Project Summary:
1.
The applicant is requesting a zone change with overlay from Rural-43 to C-2 CUPD for the entire 
8.45-acre site to accommodate a self-storage facility. A concurrent request, also for the entire 
8.45 acres, includes an SUP for covered outdoor RV storage. The applicant has provided a precise 
plan for development. This is the least intense entitlement combination that can accommodate 
the request. The applicant revised an earlier request for C-3 zoning.  The 8.45-acre parcel is 
located at the southwest corner of Carefree Hwy. and 10th St. in the Desert Hills area. According 
to the applicant, this proposed zoning supports the commercial land use designation that is

outlined in the Daisy Mountain – New River Area Plan, which recognizes Carefree Hwy. as a scenic 
commercial corridor that should be designed to complement the rural character of the area. 
2.
The property is within the Carefree Highway Scenic Corridor (CHSC). The CHSC is not regulatory 
but does present design guidelines to preserve the area’s scenic views and limit the impact of 
any commercial development along this corridor. The Daisy Mountain – New River Area Plan 
designates both sides of Carefree Hwy. for future commercial uses within a scenic corridor, 
leaving most of the Desert Hills and New River areas reserved for rural residential land uses. The 
commercial designation along Carefree Hwy. is intended to be neighborhood-oriented services 
as reflected in residents’ and stakeholders’ recommendation at the time of Scenic Corridor study. 
The Scenic Corridor does call out preferred uses such as mini storage but specifically excludes 
outdoor storage. Per the applicant’s narrative, the proposed self-storage facility and outdoor RV 
storage is intended to serve the needs of the surrounding residences. An on-site office will hold 
daily business hours, and the site storage will be available by tenant 24 hours a day with keypad 
access at the main entry gate. Enclosed self-storage is proposed along the perimeter of the site 
and within the center of the site. There are 27 enclosed self-storage stalls, 26 covered RV stalls, 
and 101 enclosed RV stalls. In the center of the site are 119 covered RV stalls and 26 enclosed 
RV stalls. Parking is provided in front of the office and within the site, including ADA spaces 
outside the office and within the site. An RV dump vault will be periodically emptied and will not 
be connected to on-site septic. Two driveway entrances are proposed on 10th St, with the 
northernmost driveway to serve as emergency access and the southern driveway to serve as a 
full driveway entrance to the site. The full access driveway, office and parking are located at this 
southern driveway along with the office’s septic system located at the southeast corner of the 
site, immediately to the north of an adjacent residence’s private driveway.

A Commercial Unit Plan of Development (CUPD) overlay is requested to limit the commercial 
zoning for a self-storage facility. The separate SUP is requested to allow outdoor RV boat storage 
that otherwise would not be allowed in the C-2 zoning district. A time-limitation may be placed on 
the SUP.  The CUPD proposes to vary several C-2 development standards and to incorporate 
modified CHAC design guidelines. See table on the next page.  It should be noted that since the 
applicant is proposing a site plan (required plan of development, POD) and although the zone 
change is a legislative approval, the POD is administratively approved. Therefore, POD approval 
is contingent on rezoning approval.

The applicant is requesting more restrictive standards than what is required in the C-2 zoning 
district to compensate for several CHSC design guidelines that will not be met. The CUPD will 
limit maximum height to 30’ (rather than 40’) and to increase the minimum front setback to 45’ 
(rather than 25’). An undulating setback from Carefree Hwy. is otherwise encouraged in the CHSC. 
This 45’ setback will be used for site retention and native desert landscaping that includes 
creosote bush, desert-adapted shrubs, and drought-tolerant trees. A minimum 20’ setback from 
adjacent commercial parcels is requested (rather than 0’ or 3’). Additionally, a maximum 45% lot 
coverage is requested (rather than 60%). These CUPD restrictions intend to limit site massing / 
bulk of structure. A min. 20’ rear setback is proposed from the residential parcels to the south, a 
decrease of the required 25’ setback. The CHSC identifies a minimum 10-foot-wide landscape 
buffer the screen commercial uses from residential areas, site retention is proposed along the 
south that will also be developed with native desert landscaping. The proposal will utilize dark-
sky compliant lighting with low glare. Staff suggests further mitigation with conditions requiring 
outdoor lighting be in conformance with Section 1112 of the Zoning Ordinance, including any 
outdoor lighting under the roof of open shade structures. Outdoor lighting must be shielded within 
one foot of the light source directing illumination downward at least twenty degrees below the 
horizonal plane at the bottom of the light source and so as not shine onto any adjacent property

in rural or residential zoning districts.  Further there shall be no indoor lighting source above 20’ 
in height allowed to illuminate exterior from the building and any indoor lighting not emanate 
outward towards outdoors facing windows. Using windows for any advertisement is prohibited. 
A 6’ tall site wall is proposed along Carefree Hwy.

