Project Summary:
1.
This request is for a Special Use Permit (SUP) for an indoor water truck depot in the Rural-43
zoning district, which is a permitted special use per MCZO, Art. 1301.1.22. The site is a 2.5 acre
parcel (APN 219-38-066C) located at the southeast corner of 172nd St. and Rio Verde Dr.
2.
The site was purchased with the plans to construct and operate a truck depot for Dynamite Water,
which serves residents in the Rio Verde foothills (RVFH) area. Dynamite Water also provides fire
support to both Rural-Metro and the US Forest Service (USFS). With Dynamite Water being one of
the three companies that supplies potable water to households in RVFH, it grown necessary to
develop a local water truck depot. RVFH has very limited water infrastructure and approximately
2,000 households rely on hauled water.

At present the nearest water truck depot is located approximately 27 miles, or about 45 minutes
from the RVFH service area. Granting of this SUP would reduce considerable time and cost to the
routing household service delivery. Also, an exclusive perpetual contract with Rural-Metro allows
Dynamite Water to provide supplemental water for emergency fire suppression. Dynamite’s ability
to mobilize on short notice is highly dependent upon properly maintained trucks and convenient
all-weather access, both of which are achievable with this proposed water truck depot facility.

On average, Dynamite Water responds to between 10 and 20 fire support calls per year for Rural-
Metro for home and structure fires, and brushfires. RVFH is adjacent to the Tonto National Forest.
Dynamite Water provides the same on-call fire support to the USFS as it does to Rural-Metro.
When a wildfire occurs, USFS will contact Dynamite Water directly to request service. The
response time from the proposed SUP site would be approximately 10 – 15 minutes compared
to approximately 2-hour response time from the current Phoenix location, which requires one or
more drivers to, pick-up truck(s) and respond to the wildfire location.

The applicant is proposing to develop the site with a 60’ x 100’ metal structure to serve as the
truck depot to house up to four (4) water delivery trucks. The structure will be located near the
center of the site. The building will be designed to have an east-west orientation for efficient truck
ingress and egress with eight roll-up bay doors, four on the east elevation and four on the west
elevation for drive-through access. The proposed drive-through access will reduce truck
maneuvering and the use of back up ‘beepers’. Trucks will access the property from 172nd Street
using a one-way driveway and exit via 172nd Place, also using a one-way driveway.

Each truck will have a single driver who will pick up a truck each morning and provide water
deliveries in the area for the day. Intermittent trips to the property are not anticipated. Typical
business hours for water deliveries during times of highest demand are 6:00 a.m. to 7:00 p.m.
Trucks will fill with water at the EPCOR’s 176th St. standpipe, south of Rio Verde Dr., which is open
from 7:00 a.m. to 7:00 p.m. daily. Dynamite’s hours of operation will generally coincide with the
standpipe hours. Additional hours of operation should be expected if and when Dynamite is called
upon for emergency fire support. This is a low traffic generator that focuses primarily on the
overnight indoor storage of no more than four water delivery trucks.

The proposed SUP conforms to the current Rural-43 zoning districts development standards. The
proposed building will be setback at least 100’ from all lot lines to help ensure a distance buffer
and compatibility with the surrounding large-lot residential and master-planned residential uses.
Screening and security of the site will include a perimeter fence and enhanced landscaping along
the Rio Verde Dr. frontage, including the addition of ten (10) mature mesquite trees. The fencing
will be the height and material consistent with the surrounding area as requested by the

neighboring property. Site improvements also includes a septic system, two 35’ x 80’ concrete
aprons, and a 70’ x 130’ asphalt parking area with paved driveway access to 172nd St. and 172nd
Pl.

Rio Verde Foothills Area Plan (adopted 2005): Designates the subject site as Rural Densities (0-
1). The proposed use and the development of the site will maintain the rural character of the area.
Public Participation Summary:

The applicant complied with all the necessary public participation requirements according to
MCZO Section 304, including notification of property owners within 300’ of the subject site and
posting of the site. Registered areas of interest were contacted by the applicant and staff
regarding the Special Use Permit request. Staff received 10 opposition emails with concerns
regarding traffic, dust, and noise during the initial phase of the case, in December 2024. The
concerns brought up by the public were resolved and to date staff has not received any new
opposition.
Outstanding Concerns from Reviewing Agencies:

There are no outstanding concerns from county reviewing agencies. Staff did not receive
comment from any secondary review entities.
Staff Analysis:

