Project Summary:
1.
The applicant, Kashif Masih of Arktent, LLC, is requesting an MCP with a POD for a semi-truck
parking and storage yard in the IND-2 MAAMF zoning district and within APZ 2 and the 65 LDN.
The subject site is located on Parcel 502-37-064R, which measures approximately 2.8 acres. The
site is located approximately 350’ south and 1,650’ east of the southeast corner of McDowell
Road and Perryville Road in the Goodyear area. The requested use already exists onsite and is
allowed within the IND-2 zoning district. However, approval of an MCP and POD is required to
formally entitle the use within the MAAMF overlay zoning district.

The IND-2 zoning onsite dates back to April 19, 1995, when the BOS approved a request to rezone
the site from Rural-43 to IND-2 without stipulations per case Z94-77. At that time, the site was a
portion of a larger parcel measuring approximately 5.6 acres; though the lot width was about the
same, the parcel’s boundaries extended north to McDowell Road. The site remained vacant until
2006. The BOS approved a precise POD on June 22, 2005, per case Z2004134, followed by a major
amendment to the precise POD on October 18, 2006, per case Z2006037. These plans of
development entitled the use of the site for an industrial equipment storage facility. Finally,
separate from the primary industrial use, the BOS approved an MCP with a POD for a freeway-
oriented billboard on December 11, 2013.

Per the previously approved POD, the southern half of the site, corresponding with the present-
day subject parcel, was to be developed with an 11,970-square-foot warehouse with office space
and 45 parking spaces. This was due to be a tenant use developed as a second phase of the
project. This second phase was never developed, but from circa 2016 until circa 2023, the south
half of the site was used as additional storage space for the use on the north half.

In 2017, the original parcel was split into halves, with the north half (fronting McDowell Road)
becoming Parcel 502-37-064Q and the south half becoming Parcel 502-37-064R. The two parcels
remained under mutual ownership until 2023, when the southern parcel was sold to Dhami Group,
LLC, its current owner. Following the sale, the new owner graded the site for use as a semi-truck
parking and storage facility, though no entitlements or permits were secured for this use. No code
violation was reported, but the owner’s applicant did request the required UCCD, per case
UC2023026, which Luke AFB deemed compatible in a formal memo dated September 25, 2023.
The applicant followed with a pre-application meeting on October 24, 2023, per case PA2023156.
The applicant formally submitted this MCP request on January 11, 2024. Staff held the required
TAC meeting with the applicant on November 19, 2024.

The applicant proposes to continue operating the site as a semi-truck parking and storage yard,
with storage limited strictly to semi-trucks and trailers. Per the narrative, the site would not include
any warehousing, standalone shipping containers, or unrelated storage uses. Access to the site
is provided by an existing 32.5’-wide ingress/egress easement, which runs from McDowell Road
down the east lot line of the adjacent site to the north. This easement terminates at a rolling
access gate at the east end of the north lot line, from which drivers would enter the parking area.
Both the easement and parking area are paved. Up to 21 semi-truck parking spaces (each
measuring 65’ x 12’) and 11 personal vehicle spaces (including two ADA-compliant spaces) would
be provided going forward. Truck drivers would be permitted to park and leave their personal
vehicles onsite during transport but would not be permitted to reside or sleep onsite overnight, as
there would be no facilities to accommodate overnight lodging. Besides the owners, all drivers
utilizing the site would be part-time employees or customers. There would be no full-time staff.

6.
Hours of operation would be from 8:00 a.m. to 5:00 p.m., seven days a week. Screening would be
provided by existing 6’-high chain-link fencing along the east and west property lines, an existing
8’-high block wall along the north lot line, and a new 6’-high block wall along the south lot line. In
addition to the gate and screening, site security would be provided by five pole-mounted light
fixtures for nighttime visibility and a security camera system.

The applicant is requesting some modifications to the IND-2 development standards with the
MCP. The most significant modification is to allow a maximum light pole height of 35’ where a
maximum of 18’ is allowed by right per MCZO Article 1102.7.6. The reason for this modification
is to ensure adequate nighttime visibility and security in a large truck yard. Furthermore, the
surrounding zoning and land uses are entirely industrial except for the I-10 freeway to the south.
This mitigates the impact of higher lampposts on rural and residential uses, which is the purpose
of the 18’ height limitation. The narrative confirms that lights will be shielded and directed
downward to minimize offsite glare, as required per the MCZO.