The following table includes existing and proposed half-width right-of-way and the future 
classification based upon the Maricopa County Department of Transportation (MCDOT) Major 
Streets and Routes Plan. MACDOT has approved a traffic statement accepting a right turn land 
on Carefree Hwy with 100’ storage and 75’ taper, as noted in the study. MCDOT has waived the 
sidewalk requirement along 10th Street, however, half street improvements of the 10th St site 
frontage will be required.

Phoenix General Plan (adopted March 4, 2015): This general plan designates the site as 
Residential with (0-2) dwelling units per acre. City of Phoenix commented that the proposed C-2 
CUPD SUP is not consistent with Peripheral Areas C and D General Plan designation; not 
consistent with the North Black Canyon Corridor Plan; minor General Plan Amendment required 
to remove the site from the Infrastructure Limit Line, development should conform to the C-2 SP 
development standards; recommendation for dedication of 30’ multi-use trail easement along the 
north side of the site, request stipulations consistent with the Street Classification Map 
consistent with improvements to the west and east of the site within City of Phoenix jurisdiction, 
10th St. improvements, bicycle infrastructure improvements, sustainable stormwater 
infrastructure, and development should make accommodation for sustainable standards.

Carefree Highway Scenic Corridor (Established 1997, Updated August 2008) Created to guide 
development to preserve unique views landscapes and rural character, the CHSC discourages tall 
structures, unsightly and overbearing signs, dull perimeter walls, intense lighting and unattractive 
buildings. The applicant’s design proposal does not meet the following policy goals:
Commercial development only when its demand can be justified.
Commercial rezones limited to C-O or C-S zoning only to help manage specific uses and 
implement Scenic Corridor concepts. At the time of zone change, all neighborhood retail 
and neighborhood office uses should demonstrate adequate infrastructure services.
A linear design is proposed.
Neighborhood retail compatible with adjacent residential development.
Outdoor storage specifically excluded from preferred land uses.
Limiting new commercial uses to neighborhood services to serve the immediate area.

Public Participation Summary:

The applicant has complied with the minimum requirements of Maricopa County’s citizen review 
process with the required posting of the site and notification to adjacent property owners within 
300 feet of the subject parcel at the time of application filing via first-class mail.  Areas of interest 
were also notified at application filing. The applicant provided a Public Participation Results 
Report that details the concerns received and how they addressed them in their design proposal.  
The results provide rebuttal of each comment for the benefit of staff. In recent conversations with 
staff, the applicant is currently reaching out to the opposed parties individually to hear concerns.

The results report indicates that no neighborhood meeting was held. Staff continues to receive 
rapidly growing community opposition to the cases. A petition currently being sent to staff 
mention concern about commercial development on this site; the proliferation of self-storage and 
RV storage facilities where 2 others are already operating on Carefree Hwy.; how the request is 
not compatible with the area’s rural character; and site illumination concerns, that the proposed 
use does not serve the immediate community as encouraged by the CHSC. Additional concerns 
include the site’s massing of walls surrounding the site, establishment of a permanent C-2 
commercial zone, lack of control over future commercial development after zone change 
approval and how this will affect the area’s traffic patterns. As of 9/5/2025, staff received a total 
of 108 petition signatures in opposition to both the zone change and Special Use Permit 
applications. 
Outstanding Concerns from Reviewing Agencies:

During the review process, staff received comments from the City of Phoenix. Even though the 
site is not in Phoenix and the property owner is not interested in annexing the site into Phoenix, 
the City provided recommendations. Most of the recommendations concern the uses

incompatibility with the City’s general plan land use designation and with site design.  Some of 
the recommendations will be incorporated, such as providing a multi-use trail along the Highway, 
into the future development on this site.  However, since the property owner is not interested in 
seeking annexation into Phoenix, most of the City’s recommendations were not applicable to this 
site. 
14.
The Town of Carefree submitted a letter clarifying that none of their water service will serve the 
site. 
Staff Analysis:
15.
In general, staff could support commercial zoning along Carefree Hwy. consistent with the area 
plan’s caveat that commercial be limited to neighborhood commercial uses serving the local 
market.  Although the applicant has indicated he intends to provide RV storage and indoor storage 
facilities for the local community, staff notes the immediate Desert Hills neighborhoods are all 
acre-plus large lots able to accommodate on-site RV storage and accessory storage buildings. It 
seems reasonable to assume the proposed RV storage and self-storage facility will serve 
customers from the larger community such as the more moderate-density residential 
subdivisions within the City of Phoenix and not the local Desert Hills neighborhoods.  There is 
also argument that the Desert Hills / New River community is experiencing a concentration of RV 
storage related uses. There are existing RV storage facilities less than a mile to the east of the 
subject parcel and immediately north of the subject site across Carefree Highway.
16.
The proposal continues to receive rapidly growing community opposition. Although it is not 
required, a neighborhood meeting, if held, would have been beneficial for the applicant to address 
community concerns and was recommended by staff to address public comments on the 
proposed development.
17.
The proposed development would follow similar development patterns for similar land uses along 
Carefree Hwy.
18.
For the reasons outlined in the report, staff recommends the Commission adopt an indefinite 
continuance of the CUPD and SUP to allow the applicant time to address neighborhood 
opposition.
19.
However, if the Commission chooses to adopt a motion to recommend approval of Z250006, 
staff offers the following conditions ‘a’ – ‘l’:
a.
A Plan of Development is approved subject to site plan entitled “Pink Door Carefree 
Highway“, consisting of one full-size sheet, dated June 4, 2025, and stamped received 
June 18, 2025. The Plan of Development may be amended administratively under 
separate application as long as the amendment complies with the established CUPD 
development standards as approved by the Board of Supervisors. Staff may determine 
slight refinements to remain in substantial conformance with the approved site 
plan.  Minor and major amendments to the site plan will be determined in accordance with 
Chapter 3 of the Maricopa County Zoning Ordinance.
b.
Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Pink Door Carefree Highway”, consisting of 5 pages, dated June 9, 2025, and 
stamped received June 18, 2025, except as modified by the following conditions.

