Project Summary:
1.
The SUP amendment is to expand a previously approved equine hospital on parcel 211-52-073E 
as well as including an adjacent parcel to the south, 211-52-074, under unified ownership, for 
equine rehabilitation, training and club polo training, practices and tournaments. The site is within 
the Daisy Mountain / New River Area Plan and the Carefree Highway Scenic Corridor. 
2.
The original SUP for the northern parcel was approved by the Maricopa County Board of 
Supervisors (BOS) on April 7, 1999 on 4.05 acres as an equine surgical center with a 30-year 
validity. On September 24, 2013, staff approved a minor amendment to the site for a 144 sf patio 
cover addition, enclosing the 264 sf entry, and ADA route modifications.

The existing structures onsite include the equine hospital, uncovered arena, MRI facility, stalls 
and pens, and an Intensive Care Unit housed in a barn. Currently, a paved parking lot 
accommodates 22 parking stalls. Existing site screening is present along the eastern portion of 
the parcel consisting of 5’ high solid wall along a shared boundary with a single family residence. 
The remaining perimeter of both parcels is improved with split-rail fencing.  The proposed 
expansions to the northern parcel include: 
•
4,967 sf expansion of the existing ICU barn
•
600 sf for hitting cages
•
4,488 sf covered horse stalls
•
1,216 sf office addition
•
600 sf hospital addition
•
146 sf ADA accessible restroom
•
3,000 sf view deck on piers
•
2 - 10’ x 30’ concrete RV pads with decomposed granite driveway access, each with 
connection to a separate and dedicated septic system and each pad with 50-amp 
electrical panels. RVs will not be permanently installed on site.

Expanded parking up to 42 parking spaces including 3 ADA parking spaces
The southern parcel is currently developed as a field track used in equine rehabilitation. Apart 
from incorporating the southern 3 ¼ acre parcel, the SUP amendment will add:
•
5 - 25’ high light poles along the north side of the polo field to illuminate the track. All 
lighting will be of low intensity, fully shielded, and directed downward as required by 
Section 1112 of the MCZO and in Sections 10.1 and 10.3 of the Carefree Highway Scenic 
Corridor Study.

Introduction of a new land use – club polo tournaments; the field will also host United 
States Polo Association tournaments twice annually. Attendance at these tournaments 
will mostly be limited to polo club members and their friends and families.

A new monument sign is proposed at the southwest corner of the polo field, the 
monument sign design conforms to Carefree Highway Scenic Corridor Study design 
standards for freestanding monument signs by implementing natural materials and 
earth tone colors and maintains a rural character.

The applicant justifies the development standards proposed above in order to accommodate 
existing site conditions. Along the northern and north-eastern boundary of the site are structures 
used to keep animals, with one of the northern most horse shade structures set back 2’ from the 
northern property line. SUP regulations for farm animal hospitals (MCZO, Art. 1301.1.20.2) require 
any building or corral for the keeping of animals maintain a minimum 40’ setback. Site screening 
deviations are also proposed from min. 6’ high solid wall to three-rail pipe fencing combined with 
landscaping along site perimeters except for an existing 5’ tall block wall screening residential 
property to the east. Site lighting is requested up to 25’ feet high, proposed at the center of the 
property. County outdoor lighting regulations prevent light trespass onto any adjoining parcels by 
requiring all lighting fixtures be shielded downwards. Finally, parking per Ordinance requires that 
5% of all provided spaces be ADA accessible. The applicant meets this federal requirement by 
providing 3 ADA parking spaces.

Adopted Plans:

Daisy Mountain / New River Area Plan (adopted 1999, updated 11/20/2019): The site falls within 
the commercial designation. Large animal veterinarian is listed as an appropriate Rural Retail land 
use allowed within the retail areas along Carefree Highway.
Carefree Highway Scenic Corridor (designated 1999, updated August 2008): A 3.5-mile segment 
between 7th Ave and 28th St, spanning ¼-mile north and south of either side of highway right-of-
way. The site is within the Scenic Corridor, Veterinary clinics are a recommended land use. 
Proposed site development has considered and implemented scenic corridor design standards 
including: low intensity, fully shielded and directed downward field lighting. Non-reflective 
aluminum split rail fencing with combination landscaping compatible with scenic corridor 
guidelines and low-profile monument sign of visually natural materials (stone veneer and rusted 
steel) highlighting earth-toned colors.
City of Phoenix PlanPHX 2025 General Plan (adopted 4/17/24): The site is undesignated in the 
City of Phoenix General Plan.
Public Participation Summary:

