Project Summary:
1.
The applicant, Peter Vesecky of Vespro, is requesting a MCP with a POD for aggregate rock sales
on parcel 501-60-039A. The subject parcel comprises approximately 43,480 square feet and is
located at the northeast corner of Sarival Avenue and Ocotillo Road in the Glendale area. The
subject site and the neighboring Parcel 501-60-040 to the north are subject to an existing MCP
and POD for a contractor’s yard for storage of construction material, equipment and onsite
storage and delivery of granular material. These entitlements were approved by the Board of
Supervisors on August 31, 2022 under a single MCP.
2.
The applicant is requesting this new MCP as an effective means of amending the POD for parcel
501-60-039A only. Each parcel has different ownership and uses. Per the existing POD, the site
was planned to be developed for the sale of granular material (such as sand, decomposed granite,
angular rock, cobble, river run, and boulders) as typically used in the landscape industry.
According to the 2022 approval, landscape material was to be stored in bunkers constructed from
large precast concrete blocks and placed in the center of the property. The areas surrounding
these bunkers would be kept open for onsite circulation. The site would have included seven
parking spaces (including one ADA-accessible space), a 400-square-foot modular office building,
a 40’ x 60’ canopy, and an aggregate weighing scale. Two full-time employees were initially
projected (with additional employment possible over time), and the site was to be open to the
public. The property was to be surfaced with compacted milled asphalt and stabilized
decomposed granite, whereas the driveway at Sarival Avenue would have been paved. Screening
would have been provided by a 6’ wrought iron fence with gabion columns along the west, a
combination 6’ CMU wall and fence along the north, an existing 6’ chain-link fence along the east,
and a 6’ steel panel screen wall along the south. Finally, a retention basin would have been
provided toward the east end of the property.

As of 2025, the rock storage bunkers have been constructed, albeit to a diagonal rather than a
straight configuration as shown on the original POD. However, the additional site improvements,
including the planned modular office and parking, have not yet been developed, and the site has
not yet been open to the public. Due to evolving circumstances surrounding the site’s construction
and proposed business operations, the owners’ applicant inquired with the Planning &
Development Department over options regarding an amendment to the site plan. Due to the
applicable regulations governing the MAAMF overlay zoning district, staff advised the applicant
that a new MCP and POD would be required altogether, although a new UCCD and pre-application
meeting would not be required if the primary use of the site was to remain unchanged.

The applicant submitted this request on April 1, 2025, and the technical advisory committee (TAC)
meeting was held on May 6, 2025. The amended POD proposed herein includes a 480-square-
foot metal building with an ADA-accessible restroom to be located toward the northwest corner
of the property. This building would be developed with three parking spaces versus the original
seven, still exceeding the minimum requirement of one parking space for each 250 square feet
of floor area. One ADA-accessible parking space would still be provided. All parking spaces and
walkways to the office would be paved with concrete, as would the portion of the driveway within
the ultimate right-of-way for Sarival Avenue. Business hours would be from 6:00 a.m. to 2:00 p.m.
Monday through Friday. Four full-time employees are currently onsite, and the applicant projects
five to ten customers will visit the site per day.

The 40’ x 60’ canopy is no longer shown, but two CONEX containers (one measuring 8’ x 20’ and
the other measuring 8’ x 40’) for onsite secured storage of small tools and construction
equipment would be provided in its place toward the east end of the property. A paved area would

also be provided at that location to accommodate parking for business vehicles. Per the narrative,
these vehicles would include up to four dump trucks used to transport material to the site from
local aggregate mines. The retention basin would remain in a slightly amended configuration.
Screening along the north, east, and south has already been provided, albeit to a slightly amended
configuration to that proposed in the original POD. The north lot line is now entirely screened with
a 6’ CMU wall, whereas the south lot line is now screened with a 6’ chain-link fence with view-
obscuring mesh. Screening along the west would be relocated slightly to accommodate right-of-
way dedication and sight visibility triangles but would nonetheless be provided by means of a
chain-link fence with mesh. For onsite circulation, the POD now shows a clearly delineated loop
surrounding the rock storage bays. This loop would be surfaced with a 4” rolled and compacted
decomposed granite driving surface bound with a liquid emulsifier. This path would connect to
the driveway and range in width from 24’ to 27’ to allow sufficient turnaround space for large
delivery and emergency vehicles.