Staff finds the proposed use to be appropriate for the area It will be in concert with area land use
and development patterns. The proposed facility will provide a critical service. Due to the rural
nature of the area, RVFH residents do not have access to public water line infrastructure but rather
depend on hauled water. Staff understands the importance to have the water service nearby not
only for efficient residential service but also for more rapid-fire emergency response services.
The proposed development will be in compliance with the Rural-43 zoning district development
standards and will not cause any predictable disturbance to the surrounding area. Therefore, staff
is supportive and recommends approval for the reasons noted above.
Recommendation:
15.
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors
approve SU240025 subject to the following conditions ‘a’ – ‘l’:

a.
Development of the site shall be in substantial compliance with the site plan entitled
“Dynamite Water” consisting of four (4) full size sheets stamped received September 17,
2025, except as modified by the following conditions.
b.
Development of the site shall be in substantial conformance with the narrative report
entitled “Dynamite Water” consisting of thirty-nine (39) pages dated September 17, 2025
and stamped received September 17, 2025, except as modified by the following
conditions.
c.
The following Planning Engineering conditions shall apply:
1.
Engineering review of planning and/or zoning cases is for conceptual design only.
All development and engineering design shall be in conformance with Section
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards;
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual;
and current engineering policies, standards and best practices at the time of
application for construction.
2.
Based on the conceptual design nature of the information submitted, changes to
the site layout may be necessitated by the final engineering design of the site’s
drainage infrastructure.
3.
Detailed Grading & Drainage (Site Infrastructure) Plans must be submitted with the
application for Building Permit.
4.
Basins shall drain within 36 hours and calculations to be shown in final drainage
report.
5.
Power poles must have meet MCDOT Roadway design clear zone distance or
provide barrier protection.
6.
MCDOT – minimum half-width 40’ ROW preservation along 172nd Street
7.
MCDOT – Mitigate turning movement conflicts with water trucks and neighboring
residents.
d.
Prior to issuance of a building permit, written confirmation will be required from the
emergency fire protection jurisdiction that emergency fire protection service will be
provided to the facility. Prior to issuance of the certificate of occupancy, local fire
protection jurisdiction review and approval will be required.
e.
The applicant shall apply for any required construction permits for the appropriate
occupancy within one (1) year of approval of this Special Use Permit prior to establishing
the use and/or occupancy of the existing structures.
f.
The Special Use Permit is valid for a period of 25 years and shall expire on November 19,
2050, or upon termination of the use for a period of 90 or more days, whichever occurs

first. All site improvements associated with the special use permit shall be removed within
90 days of such expiration or termination of use.
g.
All lighting associated within the special use permit area shall be in conformance to the
Maricopa County Zoning Ordinance Section 1112.
h.
All signage associated to the special use permit shall be in conformance with the
Maricopa County Zoning Ordinance Section 1401.
i.
Non-Compliance with any Maricopa regulations will be grounds for possible revocation of
this special use permit pursuant to the process set forth in the Maricopa County Zoning
Ordinance.
j.
The property owner/s and their successors waive claim for diminution in value if the
County takes action to rescind approval due to noncompliance with conditions.
k.
The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to
enjoy uses in excess of those permitted by the zoning exiting on the date of application,
subject to conditions. In the event of the failure to comply with any condition, and at the
time of expiration of the special use permit, the property shall revert to the zoning that
existed on the date of application. It is, therefore, stipulated and agreed that either
revocation due to the failure to comply with conditions, or the expiration of the special use
permit, does not reduce any rights that existed on the date of application to use, divide,
sell or possess the property and that there would be no diminution in value of the property
from the value it held on the date of application due to such revocation or expiration of
the special use permit. The special use permit enhances the value of the property above
its value as of the date the special use permit is granted and reverting to the prior zoning
results in the same value of the property as if the special use permit had never been
granted.
l.
All buildings associated with this special use shall be setback a minimum 100’ from lot
lines.

