Staff considers this final plat in substantial conformance with the 
approved preliminary plat for Riverwalk (S2021007).  This final plat 
meets all applicable subdivision regulations and zoning regulations 
outlined in the R1-6 RUPD zoning case (Z2021003) approved by the 
Board on July 14, 2021. The approved zoning case conditioned that 
the developer conduct a Cultural Resource Survey with the state 
historic preservation office before the approval of a final plat which 
the developer completed. The result of the survey was that there 
were no significant cultural artifacts on site (see attached). Another 
condition of the approved zoning case was that a land subsidence 
report be completed before the approval of the final plat, which the 
developer has completed. The report concluded that the site is not 
located in an area of land subsidence (see attached). A final 
condition of the approved zoning case was that a ‘will serve’ letter 
must be obtained from the local fire protection service, which is 
attached.  
 
  
The applicant has routed a copy of the final plat to all utility and 
service providers and all municipalities within three miles of the 
site. Recording fees will be furnished at the time of plat recordation. 
All requirements of the Maricopa County Department of 
Transportation, the Maricopa County Environmental Services

I. 
INTRODUCTION 
Residential Pursuits Investments, LLC (“RPI”) is requesting final plat to allow construction 
of a high quality 89-lot age restricted subdivision on a 15.31 gross acre site located at 
north and east of 99th Avenue and Olive Avenue (the “Property”). The Property is located 
in unincorporated area of Maricopa County (the “County”), lies in the southeast quarter of 
Section 29, Township 3 North, Range 1 East, and identified by the three main Assessor’s 
Parcel Numbers 142-62-694, 142-62-695 and 142-62-884. It is surrounded by New River 
on the east, and single family residential to the west, New River and Olive Avenue to the 
south, and Brook Hollow Apartments and Sunwood Apartments to the north. The property 
is currently vacant land consisting of three main parcels. The northernmost parcel was 
previously platted as Riverwalk Condominiums but never constructed. The southern two 
parcels are vacant.  
 
 
II. 
PURPOSE OF REQUEST 
RPI intends to transform this vacant land into a high-quality age restricted community 
called Riverwalk (the “Property”), consisting of 89 detached residential lots at a density 
of approximately 7.18 DU/acre with open space featuring passive and active amenities. 
The local onsite streets will be private, and will be maintained by the property owner’s 
association.  The Property would add variety to the lot sizes available in the area and 
increase the diversity of home ownership opportunities that is consistent with the west 
valley’s growth.  The current land use designation is Retirement Community, and the 
current zoning is R1-6 RUPD. RPI is requesting final plat approval consistent with the 
approved R1-6 RUPD zoning (2021003) and approved preliminary plat (S2021007).

III. 
DESCRIPTION OF PROPOSAL 
Riverwalk is a proposed age-restricted community consisting of 89 single-family detached 
homes. The proposed density is approximately 7.18 DU/acre based on the gross area. 
This request is for a final plat to develop the property based on the proposed R1-6 RUPD

standards. The design of the community is consistent with the homeowner desires for less 
maintenance of yards all while having access to a shared community amenities and 
sizeable open space areas that are maintained by the homeowner’s association.  
  
The minimum lot dimensions will be 45 feet wide by 80 feet deep, with a minimum lot size 
of 3,600 square feet.  The R1-6 RUPD zoning district’s development standard for minimum 
area per dwelling unit is 6,000 square feet. With 89 lots on 15.31 acres, the Property will 
provide at least 6,000 square feet per dwelling unit when considering both the area of the 
lot and the Property open spaces. The Property will include approximately 4.05 acres of 
open space, which is more than 26% of the gross area.  The central open space is 
anticipated to be 1.36 acres of the 4.05 acres of total open space and will have pedestrian 
paths that link to the open space amenities.  The RUPD Development Standards are 
shown below in Table B.   
 
 
The Primary access to the site will be from 99th Avenue.  This entry will include an elegant 
entry monument as well as gated entry, bordered by lushly landscaped open space areas, 
with a variety of trees, shrubs, and areas of turf. The onsite local streets in this gated 
community will be privately owned and maintained by the property owner’s association. 
 
