Project Summary:
1.
The applicant, on behalf of the property owner, is requesting a Special Use Permit (SUP) for a 
wireless communications facility (WCF) in the Rural-43 zoning district.  The facility will take up 
2,500 sq. ft. of a 22.8 acre parcel located in the northwest corner of the parcel north of the 
Interstate 10 Frwy. The WCF will be a quarter mile southeast of the southeast corner of 
Wintersburg Rd. and Osborn Rd. in the Tonopah area.  Staff held a TAC Meeting to discuss the 
first review comments on July 2, 2024. 
2.
The WCF will consist of a 2,500 SF equipment compound with a 100 foot tall monopole mast with 
one antenna array with nine wireless antennas.  Inside the compound will be a backup generator 
and equipment for the monopole mast. The compound will be surrounded by an 8 foot tall 
masonry wall with one screened gate for access. The entire WCF will be painted a color that will 
be compatible with the surrounding environment. This facility will offer one parking space for 
routine maintenance, but no one will occupy this facility.  Access to the site will be provided by a 
gravel driveway from Wintersburg Rd. to the west, which links directly with the Interstate 10 
interchange.

The applicant is requesting several modifications to the Rural-43 zoning development standards.  
The first request is to increase the maximum height for a wireless monopole mast from the 
required 80 feet to 100 feet to accommodate future wireless carrier’s antenna arrays.  The second 
request is to increase the maximum antenna array diameter from the required 8 feet to 12 feet to 
comply with current industry standards. The third request is to reduce the required setbacks for 
a 100 foot tall monopole mast from 200 feet to 94 feet to the east/south property lines and 142 
feet from the north property line due to the unique configuration of the parcel that is separated 
by a freeway. The final request is to allow for alternative surfacing, such as decomposed granite 
for the parking and driveways to minimize dust control.

as Community Retail Center, which denotes areas where general neighborhood/community 
based commercial uses may take place. 
Public Participation Summary:

The applicant has complied with the requirements of the citizen review process with required 
posting of the site and notification to adjacent property owners within 300 feet of the subject 
parcel and interested parties via first-class mail. The applicant has submitted a Public 
Participation Results Report.  According, to this report the applicant received no support or 
opposition to this request, nor did staff.

Staff Analysis:

Staff supports the  SUP, due to the proposed location along Interstate-10 in an area with little to 
no development that would be affected by the proposed use. This facility will increase reliability 
of wireless communication for Verizon users and can prove to be vital in a roadway emergency 
or incident. Placing a 100 foot tall monopole mast on this site, painted to match the surrounding 
landscape, will minimize visual impacts to motorists or passengers traveling at freeway speeds, 
thus a request to increase the height by 20 feet is not unreasonable. Increasing the antenna array

to 4 feet to meet current technological standards and decreasing the required WCF setbacks will 
cause no impacts on this isolated site. Staff recommends that the Commission recommend to 
the Board to approve this SUP request. 
Recommendation:
11.
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve Z2024062 subject to the following conditions ‘a’ – ‘m’:
a.
Development of the site shall be in substantial conformance with the Site Plan entitled 
“Wintersburg 10“, consisting of 11 full-size sheets, dated April 2, 2025, and stamped 
received May 19, 2025, except as modified by the following conditions. Staff may 
determine slight refinements to remain in substantial conformance with the approved site 
plan.  Minor and major amendments to the site plan will be determined in accordance with 
Chapter 3 of the Maricopa County Zoning Ordinance.
b.
Development of the site shall be in substantial conformance with the Narrative Report 
entitled “PHO Wintersburg 10”, consisting of four pages, dated October 5, 2024, and 
stamped received November 14, 2024, except as modified by the following conditions.
c.
The following Planning Engineering conditions shall apply: 
1.
Engineering review of planning and/or zoning cases is for conceptual design only. 
All development and engineering design shall be in conformance with Section 
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; 
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; 
and current engineering policies, standards and best practices at the time of 
application for construction.
2.
Based on the conceptual design nature of the information submitted, changes to 
the site layout may be necessitated by the final engineering design of the site’s 
drainage infrastructure.
3.
The building permit application will require an engineered grading and drainage 
plan to indicate how runoff from the north will be diverted around the compound. 
No retention will be required.
4.
The site contains areas of regulated floodplains. Any required improvements to 
the access drive to the Wireless Communication Facility from Wintersburg Rd. 
would require a floodplain use permit.
5.
Applicant to notify ADOT of proposed project through the Red Letter Process, 
RedLetter@azdot.gov, due to the proximity to the Intestate-10 Frwy.
6.
Access to the site is through ADOT Right-of-Way and may require an ADOT Right-
of-Way permit.
7.
The applicant must execute a Wireless Agreement with MCDOT for all equipment, 
conduit, F/O and other work that will be within the MCDOT R/W. This agreement 
must be coordinated with Shawn Coleman, MCDOT Utility Branch Coordination 
Manager, 602-506-8603 or Shawn,Coleman@maricopa.gov.

