CHANGE ORDER #1

THIS CHANGE ORDER #1 (this “Change Order”) is entered into as of July 31. 2025, between
the City of Buckeye, an Arizona municipal corporation (the “City”) and M. R. Tanner
Development and Construction, LLC, an Arizona limited liability company (the “Contractor”).
This Change Order modifies certain sections of Contract No. 2025081 (the “Contract”), with those
sections not expressly modified remaining in full effect pursuant to their terms.

RECITALS:

The City and Contractor entered into indefinite delivery, indefinite quantity Contract No. 2025081
dated September 3. 2024. Pursuant to which Contractor was to provide Job Order Contract
Category 1: Street Maintenance Construction Services with an expiration date of September 2.
2025.

CONTRACT CHANGES:

l. Article 1 — Contract Term, is amended by exercising option year one of the
Contract and extending the Contract end date from September 2. 2025. to September 2. 2026.

ADDITIONAL PROVISIONS:

Except as amended herein, all provisions of the Contract remain in full force and effect.

In the event of any conflict or discrepancy between the terms of this Change Order, the
Contract, and any other contract documents, the documents shall govern in that order.

This Change Order may be canceled pursuant to the provisions of A.R.S. § 38-511.