The applicant is also requesting to modify the screening requirements along the east and west
lot lines. MCZO Article 902.9.3.c requires that the perimeter of a site upon which an outdoor
industrial use is permitted shall be enclosed to a height of at least 6’ by building walls, walls, or
fences of view-obscuring material. The proposed development standards would allow the
existing 6’ chain-link fence to remain (with or without view-obscuring material) along the east and
west lot lines. As the adjacent properties are zoned IND-2 or its equivalent in the City of Goodyear
(I-2), the reduced screening requirement along these lot lines would have a reduced impact on
properties that are or would be developed with uses similar to that which would be entitled with
this request. Finally, the applicant is requesting to waive one of the two required sight visibility
triangles where the access easement meets the north lot line. The reason for this is due to the
driveway’s adjacency to the east lot line, which would place the east SVT entirely onto an adjacent
parcel. The development standards requested with this MCP are summarized in the table below.

White Tanks / Grand Avenue Area Plan (updated December 2023): This area plan assigns the
site a future land use category of Military Compatible, which is consistent with its location within
the MAAMF overlay zoning district.
13.
City of Goodyear General Plan 2035 (adopted May 2024): The site is located within Goodyear’s
municipal planning area (MPA) and is therefore subject to the City’s general plan, which places
the site within its “Neighborhood” land use category. This category identifies areas for the growth
and development of neighborhoods, which include a wide range of densities and housing
products, public and community facilities such as schools and places of worship, and commercial
uses at appropriate intensities and locations. Although this is at odds with the industrial uses of
the site and its neighbors, the site is also located within the general plan’s “Luke Compatible Land
Use Overlay,” which corresponds with the high noise and accident potential zone (HNAPZ)
surrounding Luke Air Force Base. Per the general plan, uses with low employment populations
such as industrial and warehousing are appropriate in this overlay, whereas assembly and
residential uses are not. Furthermore, the general plan defers to State Statute, which restricts new
residential development within the HNAPZ. For this reason, the industrial use of the site is
consistent with this overlay.
Public Participation Summary:

The applicant complied with the requirements of the citizen review process with the required
posting of the site and notification by first class mail to interested parties and adjacent property
owners within 300’ of the subject parcel. Two signs were posted facing north towards McDowell
Road on May 6, 2024, in accordance with applicable regulations. Both signs were updated with
public hearing dates following County sign-off. To date, staff has not received citizen comment
regarding this request.

Staff notified the registered areas of interest of this request on October 21, 2024. The City of
Buckeye responded confirming they had no comments but would support any comments
provided by Goodyear’s planning division. However, Goodyear has not commented on the request
to date. ADOT also responded confirming it has no comments or concerns with the project, so
long as any development does not encroach on ADOT right-of-way (i.e., I-10) unless the developer
obtains the appropriate encroachment permit(s). No right-of-way encroachment is proposed with
this request.