The applicant complied with the Maricopa County Citizen Review Process with the required 
posting of the site and notification by first class mail to adjacent property owners within 300’ of 
the subject parcel and interested parties. There is no known opposition.
Outstanding Concerns from Reviewing Agencies:
11.
The most recently reviewed traffic study warrants site redesign to accommodate a required right 
turn lane off Carefree Hwy and half-width street improvements. Outstanding comments will be 
conditionally approved for eventually refinement and approval at a later process. The traffic study 
was not required at the time of application. Subsequent site design proposed the addition of a 
new driveway entry for RVs and trailers, necessitating a traffic study. Town of Cave Creek, through 
counsel, advised the applicant that they will not provide additional water supply to the additional 
parcel or the expanded uses. The applicant has provided a well report verifying the site’s private 
water supply. The Department’s Chief Building Official advised the applicant the existing steel 
construction horse shades setback 2’ from property lines would be a building code concern and 
included Tim Wills, fire marshal for Daisy Mountain Fire District to advise of the as-built structure. 
Staff will include a condition that all structures set back closer than 5’ from all property lines be 
fire rated. The applicant has provided tax documents showing the property’s inclusion and 
payment in the Daisy Mountain Fire District (DMFD). Tim Wills provided a memo advising of 
currently adopted codes by DMFD and required improvements to meet those codes.
Staff Analysis:

The veterinary hospital has been in operation since 1999. The well-established use continues to 
be a benefit to the rural and equestrian oriented properties in the New River area. The request for 
expansion is evidence of the demand for this land use in the proximity to equestrian oriented 
properties that flourish in the area. Further, County’s long range planning goals specifically list 
veterinary hospitals as a preferred, contemplated use along the Carefree Highway commercial 
corridor. The addition of a complementary use on the southern parcel, a 1.46-acre equine field 
and track for equine rehabilitation and training, is reasonable and appropriate at this location. In 
furtherance of the intent of the Carefree Highway Scenic Corridor, the addition of an active equine

field along Carefree Hwy would preserve existing views, adds visual interest and supports the 
rural character along the scenic corridor. The request also seeks to introduce a new land use for 
the site, club polo tournaments. Site design accommodates the new use with additional parking 
provided on-site, a view deck overlooking the field, including restrooms. The deviated standards 
requested do not severely impact surrounding uses and keep intact the intent of the scenic 
corridor. Although site screening is required for commercial uses, the applicant proposes a 
combination of native vegetation and three rail post fencing, adding character along the scenic 
corridor by not blocking views of the polo field with a typical 6’ high block wall. Staff will 
recommend that all site lighting meet zoning ordinance standards with adequate shielding that 
reduces light trespass on adjacent parcels under separate ownership. The increase in height up 
to 25’ is proposed to illuminate the field. Given that the proposed lighting lies at the center of the 
two properties, the location of the lighting does not appear to severely impact adjacent properties 
under separate ownership.
Recommendation:
13.
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve Z2024045 subject to the following conditions ‘a’ – ‘h’:
a.
Development of the site shall be in substantial conformance with the Site Plan entitled 
“Site Plan Cave Creek Equine Hospital“, consisting of 2 full-size sheets, dated 4/18/2025, 
and stamped received 4/18/2025, except as modified by the following conditions. Staff 
may determine slight refinements to remain in substantial conformance with the approved 
site plan.  Minor and major amendments to the site plan will be determined in accordance 
with Chapter 3 of the Maricopa County Zoning Ordinance.
b.
Development of the site shall be in substantial conformance with the narrative report 
entitled “Cave Creek Equine Sports Medicine & Surgery Special Use Permit Amendment 
Narrative“, consisting of 8 full-size sheets, dated 4/16/2025, and stamped received 
4/18/2025, except as modified by the following conditions.
c.
The following Planning Engineering conditions shall apply: 
1.
Drainage “C-Values” calculations must be updated with building permit submittal 
to correspond to Table 6.3 of the Drainage Policies. Retention basin on parcel 211-
52-073E must be revised to provide 1-foot of freeboard.
2.
A cross section/profile of the proposed driveway extending through the Floodway 
must be provided with building permit application showing no fill placed within the 
Floodway.
3.
The Desert Hills Wash Tributary 2 SFHA is along the western boundary of the site. 
No fill and no buildings are allowed within the Floodway portion of this site. 
Buildings within the floodplain must be elevated above the Regulatory Flood 
Elevation.
4.
Revised plans show RV spaces within the Floodplain. Conditions will be added to 
the building plans that requirements of the Floodplain Regulations Section 
601.A.15 must be followed. Owner is responsible for documenting continued 
compliance with this requirement.
5.
Carefree Highway is classified as a principal arterial requiring fee dedication of a 
65-foot half street from the section line. a. Applicant is required to provide, at 
applicant’s expense, an American Land Title Association(“ALTA”) Owner’s Policy