The original MCP amended several of the Rural-43 development standards to accommodate the
site’s unique operations and configuration. All of the setbacks were reduced slightly, as shown in
the table below. Likewise, the required minimum lot width and area were reduced to 115’ and
43,480 square feet, respectively. Although the site exceeded one acre (43,560 square feet) at the
time of BOS approval, staff and the applicant were aware that the City of Glendale was planning
to dedicate an additional 22’ for Sarival Avenue (from 33’ to 55’), which would reduce the lot area
to less than the required one acre. This dedication is now in progress and has resulted in the
parcel number changing from 501-60-039 to 501-60-039A. All these MCP standards will be carried
over to this request.
7.
The original MCP also amended pavement requirements to allow asphalt or rolled and compacted
decomposed granite with a dust control plan approved by Maricopa County Air Quality Control.
The applicant is now proposing to amend this standard slightly to waive the requirement for an
approved dust control plan since the DG driving surface would be bound with a liquid emulsifier.
However, since the liquid emulsifier would satisfy the dust control requirement, staff believes
waiving it would be unnecessary.

White Tanks / Grand Avenue Area Plan (updated December 2023): This area plan assigns the
site a future land use category of “Military Compatible,” which is consistent with its location within
the MAAMF overlay zoning district.
12.
Envision Glendale 2040 (updated September 2016): The site is located within Glendale’s
municipal planning area (MPA) and is therefore subject to the City’s general plan, which places
the site within its “Luke Compatible Land Use Area”. This category is assigned to lands
surrounding Luke AFB that are delineated by the 1988 Air Installation Compatible Use Zone
(AICUZ) 65 LDN noise contour. The General Plan recognizes and supports the state legislation
related to the continued, viable operations of military installations. Permitted uses shall follow
the State of Arizona land use compatibility requirements and Arizona Revised Statute 28-8481.
Public Participation Summary:

The applicant complied with the requirements of the citizen review process with the required
posting of the site and notification by first class mail to interested parties and adjacent property
owners within 300’ of the subject parcel. Two signs were posted on April 18, 2025, in accordance
with applicable regulations. One sign was posted along the west lot line facing Sarival Avenue.
Another sign was posted along the south lot line facing Ocotillo Road. Both signs were updated
with public hearing dates by June 27, 2025. To date, staff has not received citizen comment
regarding this request.

The Sarival Avenue right-of-way is within the City of Glendale jurisdiction. Glendale maintains the
road and is actively in the process of acquiring an additional 22’ to extend the right-of-way half-
width from 33’ to 55’ as measured from the centerline. The applicant has been in contact with
Glendale regarding this project since at least August 2024. Per a series of emails between the
applicant and representatives with both Glendale and MCDOT, Glendale has required that the
applicant receive a right-of-way concrete permit for pavement of the driveway apron from the
ultimate property line to the pavement for Sarival Avenue.
15.
Staff notified both Glendale and Luke AFB (among the other registered areas of interest) of this
request on April 10, 2025, ahead of the scheduled TAC meeting. To date, neither agency has
directly commented. The Air Force issued an affirmative UCCD on December 22, 2020 (per case
UC2020005) confirming that the then-proposed use of the land would not have a negative impact
on Luke’s flying operations. This UCCD was issued prior to staff’s review of case MCP2021001.
Because the land use would not change with this request, staff did not require a subsequent
UCCD.

Staff Analysis:

Staff supports this request for an MCP with a POD for Rock 4 Less. The applicant is not proposing
a new use of the land, but merely requesting approval of amendments to the original POD
approved in 2021. Normally, such amendments would be reviewed administratively as a major or
minor amendment to the POD. However, due to the regulations governing the MAAMF overlay