d.
The maximum height of the Wireless Communication Facility shall be limited to 100 feet. 
e.
A Minor Amendment shall be required to co-locate future carriers on the Wireless 
Communication Facility. 
f.
This special use permit is valid for a period of 30 years and shall expire on August 20, 
2055, or upon termination of the use for a period of 90 or more days, whichever occurs 
first. All site improvements associated with the special use permit shall be removed within 
90 days of such expiration or termination of use.
g.
The Wireless Communications facility shall be painted a color that is compatible with the 
surrounding environment and any exposed portions of the monopole mast shall be non-
reflective. 
h.
All ground-mountain equipment associated with the Wireless Communications shall be 
screened by a minimum six foot tall solid wall and screened gates. 
i.
The maximum diameter of the antenna array shall be 12 feet. 
j.
There shall be a 94 foot west/south setback and 142 foot north setback from the 
monopole’s antenna array to the property lines. 
k.
All associated driveway and parking area for the facility shall be surfaced with alternative 
dust control methods, such as decomposed granite or other method deemed acceptable 
by the County’s Air Quality Department.   
l.
Noncompliance with any of the conditions assigned to the approval of this Special Use 
Permit by the Maricopa County Board of Supervisors may be grounds for revocation in 
accordance with the requirements and procedures as set forth in the Maricopa County 
Zoning Ordinance. 
m.
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner. The granting of this approval allows the property owner 
to enjoy uses in excess of those permitted by the zoning existing on the date of 
application, subject to conditions.  In the event of the failure to comply with any condition, 
and at the time of expiration of the Special Use Permit, the property may be considered 
for revocation  to the zoning that existed on the date of application.  It is, therefore, 
stipulated and agreed that either revocation due to the failure to comply with any 
conditions, or the expiration of the Special Use Permit, does not reduce any rights that 
existed on the date of application to use, divide, sell or possess the property and that there 
would be no diminution in value of the property from the value it held on the date of 
application due to such revocation or expiration of the Special Use Permit.  The Special 
Use Permit enhances the value of the property above its value as of the date the Special 
Use Permit is granted and reverting to the prior zoning results in the same value of the 
property as if the Special Use Permit had never been granted.

Purpose of Request 
 
Verizon is committed to improving coverage and expanding network capacity to meet customer 
demand throughout Maricopa County. Verizon in cooperation with ANTHEMNET (Applicant) is 
proposing a new Wireless Communication Facility (WCF) to be located at the NE Cnr of I-10 & 
Wintersburg Road, Tonopah AZ 85354. 
 
The proposed WCF will provide residents, visitors and businesses with improved high quality 
reliable wireless service for both personal & business, in addition to enhancing emergency 
services in the area.

Details of Request 
 
Applicant is proposing a new 100’ WCF with an associated equipment compound enclosure as 
detailed on the attached site plan/elevation. The proposed 2,500 sq/ft equipment compound 
will be enclosed by an 8’ Tall Masonry Screen Wall, that will conceal the ground equipment from 
view. The entire WCF will be painted a color that will be compatible with the surrounding 
environment to comply with MCZO Article 1202.4.1.d.

Applicant is requesting a Special Use Permit to allow a new 100’ WCF and equipment 
compound.p 
 
SUP Request Details/Standards that need to be varied 
 
The proposed type of WCF being proposed will require variations from the typical WCF 
standards outlined in MCZO 1202. WIRELESS COMMUNICATION FACILITIES.  
 
Applicant is requesting the following: 
• Applicant is requesting to vary the maximum height of the proposed WCF/MonoPole from 80’ 
to 100’ (MCZO 1203.1.1.a). The additional height is necessary to ensure the WCF be co-
locatable to accommodate additional carriers. 
• Applicant is requesting to vary the maximum antenna array diameter from the required 8’ to 
11’- 8”. (MCZO Art. 1202.3.1.h). The required 8’ diameter is outdated relative to the type of 
antenna/radios in use nowadays from that period when this section of code was introduced. 
• Applicant is requesting to vary the setbacks of the proposed WCF/Array reducing the 
required 200’ (MCZO Art. 1202.3.1.g) WCF Setbacks from the North, South & West property 
lines (see setback table below), as he proposed WCF location is the only location the 
property owner will allow the WCF to be placed on the property as to not impact future 
development on the property. 
• Applicant is requesting to vary the paving requirements for the driveways and parking space 
to use an alternative dust control method of decomposed granite which is acceptable by the 
County’s Air Quality Department.