of Title Insurance showing title vested in Maricopa County, a political subdivision 
of the State of Arizona.
6.
Engineering review of planning and/or zoning cases is for conceptual design only. 
All development and engineering design shall be in conformance with Section 
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; 
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; 
and current engineering policies, standards and best practices at the time of 
application construction.
7.
Based on the conceptual design nature of the information submitted, changes to 
the site layout may be necessitated by the final engineering design of the site.
8.
Detailed Grading and Drainage (Infrastructure) Plans must be submitted with the 
application for Building Permits.
9.
A right lane turn lane, with 160’ (minimum) of storage along westbound Carefree 
Highway at 14th Street, is required. The turn lane shall be designed in accordance 
with the requirements of MCDOT Roadway Design Manual. The owner/applicant 
shall provide plans for permitting and construction of the turn lane concurrent with 
the building permit submittals for any new construction on the site. No permit for 
construction on the site will be issued unless the right-of-way permit required for 
the turn lane construction is issued prior to or concurrent with the building permit.
10.
Carefree Highway is classified as a principal arterial roadway requiring a minimum 
of 65’ right-of-way dedication in fee along the entire site frontage. The owner shall 
be required to dedicate additional right-of-way needed for improvements, if 
required.
d.
The following Environmental Services Department conditions shall apply:
1.
A Minor Plan Review application must be submitted for any existing septic system(s) 
if being utilized and if the applicant believes the existing system(s) are adequate in 
size to support the new use; otherwise, a new septic permit/install may be required.
2.
A Notice of Intent to Discharge application for a septic system is required for any 
construction. Application must be submitted to the MCESD Onsite Wastewater 
Program.
3.
Wastewater is not permitted to discharge to an adjacent parcel’s septic system.
4.
If conducting food service in unincorporated Maricopa, a grease trap will be required 
by Onsite Wastewater program.
5.
Setback requirements must be maintained per Arizona Administrative Code, Title 18, 
Chapter 9, Article 312, C (Features Requiring Setbacks)
6.
RVs are allowed to be permanently connected to a septic system at a 100 GPD design 
flow.
7.
A Recreational Vehicle Park Permit may be required.
e.
This Special use permit is valid for a period of 30 years and shall expire on July 23, 2055 
or upon termination of the use for a period of 90 or more days, whichever occurs first. All 
site improvements associated with the special use permit shall be removed within 90 days 
of such expiration or termination of use.
f.
The following Rural-43 RUPD standards shall apply:

g.
Prior to issuance of a building permit, written confirmation will be required from the 
emergency fire protection jurisdiction having authority that the facility has been designed 
in accordance with their regulations and requirements, and that emergency fire protection 
service will be provided to the facility. Prior to issuance of the certificate of occupancy, 
local fire protection jurisdiction review and approval will be required.
h.
Structures encroaching closer than 5’ from all property lines shall be fire-rated.
i.
All outdoor lighting shall be of low intensity, fully shielded, directed downward, not 
trespass adjacent parcels under separate ownership, constructed no higher than 25’ and 
be shut-off by 11pm.
j.
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, and at the 
time of expiration of the Special Use Permit, the property may be considered for revocation  
to the zoning that existed on the date of application.  It is, therefore, stipulated and agreed 
that either revocation due to the failure to comply with any conditions, or the expiration of 
the Special Use Permit, does not reduce any rights that existed on the date of application 
to use, divide, sell or possess the property and that there would be no diminution in value 
of the property from the value it held on the date of application due to such revocation or 
expiration of the Special Use Permit.  The Special Use Permit enhances the value of the 
property above its value as of the date the Special Use Permit is granted and reverting to 
the prior zoning results in the same value of the property as if the Special Use Permit had 
never been granted.