zoning district, a new application for an MCP with a POD was required altogether. The
fundamental nature of the use and operations of the site is not changing from those approved
with case MCP2021001, which the BOS approved in kind with staff’s and the Planning & Zoning
Commission’s recommendation.
18.
Furthermore, no major changes have been proposed to the development standards approved with
the previous MCP. The reduced setbacks approved with MCP2021001 would remain the same,
as would the reduced lot width and lot area requirements. The only change the applicant has
proposed is to slightly modify the pavement regulations. Whereas the MCZO requires that all
nonresidential uses feature paved parking and circulation, the existing MCP allows pavement to
consist either of asphalt or rolled and compacted decomposed granite with a dust control plan
approved by the Maricopa County Air Quality Department. With the proposed MCP, the applicant
is requesting to waive the requirement for an MCAQD-approved dust control plan and instead
bind the DG with a liquid emulsifier. However, staff believes that a liquid emulsifier would fulfill
the general intent and purpose of the existing requirement and therefore recommends keeping
intact the existing standards approved with MCP2021001. This would also keep the standards
for the subject site consistent with the neighboring parcel to the north.
19.
Staff is recommending modifications to the original MCP2021001 conditions ‘a’, b’, and ‘d’ to
address an updated site plan, narrative report, and engineering comments. The updated
conditions are reflected in the staff recommendation for the case.
Recommendation:
20.
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors
approve MCP250002 subject to the following conditions ‘a’ – ‘i’ as follows:
a.
Development of the site shall be in substantial conformance with the Site Plan entitled
“Rock 4 Less,” consisting of 1 full-size sheet, dated May 22, 2025, and stamped received
June 2, 2025, except as modified by the following conditions.
b.
Development of the site shall be in substantial conformance with the Narrative Report
entitled “Rock 4 Less,” consisting of 12 pages, dated May 2025, and stamped received
June 2, 2025, except as modified by the following conditions.
c.
The Military Compatibility Permit shall be limited to the following uses:
1.
Storage of construction material, equipment and on-site storage and delivery of
granular material.
d.
The following Planning Engineering conditions shall apply:
1.
Engineering review of planning and/or zoning cases is for conceptual design only.
All development and engineering design shall be in conformance with Section
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards;
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual;
and current engineering policies, standards and best practices at the time of
application for construction.

2.
Based on the conceptual design nature of the information submitted, changes to
the site layout may be necessitated by the final engineering design of the site’s
drainage infrastructure.
3.
Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted with
the application for Building Permits.
4.
Retention basins to drain within 36 hours.
5.
The existing CMU wall(s) and chain link fences are unpermitted. Note fence permit
B202300616 was never issued and terminated. Will need to include the fences
with details when submitting for the building permit. Can label the fences as as-
built 6-foot CMU wall etc.
6.
The site is not located in a Special Flood Hazard Areas (SFHAs). The Flood Control
District has no comments on this application.
7.
Sarival Avenue is within the jurisdiction of the City of Glendale. The applicant must
contact the City to review any traffic impact, right-of-way dedication or roadway
improvement requirements. All driveway permitting will be done with the City of
Glendale.
8.
The subject site is located within the County’s Urbanized Area. If the project will
disturb one (1) acre or more, a Storm Water Pollution Prevention Permit (SWPPP)
from the County will be required prior to issuance of any construction permits. This
does NOT preclude the requirement to obtain a Notice of Intent to Discharge
(NOID) from the State (ADEQ), as may be required.
e.
All new buildings are subject to noise attenuation as per ARS § 28-8482(B).
f.
The following Military Airport and Ancillary Military Facility Overlay Zoning District
standards shall apply:

revocation of this Military Compatibility Permit as set forth in the Maricopa County Zoning
Ordinance.

The property owner/s and their successors waive claim for diminution in value if the
County takes action to rescind approval due to noncompliance with conditions.
i.
The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to
enjoy uses in excess of those permitted by the zoning existing on the date of application,
subject to conditions. In the event of the failure to comply with any condition, and at the
time of expiration of the Military Compatibility Permit, the property shall revert to the
zoning that existed on the date of application. It is, therefore, stipulated and agreed that
either revocation due to the failure to comply with any conditions, or the expiration of the
Military Compatibility Permit, does not reduce any rights that existed on the date of
application to use, divide, sell or possess the property and that there would be no
diminution in value of the property from the value it held on the date of application due to
such revocation or expiration of the Military Compatibility Permit. The Military
Compatibility Permit enhances the value of the property above its value as of the date the
Military Compatibility Permit is granted and reverting to the prior zoning results in the
same value of the property as if the Military Compatibility Permit had never been granted.