CONTRACTOR TO OBTAIN MCDOT PERMITS PRIOR TO CONSTRUCTION WITHIN COUNTY
RIGHT-OF-WAY, AND ALL NECESSARY PERMITS FROM OTHER AGENCIES AND FROM LOCAL
GOVERNMENTS FOR WORK WITHIN THEIR JURISDICTION.
6.
CONTRACTOR SHALL NOTIFY THE MCDOT INSPECTION DEPT. AT LEAST 24 HOURS IN ADVANCE OF
ANY CONSTRUCTION AT (602) 506-8606.
7.
CONTRACTOR PERFORMING CONSTRUCTION OR EXCAVATING OPERATIONS IS RESPONSIBLE FOR
LOCATING AND RELOCATING ALL UTILITIES IN CONFLICT OR WITHIN THE CLEAR ZONE, AT NO
EXPENSE TO MARICOPA COUNTY. THE CONTRACTOR SHALL CONTACT “BLUE STAKE” AT (602)
263-1100 PRIOR TO BEGINNING CONSTRUCTION.
8.
THE CONTRACTOR IS RESPONSIBLE FOR OBTAINING ANY REQUIRED PERMITS FOR EARTH MOVING
FROM MARICOPA COUNTY AIR QUALITY DEPARTMENT'S DUST COMPLIANCE DIVISION (602) 506-6010
PRIOR TO CONDUCTING EXCAVATION OPERATIONS. A COPY OF THE PERMIT AND DUST CONTROL
PLAN SHALL BE SUBMITTED TO THE COUNTY ENGINEER PRIOR TO COMMENCEMENT OF ANY
EARTHMOVING ACTIVITIES.
9.
PRIOR TO CONDUCTING EXCAVATION OPERATIONS, THE CONTRACTOR SHALL OBTAIN FROM THE
ARIZONA STATE HISTORICAL PRESERVATION OFFICER (602) 542-4009, RECOMMENDATIONS
REGARDING THE NEED FOR CULTURAL RESOURCES (ARCHAEOLOGICAL) CLEARANCE. ALL DISCOVERIES
OF HUMAN REMAINS, CULTURAL ARTIFACTS, OR PALEONTOLOGICAL REMAINS SHALL BE REPORTED
TO THE ARIZONA STATE MUSEUM AND MCDOT. UPON DISCOVERY, CONTRACTOR SHALL CEASE
OPERATIONS IN THE VICINITY OF THE FIND AND PROTECT THE DISCOVERY AREA FROM FURTHER
DISTURBANCE UNTIL THE FIND CAN BE PROFESSIONALLY INVESTIGATED BY THE ARIZONA STATE
MUSEUM AND MCDOT.
10. EXCEPT UNDER EMERGENCY CONDITIONS, ROADS SHALL NOT BE CLOSED FOR CONSTRUCTION
ACTIVITY UNLESS PRIOR APPROVAL IS OBTAINED FROM THE MCDOT TRANSPORTATION DIRECTOR OR
HIS REPRESENTATIVE.
11. PRIOR TO MOVING OR DESTROYING PROTECTED NATIVE PLANT SPECIES, THE CONTRACTOR SHALL
FILE A FORMAL NOTICE OF INTENT WITH THE ARIZONA DEPARTMENT OF AGRICULTURE NATIVE
PLANTS (602) 542-6408.
12. PRIOR TO INSTALLATION OF CURB, GUTTER, SIDEWALK, BASE COURSE AND WEARING SURFACE,
SUBMIT SOIL TEST(S) OF SUB-GRADE AND REVISED PAVEMENT DESIGN/CALCULATIONS TO MCDOT
FOR REVIEW AND APPROVAL. IF SUB-GRADE STABILIZATION IS REQUIRED, THE AREA STABILIZED
SHALL BE FROM BACK OF SIDEWALK TO BACK OF SIDEWALK AND MATCH THE STABILIZATION DEPTH
OF THE PAVEMENT STRUCTURE.
13.
ASPHALT MIX DESIGN SHALL BE SUBMITTED TO MCDOT A MINIMUM OF 48 HOURS PRIOR TO PLACING
ANY ASPHALT COURSES. (TRENCH WORK EXCLUDED.) ALL PAVED TURNOUTS SHALL HAVE THE SAME
ASPHALT AND BASE REQUIREMENTS AS THE ADJACENT ROADWAY UNLESS NOTED OTHERWISE.
14.
ALL COMPACTION AND BACKFILL WITHIN COUNTY RIGHT-OF-WAY SHALL CONFORM TO THE MCDOT
SUPPLEMENT TO MAG SPECIFICATION SECTION 601. BACKFILL UNDER EXISTING PAVEMENT, CURB
AND GUTTER, ROADWAY SHOULDERS AND UNPAVED ROADWAYS SHALL CONSIST OF ONE-HALF(1/2)
OR ONE SACK CLSM. UNPAVED ROADWAY AREAS INCLUDE THE TRAVELLED WAY PLUS FIVE FEET
BEYOND THE TRAVELLED WAY.
15.
ALL STRUCTURES, SUCH AS MANHOLES, VALVE BOX & COVERS, AND MONITORING WELLS MUST BE
MARKED WITH AT LEAST TWO REFLECTIVE YELLOW FLEX POSTS WHEN STRUCTURES ARE LOCATED
OUTSIDE THE TRAVELED WAY AND WITHIN THE RIGHT-OF-WAY. (APPLIES ONLY WHEN THERE IS NO
CURB.)
16. PAVEMENT WIDENING AND PAVEMENT REPLACEMENT SHALL CONFORM TO REQUIREMENTS OF
SPECIFICATION SECTION 336. PAVEMENT CUTS SHALL NOT BE LOCATED WITHIN A LANE WHEEL PATH.
THE LANE WHEEL PATH IS THE ENTIRE LANE WIDTH EXCEPT THE AREA WITHIN ONE FOOT OF A LANE
LINE STRIPE AND EXCEPT THE CENTER TWO FEET OF THE TRAVEL LANE.
17.
ALL EXISTING PAVEMENT MARKING, TRAFFIC SIGNS AND SIGNAL EQUIPMENT THAT NEED TO BE
REMOVED, REPLACED, RELOCATED OR REPAIRED BECAUSE OF CONTRACTOR'S WORK WILL BE DONE
BY THE CONTRACTOR AT HIS EXPENSE. ALL SALVAGED SIGNS SHALL BE DELIVERED TO THE TRAFFIC

