The applicant is proposing a zone change with overlay from Rural-43 to IND-2 IUPD over an 8.86- acre area currently consisting of five parcels at the southwest corner of Happy Valley Rd and 7th Ave north of the Deer Valley Airport. The site is currently subject to a violation, V202301538, regarding unpermitted construction and land usage without proper zoning entitlement. No Plan of Development (POD) has been proposed with this application. A POD will be required prior to construction permitting to resolve the zoning violation. 2. Much of the area north of the Deer Valley Airport has developed via unregulated land divisions with industrial uses such as storage/contractor’s yards. A number of industrial uses have developed in the Rural-43 zoning and have become subject of zoning violations. There have been five industrial rezonings approved for such uses since 2019. Staff broadly agrees that this area is appropriate for industrial uses given its proximity to the airport, the TSMC development, and its designation for industrial uses within the City of Phoenix General Plan. 3. Indeed, this application is the second application regarding a Marrs headquarters or complex within this area, with the first being located 1,700’ southwest at the corner of 11th Ave. and Alameda Rd. That project, Z2021037, was approved by the Board of Supervisors in 2022 and is in operation today. The operations for both sites seem to be similar (the subject site is currently operational as per the violation and site aerials). The applicant intends on using the existing buildings on site for offices, but otherwise would continue storage of construction material and commercial vehicles along with implementing minor yard improvements. The office would have a daily on-site staff of up to six employees and would maintain standard business hours of 8:00 am to 5:00 pm. There is no anticipated customer traffic beyond employees of the Marrs business. 4. Few changes are being proposed as part of the IUPD. These requests primarily have to do with cementing certain aspects of the current site usage as part of the zoning. The most notable request relates to screening, both in terms of fencing and landscaping. First, the applicant is requesting that instead of 6’ CMU as required by MCZO 902.9.3, that they utilize the existing 6’ opaque fencing along the south side of the property; second, that landscaping not be required in front and street yard setbacks. The justification for these requests both have to do with the industrial nature of the area and the existing zoning pattern. While it is true that there remain Rural-43 homesteads in this Section and adjacent to the subject properties, it is clear the future of this area is that of an industrial nature. Many of these homesteads themselves have been subsumed by quasi-industrial uses. Finally, there are requests relating to parking surface material and commercial storage in required yards – the applicant wishes to retain the current storage areas within the setbacks, and to utilize compacted asphalt millings in lieu of paving the entirety of the site. The following table contrasts the base zoning and proposed changes – all other zoning is presumed to be base IND-2. The applicant is ultimately responsible for coordination with Phoenix regarding these roads prior to the approval of building permits with Maricopa County. Adopted Plan: 8. City of Phoenix General Plan 2025 - Industrial (adopted 2025): The industrial land use category allows warehousing, manufacturing, and processing businesses. These categories are typically characterized as development that due to noise, smell, or some other special considerations are not appropriate for a commerce park. Staff believes the proposed usage fits this designation. Public Participation Summary: 9. The applicant completed the requirements for notifying all property owners within 300-feet of the site and area stakeholders. During the required public participation process neither staff nor the applicant received public comments. Outstanding Concerns from Reviewing Agencies: 10. N/A Staff Analysis: 11. Staff believes the proposed industrial zoning is appropriate. This area has and will continue to develop for industrial uses. The proposed zoning is consistent with the City of Phoenix General Plan designation of Industrial for this area. Recommendation: 12. Staff recommends the Commission adopt a motion recommending that the Board of Supervisors approve Z240021 subject to the following conditions ‘a’ – ‘j’: Z240021 Page 5 of 6 a. Development of the site shall be in substantial conformance with the Site Plan entitled “705, 711, 811, 825 W Happy Valley Rd“, consisting of 1 full-size sheets, dated March 1, 2025, except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. b. Development of the site shall be in substantial conformance with the narrative report entitled “Narrative Report“, consisting of 6 full-size sheets, dated March 10, 2025 except as modified by the following conditions. c. The following Planning Engineering conditions shall apply: 1. Without the submittal of a precise plan of development, no development approval is inferred by this review, including, but not limited to number of proposed building lots/units, drainage design, access and roadway alignments. These items will be addressed as development plans progress and are submitted to the County for further review and/or entitlement. 2. A Traffic Study/Statement must be submitted with future entitlement (POD) application(s). See following link to MCDOT Traffic Impact Manual. (RDM 7.1.4) https://www.maricopa.gov/DocumentCenter/View/303 3. There are Federal Patent Easements within the parcel. No encroachments are allowed within the area unless abandoned. Applicant must contact MCDOT for further interest in the Patent Easement Abandonment Process. 4. The above comments do not include identification of utilities or underground facilities within or adjacent to the required right-of-way that may have prior rights and/or require relocation. 5. Happy Valley Road and 7th Avenue are within the jurisdiction of the City of Phoenix. The applicant will be responsible for coordinating with the City to review any traffic impact, right-of-way dedication, permitting or roadway improvement requirements. 