The centralized amenity area will feature a pool with lounge seating, outdoor barbecue 
area, and a restroom building with shaded seating and outdoors showers. Adjacent to the 
amenity is a community green space providing residents with a usable turf area. Much of 
the community is surrounded by broad landscape areas that provide a buffer from the 
perimeter streets outside of the community and serve as retention for the development. 
All internal drives will be private streets and will include four-foot sidewalks on both sides 
to establish pedestrian connectivity throughout the neighborhood, and to ensure 
convenient access to the amenity and open space areas. 
 
New landscaping along 99th and Olive Avenues consists of staggered rows of street trees 
to buffer the community and to provide pedestrian shade for the sidewalks. Planting areas 
inside the community will use the same material plus additional accented areas of colorful 
plants. A large, turfed area will be the main community gathering area central to the site 
and will also act as the central retention area for the development. Another retention area 
will be located in the northeast corner of the Property which will be landscaped with turf.

There is an existing wastewater metering station in that area which will be screened with 
landscaping. 
 
 
IV. 
RELATIONSHIP TO SURROUNDING AREA  
The Property is bordered by 99th and Olive Avenues to the west and south, respectively.  
It is north and west of the City of Peoria, east and south of the unincorporated community 
of Sun City. It is located 1 mile west of Loop 101 Freeway, 2 miles north of the Glendale 
Municipal Airport and 2 miles south U.S. Route 60.  
 
The property located at the east boundary is the New River Wash, owned and maintained 
by Flood Control District of Maricopa County. Located to the north of the property is the 
Sunwood Apartments and Brook Hollow Condominium, zoned R-4. The Sun City Unit 8 
lies to the West beyond 99th Avenue, zoned R1-6. Both 99th and Olive Avenues are fully 
improved with two lanes in each direction and dedicated left turn lanes, with curb and 
gutter.  Sidewalk has been constructed along Olive Avenue, but not along 99th Ave.  The 
dedicated Right-of-Way (ROW) for Olive Ave meets the ultimate street section 
requirement of 65’ half street, 130’ full street width. There is 55’ of Right-of-Way dedicated 
for the east half width of 99th Ave, 110’ total for the total width. MCDOT granted approval 
to keep the ROW at 55’ rather than expanding it to 65’ for principal urban arterial.

V. 
LOCATION AND ACCESSIBILITY  
The existing arterial roadways that will serve the Property are 99th Avenue and Olive 
Avenue. 99th Avenue and Olive Avenue are designated as Urban Principal Arterial per 
Maricopa County Department of Transportation’s Major Streets and Routes Plan (2011).

99th Avenue has a north-south alignment and provides two lanes in each direction 
separated by a raised median. There are a curb and gutter on both sides of 99th Avenue, 
but no bicycle or pedestrian facilities. 
 
Olive Avenue has an east-west alignment and provides two lanes in each direction. There 
is a painted median throughout the Property limits and no bicycle lanes. Olive Avenue has 
curb and gutter and sidewalks in both directions. 
 
The Loop 101 freeway, US State Highway 60 are the existing regional transportation that 
serve the Property.  Loop 101 is located 1 mile east of the Property with full interchanges 
with access to U.S. Route 60 or 2 miles from the Property.  
 
 
VI. 
CIRCULATION SYSTEM 
The traffic circulation is outlined in the Riverwalk Residential Development Traffic Impact 
Analysis (“TIA”) prepared November 2020, which was submitted with the rezone and 
preliminary plat applications. The site entrance will be on 99th Avenue with a gated entry 
into the community. It will be constructed with 20’ wide entry and exit lanes separated by 
a landscaped median. The site access driveway is recommended to provide a stop sign 
on the new westbound approach from the site to 99th Avenue. The internal streets are 
considered private roads to be maintained by the homeowner’s association.  A secondary 
emergency access from Olive Avenue will be located at the south end and constructed of 
4-inch compacted decomposed granite to meet the Sun City Fire District design standards 
and the adopted fire code.  
 
