Project Summary:
1.
The applicant, Bill Koning of Smartlink Group, is requesting an SUP for a proposed WCF on Parcel 
401-19-066. The subject parcel comprises approximately 5.25 acres and is located along the west 
side of Bruner Road, about 960’ north of the northwest corner of Bruner Road and Lower River 
Road in the Buckeye area. The SUP will be a 1,600-square-foot lease area toward the southeast 
corner of the parcel.
2.
There is no direct access to the parcel from Bruner Road; groves of mature trees and a drainage 
ditch separate the north-south arterial from onsite development. Access to the site comes from 
Lower River Road by way of an ingress/egress easement that extends from the road and parallels 
the west lot line. From this existing easement, AT&T would record a new 12’-wide nonexclusive 
access and utility easement generally parallel (but not adjacent) to the south lot line and 
extending to the lease area. This new easement would be paved with an aggregate base course 
(ABC) all-weather surface.
3.
The WCF itself would be built as a “monopine” to stealth the tower and to better blend with the 
adjacent grove of trees. New Cingular Wireless PCS (AT&T) will build the tower, which has been 
designed to allow co-location by at least two additional wireless carriers.

The site is zoned Rural-43. The applicable development standards for this zoning district, as well 
as those proposed with this request, are listed in the table below. The facility would meet the pole 
diameter and screening regulations established in MCZO Article 1202.3.1.1. Specifically, the site 
would be screened with an 8’-high masonry wall along the perimeter of the lease area, with two 
6’-wide swing gates provided on the west face to allow construction and maintenance access.

The tower would reach a maximum height of 85’ (not including monopine branches), which is 5’ 
higher than the maximum permitted by right. The applicant is requesting increased height on 
behalf of the RF engineer to enable superior coverage in what is currently a rural area. 
Furthermore, to accommodate the requirements of modern telecommunications technology, the 
applicant is requesting to allow a maximum antenna array diameter of up to 18’, where 8’ is the 
maximum allowed by right.

Finally, the applicant is requesting to reduce the required setbacks from the south and east lot 
lines. All neighboring parcels are zoned Rural-43, with regulations requiring that a WCF be set 
back at least 2’ for each 1’ in height (with setbacks measured from the antenna array 
circumference). For an 85’ tower, this would require a setback of 170’ from all parcel lines. The 
proposed facility would significantly exceed this setback from the north and west lot lines, but 
reduced setbacks are proposed from the south (98’) and east (149’). The reason for the reduced 
setbacks is to allow the property owners to maximize use of the rest of their parcel.

Adopted Plans:

Old US Highway 80 Area Plan (adopted May 2007): This area plan assigns the subject site a future 
land use category of “Large Lot Residential,” which is characterized as allowing for a residential 
density greater than one dwelling unit per gross acre, but not more than two dwelling units per 
gross acre. The proposed WCF would not conflict with this land use designation, nor with the land 
use strategies, goals, or policies outlined in the area plan.
11.
Buckeye 2040 General Plan (ratified August 2018, amended June 2022): The site is located within 
the City of Buckeye Municipal Planning Area (MPA) and is therefore subject to the City’s general 
plan, which places the site within its “Agriculture” land use category. This category denotes areas 
that have large tracts of land in active agriculture uses, which may include agricultural uses as 
well as large lot residential, accessory agricultural uses, and accessory structures to support 
agricultural uses. Improvements in this designation should be low impact and retain the rural 
character of the area. Residential land uses are permitted up to one dwelling unit per acre. The 
proposed WCF would not conflict with this land use category.
Public Participation Summary:

The applicant complied with the requirements of the citizen review process with the required 
posting of the site and notification by first class mail to interested parties and adjacent property 
owners within 300’ of the subject parcel. Two signs were posted on February 22, 2025, in 
accordance with applicable regulations. One sign was posted along the east lot line facing Bruner 
Road. Another sign was posted facing Lower River Road next to its intersection with the 
ingress/egress easement that provides access to the subject parcel. Both signs were updated 
with public hearing dates on May 29, 2025. To date, staff has not received citizen comment 
regarding this request.