Purpose of Request
The purpose of this request is to construct a new 20’x 24’ metal building and associated site development
including parking and a driveway from Sarival Avenue. The proposed building will provide office space, a
restroom and a customer waiting area. A Military Compatibility Permit with Plan of Development was
previously approved in late 2022 (MCP2021001 – Arrow Concrete). The approved MCP was for 2 parcels
(APN 501-60-040 (Arrow Concrete) and 501-60-039 (Rock 4 Less)). Rock 4 Less proposes modifications
to the approved site plan (see Exhibit A) so a new MCP permit is being requested.
Description of Proposal
Rock 4 Less currently operates an aggregate rock sales business at this location. The business operates
4 dump trucks that pickup material from local aggregate mines and brings the material back to this site.
Material is then sold and delivered to the customer. Currently sales are not open to the public as there is
no restroom or ADA parking on-site.
Existing improvements include a temporary modular office trailer, rock storage bays, and 3 shipping
containers used for storage. A proposed Metal building is now being requested (see Exhibit A). The new
20’x 24’ building (with handicap accessible restroom) will be located in the northwest corner of the
property. With the new building in place, Rock 4 Less can now be open to the public. It is anticipated that
5-10 customers per day will visit the facility.
Business hours are 6am-2pm Monday-Friday. 4 full-time employees are onsite.
No new fences or walls are being proposed. There is an existing 6’ block wall along the north property
line, a 5’ chain link fence with mesh screening along the frontage and a 6’ chain link fence with mesh
screening along the south side, and a 6’ chain link fence without mesh along the rear east property line.
Note that adjacent property uses are similar in nature (Light Industrial). See Exhibit A7 for Development
Standards Table.
Relationship to Surrounding Properties
The site is bounded to the west by Sarival Avenue, Light Industrial to the north and east and a Large-
Scale Warehouse to the south. The Ocotillo Road alignment is a private drive, with no Right-of-way and
is fully contained on the adjacent parcel. The project is further identified as being located within the
northwest quarter of Section 5, Township 2 North, Range 1 West of the Gila and Salt River Meridian,
Maricopa County, Arizona.
Project Location and Accessibility
This 1 acre site is located at 16274 W. Ocotillo Road, Litchfield Park, Arizona. The site is at the northeast
corner of Sarival Avenue and the Ocotillo Road alignment within an unincorporated area of Maricopa
County. The site consists of a single parcel (APN: 501-60-039). Access is provided via an existing driveway
off Sarival Avenue.
Relationship to State Statute
This site is located within the Military Airport and Ancillary Facility Overlay Zoning District with a 65 day-
night average sound level (ldn) noise contour. As such, the proposed building will achieve an outdoor to
indoor noise reduction of 25 decibels as required per the Maricopa County Zoning Ordinance 1010.6.1
Circulation
The site currently has an unpaved driveway from Sarival Avenue. Existing aggregate stockpiles are located
in the center of the site with an unpaved drive looping around the stockpiles.

Offsite access is provided via a 1 mile drive from the 303/Glendale Avenue interchange.
While the site is in unincorporated Maricopa County, Sarival Avenue is within the City of Glendale. Sarival
Avenue currently has 33’ Right-of-Way from the centerline to the subject property. The City of Glendale
has requested an additional 22’ Right-of-Way to be dedicated. The dedication process is currently in
process. No frontage improvements are proposed or required by the City of Glendale.

No phasing is planned for this development currently. Once all permits have been obtained construction
will commence.

warehouses with no parks or amenities in the immediate area.

1. Engineering review of planning and/or zoning cases is for conceptual design

Thank you for the opportunity to provide comments on the Use Compatibility and Consistency
Determination Application for the Arrow Concrete and Rock-4-Less Project. The (2) one acre parcels are
located on the northeast corner of Sarival Ave and Ocotillo Rd in Maricopa County, AZ. The developer
is proposing selling the north acre to Arrow Concrete and the south acre to Rock-4-Less. The parcels in
the application are entirely inside the Luke AFB 1988 JLUS 70 Ldn, “high noise or accident potential
zone” as identified by A.R.S. § 28-8461 and is within the “territory in the vicinity of a military airport”
also defined by A.R.S. § 28-8461.
As described in the application, this request will not have a negative impact on Luke AFB flight
operations. Since the site will be located within the “territory in the vicinity of a military airport,” it will
be subjected to approximately 170 over flights per day. We recommend you review the sound attenuation
requirements found in A.R.S. §28-8482. We also encourage an aggressive notification program on the
part of the county to inform potential developers about Luke AFB operations.

due to noncompliance with conditions.
i.
The granting of this change in use of the property has been at
the request of the applicant, with the consent of the landowner.
The granting of this approval allows the property to enjoy uses in
excess of those permitted by the zoning existing on the date of
application, subject to conditions. In the event of the failure to
comply with any condition, and at the time of expiration of the
Military Compatibility Permit, the property shall revert to the
zoning that existed on the date of application. It is, therefore,
stipulated and agreed that either revocation due to the failure
to comply with any conditions, or the expiration of the Military
Compatibility Permit, does not reduce any rights that existed on
the date of application to use, divide, sell or possess the property
and that there would be no diminution in value of the property
from the value it held on the date of application due to such
revocation or expiration of the Military Compatibility Permit. The
Military Compatibility Permit enhances the value of the property
above its value as of the date the Military Compatibility Permit is
granted and reverting to the prior zoning results in the same value
of the property as if the Military Compatibility Permit had never
been granted.