The intersections at Olive Avenue/99th Avenue and Caron Drive/99th Avenue were 
evaluated for the TIA. The intersection at Olive Avenue/99th Avenue is controlled by a 
traffic signal. The signal provides a protected-permitted phase for the eastbound left-turn 
onto 99th Avenue. The proposed Property, the intersection will operate an acceptable level 
of service during AM/PM peak hours for the years studied, 2021 and 2025. The Property 
is anticipated to generate a total of 953 weekday daily trips (entering and exiting) with 75 
during the AM peak hour and 100 during the PM peak hour. No improvements are 
recommended at the intersection of 99th Avenue and Olive Avenue as the intersection will 
operate at an adequate LOS (LOS D or better). A northbound right-turn lane with a 
minimum storage length of 160 feet is recommended at 99th Avenue and Caron Drive. The 
proposed site access driveway is recommended to provide a STOP sign on the new 
westbound approach for traffic exiting the site. 
 
 
VII. 
PROJECT PHASING AND DEVELOPMENT SCHEDULE 
This Property will be developed as one single phase. Construction will begin shortly after 
final plat and engineering plan approval.  Construction will take 6 to 8 months.  
Construction will begin late 2023.  
 
VIII. 
COMMUNITY FACILITIES AND SERVICES 
The Property is located within Sun City Development Master Plan (DMP), within the Sun 
City DMP is the Recreation Centers of Sun City (RCSC). The recreation center is a private 
non-profit corporation. The RCSC includes facilities such as:

The Property is also located 3 miles west of Downton Peoria. The downtown area offers 
a variety of art, entertainment, sports, and recreation facilities.  
 
 
 
IX. 
PUBLIC UTILITIES AND SERVICES  
EPCOR is the water and sewer provider in the area. To the west of the Property site, there 
is an existing 8” water distribution main located along 99th Avenue. The 8” water main 
runs from north of the Property site and ends at a blow off valve near the northeast corner 
of the Property site. On the northern border of the Property site, an existing 6” waterline 
enters the site from parcel 142-62-003N and services an existing fire hydrant. There is an 
existing 12” sewer line located in 99th Avenue and along the north boundary of property 
that extends to the wastewater metering station near the northeast corner of the Property. 
 
Maricopa County Sherriff’s Office will provide police services to the Property from their 
existing district offices in Goodyear and Surprise. 
 
Existing electric, natural gas, and communications infrastructure located in the north 15’ 
easement near the Property will be extended to provide service to the Property.

Fire and emergency services will be provided by Sun City Fire District.  The nearest Sun 
City Fire Station is Station 132 located 1.6 miles north of Peoria Ave.

OPEN SPACE AND LANDSCAPE STANDARDS 
The landscape standards for the Property will provide active recreation areas that will be 
connected by pedestrian network throughout the community. The landscape plan is 
submitted with the Infrastructure Permit application. The Property will provide a central 
open space with turf areas and amenities suited for the community including ramadas, 
pool, barbeque area and sidewalks providing connectivity to the residences. There is a 
smaller open space area located at northeast corner of the site that provides two pickleball 
courts and a dog park. The open space will be provided in private tracts owned and 
maintained by the homeowner’s association. Some of the landscaped open space areas 
will also be designed to provide storm water retention. 
 
 
XI. 
CONCLUSION 
The Riverwalk final plat application is in accordance with the approved preliminary plat 
and Maricopa County’s quality standards, as outlined in this narrative. The development 
team for Riverwalk is confident that the proposed Property will be well received by adjacent 
neighbors as it complements these adjacent developments.  We respectfully submit this 
final plat application package for approval.  We look forward to collaborating with the 
County as well as the neighboring communities and residents during the process.

Water Supply pursuant to A.R.S. § 45-576 and A.A.C. R12-15-701 et seq. have been met, and therefore the 
Director has decided to issue Certificate of Assured Water Supply No. 31-700291.0001, attached. 
 
