Since the publication of the staff report for the referenced case, staff received a letter from the 
applicant regarding the approval of a right-of-way waiver from Maricopa County Department of 
Transportation (MCDOT) for the subject site. This waiver has the effect of reducing the required 
right-of-way dedication of Desert Hills Dr. from 65’ to 40’. The relevant condition will now be 
changed to read the following: 
 
d. The following Maricopa County Department of Transportation (MCDOT)  conditions shall 
apply: 
  
1. Provide a total half-width of 65' 40’ right-of-way dedication, or as otherwise 
required by MCDOT, on Desert Hills Drive with subdivision plat.

Re:   Recommendation of Future MCDOT Right-of-Way – APNs 211-86-978 & 211-86-979 - S240006 
 
Dear Applicant: 
 
Maricopa County Department of Transportation (MCDOT) has reviewed the request to waive the 
requirement that the setback lines on the referenced properties be measured from the future half street 
right-of-way as required by Section 1105 of the Maricopa County Zoning Ordinance. The subject properties 
are located along two Section Line alignments (Desert Hills Drive and 7th Avenue), requiring the setback 
lines be measured from a future half street right-of-way of 55-feet for both alignments. 
 
Based on previously approved waivers along both alignments and the MCDOT Transportation System Plan 
2040 designation of major collector roadways, it is recommended that the requirement for future half 
street right-of-way be measured as follows: 
 
APN 211-86-978  
• 
Desert Hills Drive: 40-feet 
APN 211-86-979 
• 
Desert Hills Drive: 40-feet 
• 
7th Avenue: 40-feet 
 
This recommendation pertains only to future right-of-way needs for a public roadway on the identified 
alignments and does not consider legal access requirements, easements, drainage, utilities, etc. which still 
apply to the subject property.
