Project Summary:
1.
The applicant, Kenneth Patch is requesting an MCP with a POD to allow a storage yard for 
construction equipment, recreational vehicles, a minor repair facility for vehicles, and an office on 
parcel 501-60-032D. The subject is comprised of approximately 2 acres and is located west of 
the northwest corner of Alsup Ave. and Fleetwood Ln. in the Glendale area within the Rural–43 
zoning district and Military Airport and Ancillary Military Facility Overlay (MAAMF). This is the high 
noise and accident potential zone of Luke Air Force Base (LAFB). Specifically, the site is located 
between the LDN 70 – 75 noise contours. There is an active violation case (V202102407) for 
running a business without the proper entitlement, but approval of this MCP would rectify the 
violation and bring the property into compliance.
2.
The applicant received a Use Compatibility and Consistency Determination (UC2024008) from 
Luke AFB that confirmed the proposed use as compatible and consistent with the high noise or 
accident potential of a military airport or ancillary miliary facility.
3.
The site is currently developed with a 1,735 sq. ft. storage shed and a 1,120 sq. ft. manufactured 
shipping container. The site will be redeveloped to be in compliance with the MCZO. The storage 
shed will remain on site for storage of equipment, and the manufactured shipping container which 
will be redeveloped into an office. The applicant will obtain As-Built permits for the two structures. 
4.
The applicant is proposing 6 parking spaces to serve the office, which will be located at the 
entrance of the site. Additionally, the applicant is proposing 26 covered parking spaces for the 
storage of RV/Boats on the northern portion of the site. The proposed shade canopy will have a 
height of 15’ and all parking areas will be paved and stripped. The southern portion of site will 
also be used for minor repair and maintenance of construction equipment and trucks and for 
storage of equipment for ongoing maintenance jobs such as plastic tanks, plastic chambers, and 
pvc piping. The site is enclosed by a 6’ CMU brick wall.
5.
The applicant is proposing to operate the site Monday through Sunday between the hours of 7 
am and 4 pm with 1 – 3 employees on site during business hours. Fleetwood Lane is a private 
right of way easement that ends at the entrance of the of the site, on the southern portion, and it 
is shared between parcels 501-60-030 and 501-60-032C. The applicant states in their narrative 
both neighbors are in support of using the private right of way for the proposed use of this site.   
The applicant did provide two letters of support from both neighbors. 
6.
In order to facilitate the use of the site with the existing structures and elements, the applicant is 
requesting to vary the front yard and side yard setbacks to reflect the office and storage shed 
already developed within the requested 20’ front yard setback and 10’ -7” side yard setback 
development standards as identified in the table shown in the following page:

White Tanks / Grand Avenue Area Plan (updated December 2023): This area plan assigns the 
site a future land use category of “Military Compatible,” which is consistent with its location within 
the MAAMF overlay zoning district.
11.
Envision Glendale 2040 (updated September 2016): The site is located within Glendale’s 
municipal planning area (MPA) and is therefore subject to the City’s general plan, which places 
the site within its “Luke Compatible Land Use Area”. This category is assigned to lands 
surrounding Luke AFB that are delineated by the 1988 Air Installation Compatible Use Zone 
(AICUZ) 65 LDN noise contour. The General Plan recognizes and supports the state legislation 
related to the continued, viable operations of military installations. Permitted uses shall follow 
the State of Arizona land use compatibility requirements and Arizona Revised Statute 28-8481.
Public Participation Summary:

The applicant complied with Maricopa County Citizen Review Process, with the required posting 
of the site and notification by first class mail to adjacent property owners within 300’ of the 
subject site and interested parties. The applicant submitted a Citizen Participation Results Report. 
According to the report, the applicant received two (2) letters of support from neighbors to the 
south of the site.

Staff notified both Glendale and Luke AFB (among the other registered areas of interest) of this 
request on October 15, 2024, ahead of the scheduled TAC meeting. To date, neither agency has 
directly commented. The Air Force issued an affirmative UCCD on May 16, 2024 (per case 
UC2024008) confirming that the then-proposed use of the land would not have a negative impact 
on Luke’s flying operations. This UCCD was issued prior to staff’s review of case MCP240005. 
Because the land use would not change with this request, staff did not require a subsequent 
UCCD.

Staff Analysis:

Staff supports this request for an MCP with a POD for Fleetwood Storage based on the 
determination by Luke Air Force Base that the use is  compatible and consistent with a military 
airport or ancillary facility. Staff recognizes the general area cannot be developed with any new 
residential uses in the unincorporated parcels or the City of Glendale due to the high noise or 
accident potential zones generated by military airport and ancillary military facility operations. If 
the site is not developed under this MCP it would remain vacant.