COLLIERS ENGINEERING & DESIGN (ARIZONA) STANDARD ENGINEERING NOTES
1.
These plans are subject to the interpretation of intent by the engineer. All questions regarding these plans shall be presented to the engineer. Anyone who
takes it upon themself the interpretation of the drawings or makes revisions to the same without conferring with the design engineer shall be responsible for
the consequences thereof.
2.
The estimated quantities shown are for information purposes only. The contractor shall be responsible for the completeness and accuracy of a detailed
estimate based on these plans, current codes, and site visitation.
3.
The engineer shall not be responsible for construction means, methods, techniques, sequences, procedures or safety precautions or programs utilized in
connection with the work, and will not be responsible for the contractor's failure to carry out the work in accordance with the contract documents.
4.
The engineer and applicable agency must approve, prior to construction, any alteration, or variance from these plans. Any variations from these plans shall
be proposed on construction field prints and transmitted to the engineer.
5.
Any inspection by the City, County, engineer, or other jurisdictional agency, shall not, in any way, relieve the contractor from any obligation to perform the
work in strict compliance with applicable codes and agency requirements.
6.
All earthwork construction shall conform to the latest Maricopa Association of Governments Standard Details and/or specifications including any
supplements thereto, and all addenda.
7.
The engineer makes no representation or guarantee regarding earthwork quantities or that the earthwork for this project will balance due to the varying field
conditions, changing soil types, allowable construction tolerances and construction methods that are beyond the control of the engineer.
8.
Prior to bidding the work, the contractor shall thoroughly satisfy themself as to the actual conditions, requirements of the work and excess or deficiency in
quantities. No claims shall be made against the owner/developer or engineer for any excess or deficiency therein, actual or relative.
9.
Existing utilities shown on these plans have been located according to information provided by the agency operating each utility. Locations shown are
approximate only and are not reliable for construction purposes. Call Blue Stake for field location at 811 or click Arizona811.com. The contractor shall
protect and maintain all existing utilities on the site. Any damage to existing utilities, whether shown or not on the drawing, shall be repaired/replaced at the
Contractor's expense. Existing surface features and fencing shall be replaced in kind.
10.
The engineer shall not be responsible for coordinating the relocation of utilities, power poles, etc.
11.
This set of plans has been prepared for the purposes of municipal and agency review and approval. This set of plans shall not be utilized as construction
documents until all approvals required have been obtained and all conditions of approval been satisfied.
12.
The contractor shall make no claim against the owner or the surveyor regarding alleged inaccuracy of construction stakes set by the surveyor unless all
survey stakes set by the surveyor are maintained intact and can be verified as to their origin. If, in the opinion of the surveyor, the stakes are not
maintained intact and cannot be verified as to their origin, any remedial work required to correct any item of improper construction work shall be performed
at the sole expense of the responsible contractor or subcontractor.
13.
The surveyor will make field as-built measurements of the work upon notification by the client or his representative that the work is complete and ready for
as-built survey. For pipe work, the contractor is responsible for leaving trenches open so that as-builts can be performed to comply with the City, County, or
other jurisdictional agency requirements. If the trenches are backfilled and obscured to the point that as-built measurements cannot be performed, it will be
the responsibility of the contractor to pothole utility trenches as necessary to complete an as-built survey.
14.
The contractor is to verify the location, elevation, condition, and pavement cross-slope of all existing surfaces at points of tie-in and matching, prior to
commencement of grading, paving, curb and gutter or other surface construction. Should existing locations, elevations, condition, or pavement cross-slope
differ from that shown on these plans, resulting in the design intent reflected on the plans not able to be constructed, the contractor shall notify the owner's
agent immediately for direction on how to proceed prior to commencement of construction. The contractor accepts responsibility for all costs associated
with corrective action if these procedures are not followed.
15.
Contractor is responsible for protecting all storm drain pipes, storm water retention pipes, drainage facilities and other utilities from damage during all
stages of construction. The depth of cover on the storm drain pipe is designed for final grade. Therefore, extra care such as berming over pipes, flagging
or signage should be used during construction to maintain cover or protect the pipes.
16.
If pad certifications are performed, it is understood that the certification provides only a representative elevation of the average grade of each lot, buildings
or unit pad, and shall not be construed to include yard and street sub-grade certification or certification that the entire pad is level, that it was constructed in
the designed location or was graded to the cross-section set forth on the plans or as designated in the soils report.
17.
Finish grades shown on these plans are the final finish grades. Contractor is responsible for over-excavating landscape areas to allow for planting and utility
trenching spoils and for the final landscape treatment (decomposed granite, lawn, etc.).
18.
The proposed improvements shown in these plans have been designed to applicable standards and criteria. The end user is advised that the
improvements will require ongoing maintenance in the form of periodic inspection, clean up, and/or repairs to maintain performance of the improvements as
originally designed.
19.
COLLIERS ENGINEERING & DESIGN recommends that double ring infiltrometer testing be conducted on all constructed basin bottoms
alongside constant head percolation test on installed drywells. Testing data to be provided to COLLIERS ENGINEERING & DESIGN for
analysis. The required number of drywells may be altered based upon the measured drywell percolation rates and natural infiltration rates such
that the combined dewatering rates will dewater the basin within the allotted 36-hour dry-out period. This may result in an increase or decrease
of required drywells