Purpose of Request
On behalf of Arrow Concrete, the property owner and developer (Owner), Gilmore Planning &
Landscape Architecture (Applicant) respectfully submits for consideration this application for a
Military Compatibility Permit (MCP) on approximately 2 acres (the Subject Property) that is within
Luke AFB’s 65 Ldn noise contour. The property ownership includes two 1-acre parcels totaling
2.1 acres located at the northeast corner of Sarival Avenue and the former Ocotillo Road
alignment in the unincorporated area of Maricopa County. Refer to Exhibit 1 for the location of
this property. The current zoning is RU-43, the County’s “holding zone” intended to preserve the
agricultural character until a higher and better use is considered. This MCP request seeks the
County’s support for two separate users; Arrow Concrete and Rock-4-Less, with the
understanding that a Plan of Development (POD) will be processed for these two uses
concurrently with this MCP application. The total land area by ownership is 92,020sf or 2.1 net
acres. As described above, this property is under one current ownership, but consists of two
separate parcels. The development standards for the RU-43 District will be modified with this
MCP Application to reflect the desired standards for these non-residential uses. Arrow Concrete
intends to retain ownership of the north parcel, and following the approval of this MCP and Plan
of Development, Rock-4-Less will purchase the south parcel.
3.
Project Description
As stated previously, there are two parcels that are included with this MCP Application. Each
parcel will develop separately as soon as this MCP Application has been approved. Both parcels
have existing water service from EPCOR and will have sewer service when the CC&N boundary
expansion has been approved later this year. These two business users are described as follows:
3.1
Arrow Concrete: Is an existing “west side” contractor specializing in the placement of
concrete for various types of projects, typically serving as a sub-contractor to larger general
contractors. Arrow Concrete intends to hold onto the north parcel (501-60-040) and use the site
for a contractor’s storage yard within a minimum 6-foot secured enclosure. There is no general
public interaction. Vehicles and equipment used in their construction activities that are related
to the placement of concrete will be kept on-site during off hours and overnight. There is an
existing home structure facing onto Sarival Avenue that will be removed. There are no full or
part time employees who will be on the property. This property is intended for overnight parking
of construction vehicles and equipment. Start of business follows the seasons, where
employees arrive before daylight and return mid-to late afternoon. There will be three (3) Conex
Containers (8’ x 40’) situated towards the east side of the property that will provide secured
storage for small tools and construction equipment. A concrete pad will be installed between
two of the containers to screen a small service yard. Arrow concrete intends to
remove/demolish the existing home and in a later phase, construct or install a new modular
office (approximately 24’ x 40) towards the front of the property. An updated site plan will be

included at that time that will fix the location and size of the office, parking stalls including the
ADA space. In addition, a metal service building/garage will be installed near the center of the
property for parking construction vehicles, equipment, and some material storage. This center
orientation will facilitate truck circulation around the building. Arrow Concrete is requesting one
30-foot driveway off Sarival Ave. The entrance area off Sarival will be paved past the parking
stalls, and the finish surface beyond will be compacted milled asphalt and decomposed granite
for a more decorative finish. Site grading will direct storm flows generally to the south and east
side into a retention basin.
This north parcel will be secured with a 6-foot enclosure that will include: a view wall along the
Sarival Ave frontage, an existing 6-foot chain-link fence along the north and east property line.
The south parcel boundary is defined by an existing chain link fence along the west half and an
existing 6-foot CMU wall for the east 200 feet.
3.2
Rock-4-Less: Is a company that provides various types of granular material to the
construction industry. Rock-4-Less will acquire the south parcel from Arrow Concrete (501-60-
039). The property will be used to both store and deliver granular material, including; sand,
various types and colors of decomposed granite, angular rock, cobble, river run, and boulders,
all of which are typically used in the landscape industry. There will be a modular Sales Office
that will be placed towards the Sarival Ave frontage, but parallel to the south property line. This
modular structure is 400sf (40’x10’). Initially, Rock-4-Less will have two full time employees,
one in the office and one in the yard. As the business matures, there is a potential for additional
part time help. The business will accept general public access with sales of the landscape
material. All users will weigh-in to establish a base weight that is ‘empty’, then after picking up
their selected material, will be weighed again with a “full load” to calculate the sale value. To
better control the on-site circulation and sales, Rock-4-Less is requesting a 30-foot driveway off
Sarival Ave. Recognizing that the general public will be accessing the property, there will be a
single ADA parking stall and an ADA accessible restroom within the sales office. The center of
the property will be used to store the landscape material in bunkers constructed from large
precast concrete blocks. The intent is to have the north and sides open for circulation allowing
users and their trucks, some with trailers to have a wider turning radius to and from the scale.
The entrance area off Sarival will be paved past the parking stalls, and the finish surface beyond
will be compacted milled asphalt and decomposed granite for a more decorative finish. Towards
the east end of the site will be two conex containers, one at 8’ x 40’, and a second at 8’ x 20’
that will provide secured storage for small tools and construction equipment. Similar to Arrow
Concrete this site will be graded to direct the storm flows towards the east side into a retention
basin.
Like Arrow Concrete, Rock-4-Less will secure their parcel with a combination of walls and
fencing. Along the Sarival frontage will be a 6-foot wrought iron fence with gabion pilasters filled
with river rock, similar to the photo below. The north side shares the same separation as Arrow