c.
The following Planning Engineering conditions shall apply:
1.
Underground storage tanks (UGST) will require first flush to be address per County 
drainage manuals and will also require special inspection form to be completed at 
building permit phase.
2.
Channel sizing shall provide freeboard in accordance with County drainage 
manuals.
3.
All UGST and/or retention basins must dissipate water within 36 hours.
4.
MCDOT has accepted the right turn lane on Carefree Highway with the 100’ storage 
and 75’ taper as noted in the TIS.
5.
10th street half street roadway improvements along site frontage will be required, 
the sidewalk has been waived at this time. Refer to Figure 5.12 of the Roadway 
design manual.
6.
Site is allowed two new driveways:
a.
Driveway A, located 175’ south of Carefree Highway is restricted to serve 
emergency access only.
b.
Driveway B is proposed as a fill access and is located 395 feet south of drive 
7.
Engineering review of planning and/or zoning cases is for conceptual design only. 
All development and engineering design shall be in conformance with Section 
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; 
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; 
and current engineering policies, standards and best practices at the time of 
application or construction.
8.
Based on the conceptual design nature of the information submitted, changes to 
the site layout may be necessitated by the final engineering design of the site’s 
drainage infrastructure.
9.
Maricopa County does not supply water, fire or sewer services. It is the 
applicant/owner’s responsibility to coordinate and secure water, fire and sewer 
services for the site.
10.
Sealed final Grading and Drainage (Site Infrastructure) plans and Sealed Final 
drainage report must be submitted with the application for Building Permits.
d.
Prior to issuance of a building permit, written confirmation will be required from the 
emergency fire protection jurisdiction having authority that the facility has been designed 
in accordance with their regulations and requirements, and that emergency fire protection 
service will be provided to the facility. Prior to issuance of the certificate of occupancy, 
local fire protection jurisdiction review and approval will be required.
e.
The CUPD overlay is applied to restrict the use of the site. Until such time as the site is 
served by sewer, uses on the site shall only be those acceptable to the Maricopa County 
Environmental Services Department (MCESD) that can be accommodated by septic 
systems. A public water system and public sewer system shall be required prior to 
establishment of any non-residential use that requires potable water.
f.
This CUPD overlay shall limit entitled land use to the following:

Self-storage facility. 
g.
The following C-2 CUPD development and design standards shall apply:

Noncompliance with any of the conditions assigned to the approval of this  Zone Change 
by the Maricopa County Board of Supervisors may be grounds for revocation in 
accordance with the requirements and procedures as set forth in the Maricopa County 
Zoning Ordinance. 
k.
The property owner/s and their successors waive claim for diminution in value if the 
County takes action to rescind approval due to noncompliance with conditions. 
l.
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, the property 
may be considered for revocation to the zoning that existed on the date of application.  It 
is, therefore, stipulated and agreed that either revocation due to the failure to comply with 
any conditions, does not reduce any rights that existed on the date of application to use, 
divide, sell or possess the property and that there would be no diminution in value of the 
property from the value it held on the date of application due to such revocation of the 
Zone Change.  The Zone Change  enhances the value of the property above its value as of 
the date the Zone Change is granted and reverting to the prior zoning results in the same 
value of the property as if the Zone Change had never been granted.
20.
However, if the Commission chooses to adopt a motion to recommend approval of SU250023, 
staff offers the following conditions ‘a’ – ‘h’:
a.
Development of the site shall be in substantial conformance with the Site Plan entitled 
“Pink Door Carefree Highway“, consisting of one full-size sheet, dated June 4, 2025, and 
stamped received June 18, 2025, except as modified by the following conditions. Staff 
may determine slight refinements to remain in substantial conformance with the approved 
site plan.  Minor and major amendments to the site plan will be determined in accordance 
with Chapter 3 of the Maricopa County Zoning Ordinance.
b.
Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Pink Door Carefree Highway”, consisting of 5 pages, dated June 9, 2025, and 
stamped received June 18, 2025, except as modified by the following conditions.