The City of Buckeye commented on March 3, 2025, confirming it does not have any concerns with 
the request. The City did request that the applicant provide a solid enclosure wall around the lease 
area to better screen it from adjacent streets and properties. Originally, the applicant had 
proposed a 6’-high chain-link fence enclosure topped with a 1’ anti-climb barrier. Staff provided 
Buckeye’s comments to the applicant during the TAC meeting, after which the applicant revised 
the enclosure to an 8’-high solid wall to comply with Buckeye’s recommendation.

The Arizona Fire & Medical Authority (AFMA), which has jurisdiction over the site through the 
Buckeye Valley Fire District, confirmed it has no opposition to the application.

Staff Analysis:

Staff believes the requested development standards are justified. Allowing an 18’ antenna array 
diameter where an 8’ diameter would normally be the most allowed would not significantly affect 
the facility’s impact on surrounding properties, especially given the stealthing features 
incorporated into the design. Staff concurs with the applicant’s explanation that a larger antenna 
array would be necessary to accommodate modern communications equipment. Likewise, 
allowing a 5’ increase in the maximum height would not make a significant difference in the 
aesthetic impact of the tower.

The reduced setback from the east would allow the monopine to better complement the grove of 
trees, which would also serve to naturally screen the tower from Bruner Road and the properties 
further east (which are currently farmland). The applicant estimates that only two mature trees 
would need to be relocated to accommodate the tower. As for the reduced setback from the 
south, the owners of the subject property own the adjacent parcel to the south as well, which 
would negate the impact of the reduced setback. Furthermore, both the subject parcel and its 
southern neighbor are agricultural in use. No residence has been developed on either parcel, 
which would further lessen the impact of a reduced setback even if the two properties were to 
later come under separate ownership. A residence has been developed on the adjacent parcel to 
the north, but the WCF would be set back from that residence by over 500’, far exceeding the 
minimum setback allowed by right.
18.
Staff supports the applicant’s request for an SUP. The proposed WCF promises to provide 
wireless service in a rural but growing area. Demand for such service is growing in kind but is 
currently limited. The WCF would provide enhanced wireless service not only for existing and 
future residents in the area, but for first responders as well. Finally, the effort to stealth the tower 
as a monopine would minimize the visual impact to the surrounding area.

Recommendation:
19.
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve SU250006 subject to the following conditions ‘a’ – ‘j’:
a.
Development of the site shall be in substantial conformance with the Site Plan entitled 
“AZL01701 Lower River Ranch,” consisting of 7 full-size sheets, dated April 14, 2025, and 
stamped received April 17, 2025, except as modified by the following conditions. Staff 
may determine slight refinements to remain in substantial conformance with the approved 
site plan.  Minor and major amendments to the site plan will be determined in accordance 
with Chapter 3 of the Maricopa County Zoning Ordinance.
b.
Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Narrative Report SU250006”, consisting of 7 pages, stamped received May 30, 
2025, except as modified by the following conditions.
c.
The following Planning Engineering conditions shall apply:
1.
Work in the Lower River Road Right-of-Way requires a permit from MCDOT, issued 
through Planning and Development concurrently with the Building Permit.

2.
Culvert design within MCDOT Right-of-Way must conform to RDM Section 4.7.5.
3.
The proposed construction appears to meet the requirements of the Maricopa 
County Zoning Ordinance Section 1205.7.7 and as such a site plan showing the 
scope of construction is required for building permit issuance.
4.
The applicant must execute a Wireless Agreement with MCDOT for all equipment, 
conduit, F/O and other work that will be within the MCDOT ROW. This agreement 
must be coordinated with Ms. Kelly Roy, MCDOT Utility Branch Coordination 
Manager, 602-506-8603or Kelly.Roy@maricopa.gov.
5.
The strip of land directly north of Lower River Road is within the jurisdiction of the 
City of Buckeye. The applicant is responsible for coordinating with the City to 
review any permitting requirements for work within their jurisdiction.
6.
Engineering review of planning and/or zoning cases is for conceptual design only. 
All development and engineering design shall be in conformance with Section 
1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; 
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; 
and current engineering policies, standards and best practices at the time of 
application for construction.
7.
Based on the conceptual design nature of the information submitted, changes to 
the site layout may be necessitated by the final engineering design of the drainage 
infrastructure.
8.
Detailed Grading and Drainage (Infrastructure) Plans must be submitted with the 
application for Building Permits.
d.
The maximum height of the Wireless Communication Facility shall be limited to 85’.
e.
A Minor Amendment shall be required to co-locate future carriers on the Wireless 
Communication Facility.
f.
The wireless communication tower shall retain the stealth properties as originally 
designed. Any damaged or missing fronds or branches shall be replaced within 60 days 
of such damage occurring.
g.
This special use permit is valid for a period of 30 years and shall expire on July 23, 2055, 
or upon termination of the use for a period of 90 or more days, whichever occurs first. All 
site improvements associated with the special use permit shall be removed within 90 days 
of such expiration or termination of use.
h.
The following SUP standards shall apply:

i.
Noncompliance with any of the conditions assigned to the approval of this Special Use 
Permit by the Maricopa County Board of Supervisors may be grounds for revocation in 
accordance with the requirements and procedures as set forth in the Maricopa County 
Zoning Ordinance.
j.
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions. In the event of the failure to comply with any condition, and at the 
time of expiration of the Special Use Permit, the property may be considered for revocation 
to the zoning that existed on the date of application.  It is, therefore, stipulated and agreed 
that either revocation due to the failure to comply with any conditions, or the expiration of 
the Special Use Permit, does not reduce any rights that existed on the date of application 
to use, divide, sell or possess the property and that there would be no diminution in value 
of the property from the value it held on the date of application due to such revocation or 
expiration of the Special Use Permit.  The Special Use Permit enhances the value of the 
property above its value as of the date the Special Use Permit is granted and reverting to 
the prior zoning results in the same value of the property as if the Special Use Permit had 
never been granted.

ALL WORK PERFORMED AND MATERIALS INSTALLED SHALL BE IN STRICT
ACCORDANCE WITH ALL APPLICABLE CODES, REGULATIONS AND ORDINANCES.
CONTRACTOR SHALL GIVE ALL NOTICES AND COMPLY WITH ALL LAWS, ORDINANCES,
RULES, REGULATIONS AND LAWFUL ORDERS OF ANY PUBLIC  AUTHORITY REGARDING
THE PERFORMANCE OF THE WORK. MECHANICAL AND ELECTRICAL SYSTEMS SHALL BE
INSTALLED IN ACCORDANCE WITH ALL APPLICABLE MUNICIPAL AND UTILITY COMPANY
SPECIFICATIONS, AND LOCAL AND STATE JURISDICTIONAL CODES, ORDINANCES AND
APPLICABLE REGULATIONS.

THE GENERAL CONTRACTOR SHALL SUPERVISE AND DIRECT THE WORK, USING THE
BEST SKILLS AND ATTENTION. THE CONTRACTOR SHALL BE SOLELY  RESPONSIBLE FOR
ALL CONSTRUCTION MEANS, METHODS, TECHNIQUES, SEQUENCES AND PROCEDURES
AND FOR COORDINATING ALL PORTIONS OF  THE WORK UNDER THE CONTRACT
INCLUDING CONTACT AND COORDINATION WITH THE IMPLEMENTATION ENGINEER AND
WITH THE LANDLORD'S  AUTHORIZED REPRESENTATIVE.