DETERMINED BY MARICOPA COUNTY SHALL BE TESTED PER THE DRAINAGE POLICIES AND STANDARDS FOR
MARICOPA COUNTY STANDARD 6.10.12. THE TEST RESULTS, BORING LOGS, AND REVISED DRAIN-DOWN TIME
CALCULATIONS.
DEMONSTRATING THAT ALL RETENTION BASINS DRAIN WITHIN 36-HOURS, SIGNED AND SEALED BY AN ARIZONA
REGISTERED PROFESSIONAL ENGINEER, SHALL BE SUBMITTED FOR APPROVAL WITH THE AS-BUILT PLAN
DOCUMENTATION. SOIL INFILTRATION TESTING OBTAINED DURING DESIGN PHASE ARE ACCEPTABLE.
11.
ALL DRYWELL PERCOLATION RATES SHALL BE DE-RATED IN ACCORDANCE WITH MARICOPA COUNTY STANDARD

Purpose of Request
This application is for an SUP to allow an indoor water truck depot on approximately 2.35
acres located at the southeast corner of 172nd Street and Rio Verde Drive (APN 219-38-066C, the
“Property”) under Maricopa County Zoning Ordinance Article 1301.1.22 (outdoor storage
including wholesale and retail sales of landscape materials, storage rental yards, construction

operations of Dynamite Water, LLC (“Dynamite” or “Dynamite Water”). The MCZO Article
1301.1 Special Uses allows the issuance of SUPs for certain uses which may not be listed in a
given zoning district, but such a permit may be necessary and/or tailored to operate in a manner
that does not detract from the community. Furthermore, Article 1301.5.9 of the Zoning Ordinance
allows the Planning & Zoning Commission to modify timeframes for the commencement of
construction and/or the cessation of an SUP. Supported by the details of the proposed use and the
positive impact to the community, Dynamite Water is requesting a minimum SUP duration of 25
years.
Damon Bruns, the owner and operator of Dynamite Water, LLC, purchased the Property
to construct and operate a truck depot for his existing water hauling business that serves residents
in the Rio Verde Foothills (“RVFH”) area and residents of other nearby rural communities, as well
as provide for fire support to both Rural-Metro and the Forest Service. Dynamite Water is one of
three companies that supply potable water to households in RVFH. RVFH has very limited water
infrastructure and approximately 2,000 households rely on hauled water.

service area. This distance from
its customer base is one of the
driving reasons for this SUP
application, which if granted,
would reduce considerable time
and cost to its routine household
service delivery. But perhaps more importantly, it would be detrimental to Dynamite’s ability to
serve the Rural-Metro Fire Department in a timely manner.
Dynamite Water plays a vital role in emergency fire support services in RVFH. An
exclusive perpetual contract with Rural-Metro allows Dynamite Water to provide supplemental
water for emergency fire suppression. Dynamite’s ability to mobilize on short notice is highly
dependent upon properly maintained trucks and convenient all-weather access, both of which are

