Project Summary: 
 
1. 
The applicant is proposing a Zone Change Modification of Conditions for the previously rezoned 
site at the northwest corner of 7th Ave. and Desert Hills Dr. located at the southeast boundary of 
Anthem. Under the proposal, the site will retain its Rural-43 RUPD designation with several 
modifications to the original conditions to both modernize certain conditions and remove the 
equestrian element requirements. A new subdivision plat has also been filed under case S240006 
to reflect the changes proposed by this application. The site was originally rezoned in March of 
2008 under zone change case Z2006107 and preliminary subdivision plat case S2006057.Due to 
the 2008 financial crisis a few months later, the site never developed.

The site was known as Desert Hills Equestrian Estates and as implied by its name, consisted of 
rural estates with a focus on equestrian activities befitting of the Desert Hills community 
surrounding Anthem to its south and east. The largest change to the site is the removal of an 
equestrian center along Desert Hills Dr. that was intended as a community gathering point for 
such activities. As it did then, the community is partially intended as a buffer between the more 
intensive residential development of Anthem and the rest of Desert Hills, which still primarily 
consists of such rural estates. Indeed, it is Anthem Unit 52, the last part of the Anthem 
Development Master Plan to be developed. Despite this designation, it is separated from Anthem 
itself by the Skunk Creek wash. The site, as proposed then and now, will lack direct access to 
Anthem’s internal road network. No additional lots are proposed by this application.

The primary goal of the request is to remove any mandate for the equestrian elements from the 
Rural-43 RUPD zoning district for Cadora Desert Hills (fka Desert Hills Equestrian Estates). The 
conditions of approval for the current Rural-43 RUPD per Z2006107 are attached to this report. A 
new set of conditions to govern the amended Rural-43 RUPD are listed with staff’s 
recommendation.

Staff would note several aspects of the Rural-43 zoning district have been liberalized since 2008. 
The primary change relates to the allowed lot coverage, which was approved at 20% (above what 
as then allowed at 15%). This proposal brings the lot coverage into alignment with standard Rural-
43 zoning at 25% and removes the requirement of a certain distance between buildings beyond 
what is required by building code. Notably, the lot width minimum is being increased from 110’ to 
145’ which has the effect of creating lots more befitting of a rural estate. Finally, the maximum 
wall height has been increased to 8’, again in alignment with Rural-43 zoning. The following table 
contrasts the base Rural-43 zoning standards, the standards approved under the RUPD, and lastly, 
those proposed by this application.

The applicant complied with all the necessary public participation requirements according to 
MCZO Section 304, including notification of property owners within 300’ of the subject site and 
posting of the site. Registered areas of interest were contacted by the applicant and staff 
regarding the request. As of this report, staff has received two letters of opposition. The letters 
indicate concerns with being unable to access the Anthem development from Desert Hills, 
overpopulation, and traffic.

Staff is supportive of the amended Rural-43 RUPD zoning. The removal of the equestrian 
elements brings the development more in line with its position between suburban Anthem and 
semi-rural/equestrian Desert Hills. This change will not increase potential density. It will have no 
foreseeable adverse impact on adjacent communities. It’s important to note this amendment will 
still allow for an equestrian amenity to be provided with subdivision platting and/or future 
redevelopment, but it will no longer be mandated by the Rural-43 RUPD zoning district. 
 
Recommendation:

Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve Z240023 subject to the following conditions ‘a’ – ‘g’: 
 
a. 
Development of the site shall be in conformance with the narrative report entitled "Cadora 
Desert Hills", consisting of 41 pages, dated January 16, 2025, except as modified by the 
following conditions.  
 
b. 
The following Planning Engineering conditions shall apply:

1. 
Without the submittal of a precise plan of development, no development approval 
is inferred by this review, including, but not limited to number of proposed 
building lots/units, drainage design, access and roadway alignments. These 
items will be addressed as development plans progress and are submitted to the 
County for further review and/or entitlement. 
 
