Resolution No. 2021-131 RFLS #7896 Rev 08/21 RESOLUTION # 2021-131 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF SURPRISE, ARIZONA, TO CONDITIONALLY ACCEPT THE STREET AND PUBLIC UTILITY IMPROVEMENTS AND COMMENCE MAINTENANCE AFTER TWO YEAR WARRANTY AT RANCHO MERCADO PARCEL A18W, GENERALLY LOCATED AT W. HAPPY VALLEY ROAD AND N. RANCHO MERCADO PARKWAY. WHEREAS, the Mayor and City Council of the City of Surprise approved a final plat entitled “Rancho Mercado Parcel A18W” on, September 17, 2019; WHEREAS, Brookfield Holdings (Mercado) LLC, a Delaware Limited Liability Company, the developer of Rancho Mercado Parcel A18W, dedicated to the City the street and public utility improvements, generally located at W. Happy Valley Road and No. Rancho Mercado Parkway; WHEREAS, on or about July 14, 2021, the City of Surprise Public Works Department Engineering Division completed an inspection of the public improvements described in this resolution and found the improvements to be in substantial compliance with the approved plans and specifications; WHEREAS, the City of Surprise notes that the two-year warranty period will commence upon conditional acceptance by the City; and WHEREAS, after the conclusion of the two-year warranty period, the City of Surprise will release the warranty and begin maintenance of the street and public utility improvements. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Surprise, Arizona, as follows. Section 1. The City of Surprise conditionally accepts the street and public utility improvements generally located as depicted on the map attached as Exhibit A and listed on Exhibit B. Section 2. Upon final acceptance by the City Engineer, the City Council hereby directs the City to release warranty and begin maintenance of the street and public utility improvements. The amounts for the infrastructure have been provided by a third party and not the City of Surprise. The following are the infrastructure improvements included with this acceptance and the corresponding valuation that the City will be accepting: City Paving $564,900.00 City Concrete $397,948.50 City Sewer $435,224.90 City Water $515,287.00 City Drainage $79,428.00 Total $1,992,788.40
