Public Hearing and Action to Consider an Application by Kellie Daniels for a Conditional Use Permit to Establish a Horse Boarding Facility for the Residents of the Property at the Intersection of Country Club Drive and Camino Drive, Maricopa County Assessor Number 505-37-064A, Consisting of Approximately 7 Acres of Land Steve Boyle, Community Development Director, reported that the property is currently zoned RM-1 for Multi-Family Residential. It is approximately 7 acres of vacant land with some floodzone risk through the property. The sole access is from Country Club Drive. The location of the property is at the intersection of Country Club Drive and Camino Drive on Maricopa County Assessor Number 505-37-064A. The proposal is for a Conditional Use Permit (CUP) for a boarding facility. The boarding of animals will be reserved for site occupants only, it will not be open to the general public for boarding. The Multi-Family project is not up for approval tonight, as the units have zoning rights that will come back for development review in the future. A conditional use allows a property owner to deviate from the general restrictions of zoning code but only under specific conditions approved by the Council. Unlike a variance, which allows deviation based on hardship, a conditional use permits a specific listed use such as a school in a residential zone, that is not allowed by absolute right but is considered harmonious with the district if the conditions are met. This use does align with the General Plan as a neighborhood mixed use in this area. A neighborhood meeting was held on January 21st to get feedback from residents. Below are some of the discussion items from the meeting: • Boarding animals for site residents only • No RV stalls proposed • No light trespass • Onsite waste management • Traffic Impact Analysis required by ADOT for residential component Planning and Zoning Commission Minutes of January 27, 2026 Page 3 of 8 • Horse trespass • Odor/Flies • Horse amount seems excessive at nearly 5 per unit • General Concern about project The original proposal was for 56 total horse pens. The boarding of animals is for site residents only. There will be no RV stalls. The horse pens will be on the west side of the property. After the public meeting, the applicant reduced the number of pens being proposed to 28 total horse pens. A CUP will usually include conditions associated with the special permit. The conditions being proposed for this permit include the following: • Manure waste removed on a weekly or semi-monthly, enclosed containment • Limited to 3 animals per occupied unit with a maximum horse pen count of 28 animals • Business License required • Any pens to be occupied simultaneously with residential units • Property Owner signs the waiver of rights and remedies and is on file with the Town • Used pens be mucked out daily • Outdoor lighting, wall or ground mount with cutoffs • Perimeter fencing where necessary • No RV living on the property Planning and Zoning Commission Minutes of January 27, 2026 Page 4 of 8 • Boarding for occupants of the future property units only • Hay/equipment storage to be enclosed on three sides • Single access from Country Club Drive only • Actual placement of proposed land uses to conform substantially to what is presented in the site plan Member Pollei asked if the CUP will transfer if the property is sold. Director Boyle confirmed that as long as they comply with the conditions of the CUP, the permit goes with the property. Member McGuire asked about a time for the lights. Director Boyle stated that in the Dark Sky ordinance there is no cut-off time listed for residential locations. Kellie Daniels, applicant, explained that they modified the plan after hearing from their neighbors. If they just build what is allowed in the zoning, it could include 90 units, however part of the property is in the floodway, so with only building outside the flood areas, they could build 45 units. They are proposing ten units built to be like the Country Club villas that are very close to them. There will be two bedrooms, two bathrooms and a patio with each unit. Rental units are needed in Wickenburg and most places do not have a place for people to have their horses close to them, so they must board their horses at a different location from where they live. She is for planned and controlled growth, which is one reason she isn’t building the maximum amount allowed. She has sons who can’t afford a house in Wickenburg, so this would give them the ability to live in town. Member Pollei asked if they planned short-term rentals, long-term rentals or seasonal rentals. Ms. Daniels responded that the best option for her would be long-term rentals. They are planning on having a club house and playground in the middle. The first step to completing this is to build the budget, so she needs to know if the town will allow her this many pens. Member McGuire asked if there would be other horse activities such as an arena and what if someone came with four horses and had open pens. Ms. Daniels stated that it would be just the boarding stalls. Most people will practice roping or barrels off site. She is just trying to get approval prior to proceeding and do this the right way since there is a need in the town for more affordable housing. She also needs to be able to build a budget in order to develop the plans. Member Jenson suggested adding additional landscaping and trees along the edge to the property. Ms. Daniels stated that the plans will be similar to the Country Club Villas and there will be a fence and landscaping added. Member Henson stated that there are ten units so with 3 per, the total should be 30 not 28. Ms. Daniels stated that they don’t expect everyone to have 3 horses and this number fit well. This will be a 2 year project that they will be investing in Wickenburg. They also have two homes on property near this for their family. Planning and Zoning Commission Minutes of January 27, 2026 Page 5 of 8 Member Pollei asked if they would allow their renters to rope in their arena. Ms. Daniels stated that it is a private arena on their property with no access for the renters. Member Wekell was concerned with the horses being this close to US-60 if any got loose. Ms. Daniels stated that there will be pens with gates, locks, and fences to avoid this. They will have shade over the pens for the horses. Public Hearing was opened at 6:33 PM by Chair Green Bob Christenson, In-Town Resident, stated that he was happy to see that they addressed concerns regarding the number of horses. Since this is on a major road with lots of people driving by, this does need to look good so landscaping would be a good idea. In addition, it needs to be clean and organized. He looks at what can go wrong. This will potentially have 20 people there with not everyone having the same ideas of how to keep things clean. Just lining up the trailers to make it look better. In addition, what if a tenant doesn’t clean their pens, who will monitor