2. 
A traffic impact study must be submitted with future Preliminary Plat 
applications. 
 
3. 
Engineering review of re-zone cases is conceptual in nature. All development and 
engineering design shall be in conformance with Section 1205 of the Maricopa 
County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of application for 
construction. 
 
c. 
The Rural-43 RUPD zoning district for Cadora Desert Hills shall be subject to the following 
development standards:

Provide a total half-width of 65' right-of-way dedication on Desert Hills Drive with 
subdivision plat.  
2. 
Provide a total half-width of 40' right-of-way dedication on 7th Avenue with 
subdivision plat.  
3. 
Construct ultimate half-width improvements, including pavement, curb and gutter, 
to perimeter roads (7th avenue and Desert Hills Drive) with subdivision 
infrastructure permit. 
 
e. 
Major changes to the zoning exhibit and narrative report shall be processed as a revised 
application, with approval by the Board of Supervisors upon recommendation of the 
Planning and Zoning Commission. Minor changes may be administratively approved by 
the Planning and Development Department. Major changes to the project may require a 
new Citizen Participation Process as determined by the Planning and Development 
Department. 
 
f. 
Noncompliance with the conditions of approval will be treated as a violation in accordance 
with the Maricopa County Zoning Ordinance. Further, noncompliance of the conditions of 
approval may be grounds for the Planning and Zoning Commission to take action in 
accordance with Chapter 3 (Conditional Zoning). 
 
g. 
Property owner and his successors waive claim for diminution in value if the County takes 
action to rescind approval due to noncompliance with stipulations.

Purpose of Request 
 
Tiffany & Bosco, P.A. on behalf of Toll Brothers respectfully requests a Zone Change 
Modification of Conditions for the 74.05± acres, generally located at the northwest corner of 
Desert Hills Drive and 7th Avenue. The site is identified by Maricopa County (“County”) 
Assessor’s parcel numbers, 211-86-978 and 211-86-979, the (“Property”). (See Exhibit A: 
Regional Aerial and Exhibit B Context Aerial) The Property was previously rezoned from 
Rural-43 to Rural-43 RUPD in case #Z2006107 (Desert Hills Equestrian Estates), which was 
approved by the Board of Supervisors on March 12, 2008. The Property was never developed 
as previously entitled, and the prior, approved zone change was stipulated to conditions, and 
a narrative which are not applicable to this current proposal.   
 
Description of Proposal 
 
The Property is currently vacant and zoned Rural-43, RUPD, located within the Daisy 
Mountain/New River Area Plan. The Property is in the Anthem Character Area and the Anthem 
Development Master Plan, (“DMP”), within the Daisy Mountain/New River Area Plan. (See 
attached EXHIBIT C – Area Plan Land Use Map) The original zone change, #Z2006107 was 
approved as, “Desert Hill Equestrian Estates”, proposing to develop an equestrian-oriented 
residential community with 56 single-family homes including casitas, and a community 
equestrian center for its residents. This proposed residential community was never developed. 
Toll Brothers is proposing to build a similar, 56-unit, detached, single-family residential homes 
with casitas, and wishes to retain the same underlying zoning with modifications.  
 
The request proposes to entitle the 74.05± acres (gross) with a gated neighborhood of 
detached, single-family dwellings, allowing the land uses permitted in the previous zoning case, 
#Z2006107 (Desert Hills Equestrian Estates). Access will be provided from 7th Avenue and 
Desert Hills Drive. The main open space amenity is located near the entrance of the site, with 
small open spaces and buffers spread throughout the site. Other planned amenities for the 
development include a ramada, seating areas throughout the site, and direct access to the 
adjacent Maricopa County hiking trails. 
 
To accommodate the improvements as outlined above, it is anticipated that tracts and/or 
easements will be planned for as part of preparing the preliminary plat following the location of 
trails, open spaces, perimeter landscaped areas, and utilities as required by the County. The 
proposed internal local roadways will be placed in tracts to be owned and maintained by the

HOA. A submittal of subsequent preliminary plat will show the proposed ROW dedications 
being made to the County for 7th Avenue and Desert Hills Drive.  As required by the County, 
the preliminary plat will also show where any boundaries of the adjoining floodway and/or 
floodplain encroach onto the site. 
 
Requested Modification of Approved Stipulations 
 
The previous approval stipulated “Development of the site shall be in conformance with the 
narrative report entitled "Desert Hills Equestrian Estates", consisting of eighteen (18) pages, 
dated revised September 5, 2007, and stamped received September 11, 2007.” With the 
removal of the equestrian facility, multiple conditions require modification as well as the 
approval stipulations. Case #22006107 was approved with the below stipulations. The 
proposed modifications to the approved stipulations are outlined underneath the stipulation, 
called out as “Proposed Modification” response below it. 
 
a. Development of the site shall comply with the Zoning Exhibit entitled "Desert Hills 
Equestrian Estates", consisting of three (3) full-size sheets, dated revised May, 2007, 
and stamped received September 11, 2007, except as modified by the following 
stipulations. Within thirty (30) days of Board of Supervisors approval, a revised zoning 
exhibit will be submitted to the County to address changes to the RUPD table. 
 