All outdoor lighting shall be in conformance with Section 1112 of the Zoning Ordinance, 
including any outdoor lighting under the roof of open shade structures, and must be 
shielded within one foot of the light source directing illumination downward at least twenty 
degrees below the horizonal plane at the bottom of the light source and so as not shine 
onto any adjacent property in rural or residential zoning districts.  Further there shall be

that either revocation due to the failure to comply with any conditions, or the expiration of 
the Special Use Permit, does not reduce any rights that existed on the date of application 
to use, divide, sell or possess the property and that there would be no diminution in value 
of the property from the value it held on the date of application due to such revocation of 
the Special Use Permit.  The Special Use Permit enhances the value of the property above 
its value as of the date the Special Use Permit is granted and reverting to the prior zoning 
results in the same value of the property as if the Special Use Permit had never been 
granted

Purpose of Request 
 
It is being requested to rezone the properties from Rural-43 to C-2 with a CUPD Overlay. This is being 
requested to allow this property to be a traditional mini-storage facility. A separate, but concurrent 
application will be applied to allow RV & Boat storage as a Special Use.  
 
Description of Proposal 
 
The proposed project is to construct an RV and Self Storage Facility on currently vacant land. The 
property is located on the sites known as APN 211-74-012B and 211-74-016 or the southwest corner of 
East Carefree Highway and North 10th Street. The parcels are on unincorporated Maricopa County land. 
The site is currently zoned ‘Rural-43’. The office located on site will have daily business hours and the site 
storage will be available by tenants 24 hours per day via keypad access at the main entry gate.  
 
The storage will include enclosed self storage in three locations along the perimeter of the site and 
covered and enclosed RV storage along the perimeter of the site and within the center of the site. There 
are 27 enclosed self storage stalls, 26 covered RV stalls, and 101 enclosed RV stalls. In the center of the 
site are 119 covered RV stalls and 26 enclosed RV stalls. Also included are an RV wash, air, and dump 
station - this will have an independent pit that can be pumped periodically and will not be connected to 
the site septic system. A sales office will contain a restroom for its one employee and typically one 
customer and will be connected to the septic system. Employee and customer parking is provided 
directly north of the office (in the southeast corner of the site). 
 
The color palette and material selection for the buildings proposed on site will include white 
pre-engineered metal cladding panels and standard gray CMU. The CMU will make up the building stem 
walls and site perimeter walls. Signage for the project will be located on the site wall facing the 
northeast corner of the site and on the east facing wall of the office building. THe signage will be a 
deferred submittal. 
 
Relationship to Surrounding Properties 
 
The property to the North is zoned C-2 CUPD with SUP for RV & boat storage (similar to our proposal) 
and the West Property functioning as a retail center.  The properties to the East and the South are zoned 
Rural-43 with the East Property functioning as a vacant lot and the South Properties functioning as single 
family residences. 
 
Location and Accessibility 
 
The property is a corner site on two major streets, but the site access is located off of 10th Street. This 
was done to reduce slowdown and congestion on Carefree Highway.

Circulation System 
 
The site circulation consists of a loop road within the property with one entry / exit and one exit only. 
Both driveways are located off of 10th Street and are distanced as far as possible from each other with 
the proposed development. With the project facilitating RV maneuverability, the drive aisles are greatly 
oversized to allow for the user’s ease of access. 
 
The required onsite parking is as follows: Warehouse Uses - 1 per 900 square feet of floor area =  84,707 
SF / 900 SF = 95 parking spaces. 881 sf office - 1 space per 250 sf = 3.5 round up to 4 
6209 sf mini storage - 1 space per 900 sf = 6.8 round up 7.  Total required 11 of which 1 must be ADA. 
 
The proposed project is providing 14 standard parking spaces (2 outside of the gates and 12 inside of the 
gates), 5 accessible parking spaces (1 outside of the gates and 4 inside of the gates), and 272 RV parking 
spaces. This totals 291 parking spaces, far exceeding the required parking spaces. 
 
Development Schedule 
 
This project is intended to be a single phase development. A lot combination of the two parcels will be 
applied for after zoning approval is obtained. 
 
Public Utilities and Services 
 
Water and sewer will be accomplished through well water and a septic system. The septic system will 
serve the office space, which will have one employee and typically one customer during operating hours. 
The RV wash / air / dump bay will have an enclosed pit that will be manually pumped and will not be 
connected to the septic system. Power will be provided by Arizona Public Service (APS). Fire protection 
will be provided by Desert Hills Fire Department. 
 
Compliance with General Plan 
The City of Phoenix has the area slated for Large Lot 1 - 2 Dwelling Units Per Acre. Although this is not 
residential, the adjacent commercial properties are also planned the same on the General Plan. This 
development will complement and cater to the surrounding residential planning. 
 