EPCOR - Sun City will provide water to the subdivision. The source of supply will be groundwater. The 
annual estimated water demand of the subdivision is 35.84 acre-feet per year for 91 lots, and the 
groundwater allowance for the subdivision for the 100-year period is 143.36 acre-feet. Pursuant to A.R.S. 
§ 45-578(F), the total projected average annual replenishment obligation at build-out for each plat under 
the Certificate is 34.41 acre-feet per year. 
 
The Department suggests you record your Certificate of Assured Water Supply in the appropriate county 
recorder’s office. This will provide you with a permanent public record of the Certificate. This 
determination is applicable only to the persons or entities specified on the Certificate and for the plat 
reviewed by the Department, including non-material plat changes pursuant to A.A.C. R12-15-708. 
 
Pursuant to A.R.S. § 41-1092.03, the Director’s determination and decision to issue the Certificate is an 
appealable agency action. You are entitled to appeal this action. If you wish to appeal this action, you 
must file a written appeal within thirty (30) days from receipt of this letter. A summary of the appeal

5. DESCRIPTION OF PROJECT or UNDERTAKING: Arcadia Capital is proposing to develop the Riverwalk 
project, a proposed residential development at the northeast corner of North 99th Avenue and West 
Olive Avenue in Peoria, Maricopa County, Arizona (Figure 1). The project area is approximately 15 acres 
of undeveloped land, and required compliance with City of Peoria rezoning regulations. Arcadia Capital 
contracted with SWCA to conduct a cultural resources inventory of the project area to identify cultural 
resources that may qualify as historic properties (i.e., cultural properties listed in or eligible for listing 
in the Arizona Register of Historic Places [ARHP] or National Register of Historic Places [NRHP]).

9. ENVIRONMENTAL CONTEXTS 
9a. Landform: Terrace above the New River 
9b. Elevation: 1,090 feet above mean sea level 
9c. Surrounding Topographic Features: The project area is located approximately 10.4 miles west of 
North Mountain and 11.2 miles north of the Estrella Mountains. 
9d. Nearest Drainage: The project area is adjacent to west of the New River 
9e. Local Geology: The Arizona Geological Survey has identified the surficial geology within  
the project area as late and middle Pleistocene surficial deposits composed of poorly to moderately 
sorted gravel and sand (Arizona Geological Survey 2013). 
9f. Vegetation: The natural vegetation in the project area has been mostly cleared except for the 
occasional grasses and shrubs. Prior to this development, the project area would have contained 
vegetation characteristic of the Lower Colorado River Subdivision of the Sonoran Desertscrub biotic 
community as described by Brown (1994).  
9g. Soils/Deposition: Mapped soil units in the project area include Laveen loam, Rillito loam, Vint fine 
sandy loam, which range from limy fan to sandy wash to sandy bottom (Natural Resources 
Conservation Service 2022). 
9h. Buried Deposits: Not likely 
9i. Justification: The project area has no surface evidence that would indicate the likelihood for 
subsurface cultural deposits.  
10. BUILT ENVIRONMENT: The project area is surrounded by paved roads and sidewalks, an apartment 
residence to the north with a trail adjacent to the south. In the northeast corner of the project area 
there is a small structure likely housing utility access.

18. COMMENTS: A Class III cultural resources survey for the Riverwalk Project resulted in no 
discoveries of archaeological materials or historic-era buildings, structures, objects, or districts in the 
project area. The 1957 U.S. Geological Survey El Mirage, Arizona, 7.5-minute topographic quadrangle 
depicts a large reservoir in the approximate location of the project area; however, the project area is 
not currently constructed to be used as a reservoir. Therefore, this project will not directly affect 
properties listed in or eligible for listing in the ARHP or the NRHP.