Proposed Modification: Remove stipulation “a” completely and replace with this 
narrative.  
 
b. Development of the site shall be in conformance with the narrative report entitled "Desert 
Hills Equestrian Estates", consisting of eighteen (18) pages, dated revised September 
5, 2007, and stamped received September 11, 2007, except as modified by the following 
stipulations.

With the removal of the equestrian center, the overall layout of the single-family residential 
development requires modification. Because of the combined site layout change and the 
County’s zoning code revisions which occurred since the previous zoning case was approved, 
the applicant is also proposing to modify the standards of the Residential Unit Plan of 
Development (“RUPD”) overlay. The majority of the RUPD request meets current code or the 
standards which were previously approved in the prior rezoning case. 
 
Residential Unit Plan of Development (RUPD) Overlay 
 
The proposed RUPD Overlay request is mostly a combination of what is current permitted in 
Maricopa County Zoning Ordinance and the standards in the previously approved rezoning 
case. Preliminary proposed RUPD development standards, compared with the previous 
approval and the current MCZO Rural-43, are detailed within the table below:  
 
 
Relationship to Surrounding Properties 
 
Contiguous properties to the north, south, west, and east are zoned Rural-43, with existing 
single-family residential homes. (See attached EXHIBIT D – Current Zoning Map) West of 
the abutting property abutting our western boundary are zoned R1-6 RUPD, with existing 
single-family residential homes.  
 
West: Rural-43 – Skunk Creek Wash which is an Open Space corridor and Daisy Mountain 
Fire District Station #145. West of the wash is a portion of Anthem (Unit 34) which is zoned R1-
6 RUPD PAD.

North: The continuation of Skunk Creek Wash and the associated open space tract. 
 
South: Immediately south is Desert Hills Drive, then County zoned Rural-43, large single-family 
residential lots.  
 
East: Immediately east is N 7th Avenue, then County zoned, Rural-43, large single-family 
residential lots.  
 
Location, Accessibility, and Circulation  
 
The property is located on the northwest corner of Desert Hills Drive and 7th Avenue. The 
Property is easily accessible from 7th avenue and Desert Hills Drive and is approximately 5-
miles east of Interstate 17. The primary ingress/egress is planned to occur form Desert Hills 
Drive.  
 
Internal: Two points of gated vehicular access are proposed to the site, one from 7th Avenue 
and one from Desert Hills Drive. The main point of access is proposed to be from Desert Hills 
Drive. A 35-foot-wide private local street design allowing on-street parking will be used inside 
the site. It is anticipated that the internal local streets will be privately owned and maintained 
by the HOA. 
 
As this proposed development progresses, the applicant will work with the County on ROW 
dedications.

It is the goal of the developer to begin development of the site once entitlement is approved. 
The Property is anticipated to be developed in a single phase. 
 
Conclusion 
 
The requested Modification of Conditions is in line with the with the original approved rezoning 
case, with the majority of the modifications revolving around the removal of the equestrian 
center. This proposal is justified given the site’s current zoning of Rural-43, RUPD which is the

desired zoning district for the development. The Property’s adjacent zoning to the north, south, 
east, and west is also zoned Rurual-43, which further supports this requested modification. 
This request meets the characteristics of the Daisy Mountain/New River, Anthem Area Plan 
and the Anthem DMP by promoting the preservation of scenic qualities and maintaining low-
density development. The proposed development meets multiple land use goals, by 
incorporating the preservation of washes and natural drainage systems, and by developing 
densities similar in charter to the adjacent parcels.  
 
The proposal seeks to solidify appropriate stipulations for the proposed development. The 
developers understand the need for quality design and preserving the intent area. The 
anticipated development will feature quality building design and will incorporate the necessary 
landscaping and buffering.