Concrete, west half chain link and east half CMU. The east will retain the existing 6-foot chain
link fence, and the south side will use vertical steel panels similar to the photo below.

An additional dedication of 22 feet of right-of-way (ROW) will be required to match the
existing ROW to the south and across the west side of Sarival Ave. This dedication will
reduce the current ownership area from 2.1 to 2.0 net acres, or 43,480 sf for the net area
each parcel. A single Plan of Development will establish the minimum site improvements
for these two parcels in conjunction with this MCP application.

These parcels will initially use manual access gates, but may elect to convert to an
automated gate access in the future, subject to emergency access requirements imposed
by Rural Metro.

Interior drive aisles and parking areas will be dust proofed per County standards.

Security systems and lighting will be installed.

The presence of the 65ldn noise contour imposes the MCP requirement, but the use has
been approved by Luke AFB through a Use Compatibility and Consistency Determination
(UCCD), refer to the letter from Luke AFB Exhibit 2.
4.
Relationship to Surrounding Properties
4.1 Existing Site Conditions
These parcels are partially improved and currently used to store material by these two
users. Please refer to Exhibit 3 Context Plan and Site Photos that illustrate these existing
conditions, and which are further described below:
Arrow Concrete is currently clearing and cleaning their north parcel and have temporarily
stored some of their construction equipment. There are three conex containers that are
also being stored and awaiting placement based on the final site plan and grading plan.
There are some existing trees that will be retained, if possible, but will be subject to the
final site plan and retention design. There is an existing home structure facing onto Sarival
Avenue that will be removed. The parcel is currently defined by an existing 6-foot
enclosure. There is an existing chain link fence along the Sarival Ave frontage, and along
the north and east property lines. Along the south property line is an existing chain link
fence for the front along the west half, and an existing 6-foot CMU wall for the east 200
feet. This property has water service from EPCOR.
Rock-4-Less is stockpiling some of their landscape material on-site and temporarily
storing their modular office until a final site plan and grading plan have been approved.

There is an existing 6-foot chain link fence along the Sarival Ave frontage that will be
removed when the additional ROW is dedicated and the off-site improvements initiated.
The north property line shares the chain link fence and CMU wall with Arrow Concrete,
and the east side has a 6’ chain link fence. The south property line is not fenced and
shares open frontage along the north side of an access drive for the adjacent industrial
warehouse project. There are two conex containers that are temporarily placed subject
to the final site plan approval and on-site grading. This property also has water service
from EPCOR.
4.2 Surrounding Land Uses
The following describes the adjacent surrounding land uses and zoning as referenced on
Exhibit 3:
North: The area north of subject MCP property includes one 4.0-acre parcel that has one
single family home zoned RU-43.
East: The area immediately east has been in use as what appears to be a feed lot, but
also appears to be no longer in use. The ownership includes approximately 12 plus acres
zoned RU-43.
South: The south boundary of the Subject Property is the jurisdictional boundary
separating Maricopa County from the City of Glendale. There is an industrial logistics
project that recently completed construction. The Property is zoned Light Industrial M-1.
West: The land area immediately west is vacant and remains under County jurisdiction
and currently zoned as RU-43. Surrounding this 11-acre county parcel is an extensive
industrial area that extends north to Glendale Ave, west to the Loop 303, and to the
southwest, all of which in the City of Glendale and zoned PAD for industrial development.
4.3 Existing and Proposed Zoning
The current zoning for this subject property is Rural-43, a rural zoning that limits the use
of the property to one unit per acre along with related accessory uses; however, the current
military overlay places this property within the 65 ldn noise contour and restricts residential
development. The proposed Military Compatibility Permit will allow the development of
these two parcels in accordance with the Approved Plan of Development associated with
this application.