The Daisy Mountain/New River Area Plan designates this property for commercial use. This proposed 
development aligns with that vision by providing a self-storage and RV storage facility that serves the 
needs of the surrounding community. The site’s landscaping will reinforce the Desert Hills character by 
incorporating native desert plantings, including creosote bush, desert-adapted shrubs, and 
drought-tolerant trees, consistent with the area's natural typology.

The Carefree Highway Scenic Corridor Plan requires an average building setback of 100 feet from the 
north property line, with no portion encroaching closer than 50 feet. Our proposal includes a reduced 
setback of 45 feet at its nearest point. To address this deviation and uphold the intent of the corridor 
plan, we are incorporating several compensatory design measures. Specifically, we are increasing the 
minimum building setback along the west property line from 3 feet to 20 feet, building setback on the 
east property line from 10’ to 15’, reducing the maximum building height from 40 feet to 30 feet, and 
decreasing the overall lot coverage from 60% to 45%. These modifications will reduce the scale and 
massing of the development, lessen the visual prominence of built structures, and create opportunities 
for enhanced landscaping and vegetation throughout the site. Although the proposed setback falls short 
of the stated minimum, the combination of reduced building height, increased setbacks elsewhere, and 
lower lot coverage will ensure that the overall visibility and impact of the development are minimized. In 
doing so, we believe the project still achieves the underlying intent of the Scenic Corridor 
Plan—preserving the open, visually unobtrusive character of the highway corridor. 
 
The development along Carefree Highway has become more commercial over time and this 
development will continue this trend. Building setbacks will be provided from the single family residents 
to the south (20’) and from the retail development to the west (20’). The north side of the property will 
maintain a 75’ proposed right of way and a 45’ proposed building setback line. This space will be used for 
site retention and landscaping, providing the area with visual interest and character as well as align with 
the development to the west.  
 
Compliance with General Plan - Carefree Highway Scenic Corridor 
While the Pink Door RV & Self Storage facility is located within the Carefree Highway Scenic Corridor and 
the Daisy Mountain/New River planning area, it's important to note that these plans serve as 
non-regulatory guidance frameworks, not mandatory zoning regulations. Our proposal aligns with the 
intent of these plans by maintaining a low-profile, visually unobtrusive presence—utilizing dark-sky 
compliant lighting, screened storage areas, and architectural treatments compatible with the desert 
setting. 
Self-storage and RV/boat facilities have historically been permitted in this corridor under Special Use 
Permits with appropriate mitigation strategies. Our design includes perimeter landscaping, low-glare 
lighting, and a single controlled access point, all of which respect the visual integrity of the corridor. 
Moreover, unlike speculative retail or high-traffic commercial uses, this facility generates minimal daily 
trips, does not require significant utility infrastructure, and offers a quiet, low-impact use that aligns 
with rural expectations. Therefore, while we acknowledge the area's scenic and rural character, we 
believe this facility reflects a balanced approach—honoring the spirit of the corridor’s vision while 
accommodating a practical and community-serving land use.

for the subject application on 7.24.2025 and has no objections, all approvals are 
subject to the following stipulations.   
 
DRAINAGE PLAN REVIEW  
 
1. Underground storage tanks (UGST) will require first flush to be addressed per 
County drainage manuals and will also require special inspection form to be 
completed at building permit phase.     
 
2. Channel sizing shall provide freeboard in accordance with County drainage 
manuals.  
 
3. All UGST and/or retention basins must dissipate water within 36 hours.   
 
MCDOT TRANSPORTATION PLAN REVIEW

1. Engineering review of planning and/or zoning cases is for conceptual design 
only. All development and engineering design shall be in conformance with 
Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and 
Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway 
Design Manual; and current engineering policies, standards and best practices 
at the time of application for construction.

A Notice of Intent to Discharge application for a septic system is required for any

requirements established in IFC-Appendicx B.   
6. Provide a copy of the Water Service Agreement to DMFD. 
7. Hydrant- shall be installed with a street valve to allow for service ad repair without shutting sections “off”.

b. The Hydrant at the main entry shall be located on the north side of the driveway, not proximal to

Thank you for the opportunity to comment on Z250006. The applicant is requesting to rezone 
approximately 8.45 acres located at the southwest corner of Carefree Highway and 10th Street (Parcel 
Nos. 211-74-012B and 211-74-016) from RU-43 (Rural Zoning District – One Acre Per Dwelling Unit) to C-
3 CUPD (General Commercial, Commercial Plan of Development Overlay) to allow an RV and self-
service storage facility. 
 
Sta; has reviewed the request and has the following comments and recommendations: 
 
• The subject site is directly adjacent to a commercial center in Maricopa County zoned C-2 PD 
CUPD (Intermediate Commercial, Planned Development Overlay, Commercial Plan of 
Development) to the west and single-family residential in Maricopa County zoned RU-43 (One 
Acre Per Dwelling Unit) to the south. To the east (across 10th Street) is vacant land in Maricopa 
County zoned RU-43 PD (One Acre Per Dwelling Unit, Planned Development Overlay) and to the 
north (across Carefree Highway) is a self-service storage warehouse in Maricopa County zoned C-
2 CUPD (Intermediate Commercial, Commercial Plan of Development). 
 
