarding delegated design.
•
Providing phased deliverables as described in Section 2.
•
BIM structural modeling in accordance with Exhibit B.
1.2 Buehler’s Scope of Work includes providing structural calculations only for
the following:
•
Support, anchorage, and bracing for architectural components including,
but not limited to signage, artwork, etc.
•
Light pole foundations.
•
Flagpole foundations.
Construction documents (drawings) for the items above are to be provided by
the associated design professional (Architect, Landscape Architect,
Mechanical, Electrical, Plumbing, Fire Protection (MEPF) Engineers, Kitchen
Consultant, etc.).
1.3 The following exhibits are included with this proposal:

Exhibit B: BIM Services
Buehler will review and accept the agreed upon Terms and Conditions sent by
Arrington Watkins Architects.
SECTION 2: BUEHLER’S SERVICES AND DELIVERABLES BY PHASE
2.1 Buehler shall provide structural engineering services as described in each of
the phases below.
Schematic Design Phase (estimated 8-week duration)
Buehler shall:

Perform one site visit to observe the existing structure and correlate our
observations with the structural concerns noted in the existing structural
condition assessment report.
•
Review Owner’s requirements and establish design criteria.
•
Make recommendations regarding basic structural systems for the
selected conceptual scheme.
•
Make recommendations regarding structural repairs or replacement of
damaged existing structural elements.
•
Review issues of concern and begin coordination with architectural,
mechanical, and electrical systems.

Identify pre-engineered and delegated structural systems.

design parameters. Provide preliminary foundation reactions for review by
the Geotechnical Engineer, if required.

Review the cost estimate and provide feedback for structural items.
•
Attend weekly design meetings.

Provide the following deliverables at the 100% milestone of this phase:

model/design is frozen and primary structural elements have been
located such no that further movement will occur.

Incorporate Design Development Phase review comments made by the
Owner, Contractor, or Architect.
•
Finalize the preparation of the structural drawings.
•
Finalize the preparation of the structural specifications.
•
Finalize the preparation of the structural calculations.
•
Review the cost estimate and provide feedback for structural items.

Provide the following deliverables at the 100% milestone for this phase:

documents for elements listed in Section 1.2. Provide PDF markups of
revisions to other consultants’ drawings as required in response to those

Prepare Test and Inspection Form for AHJ review and approval.
•
Provide the following deliverables for this phase:
o
Structural drawings, calculations, and specifications.
o
Analytical models (if requested by AHJ).
o
Plan review comment response letter.
•
Issue Addenda as appropriate to clarify or correct the contract
documents.
•
Provide responses to Bidder submitted Requests-for-Information (RFIs)
related to structural components of the Project.
Construction Administration Phase (estimated 48-week duration)
Buehler shall with reasonable promptness:
•
Prepare supplemental drawings and interpretations in response to
Requests-for-Clarification by the Architect, Contractor, or the Owner.
•
Review structural items within Contractor submittals for general
conformance with the information given in the contract documents.
•
Visit the site (four site visits total) periodically to observe work and to
determine, in general, if the structural portions of the constructed work are
in accordance with the contract documents. On the basis of this on-site
observation, Buehler shall endeavor to guard the Owner against apparent
defects and deficiencies in the permanent work constructed by the
Contractor but shall not guarantee the performance of the Contractor.
Buehler shall not be required to make exhaustive or continuous on-site
observations to check the quality or quantity of the construction work and
shall not be responsible for construction means, methods, techniques,
sequences, procedures, or for any safety precautions in connection with
the construction work. Buehler shall not be responsible for the
Contractor’s failure to execute the work in accordance with the
construction contract.