achievable with this truck depot facility. Each of the company’s trucks is registered with the
Arizona Department of Transportation as a non-government emergency service vehicle, for
potential fire suppression water hauling. Dynamite Water also has an exclusive standpipe
agreement with Water Utility of Northern Scottsdale to obtain and haul water to support Rural-
Metro Station #826. On average, Dynamite Water responds to between 10 and 20 fire support
calls per year for Rural-Metro. These calls include home and structure fires, and brushfires.
Additionally, RVFH is adjacent to the Tonto National Forest. Dynamite Water provides the same
on-call fire support to the Forest Service as it does to Rural-Metro. When a wildfire occurs, the
Forest Service will contact Dynamite Water directly to request service. Dynamite’s response time
from this Property is approximately 10-15 minutes compared to the approximately 2-hour response
time from Dynamite’s current location in Phoenix, which requires one or more drivers to travel to
that location, pick up the needed truck(s) and respond to the wildfire location.
In addition to founding Dynamite Water, Mr. Bruns, is a retired Phoenix Firefighter who
lives in the Rio Verde Foothills area, volunteered to help lead the Rio Verde Foothills community
in establishing itself as a Firewise USA Community. Firewise USA is a community-based
program managed by the National Fire Protection Agency (“NFPA”) that is focused on providing
residents with education, policies and practices, and resources to protect against the loss of life and
property from wildfires through enhanced property management measures and general awareness.
The NFPA approved the Rio Verde Foothills application to become a Firewise USA Community
in June 2024. Mr. Bruns’s ongoing participation, donations, and community engagement has led
to approximately 2,400 enrolled participants in the program.
Relationship to Surrounding Properties
The Property is zoned Rural-43 with a Comprehensive Plan designation of Rural
Residential (0-1 du/ac) in the Rio Verde Foothills Area Plan. The Maricopa County
Comprehensive Plan outlines 24 land use categories, five of which are residential. The Rio Verde
Foothills Area Plan contains only one residential land use category – Rural Residential (0-1 du/ac).
At only 2.35 acres, this Property is well below the 40-acre threshold for requiring a Comprehensive
Plan Amendment. This Comprehensive Plan policy recognizes the minimal impact that small
projects have on the overall character of a community.
The RVFH area is predominantly residential
in character with the exception of a recently approved
16.8-acre Shops at Rio Verde commercial center
located approximately 1,000 feet east of the Property
at the southwest corner of 174th Street & Rio Verde
Drive. The Board of Supervisors approved the Shops
at Rio Verde (Case# Z2022221; Rural-43 to C-2
CUPD) on July 28, 2023 and was approved without a
Comprehensive Plan Amendment due to the Property
being less than 40 acres in size.

The Property is adjacent to Rio Verde Drive and is surrounded by similarly zoned
properties to the east, west and south. Across Rio Verde Drive is the Vista Verde Subdivision
which is more densely zoned with a combination of Rural-43, R1-10, R1-6, R-3, and C-2.
Surrounding Zoning
The separation between the proposed building and the nearest existing homes is
approximately 160 feet to the south, 460 feet to the northeast, and 730 feet to the northwest. There
are also large intervening vacant parcels separating the Property from developed property to east
and west – over 25 acres of vacant land to the east and over 36 acres of vacant land to the west.
Description of Proposal
This application includes a Conceptual Site Plan
(Figure 3) which proposes a 60’ x 100’ truck depot metal
building for the parking and maintenance of water delivery
trucks and general business operations. This building will
house up to four (4) water delivery trucks. There will not
be any outdoor storage of vehicles or equipment, nor
will there be any on-premises office use. The building is
designed to have an east-west orientation for efficient truck
ingress and egress, with eight roll-up bay doors – four on
the east elevation and four on the west elevation – allowing
for drive-through truck access. Drive-through access will
reduce truck maneuvering and the use of back-up ‘beepers’.
Trucks will access the Property from 172nd Street using a
one-way driveway and exit via 172nd Place, also using a one-way driveway.
Up to four (4) trucks will be parked indoors overnight. Each truck will have a single driver
who will pick up a truck each morning and provide water deliveries in the area for the day.
Intermittent trips to the Property are not anticipated. Typical business hours for water deliveries
during times of highest demand are 6:00 a.m. to 7:00 p.m. Trucks will fill with water at the EPCOR
standpipe located on 176th Street, south of Rio Verde Drive, which is open from 7:00 a.m. to 7:00
p.m. Dynamite’s hours of operation will generally coincide with the standpipe hours. Additional
hours of operation should be expected if and when Dynamite is called upon for emergency fire
support. This is a low traffic generator that focuses primarily on the overnight indoor storage of
no more than four water delivery trucks.
Figure 2 below provides the development standards for the current Rural-43 zoning district,
the IND-1 industrial zoning district for reference, and the proposed development standards for this

SUP. This application conforms to the current Rural-43 zoning development standards, except
where minimum building setbacks have been increased to maximize compatibility with the
surrounding uses. This SUP is committed to increasing the rear setback from 40 feet to 100 feet
to ensure sufficient separation from the project’s nearest existing residential neighbor.
Commitments for front and side setbacks are being increased from 40 and 30 feet, respectively, to
50 feet. It is anticipated that the actual placement of the building will exceed these setbacks;
however, because the Site Plan is still conceptual, the final design could result in minor
adjustments.
The approximately 6,000 square-foot building will be located near the center of the
Property, which more than doubles the front building setback and increases both side and rear
setbacks by multiples of five and six, respectively. The small building size equates to a lot
coverage of approximately 6% where the current zoning allows 25%. Furthermore, recent
conceptual architectural elevations are showing a building height of approximately 20 feet where
the Rural-43 district allows up to 30 feet.