and deal with that. There will also be run off from the horses. What if they don’t get the tenants they want, would they consider it subsidized housing. Paul Woley, In-Town Resident, thanked them for reducing the number of horse stalls. The manure is in the flood plane which could cause this to go down the wash in a major storm. In addition, the amount of horse urine getting into the water table. Tara Hintz, In-Town Resident, stated they are directly west of this property. They appreciated that the number was reduced and recognized that it is zoned for multi-family. The concern they have is that it is ten units with 28 stalls on a seven-acre property. She stated that there are 57 rentals available in Wickenburg right now and some are affordable. She wasn’t sure how affordable these will be since they will be brand new. When does it become a commercial property instead of just residential? Currently they have issues with noise, parking of RV’s, smell and flies. The new zoning code is for two horses per acre, so that would only allow 14 on this property. Chair Green stated that they have the right to rent these for whatever they want to charge. They have the right to build multi-family homes on this property. Charleen Brotherton, In-Town Resident, stated that she lives across the street from Ms. Daniels current home. Currently they have a lot of horses at their home. On the 17th they had 23 horses, on January 20th they had 26 horses, 10 horse trailers, and 2 RV’s, and on the 21st they had 20 horses, 9 trailers and 2 RV’s. The people will be roping in her arena and parking the horse trailers all over. Planning and Zoning Commission Minutes of January 27, 2026 Page 6 of 8 Pamela Rankin, In-Town Resident, this is a lot to have so many horses in a neighborhood. When Kellie Daniels built her house, they were unaware of how many stalls she was building for her personal use. There are maybe 14 covered spaces and maybe 4 outside, which to her is excessive. It seems that the residents should be able to use their stalls instead of building more. She would like to see this in another part of town. She has horses, but this number is excessive. Jerry Rankin, In-Town Resident, stated that he is neighbor who is also a retired rancher who trained cutting horse. He has two horses due to restrictions in his area. His concern is dust, lights on all night, and trailer traffic. A few days ago, there were 21 heads of horses on the adjacent property brought in by some wonderful college kids who took care of the horses. He is worried about traffic on Camino Drive as it is not a well taken care of road. Realtors have told them that their value will go down 25% if this project is approved. This would be fine on 93 or out on 60, but not in this small community. His horse pasture touches these seven acres. Cole Daniels, In-Town Resident, stated that he is a realtor in town and sat down with his parents to try to help people who come to town with horses. They don’t want to put a large apartment complex on this as that wouldn’t look good in the neighborhood. They would like to develop this to keep it smaller in numbers. If they sell the property, someone might come in to develop this with a much larger number of units which will be allowed with the multi-family zoning. Greg Hintz, In-Town Resident, stated that he is a direct neighbor. Things are changing in Wickenburg but this will be in his backyard, there will be a ten-house cul-de-sac. He knows homes are needed in Wickenburg. They want to keep the same quality of life. Camino Drive has lots of potholes in it. Trailer traffic turning onto US-60 will be a problem. Public Hearing was closed at 6:55 PM Ms. Daniels responded that this will only be ten units and they cut the number of pens in half after hearing from the neighbors. There is trailer traffic all over Wickenburg. She does like to host her family and friends at her house. There are floodplain areas that you can build on and floodway areas where you can’t build. As the owner of this property, she will make sure that the tenants take care of it. Maintenance will be required or they will have to get new renters. They currently own a few RV parks and know to put certain language in the rental agreement to make it easier to remove tenants who aren’t doing what they are supposed to maintain the property. The manure will be in dumpsters outside the floodway. Member McGuire asked about the number of horses she has now on her property and the dust control. Ms. Daniels stated that they have two homes with 6 covered pens per home with an arena and three turnouts. They did have some friends over this past weekend. They have a water truck if it is needed and use it Planning and Zoning Commission Minutes of January 27, 2026 Page 7 of 8 on the arena. They do not have a fly issue as they clean it two times a day. Director Boyle stated that the CUP allows a deviation from the code for a non- typical use. Usually, any CUP will come with conditions that have to be followed to keep the CUP. Member Crissman stated that they or someone else could build more units than this. Wickenburg is going to get busier and this area would be much busier if there were 45 units built. Member Jenson liked that she had reduced the number after hearing from the neighbors and the conditions will give it some teeth for enforcement. The town is allowed to patrol this to enforce the conditions. ADOT might be the hardest part of this to deal with as they take a long time to get approval. Member McGuire thought this was a lot of horses in this area with 28 possible here and 12 at her other two residences. She asked the number of horses allowed. Director Boyle stated that currently it is 1 house per 1,200 square feet of corral area. The CUP allows a deviation from the code. Chair Green stated that this is about 200 feet from Wickenburg Way due to the ADOT right-of-way, the APS easement, and then the wash is closest to the road. If they add landscaping in the area, this can be hidden some from the road. Member Henson asked about changing it to 30 to have 3 per unit instead of 28. Ms. Daniels stated that this is about a $3.5 million dollar project with the cost of the horse area being about $125,000, so it is not a large expense. It is the hook to get renters that want their horses close. They will have a perimeter fence and the building will be 300 feet away from Wickenburg way. Director Boyle stated that the Country Club villas have 14 units on twelve acres. The landscape of the property will be discussed during the design review. Right now the question is regarding the conditions, if you want to keep them all or add any new ones. MOVED BY Member Jenson to approve the CUP with all the conditions listed including sight line fencing of the dumpsters and landscaping in the future design SECONDED BY Member Pollei Member McGuire didn’t like the number of pens. Member Henson said that they said they needed 24-28 pens to make it pencil out. She asked is reducing it to 24 would make a difference?
