The applicant is requesting a modification of conditions ‘a’ and ‘b’ relating to the site plan and narrative respectively for an existing SUP, case number SU240010, for an RV storage facility on a Rural-43 zoned parcel located in an area by the Agua Fria River. This modification is to add more RV parking spaces to the site in addition to creating a cross-access easement and gate between the subject site and the adjacent parcel to the east, which is being entitled separately under SU240027. This would allow for a singular cohesive RV/boat storage facility between the two parcels. Both this case and SU240027 are scheduled to be heard on the same Planning and Zoning Commission and Board of Supervisors agendas as of this writing. 2. The area has developed as a quasi-industrial area with the neighborhood surrounded by aggregate mining activity within the river. There are multiple entitled vehicle storage facilities in the vicinity. This includes a facility bordering the property to the west which was entitled under Z2021096. The site is located within the White Tank Grand Avenue Area Plan with a land use designation of Open Space. The subject facility will now accommodate 63 parking stalls as compared to 48 spaces on the approved plan with two ADA spaces with concrete and asphalt paving. The existing single-family residence will not be part of the facility. Entrance to the site would be provided via a keypad system. The site will be operated by two employees on weekdays from 8:00 am to 5:00 pm and be screened by 6’ CMU walls with a singular steel gate at the front of the property along Harmony Ln. 3. The applicant is not requesting any deviations from the existing Rural-43 zoning standards beyond the SUP request for RV storage. Plan Peoria AZ – Rural Residential (adopted 2020): The Rural Residential designation identifies areas of large‐lot residential development in areas with a semi‐rural or agricultural character. SU250011 Page 6 of 8 Most rural residential areas were developed prior to annexation into the city, or during the early years of city development and expansion starting in the late 1980s. These areas developed organically in smaller tracts of land. They highlight the City’s growth over the years and are a reminder of our agricultural past. They may have alternative or reduced streetscape standards in recognition of the desired character. In some areas, the land uses are predominantly agricultural and occupy large areas for the raising of crops, fowl and/or livestock. Public Participation Summary: 9. The applicant complied with the Maricopa County public participation process with the required posting of the property and the notification to the adjacent property owners within 300’ of the subject site. The applicant did not receive a response from their public outreach efforts. Staff has not received any notice of opposition or support to the request. Outstanding Concerns from Reviewing Agencies: 10. N/A. Staff Analysis: 11. Staff supports this proposal as the changes within the site plan and narrative per conditions ‘a’ and ‘b’ allow for a single cohesive facility between it and its sister parcel. The territory within the river terraces will not experience residential subdivision development. It will continue to experience these types of interim commercial/industrial uses until the surrounding mining/extraction activity runs its lifespan over the next decades and ultimately transitions to recreational and natural open space. Staff believes the addition of parking spaces does not provide a negative impact to site operations. Recommendation: 12. Staff recommends the Commission adopt a motion recommending that the Board of Supervisors SU250011 subject to the following conditions ‘a’ – ‘h’: a. Development of the site shall be in substantial conformance with the Site Plan entitled “Harmony Ln Residence“, consisting of 1 full-size sheet, dated March 3, 2025, except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. b. Development of the site shall be in substantial conformance with the narrative report entitled “Ruff Diamond Storage – SU250011”, consisting of 4 pages, dated May 16, 2025, except as modified by the following conditions. c. This special use permit is valid for a period of 25 years and shall expire on February 12, 2050, or upon termination of the use for a period of 90 or more days, whichever occurs first. All site improvements associated with the special use permit shall be removed within 90 days of such expiration or termination of use. d. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed SU250011 Page 7 of 8 in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. e. The following Planning Engineering conditions shall apply: 1. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 2. Condition Detailed Grading and Drainage Plans must be submitted with the application for Building Permits. 3. For sites located within the County’s Urbanized Area, a Storm Water Pollution Prevention Permit (SWPPP) from the County will be required prior to issuance of any construction permits. This does NOT preclude the requirement to obtain a Notice of Intent to Discharge (NOID) from the State (ADEQ), as may be required. 