A. 
Purpose of Request 
This application requests approval of a zoning change from Rural-43 to Rural-43 RUPD, and 
approval of a preliminary plat for Desert Hills Equestrian Estates. 
B. 
Description of Proposal Including proposed uses 
Desert Hills Equestrian Estates will be an equestrian-oriented residential community with 56 
single-family homes and a community equestrian center for residents. The homes will be built 
on lots with minimum lot sizes of 35,000 sq. ft. at a density of 0. 75 units per acre. Casitas may 
be built, as allowed by right, subject to coverage limits as discussed in Section K of this 
Narrative. Private roadways are proposed and are described in Section G. 
The equestrian center will be private, for use by residents and their guests. It will include two 
barns with stabling for approximately 100 horses, riding arenas, turn-outs, hot walker, storage 
areas and other facilities. Located adjacent to the County's new trailhead on Skunk Creek 
Wash, the equestrian center includes a trail connection that will provide access to the Maricopa 
Trail and other parts of the extensive regional trail system. A neighborhood trail will be located 
along Desert Hills Drive to provide a connection to the trailhead for other residents in the area. 
C. 
Relationship to Surrounding Properties 
The proposed development strengthens the equestrian character of the existing properties. 
This is "horse country" and many homes in the area include stables and other horse-keeping 
facilities. 
On the west, the property is bounded by an open space corridor that includes Skunk Creek 
Wash. This area is part of Anthem (Unit 34). West of the wash is an R1-6 RUPD PAD 
residential parcel with a golf course, part of the Anthem Master-Planned Development. 
Immediately west of the property on Desert Hills Drive will be the Maricopa County Trailhead 
(per the Anthem DMP stipulations, see also Section K of this Narrative) and the Daisy Mountain 
Fire District Fire Station. 
North of the property is the continuation of Skunk Creek Wash and the associated open space 
tract. 
To the east are single-family custom homes, many with horse facilities. Zoning is Rural-43. 
Immediately south of the property, land is zoned Rural-43 and Rural-43 RUPD, a mix of single-
family homes on acre lots. 
Southeast of the site is Cielo Grande at Desert Hills, a Rural-43 RUPD development with 
35,000 sq. ft. lots. This development is located south of Desert Hills Drive and west of Central 
Avenue.

Relationship to Surrounding Properties 
D. Explanation of how the proposed development will benefit the community 
or area. 
Desert Hills Equestrian Estates supports the rural equestrian character and lifestyle of the area. 
It is compatible with large-lot residences nearby and sets aside 8.44 acres for an equestrian 
center designed to encourage horse ownership and use. Too often, new development in this 
area has resulted in loss of horse properties and horse privileges. Desert Hills Equestrian 
Estates will be built to support the area horse community, equestrian lifestyle and tradition. 
Riding arenas will be located along Desert Hills Drive so horse activity is visible to passers-by. 
A neighborhood hiking and equestrian trail will be constructed along Desert Hills Drive to 
provide access to the Maricopa County Trailhead adjacent to the site. 
The homes at Desert Hills Equestrian Estates will be architecturally compatible with their 
neighbors and sited on lots with a minimum size of 35,000 sq. ft., similar to the Cielo Grande 
development approved southeast of the property. By modifying the minimum lot size through 
the County's RUPD provisions, it has been possible to set aside almost 8.5 acres for equestrian 
uses (12% of the site) and ensures long-term preservation of equestrian uses on the site.

E. Discussion of recent-ai.anges in the area of your requ"st that support the 
application request. 
There are two recent changes in the area are especially relevant to this application: 
• 
Approval of the Rural-43 RUPD for Cielo Grande at Desert Hills south of Desert Hills 
Drive, west of Central Avenue. Cielo Grande will be built at a density of 0.72 units per acre, 
with a minimum lot size of 35,000 sq. ft., amended property development standards and public 
streets. Cielo Grande, however, does not provide for or permit equestrian uses. 
Planned construction of the Maricopa County (Anthem) Trailhead by Pulte, immediately 
adjacent to the equestrian center at Desert Hills Equestrian Estates. The trailhead includes 
trailer parking, other facilities and access to the countywide regional trail system, including the 
Maricopa Trail, along Skunk Creek Wash. 
F. 
Location and Accessibility 
Desert Hills Equestrian Estates is located at the northwest corner of Desert Hills Drive and 
Seventh Avenue. Primary access to the site will be from the south on Seventh Avenue. 
G. Grculation System - proposed improvements or dedications 
Off-site circulation: Two public streets will provide access to the site - Desert Hills Drive and 
Seventh Avenue. An additional 65-feet of right-of-way will be dedicated along the north side of 
Desert Hills Drive. No additional right-of-way is required on Seventh Avenue. All street 
dedications and improvements will be constructed in conformance with current MCDOT 
standards. 
On-site circulation: All streets within the property will be 40-foot wide private streets tracts. 
These streets will be designed and constructed to MCDOT standards 
H. Development Schedule (phasing) 
A model home complex will be constructed near the main entrance, north of Desert Hills. All 
street and other infrastructure improvements will be constructed as part of the first phase of 
development. It is anticipated that the equestrian center will be built in two phases, starting with 
one barn, turn-outs, arenas and required storage and maintenance facilities. The second barn 
will be built as home sales progress and residents (and their horses) move in. 
I. Comm.unify Facilities and Services. 
Desert Hills Equestrian Estates is located within the Deer Valley Unified School District. 
The proposed development is located adjacent to Segment Fifteen of the Maricopa County 
Regional Trail System. The Maricopa Trail, including the Skunk Creek Wash segment, is 
planned as a 240-mile long equestrian, hiking and biking trail, part of the 1,521 mile Maricopa 
County Regional Trail System. 
An equestrian trailhead will be constructed by Pulte west of Desert Hills Equestrian Estates 
equestrian center, north of the fire station. The subject property was formerly part of a larger 
parcel that included the trailhead site. This 126-acre parcel was split and the trailhead and 
County trails are not part of the Desert Hills Equestrian Estates property.

