Project Summary:
1.
The applicant is requesting an SUP for outdoor storage of landscape materials, landscape trailers, 
concrete paver pallets, interim storage of tree and landscape cuttings for disposal off-site and 
on-site landscape pick-up truck parking during daylight hours. Improvements to the site include a 
retention basin, permanent bathroom facility for employees, crushed-granite vehicle driving 
surfaces, and perimeter chain link fence with site screening. The site is not intended to receive 
the public. The business will employ 3 people.

The SUP entitlement was necessary in order to resolve violation V202300184. The property was 
cited for the operation of the storage yard in a residential area, and at the code enforcement 
hearing was held on September 14, 2023, the property owner was found responsible for the 
violation.

Employees will access the property off a shared easement located at the north of the property. 
Separate driveway entrances for entry and exit are proposed off the shared easement. Entry is 
proposed at the northwest driveway and exit is proposed at the northeast corner of the property. 
On-site circulation consists of a minimum 14’ crushed granite driveway. Decomposed granite is 
proposed throughout the site to mitigate dust. The site will be secured with a perimeter chain link 
fence with screening to mitigate visual impacts, the site will not include any outdoor lighting. 20’ 
gates will be manually operated for entry to the site. These gates will be locked when the site is 
unoccupied. A permanent bathroom facility is proposed at the center of the property for employee 
use. 13 parking spaces are provided, one of which designated ADA nearest the bathroom building. 
The storage of combustible material, wooden pallets, will require an emergency contact number 
displayed at the entrance of the property. The Arizona Fire & Medical Authority did not comment 
on this case.

Rainbow Valley Area Plan (adopted 1988, updated 1992): The rural category identifies where 
single-family residential development is desirable, but urban services such as sewer and water 
are limited.
Public Participation Summary:

According to the applicant’s Citizen Participation Results Report, a phone call from a neighboring 
property owner was received by the applicant on May 10, 2025, in favor of the proposed project. 
No other comments were received.
Outstanding Concerns from Reviewing Agencies:

Revised Grading & Drainage plans are currently under review to ensure adequate on-site retention 
for the site.
Staff Analysis:

The vicinity of the site is primarily residential ranches on acre-plus sized lots with what appear to 
be equine structures such as horse shades and corrals. Also notable in the area are a few lots 
with residences and what appear to be vehicle storage. A few residences nearby host home-
based businesses. Although the site is designated as residential in the Rainbow Valley area plan, 
staff considers the change in use as appropriate for the area as aerial photography of the 
neighborhood suggests other home-based businesses operating in the area. The improvements 
to the site, such as dust proofing mitigation and site screening, all serve as positive improvements 
to the neighborhood. Proposed business operations of the site do not appear to significantly 
impact existing surrounding ranching and residential uses which have similar impact on single-
family residences. No outdoor lighting is proposed with this project as the site is intended to be 
used during daylight hours. Additionally, staff received no opposition to the request from the 
required public notification. 
Recommendation:

Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve Z2024016 subject to the following conditions ‘a’ – ‘e’:
a.
Development of the site shall be in substantial conformance with the Grading & Drainage 
Plan entitled “Grading & Drainage Plan for Caballeros Landscape Inc.“, consisting of 2 full-
size sheets, dated June, 2025, and stamped received June 23, 2025, except as modified 
by the following conditions. Staff may determine slight refinements to remain in 
substantial conformance with the approved site plan.  Minor and major amendments to 
the site plan will be determined in accordance with Chapter 3 of the Maricopa County 
Zoning Ordinance.
b.
Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Narrative Report for Caballero Landscape, Inc.”, consisting of 17 pages, dated 
December 2023, and stamped received January 29, 2024, except as modified by the 
following conditions.
c.
The following Planning Engineering conditions shall apply:

1.
Engineering review of planning and/or zoning cases is for conceptual design only. All 
development and engineering design shall be in conformance with Section 1205 of 
the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of application for 
construction.
2.
Based on the conceptual design nature of the information submitted, changes to the 
site layout may be necessitated by the final engineering design of the site’s drainage 
infrastructure.
3.
Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted with the 
application for Building Permits  
4.
The entire site and adjacent half-streets’ runoff shall be retained onsite. If portions of 
adjacent right-of-way are controlled by other jurisdictions, the adjacent half-streets’ 
runoff shall be retained unless separately addressed by the other jurisdictions.
5.
Sufficient retention volume shall be provided onsite to retain the required 100-year, 2-
hour runoff from all contributing areas. Retention basins with stormwater depths 
exceeding one foot shall provide one foot of freeboard.
6.
All retention basins shall drain within 36 hours per County requirements.
d.
This special use permit is valid for a period of 10 years and shall expire on August 20, 
2035 or upon termination of the use for a period of 90 or more days, whichever occurs 
first. All site improvements associated with the special use permit shall be removed within 
90 days of such expiration or termination of use.
e.
Emergency contact information must be displayed at the entrance of the property.
f.
Prior to issuance of a building permit, written confirmation will be required from the 
emergency fire protection jurisdiction having authority that the facility has been designed 
in accordance with their regulations and requirements, and that emergency fire protection 
service will be provided to the facility. Prior to issuance of the certificate of occupancy, 
local fire protection jurisdiction review and approval will be required  
g.
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, and at the 
time of expiration of the Special Use Permit, the property may be considered for revocation  
to the zoning that existed on the date of application.  It is, therefore, stipulated and agreed 
that either revocation due to the failure to comply with any conditions, or the expiration of 
the Special Use Permit, does not reduce any rights that existed on the date of application 
to use, divide, sell or possess the property and that there would be no diminution in value 
of the property from the value it held on the date of application due to such revocation or 
expiration of the Special Use Permit.  The Special Use Permit enhances the value of the 
property above its value as of the date the Special Use Permit is granted and reverting to 
the prior zoning results in the same value of the property as if the Special Use Permit had 
never been granted.

The Maricopa County Environmental Services Department (MCESD) has completed review 
for the Caballero Contractor’s Yard planning case(s). Please note the following MCESD 
requirements for site development: 
 
Drinking Water –  
Per the Safe Drinking Water Act, any water system that supplies more than 25 people or 15 
service connections per day for at least 60 days per year is classified as a Public Water 
System (PWS).  
• 
If the above criteria are met, a Public Water System application and a New Source 
Approval application are required and must be submitted to the MCESD’s Drinking 
Water Program. A water quality analysis report will be required with submittal and is 
good within one-year of testing. 
 
An Approval to Construct application is required to be submitted to the MCESD’s Treatment 
Program for all PWS water treatment facilities.

A Notice of Intent to Discharge application for a septic system is required for any 
construction. Application must be submitted to the MCESD Onsite Wastewater Program.

Wastewater is not permitted to discharge to an adjacent parcel’s septic system.

If conducting food service in unincorporated Maricopa, a grease trap will be 
required by Onsite Wastewater program.

Setback requirements must be maintained per Arizona Administrative Code, Title 
18, Chapter 9, Article 312, C (Features Requiring Setbacks).
