The applicant, Matthew Williamson with Midstream Energy Partners is requesting to rezone approximately 31.8 acres of land to IND-3 IUPD. They propose the land to be utilized as a rail to truck propane transfer terminal. The site is comprised of two parcels zoned IND-3 (north parcel) and Rural-43 (south parcel). This south parcel is presently undeveloped/vacant. The current IND- 3 zoned parcel is a railroad spur and agricultural-related industrial operation along the Southern Pacific Railroad established in 1975 per Z75-47. This parcel was most recently being utilized to move and stage manufactured building for transport/delivery. The proposal would expand the IND-3 zoning area to both parcels to facilitate an expansion and rail spur. The proposed facility will utilize equipment to transfer propane from rail to tanker trucks to better serve the local market and business needs. There is no proposed refinement or further production of propane on site, all activities will be transferring in nature. A specific Plan of Development has not been submitted at this time. 2. The propane facility is expected to employ two full-time on-site position as well as multiple truck drivers in transporting propane to market. There are existing buildings on site including an 18,000 sq. ft. covered storage area and a 993 sq. ft. office building. 3. The IUPD Overlay will amend certain development standards for easier site planning and operational efficiency. Paving will be waived in lieu of dust-control measures as approved by the Maricopa County Air Quality Department (MCAQ). Minimum screening is reduced from solid walls to chain-link fencing. Parking is established as the ratio of what is currently provided on site. The applicant has completed all required public participation outreach. A neighborhood letter was sent out to all parcels within 300’. The parcel was posted in 2 locations and updated with hearing information. Outstanding Concerns from Reviewing Agencies: 10. The City of Buckeye has commented in support of the proposal. While they recognize the development is outside of their planning area, they are the closest municipality at approximately .5 miles away. Staff Analysis: 11. Staff supports IND-3 IUPD zoning of this site. It is consistent with the surrounding agricultural and industrial land uses and development patterns. It takes advantage of existing railroad siding resource for industrial redevelopment. The site was developed and has been utilized as a rail transfer depot since the mid-1970s. There is a dirt road traversing the southern parcel. The applicant has committed to allowing neighboring property owners easement access through the re-orientation of ‘Dixie Packing Road’. Recommendation: 12. Staff recommends the Commission adopt a motion recommending that the Board of Supervisors approve Z250014 subject to the following conditions ‘a’ – ‘g’: a. Development of the site shall be in substantial conformance with the Zoning Exhibit entitled “Z250014 Zoning Exhibit“, consisting of 1 full-size sheet, dated June 30, 2025, except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. Z250014 Page 7 of 8 b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Midstream Buckeye LPG Terminal”, consisting of 9 pages, dated June 2, 2025, except as modified by the following conditions. c. The following IUPD standards shall apply: 1. Minimum Paving: Dust control measures as approved by the Maricopa County Air Quality Department 2. Minimum parking spaces: 1:18,000 sq ft. 3. Any request for new access points and additions to the subject parcel that will generate between 50-100 AM or PM peak hour trips will require the developer to submit a Traffic statement or Traffic impact study for review and approval by MCDOT. 2. Owner shall comply with any additional ROW preservation or dedication requirements that may be requested by MCDOT planning during permit process. 3. Under MCZO 1205.3.4-1 thru 3, drainage requirements (G&D plans, storm water retention, drainage report and percolation) could be removed if Parcels 401-30-010E and 401-30-010G are combined to create a single site; and only a site plan would be required. Without the submittal of a precise plan of development, no development approval is inferred by this review, including, but not limited to number of proposed building lots/units, drainage design, access and roadway alignments. The County does not provide fire service, therefore, it is incumbent that the applicant seek service and approval of plans from the jurisdictional fire service provider. e. Administrative approval of a Plan of Development will be required prior to approval and issuance of construction permits to develop and establish use of the site. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. f. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property may be considered for revocation to the zoning that existed on the date of application. (“Midstream” or the “Applicant”) has recently purchased a 16.8-acre parcel in Maricopa County, identified as APN #: 401-30-010E, located at 32105 W. Salome Highway, Arlington, Arizona 85322 (the “Property”). Midstream has also acquired the parcel directly north of the Property (APN #: 401-30-010G, the “North Parcel”) and the parcel to the northwest (APN #: 401-30-006B, the “West Parcel”). The Applicant intends to operate a liquefied petroleum gas (“LPG”) bulk transfer terminal on the North Parcel and proposes to extend its operations onto the Property by expanding the existing rail track further south. To facilitate this expansion, the Property must be rezoned from its current RU-43 zoning designation to IND-3, which is the current designation of the North Parcel. Following pre- application meetings with representatives from Maricopa County, it was determined that a Zone Change with Overlay application is required to adjust the zoning district boundaries from the North Parcel to include the Property. The Applicant - Midstream LPG Inc. Midstream LPG Inc. is part of the Midstream Energy Group, which is a privately held business focusing on the purchase, sale and distribution of LPGs in the U.S. and Canada. Midstream’s principals have been in the LPG industry for decades with assets including fractionation facilities, gas processing, gathering and storage infrastructure, complemented by LPG wholesale marketing and distribution business segments. Midstream and its affiliates have a fleet of over 900 long- term leased railcars and trucking operations spanning across the Western United States with a focus in California, Nevada, Utah and Wyoming. The company primarily trucks its own product which includes LPGs and natural gas liquids. Economic Impact Midstream’s operations on the Property will generate significant full-time employment opportunities for Maricopa County residents, as well as multiple contracting opportunities for local service providers. The facility will require two full-time rail unloading operators, along with a sizable number of truck transport drivers employed by both Midstream and third-party contractors. Transloaded LPG from Midstream’s rail terminal will help to add competitively priced wholesale LPG supply not only to the surrounding local area but will fuel the growing energy needs of Maricopa County and the business community. Midstream also is a wholesale distributor of renewable LPG, which it plans on offering to its customers as demand for renewable LPG expands. To support the expansion of operations onto the Property and to prepare for LPG transloading, the following work will be required: - railroad design and constructions services; - civil construction services including grading, compaction and road construction; - fencing construction; - electrical construction; - communications and information technology; - commercial building construction and renovation; - HVAC; - industrial scale installation; - welding and other industrial mechanical contract services; - engineering and design services; - inspection services; - utility power service; - waste management services; - railroad services; and - vehicle maintenance services. Property The Property is 16.8 acres and combined with the North Parcel would total 31.8 acres. The proposed plan is to extend the rail track from the North Parcel down south into the Property. The Property is currently undeveloped and vacant, but the North Parcel includes an 18,000 sq. ft. covered storage area, a 993 sq. ft. one-story building, and a 485 ft. industrial rail spur connected to the Southern Pacific rail line. Remains of various concrete foundations, containments, and other works from previous uses also exist on the Property. Safety and Security Midstream values its longtime successful safety and security record. The company works closely with all applicable authorities and agencies to constantly evaluate and update its safety and security programs. In addition to the operations on the North Parcel, Midstream owns and/or operates dozens of other LPG bulk terminals throughout the U.S. and Canada. Midstream believes that the safe and secure operation of these terminal operations is paramount to its operations, as well as to its corporate reputation and its commitment as a commercial neighbor in the counties within which it operates. Consistent with its other LPG bulk terminals, the Property will be operated under the program requirements of OSHA Process Safety Management and the EPA Risk Management Plan. Midstream utilizes engineered equipment and detailed processes proven to transfer LPG safely and effectively. These systems are developed through a rigorous engineering design process and hazards analysis to identify potential risks and implement safeguards to mitigate those risks. All employees are thoroughly trained in all required aspects so as to safely transload LPG and are qualified through a mentorship program and hazard identification. Additionally, Midstream personnel maintain safety equipment such as personnel lower explosive limit (LEL) gas monitors, strategically located fire extinguishers, flame resistant clothing and other safety equipment. This proposed LPG Terminal will have a Site Security Plan in place to assess and mitigate the various hazards and threats to the safety and security of the operation. Standard security measures proposed are standard 6’ foot high chain link fencing surrounding the operation, security cameras with remote viewing capabilities, manned operations, site access