4. Retention basins with stormwater depths exceeding one foot shall provide one foot of freeboard. 5. All retention basins shall drain within 36 hours per County requirements. f. Noncompliance with any of the conditions assigned to the approval of this Special Use Permit by the Maricopa County Board of Supervisors may be grounds for revocation in accordance with the requirements and procedures as set forth in the Maricopa County Zoning Ordinance. g. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. h. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the Special Use Permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. The original SUP approval was approved using an old version of the site plan, which showed 48 spaces available. The correct site plan should show 63 spaces including two ADA spaces. This amendment aims to provide access from the existing RV Storage facility into the expansion located on the lot immediately to the east APN 503-67-935, as well as correct the number of spaces available. There is currently an open SUP case # SU240027. Description of Proposal The proposed use of the cross access for ingress/egress/regress will be solely for tenants to pass through the driveway joining the two properties to access RVs being stored on the adjoining lot. To enhance durability and ensure long-term performance, the new driveway will be constructed from asphalt milling bound and compacted using a liquid emulsifier. This material selection provides a robust surface capable of supporting the weight and frequency of RV traffic. Relationship to Surrounding Properties To the left of the property lies a junkyard, while an existing RV parking area is situated to the right. The surrounding properties are zoned for similar storage uses, which aligns with the proposed RV parking area. The establishment of this designated RV parking will not only create a structured and secure storage option but also improve the neighborhood's visual appeal, particularly compared to the current empty lot adjacent to the junkyard. This development holds the potential to increase property values in the vicinity. Recent trends in the area have shown approvals for similar storage and parking facilities, indicating community support for developments of this nature. Location and Accessibility The site is located within an unincorporated county “island” with active gravel mines on the North and South operated by CalPortland and Vulcan Materials. The parcels located within this county island are mixed in use and currently 12 of the 33 parcels have more than 20 vehicles stored on the property or appear to be junkyards, and 2 parcels are being used for business. The property is easily accessible from Tessmer Rd and 107th Ave where there is a traffic control light allowing a safe traffic flow into and out of the neighborhood. There is a 4 way stop at Tessmer and Rose Garden Ln to further help facilitate safe entrance and exit from the neighborhood. Major roadways within 2 miles of the site are Deer Valley Rd, Happy Valley Rd, 107th Ave and Beardsley Rd. Loop 303 is also easily accessible which allows people from Crossriver, Sun City West, Corte Bella and communities in Vistancia easy access to the facility. There are only 3 residential homes (one of them being our son’s) that people would need to drive past within the neighborhood in order to access the facility. Lake Pleasant Towne Center is located 3.5 miles from the facility. There are retail stores, grocery stores, medical facilities, banks, gas stations and Pharmacies all located within the shopping area at Lake Pleasant Rd and Happy Valley Rd, which is 3.5 miles from the facility. There is a Quik Trip on Happy Valley Rd and 115th Ave which is less than 3 miles from the site. The property benefits from accessibility via major roads and is conveniently located near public transportation routes, making it easy for residents and visitors to reach. Essential services and amenities, including shopping centers and healthcare facilities, are also in close proximity. Circulation System On-site circulation will be facilitated by a defined driveway and the designated RV parking area, ensuring smooth ingress and egress. The existing road infrastructure is adequate to support the property, and no significant off-site improvements are deemed necessary. Development Schedule The development will proceed in a single phase, with an estimated timeline for completion of 4 weeks from the start of construction. Community Facilities and Services Although Sun City, Arizona, does not have its own school district, it is served by the Peoria Unified School District. Residents will have access to nearby parks and recreational facilities, alongside community amenities such as shopping centers, healthcare facilities, and public libraries. Public Utilities and Services Refuse collection in the area is managed by private companies, with Parks and Sons being the most popular provider. The property will likely utilize their services for waste management. Regarding sewage and water, the residential home operates on a septic system, and the RV parking area does not currently include sewage disposal measures. The expansion area will have a septic vault for RV Storage tenants to utilize.