A. REQUEST 
The purpose of this request is for approval of a Major Special Use Permit Amendment and 
expansion of an existing Special Use Permit (the “SUP”; Case Number Z98-18) on approximately 
8.5 acres located at the northeast corner of North 14th Street and East Carefree Highway, in 
Phoenix, AZ, 85086 (the “Site”). The Site is comprised of two parcels, designated as Maricopa 
County Assessor’s Parcel Numbers 211-52-073E and 211-52-074A. The existing SUP only covers 
the northern parcel and the intent is to amend the SUP to include both parcels shown in red below.   
 
B. DESCRIPTION OF PROPOSAL 
The existing SUP allows the equine hospital on the northern parcel. Though the Site currently is 
comprised of two separate parcels, the intent is to expand the SUP to include the southern parcel 
and prior to combining them into a single parcel. The Site is located within the Carefree Highway 
Scenic Corridor Plan (the “Corridor Plan”), which explicitly identifies veterinarian clinics as being 
a recommended land use with the development concepts and design guidelines set forth in the 
Corridor Plan. The proposal advances the goals of the Corridor plan by improving the existing 
veterinarian uses on the northern parcel of the Site and allowing complementary development on 
the southern parcel of the Site with an equine training field that can also be used for equine 
rehabilitation, training, and club polo tournaments.  
NORTH HALF OF SUP AREA 
The existing equine veterinarian campus on the northern portion of the Site is already developed 
and contains an existing: equine hospital, uncovered arena, MRI facility, stalls and pens, and 
Intensive Care Unit (“ICU”) Barn. The northern parcel also houses a paved surface parking lot, 
which provides 21 standard parking stalls and 1 ADA parking stall.  
The intent is to expand the existing hospital and establish equine training uses on the northern 
portion of the Site to enhance the Site’s diagnostic, training, and rehabilitative capabilities. The

proposal includes expanding the existing ICU Barn by approximately 4,957 square feet, the office 
by approximately 1,265 square feet, and the existing hospital by approximately 600 square feet. A 
high-quality equine examination structure will also be constructed to serve the equine hospital. 
Further, the proposal aims to improve the northern parcel with state-of-the-art equine training uses 
including stalls and pens, a hay barn, and observation deck to view the training, rehabilitation, and 
polo field located on the southern half of the SUP area, as described below.  
 
A new decomposed granite drive will be constructed along the north boundary of the northern 
parcel. The purpose of the new drive is to allow RVs and equine trailers to enter and exit the Site, 
a design goal envisaged in the Corridor Plan. Concrete pads will be installed off the concrete drive 
and will serve as parking for the RVs, which be used to support polo athletes completing in club 
polo tournaments. On the southern portion of the northern parcel, off the existing vehicular access 
point, is an existing parking area with 19 standard parking stalls and 2 ADA spaces. This parking 
area will be improved and expanded to add an additional 23 standard parking stalls to the Site, for 
a total of 41 standard parking stalls, and 3 ADA spaces. The additional parking will accommodate 
existing users of the Site who are seeking equine diagnostic, training, rehabilitation services, as 
well as users seeking to attend proposed club polo tournaments.  
 
SOUTH HALF OF SUP AREA 
The southern portion of the Site is occupied by an existing 63,705 square foot equine field and a 
track that is used for equine lameness and respiratory diagnostics as well as rehabilitation and 
training. The field and track will be improved and used to test horses under stress conditions. The 
field will also be used for occasional club polo tournament matches, for which goal posts and catch 
nets are being added.