SECTION 21. DISCOVERY CLAUSE 
 
In the event that previously unreported cultural resources are encountered during ground-disturbing 
activities, all work must immediately cease within 30 meters (100 feet) until a qualified archaeologist 
has documented the discovery and evaluated its eligibility for the ARHP or NRHP in consultation with the 
lead agency, the State Historic Preservation Office (SHPO), and Tribes, as appropriate. Work must not 
resume in this area without approval of the lead agency. 
If human remains are identified during ground-disturbing activities, all work must immediately cease 
within 30 meters (100 feet) of the discovery and the area must be secured. The ASM, lead agency, SHPO, 
and appropriate Tribes must be notified of the discovery. All discoveries will be treated in accordance 
with Arizona Revised Statutes 41-844, and work must not resume in this area without authorization from 
the ASM and the lead agency.

As requested, this addendum has been prepared to discuss ground subsidence and earth fissures 
at the above-mentioned project. 
Ground Subsidence and Earth Fissure Commentary 
The project site is situated within the Basin and Range Province of Arizona in Glendale, Arizona. 
The area has been affected by a period of regional extension that resulted in a series of normal 
fault-block mountains and basins.  The up-thrown side of the normal fault forms a mountain that 
rises steeply and the down-dropped side forms low valleys.  After tectonic activity ceased, a series 
of alluvial fans and pediments formed along the margins of the mountain ranges.  Continued 
erosion of the mountain ranges buries these normal faults, as well as other discontinuities of the 
rock mass, under hundreds of feet of sediments.   
Earth fissures in the area are more than likely clustered above or near these normal faults or 
buried discontinuities as differential compaction above steeply sloped bedrock surfaces results in 
both vertical and horizontal strain in the basin sediments (see the illustration on the following page 
for the differing mechanisms of earth fissuring). 
Land Subsidence - Land subsidence is a reduction in surface elevation resulting from the loss of 
subsurface support at rates that are significant to man-made structures.  Land subsidence is 
caused by various natural and anthropogenic activities.  The most common types of land 
subsidence can be attributed to land development and resource extraction (i.e., underground 
mining, underground fluid withdrawal, etc.).  In southern Arizona subsidence features are closely 
linked to long-term withdrawal of groundwater.  Both fluid pressures and the aquifer sediments 
support the weight of the overburden material above an aquifer.  As groundwater is extracted, the 
buoyant forces decline, and the drained unconsolidated aquifer soils lose the ability to support 
overlying sediments.  As a result, a permanent loss of pore volume will occur, and the aquifer will 
consolidate as it adjusts to the new stresses.  This aquifer consolidation translates at the surface 
as land subsidence.

Earth Fissures - Earth fissures are a localized manifestation of land subsidence that appears as 
surficial tensile cracks in unconsolidated soils.  Typically, subsidence is not uniform throughout 
an area because of subsurface geology, ground water conditions, and ground water pumping 
rates.  It is when this differential subsidence occurs that fissures arise.  Earth fissures develop 
from narrow cracks or lines of small shallow depressions into large gaping features most 
commonly from surface water runoff.  
Please note, earth fissures can only be identified if they are visible at the surface.  Very young 
fissures typically lack the tell-tale signs (i.e., vegetation, width, continuity, etc.) that allow young, 
mature, and old earth fissures to be identified.  If local and regional groundwater withdrawal 
exceeds groundwater recharge, and land subsidence continues, then there is a risk that earth 
fissures may form at locations where no earth fissures currently exist.   
The nearest earth fissure study area is known as the Luke Study Area (approximately 2.8 miles 
to the west).  An Earth Fissure Map of the northern portion of the Luke Study Area is shown below.

In conclusion, during the site investigation performed on November 11, 2020, no evidence of 
localized subsidence, such as earth fissures, were detected at the project site.  Because no visual 
evidence of land subsidence and earth fissures were observed at the site, and because the site 
is not located within an active study area, the site is not considered by this firm to be an active 
earth fissure site.  During construction, if evidence of land subsidence or earth fissures is 
encountered, this firm must be contacted to perform a further investigation. 
 
This concludes all items to be addressed by this addendum, which must be attached to the initial 
report and made a part thereof. Should any questions arise concerning the content of this