6. Engineering review of re-zone cases is conceptual in nature. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. d. Commercial building permits are required for any building on-site which have been prior approved for a residential occupancy. Any existing residence on parcel that is a manufactured building must have such an occupancy change processed through Arizona Department of Housing. e. The IUPD overlay is applied to restrict the use of the site. Until such time as the site is served by sewer, uses on the site shall only be those acceptable to the Maricopa County Environmental Services Department (MCESD) that can be accommodated by septic systems. A public water system and public sewer system shall be required prior to establishment of any non-residential use that requires potable water. g. Administrative approval of a Plan of Development will be required prior to approval and issuance of construction permits to develop and establish use of the site. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. h. Noncompliance with any of the conditions assigned to the approval of this Zone Change by the Maricopa County Board of Supervisors may be grounds for revocation in accordance with the requirements and procedures as set forth in the Maricopa County Zoning Ordinance. i. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. j. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property may be considered for revocation to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. Box 8391 Sco2sdale, AZ 85252 (480) 290-2833 clark@hawkeyedevelop.com cc: Rm@hawkeyedevelop.com Project Introduc2on & Background The purpose of this request is to apply for the Maricopa County Rezone with Overlay process to change an existing RU-43 (Rural Zoning District-One Acre per Dwelling Unit) 8.86-acre property to IND-2 IUPD (Light Industrial with overlay) to allow for all uses under MCZO section 902, but restricting multifamily uses. This Rezoning would be more in keeping with the other surrounding property uses and aligns with the Owner’s intended use of the property, that of a light industrial use. Per Article 902.2 of the Maricopa County Zoning Ordinance (MCZO) the use would most closely resemble item: The proposed current use of the property as an office building with storage of construction equipment and vehicles are allowed uses in the IND-2 zoning district, as per Articles 901.2.11 and 902.2.7 of the Zoning Ordinance. The IUPD zoning on this site shall prohibit any kind of multi-family/high-density residential uses. Description of Proposal We are proposing to re-use all the existing buildings and infrastructure that’s already at the site. Currently on 711 W Happy Valley Rd, there is one pre-existing 2,038 SF office and one 1,139 shop building for Marrs Construction Inc., as well as minor yard improvements (described below) needed for commercial vehicle parking and short-term storage. The company purpose is described on their home web page: “Marrs Construction Inc., a Phoenix construction company, provides grading, excavation, and civil services for both residential and commercial projects all over Arizona. We are one of the few companies that provide grading, excavation, as well as site preparation in Phoenix”. The corporate office is intended for 5-6 staff occupancy with a remote staff of 57 who will visit the office from time to time. Anticipated public interaction with the facilities – 10% clients, 90% remote staff. Company trucks from project work will be parked on site along with heavy construction equipment. Standard commercial business hours of operation are anticipated: 5-6 days/week from 8am-5pm. Traffic on N 7th Ave would include trips from office staff, remote staff, and trips by trailers. Miscellaneous additional traffic is anticipated to be no more than 10 trips per day. No other non-permeable surface is being constructed or added to the site, so the storm water drainage should be unaffected. Currently on 825 W Happy Valley Rd, there is one pre-existing 2,450 SF office and one 718 SF storage building as well as minor yard improvements (described below) needed for a future landscaping supply company. The main office is intended for 2-3 staff occupancy. Anticipated public interaction with the facilities – 90% customers, 10% staff. Standard commercial business hours of operation are anticipated: 5-6 days/week from 8am-5pm. Traffic on W. Happy Valley Rd. and N 9th Ave. would include trips by these customers. No other non-permeable surface is being constructed or added to the site, so the storm water drainage will be unaffected. IUPD Overlay The Overlay qualifier is needed to address several varied development standards. Varied development standards including: 1. Article 902.9-3. b. A solid masonry wall not less than six feet in height shall be required along and adjacent to any side or rear property line abutting any rural or residential zone boundary, or any alley abutting such zone boundary. Further, any access gates shall be constructed of view-obscuring material to provide effective site screening. We request that the pre-finished 6 ft high opaque fencing be acceptable in lieu of the masonry wall along the south side of the property. The current neighboring industrial type uses surrounding the property, although RU-43 zoned, don’t warrant the type of screening called for in the ordinance. 2. Parking Surface Material: All uses other than a single-family residence required paved parking. Asphalt millings alone is not considered paving because it is not cohesive to withstand erosion. If water were to flow across millings, they would be displaced and maintenance would be required to restore its uniformity, where with paving, no maintenance would be required. We request that compacted GSA material (asphalt millings) with a petroleum-based stabilizer be accepted as an alternate paving material in locations as depicted on site plan paving legend. It has a proven record in many applications to stabilize and solidify any soil or aggregate as well as provide erosion control and dust suppression. We request this alternate paving noting that sufficient conventional asphalt paving addressing all traffic and yard areas is cost prohibitive as a first cost item and is an expensive ongoing maintenance item. Also, the heavier equipment loading over long durations will lead to premature failure of asphalt paving; it is more cost effective to reinstall compacted GSA material and apply stabilizer where needed. 