• The subject site is not located within the City of Phoenix municipal boundaries; however, the site 
is located within the City of Phoenix planning area. The subject site is designated “Residential 0 to 
2 dwelling units per acre” on the City of Phoenix General Plan Land Use Map. Thus, the proposal 
for C-3 CUPD zoning would not be consistent with the General Plan Land Use Map designation. 
 
• The subject site is within the Desert View Village planning area of the City of Phoenix. Each village 
within the City of Phoenix has a Village Planning Committee which includes residents and workers 
of the community appointed by the Mayor and City Council. The Desert View Village Planning 
Committee (VPC) meets on a monthly basis on the first Tuesday of each month at 6:30 p.m. at the 
Paradise Valley Community Center, Multi-Purpose Room, 17402 N. 40th Street, Phoenix, AZ. The

• The subject site is located within the Peripheral Areas C and D General Plan area and is 
designated “Residential 0 to 2 dwelling units per acre” (page 11). The proposal for C-2 CUPD

• The subject site is located within the North Black Canyon Corridor Plan (NBCCP) area. Sta; has 
the following comments: 
 
o The subject site is designated “Residential 0 to 2 dwelling units per acre” (page 6). The 
proposal for C-2 CUPD zoning is not consistent with the NBCCP designation.  
 
o The subject site is located within the Infrastructure Phasing Overlay (page 9), which was 
created to discourage development outside of the Infrastructure Limit Line. The 
Infrastructure Limit Line was an area created to encourage a concentration of 
development within a defined growth corridor where municipal infrastructure would be 
supported, and areas outside of the defined growth corridor would not have significant 
expansion of municipal infrastructure until such time as the boundary restrictions of the 
Infrastructure Limit Line are lifted. As development has occurred within the City of Phoenix 
over the years in the surrounding area (outside of the Infrastructure Limit Line), minor 
General Plan Amendments (GPAs) have been processed concurrently with rezoning 
applications to remove sites from the Infrastructure Phasing Overlay and to extend the 
Infrastructure Limit Line.  
 
o Sta; would recommend the development comply with the design guidelines of the North 
Black Canyon Overlay District (NBCOD) in accordance with Chapter 6, Section 654 of the 
Phoenix Zoning Ordinance, which are consistent with the goals, policies, and 
recommendations of the NBCCP. Specifically, the plan and overlay address colors and 
materials of buildings and walls to be muted and blend, rather than contrast strongly, with

• The subject site abuts Carefree Highway, which was designated as a scenic corridor by the 
Phoenix City Council in 1987. For commercial development, the City of Phoenix recommends a 
120-foot setback from the centerline of Carefree Highway, consistent with the recommendations 
of the 1987 Carefree Highway Scenic Corridor Design Policies, available online, here:

view.html.  
 
• A self-service storage warehouse would require a minimum of C-2 SP (Intermediate Commercial, 
Special Permit) zoning in the City of Phoenix and would be subject to the C-2 development 
standards found in Chapter 6, Section 623 of the Phoenix Zoning Ordinance. If approved, the City 
of Phoenix recommends consistency with the C-2 development standards in order to avoid the 
potential for future non-conformities, should the property be annexed and served by the City of 
Phoenix in the future, including maximum building height, minimum building setbacks, minimum 
landscape setbacks, minimum landscape planting, and maximum lot coverage, in accordance

with Section 623.E.4 of the Phoenix Zoning Ordinance, available online, here:

• If the self-service storage warehouse is proposed to be taller than two stories and 30 feet in 
height, then it would require a minimum of C-2 HGT/WVR SP (Intermediate Commercial, Height 
Waiver, Special Permit) zoning in the City of Phoenix, which would allow a maximum building 
height of four stories not to exceed 56 feet, in accordance with Section 623.E.4.b of the Phoenix 
Zoning Ordinance.  
 
• Self-service storage facilities would also be subject to the requirements of Section 647.A.2.i of the 
Phoenix Zoning Ordinance, available online, here: https://phoenix.municipal.codes/ZO/647. If 
approved, sta; recommends the following stipulations: 
 
o All storage shall be within a closed building except that within the grounds of a self-service 
storage warehouse where trailers and motor vehicles may be placed in outdoor storage 
areas which are separate from view from adjacent streets and property by walls, fences or 
landscaping. Outdoor storage areas shall not exceed ten percent of the gross site area and 
shall not count toward meeting parking requirements. 
 
o No auctions, sales, service or repair activities or anything other than dead storage and the 
rental and supervision of storage units and such additional uses permitted in the C-2 
district that are specified through special permit approval shall be conducted on the 
premises. 
 
o There shall be no storage [or] use of hazardous or dangerous materials on the premises. 
 
o The premises shall abut or have direct access to a freeway or arterial street, as designated 
on the street classification map. 
 
o Screening the perimeter of the premises of a self-service storage warehouse may be 
required. All parts of the perimeter which are adjacent to a residential zone shall be 
screened by a fence or wall with a landscaped area at least ten feet wide, additional 
setback and the reorientation of buildings may be required to ensure compatibility with 
surrounding properties. 
 
o A self-storage warehouse may be combined with a household moving center. 
 
