Resolution No. 2021-63 RFLS #7721 Rev 04/21 RESOLUTION # 2021-63 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF SURPRISE, ARIZONA, TO CONDITIONALLY ACCEPT THE STREET AND PUBLIC UTILITY IMPROVEMENTS AND COMMENCE MAINTENANCE AFTER ONE YEAR WARRANTY AT W. WADDELL ROAD, GENERALLY LOCATED AT W. WADDELL ROAD AND N. BULLARD AVENUE. WHEREAS, the Mayor and City Council of the City of Surprise approved a map of dedication entitled “Waddell Road, Litchfield Road and Cactus Road” on, April 13th, 2006; WHEREAS, Marley Park Phase II LLC, an Arizona Limited Liability Company, the developer of Marley Park, dedicated to the City the street and public utility improvements, generally located at W. Waddell Road and N. Bullard Avenue; WHEREAS, on or about October 16th, 2020, the City of Surprise Public Works Department Engineering Division completed an inspection of the public improvements described in this resolution and found the improvements to be in substantial compliance with the approved plans and specifications; WHEREAS, the City of Surprise notes that the one-year warranty period will commence upon conditional acceptance by the City; and WHEREAS, after the conclusion of the one-year warranty period, the City of Surprise will release the warranty and begin maintenance of the street and public utility improvements. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Surprise, Arizona, as follows. Section 1. The City of Surprise conditionally accepts the street and public utility improvements generally located as depicted on the map attached as Exhibit A and listed on Exhibit B. Section 2. Upon final acceptance by the City Engineer, the City Council hereby directs the City to release warranty and begin maintenance of the street and public utility improvements. Waddell Road The public improvements for the above project have been completed and are tentatively scheduled for the May 18th, 2021 council agenda for acceptance. The amounts for the infrastructure have been provided by a third party and not the City of Surprise. The following are the infrastructure improvements included with this acceptance and the corresponding valuation that the City will be accepting: City Water: $54,058.00 City Reclaimed Water: $34,430.00 City Concrete: $261,432.75 City Paving: $869,779.00 Total: $1,219,699.75