SEAL PENETRATIONS THROUGH FIRE RATED AREAS WITH U.L. LISTED AND FIRE CODE
APPROVED MATERIALS.
9.
PROVIDE A PORTABLE FIRE EXTINGUISHER WITH A RATING OF NOT LESS THAN 2-A OR
2-A10BC WITHIN 75 FEET TRAVEL DISTANCE TO ALL PORTIONS OF THE PROJECT AREA
DURING CONSTRUCTION.
10. DETAILS ARE INTENDED TO SHOW END RESULT OF DESIGN. MINOR MODIFICATIONS
MAY BE REQUIRED TO SUIT JOB DIMENSIONS OR CONDITIONS, AND SUCH
MODIFICATIONS SHALL BE INCLUDED AS PART OF THE WORK.
11. REPRESENTATIONS OF TRUE NORTH, OTHER THAN THOSE FOUND ON THE PLOT OF
SURVEY DRAWING (SHEET LS1 OR SHEET C-1), SHALL NOT BE USED TO  IDENTIFY OR
ESTABLISH THE BEARING OF TRUE NORTH AT THE SITE. THE CONTRACTOR SHALL RELY
SOLELY ON THE PLOT OF SURVEY DRAWING AND  ANY SURVEYOR'S MARKINGS AT THE
SITE FOR THE ESTABLISHMENT OF TRUE NORTH, AND SHALL NOTIFY THE ENGINEER
PRIOR TO  PROCEEDING WITH THE WORK IF ANY DISCREPANCY IS FOUND BETWEEN
THE VARIOUS ELEMENTS OF THE WORKING DRAWINGS AND THE TRUE NORTH
ORIENTATION AS DEPICTED ON THE CIVIL SURVEY. THE CONTRACTOR SHALL ASSUME
SOLE LIABILITY FOR ANY FAILURE TO NOTIFY THE ENGINEER.
12. THE CONTRACTOR SHALL MAKE NECESSARY PROVISIONS TO PROTECT EXISTING
IMPROVEMENTS, PAVING, CURBS, VEGETATION, GALVANIZED SURFACES, ETC., AND
UPON COMPLETION OF WORK REPAIR ANY DAMAGE THAT OCCURRED DURING
CONSTRUCTION TO THE SATISFACTION OF AT&T.
13. KEEP GENERAL AREA CLEAN, HAZARD FREE, AND DISPOSE OF ALL DIRT, DEBRIS,
RUBBISH AND REMOVE EQUIPMENT NOT SPECIFIED AS REMAINING  ON THE PROPERTY.
LEAVE PREMISES IN CLEAN CONDITION AND FREE FROM PAINT SPOTS, DUST OR
SMUDGES OF ANY NATURE.
14. PENETRATIONS OF ROOF MEMBRANES SHALL BE PATCHED/FLASHED AND MADE
WATERTIGHT USING LIKE MATERIALS IN ACCORDANCE WITH NRCA ROOFING
STANDARDS AND DETAILS. CONTRACTOR SHALL OBTAIN DETAILING CLARIFICATION
FOR SITE-SPECIFIC CONDITIONS FROM ENGINEER,  IF NECESSARY, BEFORE
PROCEEDING.
15. BEFORE ORDERING AND/OR BEFORE FABRICATING/CONSTRUCTING/INSTALLING ANY
ITEMS, VERIFY THE TYPES AND QUANTITIES.
16. CONTRACTOR SHALL PROVIDE SITE FOREMAN WITH A CELLULAR PHONE AND PAGER,
AND KEEP SAME ON SITE WHENEVER PERSONNEL ARE ON SITE.
17. THE CONTRACTOR SHALL VERIFY ALL DIMENSIONS AND CONDITIONS ON THE SITE AND
NOTIFY THE PROJECT MANAGER OF ANY DISCREPANCIES BEFORE STARTING ANY
WORK.
18. CONTRACTOR TO PROVIDE COMPLETE SET OF AS BUILT DRAWINGS WITHIN 10
WORKING DAYS OF PROJECT COMPLETION.
19. CONTRACTOR IS TO EXCAVATE 6" BELOW EXISTING GRADE AND SPRAY WITH WEED
CONTROL. REPLACE WITH CLASS II AGGREGATE BASE AND CRUSHED WASHED ROCK.
AS SPECIFIED ON SITE PLAN.
20. CONTRACTOR SHALL PROVIDE TOILET FACILITY DURING ALL PHASES OF
CONSTRUCTION.
21. PRIOR TO THE COMMENCEMENT OF CONSTRUCTION OR THE FABRICATION OF
MATERIALS TO BE INSTALLED AT THE SITE, THE CONTRACTOR SHALL FIELD VERIFY ALL

Site Locaon: Approx. 1,060' north and 150' west of the NWC of Lower River Road and 
Bruner Road in the Buckeye Area

PURPOSE OF REQUEST 
New Cingular Wireless PCS, LLC (aka AT&T) is looking to build a new Stealth Tower to 
provide cellular coverage in this  area for residents, workers and First Responders. 
DESCRIPTION OF PROPOSAL 
This modifica
n consists of: 
Constructing a new Monobroadleaf Stealth tower.  The tower will be 85' tall not including 
stealth features.  The max diameter of the tower will be 18' not including stealth features. 
The tower will be setback >98' from the south lot line to the antenna array circumference 
line; >149' from the east lot line to the antenna array circumference line.   These proposed 
development standards require variation from those established in MCZO Article 
1102.3.1.1, which regulates WCFs in the Rural-43 zoning district. The additional height was 
requested by the RF engineer as this is a rural area and he is looking to maximize his 
coverage objective.  The setback requirements were not able to be met as the location 
selected minimizes possible future developments on the property for the landowner.  The 
diameter of the site is needed to meet the requirements of modern communications 
equipment.  The ground equipment will be located in a 40' x 40' compound surrounded by a 
CMU Wall. This will be an unmanned facility..