3. No storage allowed in Front or street side required yards Additionally, due to the site's unique configuration and existing access points, relocating storage away from these areas would create operational inefficiencies and require unnecessary site modifications. 4. Landscaping required in front and street yards The natural landscape buffer already present due to the site’s topography serves the intended purpose of the ordinance by providing visual screening and maintaining the character of the area. Additionally, introducing new landscaping would be impractical due to site constraints, ongoing industrial operations, and maintenance challenges. Furthermore, preserving the existing natural buffer aligns with sustainable development practices by minimizing unnecessary land disturbance and irrigation requirements. Relationship to Surrounding Properties This parcel currently lies in a neighborhood of light industrial uses and vacant undeveloped parcels with a variety of zoning designations. To the immediate north on the other side of W Happy Valley Rd is a property zoned RU-43 in Maricopa County’s jurisdiction but is being used as the headquarters of a landscaping company with outdoor storage of various equipment, rock aggregate, and other materials (unscreened). To the east is an A-1 zoned, Light Industrial property in the city of Phoenix’s jurisdiction. It is being developed into a battery storage facility for electric vehicles. To the south is a property zoned RU-43 in Maricopa County’s Jurisdiction and is being used as horse property, outdoor storage, and a construction yard. To the west on the west side of N 9th Ave, the property zoned RU-43 in Maricopa County’s jurisdiction, is currently being used as a truck/trailer storage yard. The intended use of this property is compatible with the surrounding uses. It’s generation of minimal additional traffic on the N 7th Ave to the east & N 9th Ave to the West, and will have an insignificant impact in the neighborhood. The office and storage use will not generate an unusual amount of noise disturbance nor obnoxious odors, in comparison to the adjacent uses, nor will it adversely affect the public health, safety and general welfare. Location and Accessibility Parcels 210-08-003A, 210-08-003B, 210-08-015D, 210-08-015C, 210-08-015B are located on the Southwest Corner of West Happy Valley Road & North 7th Avenue, Phoenix, AZ 85085. The closest major road is West Happy Valley Road to the north, designated a major arterial. This location is approximately 2 miles East of the I-17 Highway & Happy Valley Road interchange and 6 miles north of the I-17 & Arizona State Route 101, strategically convenient for conducting business in the county and the state. Circulation System As described above the off-site circulation is along W. Happy Valley Rd. to the North, East along N. 7th Ave, and west along N 9th Ave. The access to the property along the East & West sides of the parcels along North 7th Ave & North 9th Ave respectively, will be surfaced with compacted GSA material with petroleum-based stabilizer which meets the County intent for paving. This same GSA material with stabilizer is used throughout the yard maintaining an erosion proof, uniform, cohesive surface in equipment parking areas and circulation paths. The outdoor yard space areas are also finished with compacted GSA material with petroleum-based stabilizer material. While this parking area is primarily for smaller vehicles it is designed to allow for larger vehicles to access throughout. Staff parking will be located immediately north and east of the 2,038 SF building office building on 711 W Happy Valley Rd, and located immediately northwest of the 2,450 SF building office building on 825 W Happy Valley Rd. Given the current site layout, the area is large enough to allow both Marrs large equipment and emergency vehicles to complete a return loop to the pre-existing driveway along either side of the properties (along N 7th Ave & N 9th Ave). Fencing between the properties will be removed for site circulation Development Schedule No major development or construction will be done for this project. Community Facilities and Services The area northwest of the I-17 and State Route 101 is served by the Deer Valley Unified School district, the school campuses being west of the I-17 and north of the 101. The Northeast campus for West-MEC (Western Maricopa Education Center) is approximately a mile to the southwest. A regional, small craft, public airport lies due south of this property: Phoenix Deer Valley Airport. A vibrant commercial district exists immediately east of the I-17 and Happy Valley Road interchange, comprised of the Happy Valley Towne Center and the Shops at Norterra. To the south, at the I-17 and 101 interchange is Deer Valley Medical Center. Public parks in this north portion of the City of Phoenix include the Phoenix Sonoran Preserve some 2 miles to the north and Cave Buttes Recreation Area approximately 1.5 miles to the east. Public Utilities and Services The Utility Providers in this area are: • Electric: APS is the local provider. The property is already connected with power, and we are proposing to reuse the pre-existing service. • Water and Sewer: the City of Phoenix is the water and sewer provider for this area. There is a water and sewer main in N. 7th Ave. The property is currently being served by a private well and septic system. We are proposing to reuse those services. • Gas: though Southwest Gas is the local provider, there is no service to the site. • Fire Protection: this parcel is not within City of Phoenix jurisdiction, nor is it served by Daisy Mountain Fire District. Services however would be provided by nearest Phoenix fire station, most likely station 36 to the south. Will Serve letter to be provided. • Police Protection: though this parcel is not within City of Phoenix jurisdiction.