Site improvements will include a septic system, two 35’x 80’ concrete aprons, and a 70’ x
130’ asphalt parking area with paved driveway access to 172nd Street and 172nd Place (Fig. 3
Conceptual Site Plan). Both roads are currently privately maintained dirt roads (easements) on
private Property and have direct access to Rio Verde Drive. Both roads will be paved from Rio
Verde Drive to the Property. The Conceptual Site Plan shows the new septic system being located
at the northeast corner of the Property, which maximizes its separation from the wash that traverses
the Property and from the neighbor’s Property to the south.
Screening and security of the Property will include perimeter fencing and enhanced
landscaping along the Rio Verde Drive frontage, including the addition of ten (10) mature mesquite
trees. Special consideration for the community has been a priority in the design this project. Care
has been taken to center the building on the Property, to maximize separation from the surrounding
properties and to work with building manufacturers who can produce a building that complements
the rural character of the Rio Verde Foothills community.

The Property will be maintained in its natural desert state to the extent possible with native
trees to help screen the building and required parking area. The building has been oriented to
minimize on-site maneuvering of trucks and equipment, which reduces noise. On-site lighting will
be limited to a pedestrian-scale, downward facing motion-activated light over the building’s
employee entrance.
The Property will be secured with unobtrusive no-climb fencing to match height and
material that of the neighboring property and similar to that which can be found throughout the
community. This will secure the Property while preserving the natural desert appearance of the
Property and seamlessly integrating it with the adjacent and other nearby properties. Coordination
has occurred with the adjacent Property owner to the south regarding this fence material, design,
and placement. The fence height is less than what IND-1 standards would require, if applicable -
but in those instances, the requirement is intended to screen typical industrial uses, particularly
those uses with outdoor uses, such as manufacturing and storage. As established herein, this SUP
does not include any outdoor uses. Moreover, the site has been designed to orient the building and
all on-site activities away from adjacent and nearby neighbors to maximize compatibility with the
adjacent properties and the greater Rio Verde Foothills community. As such, this application
proposes a deviation to allow the Property to remain in a predominantly natural desert state,
enhanced with ten (10) mature desert trees along Rio Verde Drive, and secured with a five (5) foot
tall no-climb wire mesh fence that matches the recently installed fence on the adjacent property to
the south of this site and similar to other fences in the community.

MCZO Section 1301.5 Variations of Standards and Requirements within the Special Uses
ordinance authorizes the Planning & Zoning Commission to recommend certain development
standards, including fences and walls, or other screening (Sec. 1301.5.2). Regular communication
with this adjacent property owner has been maintained throughout this SUP process and it is in
response to this owner’s request that this SUP includes the no-climb fence, and this request for
modified screening.
Circulation System
Vehicles will access the Property using 172nd Street, an existing unpaved and privately
maintained dirt road on the west side of the Property. The site has been designed to accommodate
a future possible 40-foot right-of-way dedication for 172nd Street that would correct the alignment
of 172nd Street north and south of Rio Verde Drive. Vehicles will exit the Property to the east
using 172nd Place, an existing privately maintained access easement that is entirely on the property
that terminates at the southern boundary of the Property. Access to 172nd Street and 172nd Place
will be from Rio Verde Drive, an improved arterial County road. Both, 172nd Street and 172nd
Place will be paved from Rio Verde Drive to the southern edge of their respective driveways on
the Property to improve dust control and to help maintain the condition of the roads. Onsite
circulation for water trucks will include a paved asphalt parking area and two driveways, plus two
concrete ‘aprons’ for dust-free garage access.
Development Schedule
The development of this Property will occur in a single phase and will begin immediately
following the necessary entitlement, site planning, and permitting approvals.
Community Facilities and Services
The RVFH area does not have substantial public amenities or parks. The Property is
approximately one-half mile west of the Tonto National Forest.
Public Utilities and Services
Water and Sewer: The Property will be served by a private well and a septic tank.
Food Concessions: Not applicable.
Sanitation: Refuse service will be provided at the site by private carrier.
Medical Facilities and Fire Protection: Dynamite Water has submitted the requisite
application materials to the Rio Verde Foothills Fire District to be considered for
annexation into the District.
The nearest Rural/Metro fire station is located at 164th Street and Rio Verde, and provides
both fire protection and emergency medical transport. Rural/Metro is a subscription service
and will provide service to the Property. The nearest urgent care/hospital facility is Honor

Health located at Scottsdale Road and Thompson Peak Parkway, approximately 17 miles
away.
Police Services: The Property is located within Maricopa County Sheriff’s Office District
7, served from the substation at 16705 E. Avenue of the Fountains, in Fountain Hills.
Illumination: Onsite lighting will be limited to low-level safety lighting located above the
pedestrian access door. This lighting will be directed downward to minimize spillage and
will be operated by a motion sensor to limit the duration of its use.
Conclusion
This project will provide better water service, enhanced fire protection for RVFH, and has
been designed for maximum community compatibility by providing for a barn-like appearance
within increased setbacks and adequate off-street parking to protect adjacent properties, thereby
protecting the public health, safety and general welfare of the adjacent property and the permitted
uses thereof as required by MCZO Article 1301.4.