By modifying the minimum lot size through the County's RUPD provisions, it has been possible 
to set aside almost 8.5 acres for a community equestrian center, ensuring long-term preserva-
tion of equestrian uses on the property and support of the area's equestrian lifestyle and 
character. 
In addition, more than 7.6 acres have been dedicated as tracts within the site for open space 
and drainage. There are no on-lot drainage easements at all. Together, the drainage tracts 
and equestrian center comprise more than 23% of the property. 
The land use plan for Desert Hills Equestrian Estates also responds to the site's unique 
topographic and drainage characteristics and to the owner's desire to minimize streets and 
paved areas. The site has irregular topography and slopes to the west, toward Skunk Creek. A 
404 wash extends through a portion of the property. The plan preserves this wash as an 
amenity within the development and also accommodates topographic variations. 
It should be noted that a similar lot area reduction, to 35,000 sq. ft., was granted at Cielo 
Grande, the R-43 RUPD southeast of the Desert Hills Equestrian Estates property. 
Within individual lots, variation from four basic zoning standards is requested, as allowed within 
Residential Unit Plan of Development (RUPD). The request for the RUPD reflects the intention 
to build homes of a size and character similar to those found in the immediate area. When lot 
size is reduced slightly to allow provision of the equestrian center, rather than allowing horse 
facilities on individual lots, the need for adjustments to setbacks and coverage is apparent. 
Requested variations include:

slight increase in allowable coverage (less than the 25% approved for Cielo Grande) will 
also encourage reduced building height by allowing a larger footprint on the lot. 
L. Other Information that will be helpful in evaluating the request 
1. 
Casitas 
The main residence and any casitas will comply with the latest version of the Maricopa County 
Zoning Ordinance, Chapter 10. Casitas are now allowed by right. Maximum lot coverage (main 
residence + casita) will not exceed 20%. Casitas are typically detached structures.

Desert Hills Equestrian Estates Equestrian Center 
The Desert Hills Equestrian Estates Equestrian Center (see conceptual site plans, following this 
page) is planned to accommodate 100 horses. It has been designed as a first-class private 
facility where residents can board and train their horses. Arenas are sized to allow a full range 
of equestrian disciplines from reining and roping to dressage and jumping. Trail riders will be 
able to use an internal trail connection to access the Maricopa Trail west of the nearby County 
trail head. 
Two lighted arenas are proposed (see lighting details, page 10) with light standards at 25 ft. 
in.height, consistent with Anthem Design Standards. All lights will be shielded to prevent glare 
and light spillage onto nearby residential properties. All lights will be on timers, with automatic 
cut-offs, so arena lights cannot be used later than 9:00 p.m. 
Tow barns, each with 48 stalls approximately 12 ft. x 12 ft. will be built. Each barn includes 
wash racks, storage lockers for feed and tack and other facilities. Stalls will have automatic 
built-in watering systems. 
Outdoor turn-outs and pastures will be built, along with other facilities such as a hot walker, 
storage for shavings, feed, equipment and manure disposal. On-site trailer parking is expected 
to be very limited, as trail parking can be accommodated on residential lots. All arenas will be 
enclosed with pipe rail fences painted to be compatible with development entry monuments and 
gateway fencing. Security gates will be provided at the Desert Hills Drive service drive and on 
the internal entry drive at the northwest corner of the equestrian center. These gates will be 
kept closed and used for deliveries and service access only. The main equestrian center entry 
gate will be on its east side, near the development entry gates. 
The equestrian center will be maintained and managed through the Desert Hills Equestrian 
Estates Property Owners Association. A facility manager will be employed to oversee day-to-
day operations and be directly responsible for maintenance. The facility will contract for 
professional waste removal services to assure a high level of maintenance for equestrian users 
and residents.