Pole lighting 25’ in height will be installed at the northern edge of the southern parcel to illuminate 
the field and existing track. All lighting will be of low intensity, fully shielded, and directed 
downward as required by Section 1112 of the Maricopa County Zoning Ordinance (the 
“Ordinance”) and recommended in Sections 10.1 and 10.3 of the Corridor Plan. To preserve the 
rural nature of the area, as envisaged in the Design Guidelines of the Corridor Plan, no exposed 
neon lighting will be used to illuminate the Site.  
In addition to the existing 5-foot solid CMU wall along the east boundary of the northern parcel, 
a split rail aluminum fence is proposed around the remaining perimeter of the Site. The Corridor 
Plan advances design 
guidelines 
for 
the 
materials and decorative 
elements of perimeter 
fencing with the goal of 
preserving the natural 
desert 
context. 
The 
proposed split rail non-
reflective 
aluminum 
fence is consistent with 
this goal by embodying 
the rural ranch style 
commonly found in the 
area. As shown to the right, the proposed fence will incorporate native landscape plantings to bring 
elements of the natural Arizona desert into the design and create an attractive presence along 
Carefree Highway.

To provide direction to the Site, an illuminated monument sign will be placed on the southern 
parcel at the southwest corner of 
the Site. The monument sign, as 
shown below, will comply with 
the commercial sign standards 
for 
freestanding 
signs, 
as 
embodied in Section 1403.2.3 of 
the Maricopa County Zoning 
Ordinance (the “Ordinance”).  
Additionally, the Corridor Plan 
provides that freestanding signs 
for commercial uses should be 
monument 
type, 
rural 
in 
character, and be comprised of 
neutral, earth toned colors and 
materials that can be found in the 
surrounding natural and built context. As shown below, the signage is proposed to be monument 
in style. Further, the sign is proposed to be constructed with steel with a natural rust finish and 
CMU base stone veneer to complement the natural context and match the finishes on the existing 
equine hospital.  
 
 
The proposed improvements will significantly improve the appeal of the Site along Carefree 
Highway. Further, improving the Site with enhanced veterinarian, training, rehabilitative, and 
diagnostic uses, and club polo tournaments will allow equestrians who train on the Site to take 
advantage of the world-class veterinarian services offered.

C. USE PERMIT DEVIATIONS 
Section 1301.1.20 of the Maricopa County Zoning Ordinance (the “Ordinance”) requires that, for 
medical clinics and surgical referral hospitals, any structures for keeping animals to be setback 40’ 
from the property line. As part of the Amendment to the Use Permit, we are requesting that there 
be 2’ setback requirements on the northern property line. Existing covered horse stalls are set back 
2’ feet from the north property line. The horse stalls are legal nonconforming structures because 
the north portion of the SUP has received an Agricultural Land Use Exemption.  
Additionally, the Ordinance requires that lighting shall have a maximum height of 18 feet. We are 
requesting that all light poles on the Site, particularly on the polo field and track, be increased to a 
maximum of 25 feet in height. Increasing the height of the light poles will ensure higher visibility 
for users of the Site, particularly those engaging in equine training on the Site.  
Finally, we are requesting to eliminate the screening standards. Screening will be provided around 
the perimeter of the Site. To mitigate any noise, odor, or dust produced by the animals, and in 
addition to the existing 5-foot CMU wall on the east boundary of the north parcel, landscaping 
will be added to the split rail aluminum fence that will line the remaining perimeter of the Site to 
provide a buffer to the surrounding uses.  
These deviations will not alter the existing Site conditions. As shown on the below aerial, the Site 
is bounded by roads on the west and southern boundaries. The northern parcel abuts properties 
with analogous equine uses. The larger surrounding context is primarily comprised of equine and 
agriculturally oriented uses. The Site has been used as an equine hospital and rehabilitation facility 
for many years. Accordingly, the surrounding community is familiar with the uses currently 
occurring on the Site and will not be significantly impacted by the setback reduction or increased 
height for pole lighting.