As a resident of Trilogy In Rio Verde I would like to express my opposition to the
water hauling projects that are in the planning/ development stage.
Water hauling projects should not be located in front or nearby the Trilogy residential
community. The purpose of these projects is for the benefit of homeowners who
reside in the Rio Verde Foothills neighborhoods. Why should Trilogy residents have
to contend with trucks hauling water back and forth all day long in front of our
community entrances? These facilities should be located further west in the
community they serve.
Also, all roads that go in and out of these facilities need to be fully paved roads.

E. Rio Verde Dr can be very busy at certain times of the day. Large slow trucks crossing this road
may create a very hazardous situation. I would hope a temporary light stopping E Rio Verde Dr
vehicles will be installed to allow safe access of these trucks onto the highway if you choose to use
the area south of the road.
There is no speed enforcement by the Sheriff in the area, and no traffic light slowing traffic speed
along E Rio Verde Dr. It would be more safe to have the stand pipe and yard on the north side of the
road. The route used should be standardized so the impact is isolated as much as possible. The
times these trucks may drive on E Rio Verde drive should be limited with these routing
considerations.
There also should also be limited hours and days that the operation may operate as the noise and
diesel exhaust fumes will certainly impact certain addresses within Trilogy.

I am a water hauler in the Rio Verde Foothills area and have some concerns regarding this project.
I have concerns about the quantity of trucks and equipment being planned for this SUP. Our community needs a
relatively few number of vehicles (class “B” only) to fully provide water service. Having trucks and equipment that
are to be used for inter-state and intra-state jobs (neither benefitting nor servicing the RVF community) will detract
from the rural nature of my community. This could be a slippery slope if a commercial/industrial complex is
allowed to be established without adequate thresholds in place. Having equipment serviced and stored in a
residential area that is intended for use outside of our community will not benefit anyone in the RVF community. A
commercial maintenance facility that encompasses equipment that will not be of service to the RVF community
should not be allowed. If it is, then pandora’s box will be opened, potentially paving the way for future
commercialization of the RVF community as if one company is allowed to establish a commercial footing, then
other companies will likely request similar allowances.
Again, the RVF community only needs a relatively small number of trucks to adequately service our area. The
terrain out here is not conducive to class “A” tanker trucks that simply cannot be of service to this
community. Dynamite Water currently has an industrial maintenance/storage facility where they store and
maintain the equipment used for jobs outside the RVF community and there simply is no reason to allow for such
an industrial facility in the RVF community. It will absolutely degrade the overall appeal of why people live out
here. Keep industrial properties in areas already zoned for such usage, NOT in the RVF community.
My suggestion would be to limit the type and purpose of allowed equipment to only the vehicles that will be
directly used to service the RVF community alone and to not allow the storage and maintenance of the vehicles
used to service jobs outside of the RVF community. In other words, there is absolutely no reason to have class “A”
trucks stored and maintained in the RVF community. As stated, the RVF community is adequately serviced with
class “B” trucks exclusively and only a relatively small number of trucks are needed for this purpose. There is no
reason to allow for more than a few class “B” trucks per water hauler to maintain the integrity of the RVF
community.
I have been servicing the RVF community for almost 25 years and I know what is and is not needed to support this
community. The future EPCOR fill station will likely not be designed to accommodate class “A” vehicles as well,
further substantiating the reason to disallow the storage of such large vehicles. My fear is that Dynamite Water
desires to move their base of operations from its current location in an industrial area to this community. This is
unnecessary and unwarranted.

Furthermore, the traƯic on Dynamite/Rio Verde Road is already very congested as is. Allowing for large class “A”
tank trucks or an excessive amount of equipment to be stored in the RVF community which absolutely will not be
of value or necessity to this community will only further add to the congestion. It makes no sense to have such
large trucks stored in a residential community. Every time those vehicles are called upon, they will enter and
depart from Dynamite/Rio Verde Road creating traƯic hazards without any benefit to the community they are
stored and maintained in.
Please advise as to the nature and stipulations of the proposed SUP. All water haulers have been operating out
here on a low-key basis which has proven eƯective for nearly a quarter century. I am curious as to why now an
industrial complex is being proposed and considered. The last time Dynamite Water attempted to create an
industrial complex in this community, it was received poorly causing intense reactions. The RVF community has
made it abundantly clear that industrialization of the RVF community is unacceptable and not wanted. Limiting
the storage of vehicles to ONLY what is required to service the RVF community would be prudent to maintaining
the integrity and vibe of our rural RVF community as well as minimizing future unnecessary road congestion and
hazards.