Current use of the property:   
Current use of property is a 5.2 acre parcel without buildings for farming operations. 
Following the initial placement of the tower mounted equipment, there will be minimal. 
operations, employees on site. The site is unmanned, and vehicular traffic is minimal. No 
traffic plan would be required.  
RELATIONSHIP TO SURROUNDING PROPERTIES  
Properties surrounding the parcel are zoned as follows: 
West Parcel: Zoning = RU-43 
East Parcel: Zoning = RU-43 
South Parcel: Zoning = RU-43 
North Parcel: Zoning = RU-43 
The surrounding area is sparsely populated / developed and predominantly used for 
agriculture.  The property to the south is currently under the same ownership as the subject 
parcel, which effectively negates the impact of the reduced setback.  Stealthing the tower 
into a monobroadleaf, effectively blending it in with the surrounding vegetation, will limit its 
visual impact on surrounding properties. 
DEVELOPMENT SCHEDULE 
Construction of the site will take 45-60 days. 
COMMUNITY FACILITIES & SERVICES 
The elementary school district for the area is Palo Verde Elementary School District and the 
high school district is Buckeye Union High School District. The nearest school is Palo Verde 
Elementary School which is approx. 2 miles away. 
PUBLIC UTILITIES & SERVICE 
The providers of fire protection for the area are the Arizona Fire & Medical Authority & The 
Buckeye Valley Fire District.   Police protection is provided by the Maricopa County Sheriff’s 
Office. The property is served by a well and septic, but that the WCF will not be requiring 
either water or wastewater services.  Power for the facility will be provided by APS. 
LOCATION AND ACCESSIBILITY

The driveway entrance for the property is located on the north side of Lower River Road, 
approx. 660’ west of Bruner Road. From here, construction and maintenance crews will 
follow an existing easement north toward the subject property. Approximately 1,000’ north 
of Lower River Road, crews will turn east on to a new 12’-wide non-exclusive access and 
utility easement, which will provide access to the WCF compound toward the east end of 
the property. A hammerhead turnaround will be provided at the end of the new easement, 
with the access gate to the WCF compound alongside the north end of the hammerhead. 
Access from Lower River Road, along both the existing and the new easement, will be 
improved with a 20’-wide ABC surface. 
Some of these access improvements will require work within the MCDOT-maintained right-
of-way for Lower River Road, as well as within a small strip of City of Buckeye jurisdiction 
parallel to the road. The applicant will coordinate with MCDOT and with Buckeye to review 
any permitting requirements within their respective jurisdictions. 
CLOSING  
The Citizens of this area will not be unduly affected by the addition of this wireless  
facility, and will benefit by the improved dependability, coverage, and high-quality  
wireless communications for personal, business and emergency use. AT&T is committed

Engineering Review has reviewed the first plan and report routed for review on 
02/04/2025, for the subject application and has no objections, subject to the following

DRAINAGE PLAN REVIEW  
 
1. Work in the Lower River Road Right-of-Way requires a permit from MCDOT, 
issued through Planning and Development concurrently with the Building 
Permit. 
 
2. Culvert design within MCDOT Right-of-Way must conform to RDM Section 
4.7.5. 
 
3. The proposed construction appears to meet the requirements of the Maricopa 
County Zoning Ordinance Section 1205.7.7 and as such a site plan showing 
the scope of construction is required for building permit issuance. 
 
4. The applicant must execute a Wireless Agreement with MCDOT for all 
equipment, conduit, F/O and other work that will be within the MCDOT ROW. 
This agreement must be coordinated with Ms. Kelly Roy, MCDOT Utility Branch 
Coordination Manager, 602-506-8603or Kelly.Roy@maricopa.gov.  
 
5. The strip of land directly north of Lower River Road is within the jurisdiction of 
the City of Buckeye. The applicant is responsible for coordinating with the City 
to review any permitting requirements for work within their jurisdiction. 
 
6. Engineering review of planning and/or zoning cases is for conceptual design 
only. All development and engineering design shall be in conformance with 
Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and 
Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway 
Design Manual; and current engineering policies, standards and best practices 
at the time of application for construction.