The Conceptual Landscape Plan that accompanies this resubmittal (see following pages)

HOA. A submittal of subsequent preliminary plat will show the proposed ROW dedications 
being made to the County for 7th Avenue and Desert Hills Drive.  As required by the County, 
the preliminary plat will also show where any boundaries of the adjoining floodway and/or 
floodplain encroach onto the site. 
 
Requested Modification of Approved Stipulations 
 
The previous approval stipulated “Development of the site shall be in conformance with the 
narrative report entitled "Desert Hills Equestrian Estates", consisting of eighteen (18) pages, 
dated revised September 5, 2007, and stamped received September 11, 2007.” With the 
removal of the equestrian facility, multiple conditions require modification as well as the 
approval stipulations. Case #22006107 was approved with the below stipulations. The 
proposed modifications to the approved stipulations are outlined underneath the stipulation, 
called out as “Proposed Modification” response below it. 
 
a. Development of the site shall comply with the Zoning Exhibit entitled "Desert Hills 
Equestrian Estates", consisting of three (3) full-size sheets, dated revised May, 2007, 
and stamped received September 11, 2007, except as modified by the following 
stipulations. Within thirty (30) days of Board of Supervisors approval, a revised zoning 
exhibit will be submitted to the County to address changes to the RUPD table. 
 
Proposed Modification: Remove stipulation “a” completely and replace with this 
narrative.  
 
b. Development of the site shall be in conformance with the narrative report entitled "Desert 
Hills Equestrian Estates", consisting of eighteen (18) pages, dated revised September 
5, 2007, and stamped received September 11, 2007, except as modified by the following 
stipulations. 
 
Proposed Modification: Remove stipulation “b” completely. This modification 
request should be stipulated to this narrative.  
 
c. Development of the site shall be in conformance with the landscape plan entitled 
"Preliminary Landscape Plan Desert Hills Equestrian Estates", consisting of four (4) full

Office of Arizona State Fire Marshal prior to any construction.

q. Development and use of the site shall comply with requirements for fire hydrant

fire department. Prior to Final Plat approval, the applicant shall seek review and 
comment from the applicable fire protection agency and shall provide written 
confirmation that the site will be developed in accordance with their requirements.

r. Prior to Final Plat approval, developer(s) and/or builder(s) shall establish emergency fire 
protection services, covering all real property contained within the project area during 
course of construction and shall obtain a 'will serve' letter substantiating coverage from 
the appropriate Fire Department servicing the site.

s. Major changes to the zoning exhibit and narrative report shall be processed as a revised 
application, with approval by the Board of Supervisors upon recommendation of the 
Planning and Zoning Commission. Minor changes may be administratively approved by

a new Citizen Participation Process as determined by the Planning and Development 
Department.

v. The equestrian center shall be relocated as per the alternative design exhibit entitled, 
"Revised Equestrian Center Concept Plan", consisting of one (1) full size sheet prepared 
by Sonora West Development, dated revised March 3, 2008 and stamped received 
March 3, 2008. Technical review of the Final Plat may result in different subdivision 
layout due to a reduction in the number of lots, drainage and retention requirements, 
etc.

w. The manure generated from the Desert Hills Equestrian Facility shall be stored within 
the northern portion of the area designated "Storage for feed, equipment, and shavings".

With the removal of the equestrian center, the overall layout of the single-family residential 
development requires modification. Because of the combined site layout change and the 
County’s zoning code revisions which occurred since the previous zoning case was approved, 
the applicant is also proposing to modify the standards of the Residential Unit Plan of 
Development (“RUPD”) overlay. The majority of the RUPD request meets current code or the 
standards which were previously approved in the prior rezoning case.