• O;ices, professional services, and convenience retail are permitted in the C-2 zoning district in 
the City of Phoenix, subject to the provisions of Section 623 of the Phoenix Zoning Ordinance. If a 
use is not explicitly listed in the C-2 zoning district (Section 623), it may be listed in a lower 
intensity zoning district, such as the C-1 zoning district (Section 622) or the R-5 zoning district 
(Section 618).

• A multi-use trail (MUT) is designated along the north and south side of Carefree Highway, which 
connects to the urban trail system of the City of Phoenix. If approved, sta; recommends the 
following stipulation: 
 
o A 30-foot-wide multi-use trail easement (MUTE) shall be dedicated along the north side of 
the site, adjacent to Carefree Highway, and a minimum 10-foot-wide multi-use trail (MUT) 
shall be constructed within the easement, in accordance with the MAG supplemental 
detail and Planning and Development Department, as approved by the Planning and 
Development Department. 
 
• Carefree Highway is designated as a Scenic Drive Major Arterial and is designated as Cross 
Section A on the City of Phoenix Street Classification Map. This cross section includes a total of 
140 feet of right-of-way, with 40 feet of pavement from curb to curb on each side of the street, a 
24-foot-wide raised landscape median in the center of the street, and 18 feet of right-of-way 
remaining between the back of curb and right-of-way line on each side of the street. If approved, 
sta; recommends the stipulations below to be consistent with the Street Classification Map and 
consistent with improvements to the west and east of the site within the City of Phoenix 
jurisdiction. 
 
o A minimum of 70 feet of right-of-way shall be dedicated for the south side of Carefree 
Highway, adjacent to the development, as approved by the Planning and Development 
Department. 
 
o The south side of Carefree Highway, adjacent to the development, shall be constructed in 
accordance with the City of Phoenix Scenic Drive Major Arterial Cross Section A, as 
approved by the Planning and Development Department. 
 
o The raised landscape median in the center of Carefree Highway shall be planted to the 
following standards, as approved by the Planning and Development Department: 
 
 Minimum 2-inch caliper, single-trunk, large canopy, drought-tolerant, shade trees, 
planted 20 feet on center or in equivalent groupings. 
 
 A mixture of drought-tolerant shrubs, accents, and vegetative groundcovers, with a 
maximum mature height of two feet, evenly distributed throughout the landscape 
areas to achieve a minimum of 75% live coverage. 
 
o A minimum 8-foot-wide detached sidewalk separated by a minimum 8-foot-wide 
landscape strip located between the back of curb and sidewalk shall be constructed along 
the south side of Carefree Highway, adjacent to the development, planted to the following 
standards and as approved by the Planning and Development Department. 
 
 Minimum 2-inch caliper, single-trunk, large canopy, drought-tolerant, shade trees, 
planted 20 feet on center or in equivalent groupings on both sides of the sidewalk to 
achieve a minimum of 75% shade.

 A mixture of drought-tolerant shrubs, accents, and vegetative groundcovers, with a 
maximum mature height of two feet, evenly distributed throughout the landscape 
areas to achieve a minimum of 75% live coverage. 
 
Where utility conflicts exist, the developer shall work with the Planning and Development 
Department on an alternative design solution consistent with a pedestrian environment. 
 
• 10th Street adjacent to the site is designated as a local street on the City of Phoenix Street 
Classification Map. Consistent with adopted City of Phoenix policies and plans, including Vision

development of its Bikeway System and supportive infrastructure. The Comprehensive Bicycle 
Master Plan supports options for both short- and long-term bicycle parking as a means of 
promoting bicyclist tra;ic to a variety of destinations. In April 2023, the Phoenix City Council 
adopted the Active Transportation Plan, which was an update and expansion of the 
Comprehensive Bicycle Master Plan. If approved, sta; recommends the below stipulations to 
further this plan.

maneuvering areas, where applicable. The repair station shall include, but not be limited 
to, standard repair tools a;ixed to the station, a tire gauge and pump a;ixed to the base of 
the station or the ground, and a bicycle repair stand which allows pedals and wheels to 
spin freely while making adjustments to the bike. 
 
• In October 2021, the Phoenix City Council approved the Climate Action Plan. The Climate Action 
Plan will serve as a long-term plan to achieve greenhouse gas emission reductions and resiliency 
goals from local operations and community activities as well as prepare for the impacts of 
climate change. This plan contains policies and initiatives regarding stationary energy, 
transportation, waste management, air quality, local food systems, heat, and water. Goal W2 
(Water), Action W2.4, pertains to the implementation of the Greater Phoenix Metro Green 
Infrastructure and Low Impact Development Details for Alternative Stormwater Management to 
benefit the environment, promote water conservation, reduce urban heat, improve the public 
health, and create additional green spaces. Additionally, the Conservation Measures for New 
Development policy encourages the implementation of green stormwater infrastructure (GSI). If 
approved, sta; recommends the stipulation below to further this plan.