Location & Accessibility
Access to both of these parcels will only be available from Sarival Ave. The Glendale Street
Classification Map indicates Sarival Ave as an Arterial Road with 4 lanes of traffic (72’ B/B), a 14-
foot painted center turning lane, and 19 feet from back-of-curb to the ROW that includes a 6-foot
sidewalk, all which is within a 110-foot ROW. Arrow Concrete is requesting two driveways to
facilitate truck circulation on site. Rock-4-Less is requesting one driveway. Sarival Ave is fully
improved south of this Subject Property and the west half off-sites opposite this Subject Property
is currently being installed. These users recognize that additional ROW will be necessary along
with the east half off-sites.
6.
On-Site Circulation
Arrow Concrete is requesting to install asphalt for first approximate 60 feet for the two driveways
off Sarival Ave, then using milled asphalt over a gravel base for the balance of the site except for
the retention basin. Near the center of the property will be a 30’x50’ steel canopy to park/store
selected equipment and vehicles. The approximate 25 feet between the two conex containers
will be finished with concrete to provide light maintenance for their service vehicles.
Rock-4-Less is requesting to install asphalt paving for the first approximate 80 feet for their
driveway off Sarival Ave, then using milled asphalt over a gravel base for the balance of the site
except for the retention basin. Towards the east side, will be a 40’x50’ garage

Development Schedule
Establishing the MCP designation with the Plan of Development will permit the Owner to sell the
south parcel to Rock-4-Less and allow these two parcels to be developed. These two parcels will
be under separate ownership and both will develop as soon as the MCP is approved.

Public Utilities & Services
8.1
Water Service
Both parcels are currently metered and service provided by EPCOR
8.2
Sanitary Sewer Service
There is a CC&N currently in process that will expand the sewer service to these parcels.
If necessary, the Owners are prepared to install all onsite septic as coordinated with both
EPCOR and the County Health Dept.

Police &Fire
Maricopa County Sherriff’s Office and the Rural Metro Fire District respectively.

Thank you for the opportunity to provide comments on the Use Compatibility and Consistency
Determination Application for the Arrow Concrete and Rock-4-Less Project. The (2) one acre parcels are
located on the northeast corner of Sarival Ave and Ocotillo Rd in Maricopa County, AZ. The developer
is proposing selling the north acre to Arrow Concrete and the south acre to Rock-4-Less. The parcels in
the application are entirely inside the Luke AFB 1988 JLUS 70 Ldn, “high noise or accident potential
zone” as identified by A.R.S. § 28-8461 and is within the “territory in the vicinity of a military airport”
also defined by A.R.S. § 28-8461.
As described in the application, this request will not have a negative impact on Luke AFB flight
operations. Since the site will be located within the “territory in the vicinity of a military airport,” it will
be subjected to approximately 170 over flights per day. We recommend you review the sound attenuation
requirements found in A.R.S. §28-8482. We also encourage an aggressive notification program on the
part of the county to inform potential developers about Luke AFB operations.

1. REFERENCE MARICOPA COUNTY PERMIT AND ADDENDUMS FOR ADDITIONAL CONDITIONS.
2. ANY WORK PERFORMED WITHOUT APPROVAL OF THE APPLICABLE COUNTY DEPARTMENT OR AFFECTED UTILITY COMPANY AND/OR ALL WORK AND MATERIAL NOT IN
CONFORMANCE WITH THE CONSTRUCTION DOCUMENTS IS SUBJECT TO REMOVAL AND REPLACEMENT AT THE OWNER’S EXPENSE.
3. THE ISSUANCE OF ANY CONSTRUCTION PERMIT SHALL NOT RELIEVE THE OWNER OR OWNER’S AGENT FROM COMPLIANCE WITH ALL OTHER GOVERNMENTAL REGULATIONS AND

