ORDINANCE NO. 1249
AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF WICKENBURG, MARICOPA COUNTY, STATE OF ARIZONA,
AMENDING THE ZONING MAP OF THE TOWN OF WICKENBURG BY
CHANGING THE ZONING CLASSIFICATION OF CERTAIN DESCRIBED
REAL PROPERTIES IN THE TOWN FROM R1-87 SINGLE FAMILY
RESIDENTIAL TO C-3 MAJOR STREET COMMERCIAL; PROVIDING
FOR REPEAL OF CONFLICTING ORDINANCES; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR PENALTIES.
WHEREAS, an application has been filed to the Town of Wickenburg requesting
approval of a zone change on properties consisting of approximately 4.29 acres from R1-
87 Single Family Residential to C-3 Major Street Commercial; and
WHEREAS, the Planning and Zoning Advisory Commission and the Town Council
have provided public notice and conducted Public Hearings in accordance with applicable
state and local laws to hear comments on this rezone application; and
WHEREAS, it is found that the zone change is consistent with and conforms to the
General Plan and is in the best interests of the Town of Wickenburg.
NOW THEREFORE, BE IT ORDAINED, BY THE MAYOR AND COMMON
COUNCIL OF THE TOWN OF WICKENBURG, MARICOPA COUNTY, ARIZONA AS
FOLLOWS:
SECTION I. In General.
The Zoning Ordinance of the Town of Wickenburg, Arizona is hereby amended
by amending the Zoning Map of the Town of Wickenburg as follows: Assessor’s Parcel
Number 201-10-024N shall be changed from R1-87 Single Family Residential to C-3
Major Street Commercial as shown on Exhibit A.
SECTION II. Providing for Repeal of Conflicting Ordinances.
All ordinances and parts of ordinances in conflict with the provisions of this
Ordinance or any part of the Code adopted herein by reference are hereby repealed.
SECTION III. Providing for Severability.
If any section, subsection, sentence, clause, phrase, or portion of this Ordinance
or any part of the Code adopted herein by reference is, for any reason, held to be
invalid or unconstitutional by the decision of any court of competent jurisdiction, such
decision shall not affect the validity of the remaining portions thereof.

SECTION IV.Providing for Penalties.
Any person found responsible for violating this Ordinance shall be subject to the
enforcement, civil sanctions and habitual offender provisions set forth in Article 14-27
Wickenburg Town Code. Each day a violation continues, or the failure to perform any
act or duty required by this zoning ordinance, the Town Code or by the Town of
Wickenburg Municipal Court continues, shall constitute a separate civil offense,
punishable by not more than three hundred dollars ($300.00) for each offense. Habitual
offenders may be charged with a class one misdemeanor and subject to the penalties
set by the Arizona Revised Statutes for such criminal offense.
SECTION V. Zoning
Considerations
.
In accordance with Article II, Sections 1 and 2, Constitution of Arizona, and the
laws of the State of Arizona, the Town Council has considered the individual property
rights and personal liberties of the residents of the Town and the probable impact of the
proposed ordinance on the cost to construct housing for sale or rent before adopting
this ordinance. The Town Council has also considered a housing impact statement in
accordance with A.R.S. § 9-462.01(J)(1)-(3).
Section VI.
Authorizations.
The Mayor, the Town Manager, the Town Clerk and the Town Attorney are
hereby authorized and directed to take all steps and to execute all documents
necessary to carry out the purpose and intent of this Ordinance.
APPROVED, PASSED AND ADOPTED by the Mayor and Common Council of the Town
of Wickenburg, Arizona, this 18th day of May 2026.