controls, and area lighting. All contractors and visitors will be trained in safety and security considerations through a comprehensive site orientation process. All transport drivers hauling LPG from the terminal will be trained and qualified in specific tasks related to the LPG transfer process. Prior to being granted site access, each transportation company will be vetted through a rigorous process and will need to access a Terminal Access Agreement. Utilities and Services The Property has no public water or sewer utility services. Water is supplied by a well located on the North Parcel, which also has an on-site septic tank system and accompanying restroom facilities. Power is supplied to the Property by Arizona Public Service (APS). In addition to bringing economic value and activity to Maricopa County, the proposed land use and improvements do not require any public expenditure for infrastructure. The proposed use will not result in the need for additional road, sewer or water systems. With the Arizona State Trust owning the property directly to the south of the Property and there being no residential neighbors to the west within 300 feet, the livability of the adjacent properties will not be affected. It is also important to note that transloading operations are already currently undertaken on the North Parcel and the proposed operations will not materially differ from what is already being conducted on the Property. Also, the LPG transload operations will be sufficiently distant from the boundaries of the North Parcel and Property, to provide an adequate buffer. Purpose of Request The purpose of this request is to have the North Parcel’s zoning boundaries extend down to the Property so that both parcels have the requisite IND-3 zoning designation and to allow for extension of the rail spur to the southeast edge of the Property. Due to the challenges of limited daily rail service in western Maricopa County and the inadequate length of the existing rail spur, rezoning of the South Parcel is required to enable the extension and expansion of the existing rail spur. The rezoning coupled with the expansion of the existing rail spur would allow Midstream to increase LPG supply to western and the greater Maricopa County area. The expansion of the rail spur would allow Midstream to better serve retail LPG customers serving Maricopa County, such as AmeriGas, Ferrellgas/Blue Rhino, Suburban, Canyon State, Pacific Coast and Arizona Propane, to name a few. It is anticipated that the rail track expansion would allow Midstream to double the current transloading capacity. IUPD The IUPD is requested to address fencing, dust pollution requirements, and other development requirements and restrictions. The Property is currently fenced with approximately 4,600 linear feet of 6-foot-high chain-link fencing without screening provisions. The IND-3 zoning designation requires a 6-foot-high solid masonry wall. For a LPG terminal, chain link fencing offers many advantages over masonry walls such as: (i) increased visibility into and out of the property for security and emergency response purposes; (ii) reduced maintenance requirements; and (iii) ease of installation and modification in the event improvements are identified. The existing site has been in the same use with the same fencing design and is more in keeping with the fencing used in the surrounding area which consists of largely vacant and ranch land. The Property is currently largely vacant and unpaved, except for some previous site improvements that are no longer in use. As such, given that the Property will primarily be limited to vehicle use in open areas and vacant lots, only the areas of the Property expected to have a normal traffic pattern would have dust pollution control methods applied such as a surface of decomposed granite or asphalt milling, as well as control measures limiting vehicle access to those areas of the Property. The areas on the Property where no activity is planned will see no change in the potential for dust pollution from the existing state. Description of Proposal The plan for Property is to extend the existing rail spur from the North Parcel onto the South Parcel per the design below. The extension and expansion of the existing rail spur will allow for efficient usage of the property for the new rail lines. The majority of the Property will remain vacant in its current state. Internal roads and transloading areas are expected to be constructed of decomposed granite or asphalt milling. Relationship to Surrounding Properties The Property is located north of Old Highway 80 and west of Salome Highway, west of the city of Buckeye. Directly to the north of the Property, is the North Parcel which already has an IND-3 zoning designation and is currently used for rail transloading purposes from the Southern Pacific Rail Line. The northwest corner of the Property borders the West Parcel, which is also owned by the Applicant which is employed in its current operations. The remainder of the western border is shared with parcel number 401-30-008L which is owned by Olivas Sylvester and Trisha Canfield and used for primarily residential and agricultural purposes. The Property’s southern border