• In June 2022, the Phoenix City Council approved the Transportation Electrification Action Plan. 
The current market desire for the electrification of transportation is both a national and global 
phenomenon, fueled by a desire for better air quality, a reduction in carbon emissions, and a 
reduction in vehicle operating and maintenance costs. Businesses, governments, and the public 
are signaling strong future demand for electric vehicles (EVs), and many automobile 
manufacturers have declared plans for a transition to fully electric o;erings within the coming 
decade. This Plan contains policy initiatives to prepare the City for a future filled with more EVs,

charging infrastructure and e-mobility equity, and outlines a roadmap for a five-step plan to 
prepare for the EV infrastructure needs of 280,000 EVs in Phoenix by 2030. One goal of the Plan to 
accelerate public adoption of electric vehicles through workplace, business, and multifamily 
charging infrastructure recommends a standard stipulation for rezoning cases to provide EV 
charging infrastructure. If approved, sta; recommends the stipulations below to further this plan.

(Resolution 22129). This resolution addresses the future water consumption of new development 
to support one of the City’s Five Core Values in the General Plan which calls for Phoenix to “Build 
the Sustainable Desert City”. The Conservation Measures for New Development policy includes 
direction to develop standard stipulations for all rezoning cases that will address best practices 
related to water usage in nine specific categories. If approved, sta; recommends the stipulations 
below to further this policy.

allowed on slopes if required for slope stabilization) and functional turf areas such as 
common areas, as approved by the Planning and Development Department. 
 
o Landscaping shall be maintained by permanent and automatic/water e;icient WaterSense 
labeled irrigation controllers (or similar smart controller) to minimize maintenance and 
irrigation water consumption for all on and o;site landscape irrigation, as approved by the 
Planning and Development Department.

o Pressure regulating sprinkler heads and/or drip lines shall be utilized in any turf areas to 
reduce water waste, as approved by the Planning and Development Department. 
 
o A leak detection device shall be installed for the irrigation system of landscape areas larger 
than 10,000 square feet, as approved by the Planning and Development Department. 
 
o A minimum of 25% of the surface parking areas shall be shaded. Shade may be achieved 
by structures or by minimum 2-inch caliper, single-trunk, large canopy, drought tolerant, 
shade trees, or a combination thereof, as approved by the Planning and Development 
Department. 
 
o Prior to final site plan approval, documentation shall be provided that demonstrates a 
commitment to participate in the Phoenix Water E;iciency Checkup program for a 
minimum of 10 years, as approved by the Planning and Development Department. 
 
• In November 2024, the Phoenix City Council adopted the Shade Phoenix Plan. The Shade Phoenix 
Plan prioritizes increasing shade coverage throughout the City to improve health and quality of 
life. Investing in shade can address the urban heat island e;ect, clean the air, preserve Sonoran 
vegetation, and prevent health complications related to prolonged exposure to heat. The Shade 
Phoenix Plan provides numerous strategies to increase shade including expanding and 
maintaining existing shade, strengthening tree code enforcement, and developing shade 
stipulations in rezoning cases. The Shade Phoenix Plan was an update and expansion of the 2010 
Tree and Shade Master Plan. If approved, sta; recommends the stipulation below to further this 
plan.

o All bicycle parking, pedestrian pathways (including sidewalks), and transit stops (when

• Should the development be annexed and served by the City of Phoenix in the future, sta; 
recommends that the development comply with the City-wide Design Review Guidelines in 
accordance with Chapter 5, Section 507 Tab A of the Phoenix Zoning Ordinance and the 
Development Standards of General Applicability in accordance with Chapter 7 of the Phoenix 
Zoning Ordinance, in order to avoid the potential for future non-conformities.

Dear Members of the Planning Commission, Planning Staff, and Supervisor Brophy McGee, As a 
concerned community member, I urge you to deny Zoning Case Z250006 and Special Use Permit 
SU250023 at 10th Street and Carefree Highway. The proposal exceeds zoning restrictions, violates size 
and coverage limits, lacks basic water and sewer infrastructure, and would route commercial traffic onto 
a narrow residential road—contradicting the Carefree Highway Scenic Corridor and Daisy Mountain/New 
River Area Plans. Granting C-2 zoning would confer permanent “by-right” development rights, including 
gas stations, drive-throughs, auto sales, and other intensive uses, setting an irreversible precedent that 
could transform this scenic corridor into another Bell Road without future community input. The project 
would degrade the area’s rural character, create noise and lighting impacts incompatible with our 
community, and is unnecessary given the many storage facilities already nearby. Our community