4. AS SPECIFIED IN THE PERMIT CONDITIONS, CONTACT MARICOPA COUNTY TO SCHEDULE AN IN-PROGRESS INSPECTION FOR ALL HEADWALLS, CUT OFF WALLS, AND WEIRS AFTER
EXCAVATION AND FORM PLACEMENT BUT PRIOR TO PLACEMENT OF ANY MATERIAL.
5. AS SPECIFIED IN THE PERMIT CONDITIONS, CONTACT MARICOPA COUNTY TO SCHEDULE AN IN-PROGRESS INSPECTION FOR ALL GABION MATTRESSES, RIP-RAP, FILTER FABRIC,
AND/OR GRAVEL UNDERLAYMENT AFTER EXCAVATION BUT PRIOR TO PLACEMENT OF ANY MATERIAL.
6. AS SPECIFIED IN THE PERMIT CONDITIONS, CONTACT MARICOPA COUNTY TO SCHEDULE AN IN-PROGRESS INSPECTION FOR ALL RETAINING WALLS AFTER EXCAVATION BUT PRIOR
TO PLACEMENT OF CONCRETE, BLOCK, OR OTHER RETAINING WALL MATERIAL.
7. ADDITIONAL INSPECTIONS AND/OR RE-INSPECTIONS SHALL BE ASSESSED ADDITIONAL FEES IN CONFORMANCE WITH ADOPTED FEE SCHEDULES.
8. RIP-RAP AREAS SHALL BE OVER-EXCAVATED SUCH THAT TOP OF RIP-RAP WILL MEET ADJACENT GRADE.
9. CERTIFIED AS-BUILT PLANS, PREPARED IN CONFORMANCE WITH MARICOPA COUNTY AS-BUILT SUBMITTAL REQUIREMENTS SHALL BE SUBMITTED TO MARICOPA COUNTY FOR
APPROVAL PRIOR TO FINAL DRAINAGE CLEARANCE.
10. PRIOR TO FINAL DRAINAGE CLEARANCE EACH RETENTION BASIN WITH DEPTHS GREATER THAN 1-FOOT OR AS DETERMINED BY MARICOPA COUNTY SHALL BE TESTED PER THE
DRAINAGE POLICIES AND STANDARDS FOR MARICOPA COUNTY STANDARD 6.10.12. THE TEST RESULTS, BORING LOGS, AND REVISED DRAIN-DOWN TIME CALCULATIONS.
DEMONSTRATING THAT ALL RETENTION BASINS DRAIN WITHIN 36-HOURS, SIGNED AND SEALED BY AN ARIZONA REGISTERED PROFESSIONAL ENGINEER, SHALL BE SUBMITTED FOR
APPROVAL WITH THE AS-BUILT PLAN DOCUMENTATION. SOIL INFILTRATION TESTING OBTAINED DURING DESIGN PHASE ARE ACCEPTABLE.
11. ALL DRYWELL PERCOLATION RATES SHALL BE DE-RATED IN ACCORDANCE WITH MARICOPA COUNTY STANDARD 6.10.13. THE DRYWELL TEST RESULTS, BORING LOGS, PROOF OF
DRYWELL REGISTRATION, AND REVISED DRAIN-DOWN CALCULATIONS SEALED BY AN ARIZONA REGISTERED PROFESSIONAL ENGINEER DEMONSTRATING THAT ALL RETENTION
BASINS DRAIN WITHIN 36-HOURS SHALL BE SUBMITTED FOR APPROVAL WITH THE AS-BUILT PLAN DOCUMENTATION.
12. REQUIRED DRAINAGE OPENINGS FOR CMU WALLS SHALL BE AS PER THE APPROVED PLAN DETAIL. IF NO DETAIL IS SHOWN, PROVIDE NON-DECORATIVE TURNED BLOCK, EVERY
OTHER BLOCK AT GRADE. IF TWO BLOCKS NEXT TO EACH OTHER ARE NOT TURNED, TWO TURNED BLOCKS NEXT TO EACH OTHER SHALL THEN FOLLOW.
13. SHOULD ANY PROPOSED DEVELOPMENT REQUIRE CLARIFICATION AS DETERMINED BY MARICOPA COUNTY, A PLAN ADDENDUM SIGNED AND SEALED BY A REGISTERED
PROFESSIONAL ENGINEER SHALL BE SUBMITTED FOR PERMISSION OF THE APPLICABLE COUNTY DEPARTMENT. APPROVAL. SUBMITTAL OF AN ADDENDUM MAY REQUIRE FORMAL
PLAN MODIFICATION AS DEEMED BY MARICOPA COUNTY.
14. ALL CONSTRUCTION FILL SHALL MEET OR EXCEED MAG SPECIFICATION 211.
15. ALL CONSTRUCTION SHALL MEET OR EXCEED CURRENT MAG SPECIFICATIONS AND STANDARDS.
16. AN APPROVED SET OF PLANS SHALL BE MAINTAINED ON THE JOB SITE AT ALL TIMES PERMIT IS ACTIVE.
17. OMISSIONS OR CONFLICTS BETWEEN VARIOUS ELEMENTS OF THE DRAWINGS, NOTES, AND DETAILS SHALL BE BROUGHT TO THE ATTENTION OF THE ENGINEER OF RECORD AND
RESOLVED WITH MARICOPA COUNTY PRIOR TO PROCEEDING WITH THE WORK.