Staff Analysis:
17.
Staff supports the applicant’s request for an MCP with a POD for a semi-truck parking and storage
facility. The requested use is compatible with the existing IND-2 zoning district as well as the High
Noise and Accident Potential Zone surrounding Luke AFB, as affirmed by the UCCD. Surrounding
properties are also zoned IND-2 or its equivalent in Goodyear, I-2, which mitigates the impact of
an outdoor storage use with frequent truck movements on adjacent properties. The site’s
proximity to the I-10 Papago Freeway also makes the site an appropriate location for long-term
truck parking. Finally, staff believes the requested development standard modifications are
sufficiently justified and would not negatively impact the site’s relationship to surrounding
properties.
Recommendation:
18.
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors
approve MCP2024001 subject to the following conditions ‘a’ – ‘g’:
a.
Development of the site shall be in substantial conformance with the Site Plan entitled
“Dhami Group LLC,” consisting of one full-size sheet, dated June 2025, and stamped
received July 15, 2025, except as modified by the following conditions. A revised site plan
that features an MCP Development Standards table consistent with the narrative
referenced in condition ‘b’ shall be submitted within 30 days of Board approval.
b.
Development of the site shall be in substantial conformance with the Narrative Report
entitled “Narrative – McDowell Trucking Yard Utility Improvements,” consisting of three
pages, stamped received August 27, 2025, except as modified by the following conditions.
c.
The following Planning Engineering conditions shall apply:
1.
A drainage easement covering the retention basin must be in place prior to building
permit issuance. The easement should note that the retention basin provides
retention for parcel APN 502-37-064Q.
2.
Any exterior screen wall must not obstruct flow onto the property.
3.
Prior to building permit Final Drainage Inspection, as-builts will be required to show
the site has been constructed in accordance with approved plans including the
retention basin. Testing data for the drywells must be provided for the drywells
showing the retention basin will drain within 36-hours.
4.
Engineering review of planning and/or zoning cases is for conceptual design only.
All development and engineering design shall be in conformance with Section
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards;
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual;
and current engineering policies, standards and best practices at the time of
application for construction.
5.
Based on the conceptual design nature of the information submitted, changes to
the site layout may be necessitated by the final engineering design of the site’s
drainage infrastructure.

d.
All buildings subject to noise attenuation as per ARS § 28-8482(B).
e.
The following MCP standards shall apply:
1.
Screening along east and west lot lines: minimum 6’-high chain-link fence.
2.
Sight visibility triangles: none required east of the driveway.
3.
All outdoor lighting shall be limited to a maximum height of 35’ and shall be fully
shielded to direct illumination downward at least 20 degrees below the horizontal
plane at the bottom of the fixture. Furthermore, any lighting installed onsite shall
not illuminate adjacent properties. Lighting shall be shut off nightly no later than
9:00 p.m. but may be motion activated during all nighttime hours. The owner,
applicant, or developer shall submit a site photometric lighting plan and elevation
drawings with the building permit to ensure conformance to this condition.
f.
Prior to issuance of a building permit, written confirmation will be required from the
emergency fire protection jurisdiction having authority that the facility has been designed
in accordance with their regulations and requirements, and that emergency fire protection
service will be provided to the facility. Prior to issuance of the certificate of occupancy,
local fire protection jurisdiction review and approval will be required.
g.
The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to
enjoy uses in excess of those permitted by the zoning existing on the date of application,
subject to conditions. In the event of the failure to comply with any condition, the property
may be considered for revocation to the zoning that existed on the date of application. It
is, therefore, stipulated and agreed that either revocation due to the failure to comply with
any conditions, does not reduce any rights that existed on the date of application to use,
divide, sell or possess the property and that there would be no diminution in value of the
property from the value it held on the date of application due to such revocation of the
MCP. The MCP enhances the value of the property above its value as of the date the MCP
is granted and reverting to the prior zoning results in the same value of the property as if
the MCP had never been granted.

ARTICLE 903.9. ADDITIONAL REGULATIONS: The additional regulations are as
follows:
1. A building or premise other than the residence, or one mobile home of the family
of the operator or caretaker employed on the premises of commercial or industrial use
shall not be used for dwellings, mobile home parks, travel trailer parks, mobile home
subdivisions and resort hotels.
2. Any outdoor lighting shall be in conformance with provisions in Chapter 11,
Section 1112. hereof. Any outdoor lighting shall be placed so as to reflect light away
from any adjoining rural or residential zoning district.*3
3 Site Enclosure and Screening Requirements: Industrial sites and/or uses shall be
enclosed to provide effective site screening from adjoining properties, uses or streets
as follows:
a. Adjacent to any rural or residential zone, automobile parking shall be screened
from view.
b. A solid masonry wall, not less than six feet in height shall be required along and
adjacent to any side or rear property line abutting any rural or residential zone
boundary, or any alley abutting such zone boundary. Further, any access gates shall
be constructed of view-obscuring material to provide effective site screening.