SECTION 3: EXCLUSIONS AND CONTINGENT ADDITIONAL SERVICES
3.1 Exclusions and Contingent Additional Services are not included in Buehler’s
Services. Contingent Additional Services may be delegated to other design
professionals or added to Buehler’s Services under mutually agreed terms
and when authorized by the Client.
3.2 Services specifically excluded are:
•
The design of deep foundation elements (APG piles, micropiles, etc.).
•
The design of ground improvements (GeoAggregate piers, Drilled
Displacement Columns (DDCs), etc.).
•
The design of proprietary lateral-force-resisting systems or components.
•
The design of construction shoring and erection bracing.
•
The design of shoring and/or bracing for excavations.
•
The design of structural support for and bracing of MEP and Fire
Protection distribution systems (ductwork, piping, conduit, cable trays,
etc.).
•
The design and anchorage of the following exterior cladding systems:
o Curtain wall systems.
o Storefront systems.
o Architectural precast concrete panels.
o GFRC panels.
o Decorative and mechanical louvers.
•
The design of exterior building maintenance elements and their
anchorage to the structure.
•
The preparation of construction cost estimates.
•
Fees associated with permitting or use of any proprietary elements.
•
Inspections of any type including continuous, periodic, or detailed.
3.3 Contingent Additional Services may include, but not be limited to, the
following:
•
Services required due to significant changes in the Project including
changes in size, use, quality, complexity, schedule, budget, or methods of
bidding.
•
Revisions required after the Design Development Phase to reduce
construction cost due to reasons beyond the control of Buehler.
•
Services resulting from damage as the result of fire, man-made disasters,
or acts of God.
•
The design of egress stairs, stair landings, and handrails unless
specifically included in Section 1.
•
Anchorage design for nonstructural elements unless noted in Section 1.
•
Attendance at meetings in excess of one hour per week.
•
Publishing progress documents at milestones other than those identified
in Section 2.
•
Preparing and/or publishing construction documents for the purposes of
early procurement or permitting unless noted in Section 2.
•
Review of Requests-for-Information (RFIs) or submittals beyond the
second review.

Services related to the review and design of alternate or substitute
systems submitted by the Contractor.
•
Services resulting from errors or omissions in construction, including but

BIM Services Provided:

Buehler will provide Building Information Models (BIMs) developed using Revit Structure throughout the design
and permitting phases of the Project.

The anticipated end-use of the model is for the creation of structural contract documents and model-based

Buehler may, at their sole discretion, exceed the LOD for any element shown in the matrix above to facilitate the
creation of 2D documents.

Buehler may elect to provide quantity takeoffs and schedules to assist with procurement and scheduling provided
additional release forms acknowledging the limitations of the in-progress BIM models are signed by all parties.
SECTION B3: EXCLUDED AND CONTINGENT ADDITIONAL BIM SERVICES
1. The following BIM services are excluded from the base scope of work for this Project, but may be provided contingent
upon receipt of additional compensation (to be negotiated):

The development of the structural Building Information Model(s) for anything beyond the end-use stated in
section “B1: BIM Services Provided”.

Pursuant to your request, JRM Environmental, Inc. (JRM) is pleased to provide the following
proposal for your consideration:
Scope of Work: Asbestos
One of JRM’s certified Environmental Protection Agency (EPA) Asbestos Hazard Emergency
Response Act (AHERA) certified building inspectors would complete the inspections for your
planned renovations. The federal Occupational Safety and Health Administration (OSHA)
standard 29 CFR 1926.1101, requires building owners to identify the presence, location, and
quantity of asbestos containing material (ACM) at a work site prior to the performance or any
work on that site.
JRM’s laboratory, accredited under the National Voluntary Laboratory Accreditation Program
(NVLAP), will perform asbestos analysis of material samples. The asbestos samples will be
analyzed using Polarized Light Microscopy (PLM).
Scope of Work: Lead
One of JRM’s certified EPA lead-based paint (LBP) risk assessors would complete the inspection
for the presence of LBP using a portable X-ray fluorescence (XRF) paint analyzer. Placing the
analyzer on the test surface, and exposing the lead paint film to gamma radiation, XRF values
are collected.
Reporting:
After the inspections and laboratory analysis are complete, comprehensive, easy to read final
reports will then be generated detailing the findings of the inspections and emailed to you.

Insurance:
Insurance is an important barometer of the quality and financial strength of an environmental
service company. If a problem does arise on a project, insurance will frequently become the
economic savior of the venture. As a result, JRM maintains the highest levels of insurance with
$2,000,000 professional liability (Errors and Omissions) on a per aggregate basis with an A
rated carrier. In addition, JRM maintains $2,000,000 personal and injury insurance. Our record
in the industry is without incident and there has never been a claim filed against JRM. JRM is
also a member of the Better Business Bureau.
Timeline:
The inspections can be started as soon as you would like. You can expect to see the final reports
within five business days after the inspections are completed.
Limitations:
The above listed bid/cost is a lump sum not to exceed grand total amount. The price is all-
inclusive according to the current scope of work, terms and conditions of the site. The price
includes all overhead costs, insurance, travel, laboratory fees, administration fees, labor, and
applicable taxes. Payment terms for the project are net 30 days.
