ARTICLE 3-2 PLANNING AND ZONING ADVISORY COMMISSION Section 3-2-1 Creation Section 3-2-2 Membership, Terms And Removal, Compensation, Organization And Reports Section 3-2-3 Functions Section 3-2-4 Duties Section 3-2-5 Hearings Section 3-2-1 Creation There is hereby created the Wickenburg Planning and Zoning Advisory Commission, hereinafter referred to as Commission. Section 3-2-2 Membership, Terms And Removal, Compensation, Organization And Reports Membership, terms and removal, compensation, organization and reports of the Commission shall be as set forth in Sections 3-1-1 through 3-1-6. Except that the commission shall be composed to seven (7) regular members, one (1) nonvoting Councilmember and two (2) alternate members appointed by the Town Council. The alternate members of the Commission shall act as a regular member in the absence of a regular member at any meeting or hearing of the Commission. (Ord. 1128/01-14) (Ord. 1181/03-18) HISTORY Amended by Ord. 1128 on 1/6/2014 Amended by Ord. 1181 on 3/5/2018 Section 3-2-3 Functions The function of the Commission shall be to provide advisory services in matters related to Planning and Zoning to the Council, Town officials and Boards and other governmental agencies. The Mayor may request from the Commission a report or recommendation in connection with any matter relating to the present or future development of the Town, pertaining to the use of land and buildings for any purpose, together with all incidental activities associated therewith and commonly known as "Planning and Zoning". The Commission shall have authority to make such investigations, maps, reports and recommendations in connection therewith as it deems desirable. In general, the Commission, its members and officers shall have such authority as may be necessary to enable it to fulfill its functions, promote planning and carry out the purposes of this Article. The Chairperson shall have the power to administer oaths and to take evidence. Section 3-2-4 Duties A. The Commission shall undertake and carry out comprehensive studies and surveys of existing conditions and factors of prospective community growth. B. The Commission shall formulate, recommend for adoption by the Council and, when adopted, develop a Master Plan for the long-term development of the Town and of any land outside the Town, which, in its opinion, bears relation to the planning of the Town. The Master Plan shall be prepared with the general purpose of guiding and accomplishing a coordinated and harmonious development of the Town, which will, in accordance with present and future needs and resources, best promote the health, safety, morals, order, convenience, prosperity and general welfare of the citizens. C. The Commission shall prepare and recommend for adoption, and transmit to the Council, regulations governing the subdivision of land within the area over which the Mayor and Council have jurisdiction under State law. D. The Commission shall be responsible for assisting the Council and the administrative staff in preparation of programs for public works improvements and for the financing thereof, and for such other administrative procedures and regulations as may, in its opinion, provide effective means for furthering the objectives of the Master Plan. The Commission shall promote public interest in and understanding of the studies and plans it prepares and, to that end, may publish and distribute copies of the Master Plan or any report relative thereto, and may employ such other means of publicity and public information as it may determine with prior approval of the Town Council. The Commission shall consult and advise public officials and agencies; public utilities; civic, educational, professional and other organizations and citizens in relation to the Plan it prepares and the implementation or effectuation thereof. (Ord. 1128/01-14) HISTORY Amended by Ord. 1128 on 1/6/2014 Section 3-2-5 Hearings In carrying out its advisory functions under this Article, the Commission shall review and consider all matters related to its duties and responsibilities. In matters requiring official action by the Council, the Commission shall hold at least one (1) preliminary public hearing, wherein it shall determine the nature of its recommendations by the affirmative vote of at least four (4) of its members, enter its action thereon over the signature of its Chairperson, and forward its recommendation to the Council for a final public hearing and action. Notice of such public hearing shall be published and posted at least fifteen (15) days prior to the holding of such hearing.