1. Engineering review of planning and/or zoning cases is for conceptual design 
only. All development and engineering design shall be in conformance with 
Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and 
Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway 
Design Manual; and current engineering policies, standards and best practices 
at the time of application for construction. 
 
2. Based on the conceptual design nature of the information submitted, changes 
to the site layout may be necessitated by the final engineering design of the 
sites drainage infrastructure. 
 
3. The building permit application will require an engineered grading and drainage 
plan to indicate how runoff from the north will be diverted around the 
compound. No retention will be required. 
 
4. The site contains areas of regulated floodplains. Any required improvements 
to the access drive to the WCF from Wintersburg Road would require a 
floodplain use permit. 
 
5. Applicant to notify ADOT of proposed project through the Red Letter Process, 
RedLetter@azdot.gov, due to the proximity to the I-10. 
 
6. Access to the site is through ADOT Right-of-Way and may require an ADOT  
Right-of-Way permit.

Dear Mr. Martell:
The Arizona Game and Fish Department (Department) reviewed your Project Evaluation
Request dated May 20, 2024, regarding the construction of a proposed 100-foot monopole
telecommunications tower enclosed within a new 2,500-square-foot compound on undeveloped
Sonoran desert scrub. Based on the information provided, the Department offers the following
general recommendations:
●
Suitable habitat may be present within the project vicinity for the western burrowing owl,
a special status species that is regulated under the Migratory Bird Treaty Act (MBTA). If
suitable habitat for this species is present within or adjacent to the project area, the
Department recommends conducting an occupancy survey for western burrowing owls to
determine if this species occurs within the project footprint. Guidelines for conducting
this survey are found in Burrowing Owl Project Clearance Guidance for Landowners .

Please note that the survey should be conducted by a surveyor who is certified by the
Department or has similar training and qualifications. If an active burrowing owl burrow
is detected, please contact the Department and the U.S. Fish and Wildlife Service for

direction, in accordance with the Guidelines.
●
If vegetation removal/trimming is required, the Department recommends that a qualified
biologist survey for nesting birds within the project area if work will be conducted during
the breeding season. The trees and/or vegetation within the project area may provide
nesting opportunities for avian species that are regulated under the MBTA and protected
under state law. Breeding season for birds in the project vicinity is generally January
through late June. If it is anticipated the project will not be in compliance with MBTA,
the Department also recommends contacting the USFWS for technical assistance and
options to comply with the MBTA.

Suitable habitat for the Sonoran desert tortoise, an Arizona Species of Greatest
Conservation Need (SGCN), may be present within the project vicinity. While work is
being conducted within suitable Sonoran Desert tortoise habitat, construction crews
should refer to the Guidelines for Handling Sonoran Desert Tortoises Encountered on
Development Projects should a tortoise be encountered.

The Department's Online Environmental Review Tool report (HGIS-22305, attached)
created on June 21, 2024, indicates that other SGCN have the potential to occur within
the project area. If wildlife are encountered while working in the project area, the
Department recommends moving them out of harm’s way, no more than 0.25 mile
outside the project area into similar habitat.
●
If trenching or digging of holes will occur, trenching/digging and backfilling crews
should be close together to minimize the amount of open trenches/holes at any given
time. Avoid leaving trenches/holes open overnight. Where trenches/holes cannot be
back-filled immediately, escape ramps should be constructed, which can be short lateral
trenches or wooden planks sloping to the surface. The slope should be less than 45
degrees (1:1). Trenches/holes that have been left open should be inspected and animals
removed prior to backfilling.
●
Please ensure the project complies with Arizona Native Plant Law regulations . A Native

Plant Inventory may need to be conducted to identify, record, and coordinate plant
salvage efforts for species that are Protected under the Arizona Native Plant Law. In
addition, the applicable land management agencies should be consulted regarding
guidelines for revegetation efforts.
●
Minimize the potential introduction or spread of exotic invasive species, including
aquatic and terrestrial plants, animals, insects, and pathogens. Precautions should be
taken to wash and/or decontaminate all equipment utilized in the project activities before
entering and leaving the site. Please review the Arizona Department of Agriculture’s
website for a list of prohibited and restricted noxious weeds and the Arizona Native

Plant Society for recommendations on control methods. To view a list of documented

invasive species or to report invasive species in or near your project area visit
iMapInvasives – a national cloud-based application for tracking and managing invasive

species.