The proposed use would not negatively impact the surrounding residential uses or cause an influx 
of traffic through Fleetwood Lane, as customer would only come onto the site to drop off or pick 
up equipment within the limited business hours.

Recommendation:
17.
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve MCP240005 subject to the following conditions ‘a’ – ‘j’ as follows: 
a.
Development of the site shall be in substantial conformance with the Site Plan entitled 
“Fleetwood Storage,” consisting of 2 full-size sheets, dated May 6, 2025, and stamped 
received May 13, 2025, except as modified by the following conditions.
b.
Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Fleetwood Storage,” consisting of 4 pages, dated May 8 2025, and stamped 
received May 13, 2025, except as modified by the following conditions.
c.
The Military Compatibility Permit shall be limited to the following uses:
1.
Storage of construction material, equipment, and repair of equipment.
2.
Minor Repair Facility for up to two vehicles at a time.
3.
Storage of recreational vehicles (Boats and RV’s)
d.
The applicant shall obtain the appropriate commercial building permits for the existing 
structures. 
e.
The following Planning Engineering conditions shall apply:
1.
Engineering review of planning and/or zoning cases is for conceptual design only. 
All development and engineering design shall be in conformance with Section 
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; 
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; 
and current engineering policies, standards and best practices at the time of 
application for construction.
2.
Based on the conceptual design nature of the information submitted, changes to 
the site layout may be necessitated by the final engineering design of the site’s 
drainage infrastructure.
3.
Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted with 
the application for Building Permits 
4.
Retention basins to drain within 36 hours
5.
This site is not located in a Special Flood Hazard Areas (SFHAs). The Flood 
Control District has no comments on this application.
6.
The subject premises is located within the County’s Urbanized Area. If the project 
will disturb one (1) acre or more, a Storm Water Pollution Prevention Permit 
(SWPPP), issued by the County (PND), will be required prior to issuance of any 
building permits required for site development.
f.
All new buildings are subject to noise attenuation as per ARS § 28-8482(B).
g.
The following Military Airport and Ancillary Military Facility Overlay Zoning District 
standards shall apply:

1.

Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this Military Compatibility Permit as set forth in the Maricopa County Zoning 
Ordinance.
i.
The property owner/s and their successors waive claim for diminution in value if the 
County takes action to rescind approval due to noncompliance with conditions.
j.
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, and at the 
time of expiration of the Military Compatibility Permit, the property shall revert to the 
zoning that existed on the date of application.  It is, therefore, stipulated and agreed that 
either revocation due to the failure to comply with any conditions, or the expiration of the 
Military Compatibility Permit, does not reduce any rights that existed on the date of 
application to use, divide, sell or possess the property and that there would be no 
diminution in value of the property from the value it held on the date of application due to 
such revocation or expiration of the Military Compatibility Permit.  The Military 
Compatibility Permit enhances the value of the property above its value as of the date the 
Military Compatibility Permit is granted and reverting to the prior zoning results in the 
same value of the property as if the Military Compatibility Permit had never been granted.

Engineering Review has reviewed the second plan and report routed for review on 
02/12/2025, for the subject application and has the following objections: 
 
 
PND TRANSPORTATION PLAN REVIEW R/W INFORMATION  
 
1. Repeat comment: Email provided by applicant,  Maricopa County 
Department of Transportation currently reviewing application for TIS waiver, 
submitted 09-05-2024.  Clarification: either provide approved TIS waiver or 
an approved TIS.  
 
2. Fleetwood Lane is comprised of a series of private easement(s) that has not 
been accepted by the County; and is therefore not maintained by the County. 
It is the owner/applicant’s responsibilities to determine access rights to 
Fleetwood Lane. 
 
The following stipulations will apply: 
 
1. Engineering review of planning and/or zoning cases is for conceptual design 
only. All development and engineering design shall be in conformance with 
Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and

for the  Storage Facility planning case(s). Please note the following MCESD requirements for 
site development: 
Onsite Wastewater –  
A Notice of Intent to Discharge application for an onsite wastewater treatment (septic) 
system is required for any construction. Application must be submitted to the MCESD 
Onsite Wastewater Program. 
• 
Wastewater is not permitted to discharge to an adjacent parcel’s septic system. 
• 
Setback requirements must be maintained per Arizona Administrative Code, Title 
18, Chapter 9, Article 312, C (Features Requiring Setbacks).