The proposed RUPD Overlay request is mostly a combination of what is current permitted in 
Maricopa County Zoning Ordinance and the standards in the previously approved rezoning 
case. Preliminary proposed RUPD development standards, compared with the previous 
approval and the current MCZO Rural-43, are detailed within the table below:

single-family residential homes. (See attached EXHIBIT D – Current Zoning Map) West of 
the abutting property abutting our western boundary are zoned R1-6 RUPD, with existing

West: Rural-43 – Skunk Creek Wash which is an Open Space corridor and Daisy Mountain 
Fire District Station #145. West of the wash is a portion of Anthem (Unit 34) which is zoned R1-
6 RUPD PAD.

This application is requesting a zone change modification from the originally approved 
Zone Change case Z2006107 Desert Hills Equestrian Estates which was never 
developed.  Current zoning is Rural 43 RUPD.  The modification request via a new 
developer to remove the equestrian component and a few minor requested

PND Engineering Plan Review (DPR, FCD, MCDOT and PND Transportation) has 
reviewed the 1st submittal of the Zone Change modification application routed for 
review on November 8, 2024 and has no objections to the Zone change modification 
without a POD. Approvals are subject to the following conditions:    
 
 
DRAINAGE GENERAL COMMENTS: 
 
1. Without the submittal of a precise plan of development, no development approval 
is inferred by this review, including, but not limited to number of proposed building 
lots/units, drainage design, access and roadway alignments. These items will be 
addressed as development plans progress and are submitted to the County for 
further review and/or entitlement. 
 
2. A traffic impact study must be submitted with future entitlement (POD or 
Preliminary Plat) application(s). 
 
3. Engineering review of re-zone cases is conceptual in nature. All development and 
engineering design shall be in conformance with Section 1205 of the Maricopa

The Maricopa County Environmental Services Department (MCESD) has completed review 
for the Cadora Desert Hills planning case(s). Please note the following MCESD requirements 
for site development: 
Onsite Wastewater –  
A Notice of Intent to Discharge application for an onsite wastewater treatment (septic) 
system is required for any construction. Application must be submitted to the MCESD 
Onsite Wastewater Program. 
• 
Wastewater is not permitted to discharge to an adjacent parcel’s septic system. 
• 
Setback requirements must be maintained per Arizona Administrative Code, Title 
18, Chapter 9, Article 312, C (Features Requiring Setbacks). 
 
Prior to Final Plat approval, a Septic Soils and Hydrology Report must be submitted to and 
approved by MCESD’s Subdivision & Infrastructure Program for subdivided lots that will be 
served by individual septic systems. The number of soil tests must be at least 30% of the 
number of platted lots and the locations evenly spaced throughout the development.

Thank you, Mr., Landis for your prompt reply.
I am a 4th Generation Arizonian, my family moved to Wickenburg, Phoenix,  and Flagstaff in the 1890's.
They would be shocked to see how this beautiful State has been ruined by overgrowth of populations
and depreciation of natural resources.
My comment most relative to this project is: this tract of land was (and I would assume still is), part of
the Anthem Community. If that is true, then there was a provision that there would be no road
connections from Rural Desert Hills to the Anthem community, other than Emergency Access. It was
understood that to access this parcel of land, a private bridge would have to be built over Skunk Creek
Wash with access and egress through Anthem.
So, the Desert Hills community has to travel all the way around to access the Anthem area. A small price
to pay, for the inconvenience and noise adding 30,000 Anthem residents and business vehicle traffic into
the Desert Hills Community. There is no way the current road system could handle that amount of
traffic.
If these new road connections are approved, then our property values with be negatively affected in
value. 
I will leave the above opinion as my major objection, and I will continue to monitor the progress through
your office.

Please let me know if you have any questions or comments on this case.
There are a few ways that people are notified of upcoming public hearings. The applicant is required to
put in signs on the property per state law that are to be updated when public hearings have been
scheduled. The applicant, at their choosing, may hold a public meeting regarding the case, but this is
different from a public hearing in front of the Planning & Zoning Commission and Board of Supervisors.
Maricopa County does not sanction public meetings, but we do sanction public hearings. 
Second, the County mails out postcards to any property within 300' of the property bounds prior to the
Planning & Zoning Commission hearing. That card will have information on the case(s), and hearing
dates/times/locations.

I’m very concerned about the traffic impact this will have in my
area. Desert Hills Dr. & 7th Ave. . A flow of traffic should be
studied before a development is built.
Most of Desert Hills gets there water supply from private wells.
I would like to know where water would becoming from for the
development.