A. Project Overview
Project Title: Semi-Truck Parking Lot Utility Improvements
Location: South of McDowell Road, west of N. Citrus Road, and north of Interstate 10.
B. Purpose of Request
This Military Compatibility Permit (MCP) with Plan of Development (POD) is requested to:
- Install a new electric meter for independent APS electrical service.
- Secure a water easement for direct service from Arizona Water Company.
- Establish a physical address for site identification and utility compliance.
No changes to the use, intensity, or operation of the site are proposed.
C. Requested Use and Site Details
Existing Use:
The site will continue operating as a semi-truck parking lot and equipment storage yard.
“Trucking-related equipment” is limited exclusively to semi-trucks and trailers. No
warehousing, shipping containers, or unrelated storage uses are proposed.
Operations:
- Days/Hours: 8:00 AM – 5:00 PM, 7 days a week
- Staffing: Owner-operated; no full-time staff
- Usage: Long-term truck and trailer parking. Drivers may leave personal vehicles on-site
during transport but are not permitted to reside or sleep overnight on the premises.
- Driver Access: All drivers utilizing the site are either employees or customers of the
property owner.

Security Measures:

adoption of the resolution.

The property is zoned IND-2 and complies with the base zoning standards except for a few
requested modifications outlined below. Note: The site is located within the MAAMF zoning
overlay, which restricts new residential development in this area. Surrounding properties

Engineering Review has reviewed the 3rd plan (only site plan resubmitted, G&D not
resubmitted) routed for review on 5/27/2025, for the subject application and has no
objections subject to the following stipulations:
1.
A drainage easement covering the retention basin must be in place prior to
building permit issuance. The easement should note that the retention basin
provides retention for parcel APN 502-37-064Q.
2.
Any exterior screen wall must not obstruct flow onto the property.
3.
Prior to building permit Final Drainage Inspection, as-builts will be required to
show the site has been constructed in accordance with approved plans
including the retention basin. Testing data for the drywells must be provided
for the drywells showing the retention basin will drain within 36-hours.
4.
Engineering review of planning and/or zoning cases is for conceptual design
only. All development and engineering design shall be in conformance with
Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and
Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway
Design Manual; and current engineering policies, standards and best practices
at the time of application for construction.
5.
Based on the conceptual design nature of the information submitted, changes
to the site layout may be necessitated by the final engineering design of the
site’s drainage infrastructure.

The development owner is requesting an easement to receive a physical address for his property and turn on utilities in his own name. The site parcel (APN 502-37-064R) is
located at 18403 West McDowell Road, Goodyear, Arizona, 85395. Owner informs that he bought the South Parcel and has been borrowing utilities from the North Parcel. The
parcel was recently purchased and split into two separate properties. Owner proposes no improvements nor changes to existing operations (long-term semi-truck parking lot)of

Subdivision and Infrastructure –
An Approval to Construct application is required and must be submitted to MCESD’s

infrastructure.

Dear Mr. Holm
Thank you for the opportunity to comment on the Use Compatibility and Consistency
Determination, application for the existing Trailer Parking and Storage Yard. The site sits on
approximately 2.81-acres and is located within the arrival/departure corridor of Luke AFB at the
southeast corner of McDowell Road and Perryville Road in unincorporated Maricopa County, AZ.
The request is to issue a new address for the parcel in order to have an electrical meter installed. This
application does not propose new buildings or structures. The site is located inside the Luke AFB
Accident Potential Zone 2 (APZ 2), “high noise or accident potential zone,” as identified by
A.R.S. § 28-8461, and is within the “territory in the vicinity of a military airport,” also defined by
A.R.S. § 28-8461.
Luke AFB follows A.R.S. § 28-8481 when evaluating compatible land use within the “territory in
the vicinity of a military airport” and considers this request to be compatible and consistent with the high
noise or accident potential of a military airport or ancillary military facility and therefore will not
negatively impact Luke AFB’s flying and base operations.
We do request the opportunity to comment further as development plans and uses become more
defined. Since the development will be located within the “territory in the vicinity of a military airport,”
it will be subjected to approximately 170 over flights a day. We recommend you review the sound
attenuation requirements found in A.R.S. § 28-8482. In addition, a strong notification program on the
part of the applicant is essential to inform patrons about Luke AFB operations.