is shared with land held by the Arizona State Trust and is currently vacant. There are four properties all owned by the same property owner to the southwest of the Property that are within 300 feet of the proposed rezoning change and Midstream has been in contact with this property owner as part of Midstream’s Citizen Participation Plan. Midstream does not anticipate a material change to truck traffic in the surrounding area from its operations. The neighbors to the south and west have access to their properties through a local road that runs parallel to the southern border of the Property. As truck traffic for Midstream’s operations will be entering the Property from the northeast there should be no effect on our neighbors, public roads or infrastructure. Midstream has also been in contact with Hickman’s Egg Farm, which is the northern neighbor to the North Parcel, and they have expressed support for Midstream’s application Location and Accessibility The application and proposed rezoned business use will not have a material effect on the local transportation system. The application does not require any new access to the Property and will only have approximately four (4) additional truck trips per day, once the operations have been expanded and the rail spur extended down into the Property from the North Parcel. The location of the property is approximately 8 miles south of Interstate 10 by way of 339th Avenue and West Salome Highway. Access to the property is obtained via an existing unpaved turn-off from West Salome Highway just south of the UPRR railroad crossing. This connection to West Salome Highway will be improved in accordance with MCDOT design criteria to accommodate safe entry and exit of LPG transports to the property and West Salome Highway. Circulation System As mentioned, the application and proposed rezoned business use will not have a material effect on the local transportation system. The application does not require any new access to the Property and will only have an average of four (4) additional truck trips per day, once the operations have been expanded and the rail spur extended down into the Property from the North Parcel. In general, the timing of vehicles entering and leaving the site will be sparse and will only minimally affect traffic patterns in the surrounding area. Operations staff is normally limited to two individuals who would arrive at the site in the morning hours to prepare for operations and leave in the afternoon or early evening after securing the site for the day. All transport loads are pre-scheduled, which spreads out arrivals to the site. On average, LPG Transports will arrive at the property and be involved in loading and other activities for at least 1 hour providing for significant separation between transports leaving the site. Midstream has received a Traffic Waiver Study Waiver from Maricopa County’s Transportation Systems Management & Operations Division as part of its application. Development Schedule Once the approval is received for the IND-3 designation for the Property, Midstream will retain a railroad construction firm to design detailed plans for the proposed rail extension and expansion. The detailed rail plans along with all other required improvements will be submitted for approval. It is expected that the detailed engineering and approval process will take 3-6 months, with the construction timeline to be another 3-6 months. Community Facilities and Services There are no community facilities located near the Property and none are necessary. Public Utilities and Services The Property and Midstream’s operations are largely self-sufficient and as such will not be relying on many public utilities or services, other than those provided by the local police and fire departments. Below is the Utility Commitment Table from Midstream’s Site Plan and it should be noted that the natural gas and telecom utilities are not planned to be utilized at this time. Please note the following MCESD requirements for site development: Drinking Water – Per the Safe Drinking Water Act, any water system that supplies more than 25 people or 15 service connections per day for at least 60 days per year is classified as a Public Water System (PWS). • If the above criteria are met, a Public Water System application and a New Source Approval application are required and must be submitted to the MCESD’s Drinking Water Program. A water quality analysis report will be required with submittal and is good within one-year of testing. A Notice of Intent to Discharge application for a septic system is required for any construction. Application must be submitted to the MCESD Onsite Wastewater Program. • Wastewater is not permitted to discharge to an adjacent parcel’s septic system. • If conducting food service in unincorporated Maricopa, a grease trap will be required by Onsite Wastewater program. • Setback requirements must be maintained per Arizona Administrative Code, Title 18, Chapter 9, Article 312, C (Features Requiring Setbacks). Dependent/independent recreational vehicles cannot discharge wastewater to any septic system(s). A dump station/holding tank will be required for any onsite recreational vehicle wastewater dumping.