D. RELATIONSHIP TO SURROUNDING PROPERTIES 
The Site is ideally situated on the corner of Carefree Highway and 14th Street. The Site is zoned 
Rural 43, One Acre Per Dwelling Unit (“RU-43”) and is within the New River Area Plan, Rural 
Densities (0-1 du/ac). The northern parcel receives agricultural property tax treatment through the 
Maricopa County Assessor’s Office. The Site is bounded on the north by equestrian properties, 
zoned RU-43. To the east and west of the Site is vacant, desert land, zoned RU-43. Finally, to the 
south of the Site, across Carefree Highway, is vacant, desert land, zoned RU-43.  
As previously mentioned, the Site is within the planning area for the New River Area Plan and has 
a designation of Rural Densities (0-1 du/ac). The Area Plan advances policy objectives that 
promote a healthy community, encourages economic and energy growth, develops an efficient 
transportation system, and promote the development of open space and growth areas. The proposed 
development conforms with the overall goals of the Area Plan. The Site will help promote the 
economic growth and development of the growth areas by offering a comprehensive equine 
training facility and program coupled with veterinarian and rehabilitative uses, and club polo 
tournaments, a unique combination of uses not present in the surrounding area. 
E. LOCATION AND ACESSIBILITY 
The Site is located at the northeast corner of 14th Street and Carefree Highway in Phoenix, AZ, in 
the 
jurisdiction 
of 
Maricopa 
County.

Cave Creek equestrian community. Vehicular ingress and egress to the Site is accessed via a 
private drive off 14th Street.  
F. CIRCULATION SYSTEM 
Again, the Site has one existing access point at the southwest corner of the northern parcel, via 
14th Street. One new access point will be established at the northwest corner of the northern parcel 
and will connect to a decomposed granite driveway and RV and equine trailer parking. A small 
surface parking lot is provided on the northern parcel that will be improved and expanded to 
provide a total of 41 standard and 2 ADA parking spaces. A Traffic Impact Study waiver is being 
submitted in conjunction with this application.  
G. DEVELOPMENT SCHEDULE 
The intent is to first combine the two parcels into a single parcel. The lot combination will be 
processed immediately following approval of the SUP Amendment. The property owner also 
intends to obtain any required commercial building permits along with the relevant as-built permits 
and begin improvements after approval of this request.  
H. COMMUNITY FACILITIES AND SERVICES 
Currently, educational needs are being served by the Deer Valley school district; however, given 
the nature of the existing and proposed use, no impact on public schools is anticipated. The Site 
is also near the Cave Creek Regional Park, which is equipped for equestrian use.

I. PUBLIC UTILITIES AND SERVICES 
The Site will receive electric power service through APS. A private well located on the northern 
parcel provides water for the Site and an existing septic tank provides sewer service. Refuse and 
trash collection is handled through Waste Management. Police services are provided by Maricopa 
County Sheriff’s Office. The Site receives fire service from Daisy Mountain Fire.  
J. CONCLUSION 
We respectfully request that the Major Amendment and expansion to the existing SUP be 
considered for approval. Given the vast number of horses in this state, it is evident that the Arizona 
equestrian community would benefit from another fully functioning equine hospital and training 
facility.

for the Cave Creek Equine planning case(s). Please note the following MCESD requirements 
for site development: 
 
Onsite Wastewater (Septic) –  
A Minor Plan Review application must be submitted for any existing septic system(s) if 
being utilized and if the applicant believes the existing system(s) are adequate in size to 
support the new use; otherwise, a new septic permit/install may be required. 
 
A Notice of Intent to Discharge application for a septic system is required for any 
construction. Application must be submitted to the MCESD Onsite Wastewater Program. 
• 
Wastewater is not permitted to discharge to an adjacent parcel’s septic system. 
• 
If conducting food service in unincorporated Maricopa, a grease trap will be 
required by Onsite Wastewater program. 
• 
Setback requirements must be maintained per Arizona Administrative Code, Title 
18, Chapter 9, Article 312, C (Features Requiring Setbacks). 
 
RVs are allowed to be permanently connected to a septic system at a 100 GPD design flow.  
A Recreational Vehicle Park Permit (mobile home permit) may be required.

DMFD comments are directed toward the new/future additions to the exiting Equine 
Hospital and ICU Barn.  Based on limited water supplies for fire protection, current and 
proposed use of these facilities, the adopted 2018 Internation Fire Code with Daisy 
Mountain Fire Department amendments, we have the following comments: 
 
Automatic Fire Sprinkler are required.  Shall be designed and installed in accordance with 
NFPA 13.   
Required Water supply shall be capable of providing the fire sprinkler system design   
Fire Hydrant in service at front of property (N 14th St); Cave Creek Water 
An NFPA 72 Fire Alarm System shall be installed to monitor fire sprinkler flow, tamper and 
additional coverage (smoke detection and notification) based on Occupancy 
Use/Classification (by MC Building Official).   
Medical gas system(s) if amended or added shall be designed and installed as per Fire 
Code Chapter 53 and Section 5306.  
Owner and developer are encouraged to review NFPA 150 Fire and Life Safety in Animal 
Housing Facilities Code.  The purpose of this Code shall be to prevent the loss of animal 
life, human life, and property from fire or other emergencies by providing the minimum 
requirements for the design, construction, operation, and maintenance of facilities where 
animals are housed, including, but not limited to, rest, feed, work, exercise, and production 
areas. 
Applying this code may result in best practices and most appropriately design and install 
fire and life safety systems that are unique to the equine veterinary care.  Whereas it has 
not been adopted by DMFD; DMFD may accept proposed design from NFPA 150 as a 
national recognized standard.

This structure was built between October 2023 and October 2024 without benefit of a building 
permit.  
 
The building code requires three feet from the property line to prevent fire propagation between 
properties.  The fire code also has a similar requirement. This was the basis of my comment in the 
TAC report I prepared last June. 
 
Before you consider a variance for the setback, the fire marshal and I will have to consider a fire 
department appeal and building code modification respectively, so I am copying Tim Wills. Unlike 
zoning variances, there are no “hardships” to consider, only equivalencies to the codes.

I am not advocating for approval, only asking if this is something you would consider. My thoughts 
are; They did this without benefit of a permit. If the roof sloes upwards to the south, away from the 
north property, and there are not combustibles under the roof, it may be possible to consider for 
building approval.

The distance to property line is a life safety item in both the building and fire codes – IBC Chapter 6. The 
minimum distances are based on occupancy and construction type.  
 
The minimum distance requirements are applied to each side meaning that the neighbor to the north will 
have a building setback requirement for the structure they which to build. This structure currently placed 
two feet instead of three encumbers the property owner to the north with the additional foot if it remains 
in its current location.  Building setbacks are one of the items reviewers check when a permit application 
for structures are submitted. We don’t have record of a building permit for this structure. 
 
As the Chief Building Official of Maricopa County, I can’t solely support a building code modification to 
allow the encroachment. I am copying Tim Wills on this email as he is the fire marshal for Daisy Mountain 
Fire District in which this structure is located.

Water Supply  
Dear Cassandra: 
 
I am writing to you on behalf of the Town of Cave Creek.  The Town received a notice of 
a proposal for a major amendment of the Special Use Permit for the Cave Creek Equine Hospital 
that proposes to expand various operations, including the addition of facilities within a new 
southern parcel, APN 211-52-074.  The facilities may include substantial additional water 
demands.  While the Town does not intend to object to the new use permit, this letter is sent to 
make clear that the Town will not be providing any additional water supply to the adjacent parcel 
or to expanded uses within the existing facility. 
On December 20, 2021, the Town adopted a Water Resources Policy for the Desert Hills 
area where the equine hospital is located that ended the expansion of Town-provided water 
service for new connections and changes that would increase the Town’s water resource 
commitment.  The current water service for the equine facility is limited to the existing 
buildings’ domestic water at the volume in use when the policy was adopted.  A copy of the 
Town’s Water Resources Policy is enclosed.

The proposed development is located along the NEC of Carefree Highway and 14th Street in unincorporated Maricopa County.  The proposed development is an expansion 
to the existing equine veterinary hospital.  The development plans to add medical facilities, an arena, and polo field and to the existing business.
The site will be served by two driveways.  One existing, gated, full movement driveway on 14th Street 420’ north of Carefree Highway.  A second driveway is proposed as a 
full movement driveway on 14th Street along the northern property boundary.
It is noted within the report the trip generation is projected be unchanged with the medical facility expansion.  Upon build-out planned for 2030, utilizing ITE LUC 640, the 
expansion of the medical facility is estimated to generate 190 total daily trips with 27 AM peak hour trips and 18 PM peak hour trips. With the added polo tournament field, 
the development is expected to generate at least 50 new daily trips during tournaments.
