Project Summary: 
 
1. 
This request is for a major amendment of zoning case Z02-133; an approved Special Use Permit 
(SUP) that allowed for a hospice care facility. The applicant is seeking to amend the SUP to allow 
for the reutilization of the existing hospice center to a physical assisted living/rehabilitation 
center. The SUP site is comprised of approximately 1.74 acres in the C-O zoning district. The 
initial SUP was approved by the Board of Supervisors (BOS) on June 4, 2003 with a required status 
report due at two (2) years and twenty-five (25) year time period after BOS approval. A status 
report was administratively approved within the two-year time frame. 
 
2. 
The facility is a 13,975 sq. ft., single story, concrete block building built in 2004 (B200306466) for 
the use of the hospice center. The building is currently vacant, the previous owner sold the 
property to Banner Health in 2019 (Deed 20190623092). Banner Health is seeking to use the 
existing infrastructure for a Neuro Transitional Rehabilitation Center, for individuals with 
traumatic brain (TBI) or spinal cord injuries, stroke, or other neurological diseases.  
 
3. 
The center will provide a comfortable environment that will be designed to feel like home. It will 
provide patients with physical, behavioral and cognitive impairments access to comprehensive 
therapy in multiple settings. Specialized therapists will help transitional patients regain 
independent living skills with the goal of safely functioning in their home and community. 
 
4. 
The center will operate according to the Assisted Living Facilities Licensing requirements with 
the Arizona Department of Health Services and will be staffed by healthcare professionals, from 
administrative to specialized medical staff. The center is proposed to operate 24/7 with a 10-
patient capacity, with 18 staff members during the day shift and 4-6 staff members during the 
night shift. Visitors/family members will only be permitted during the hours of 8 a.m. to 8 p.m. or 
upon special request.

The applicant is not proposing any changes to the site other than interior renovations. The site 
plan is consistent and in substantial conformance with previously approved SUP, case Z2002133.  
 
6. 
Case Z2002133 approval varied the screening and parking light standards. Under ordinary 
circumstances, the ordinance requires that a 6’ CMU wall be erected between commercial and 
rural/residential zoning districts; the approval allows for a 6’ wrought iron-type view fence along 
the rear property line, adjacent to the golf course. Also, the MCZO requires a maximum height of 
18’ for light standards; the existing light fixtures in the parking light have a height of 20’-6”, 
which was approved in order to be consistent with the area.

The site provides 47 parking spaces and four ADA parking spaces, where 56 parking spaces and 
three ADA parking spaces are required. The applicant does not anticipate the need for additional 
parking based on the specific operations of the center.  The site shares a 40’ driveway from 
Routzahn Way with the abutting parcel to the southwest, with 20’ encroaching into each parcel, 
while on the opposite end the existing monument sign is located directly northeast of the 
driveway. A 25’ x 25’ SVT is impossible to be placed on either side of the driveway without 
reconfiguration of the driveway and/or removal of the monument sign. Staff notes this 
neighborhood is acts as a regional medical campus with slow speed limits and wide streets. The 
screening, lighting height, parking and sight-triangles are the only development standards that 
have been varied by the SUP.

Maricopa County “Vision 2030” Comprehensive Plan: The Comprehensive Plan designates the 
site within the area of a County Area Plan, the White Tank/Grand Avenue Area Plan.

White Tank/Grand Avenue Area Plan (County Area Plan): The County Area Plan identifies the site 
for Single Family Transitional development with a density of 3-5 d.u./ac. The proposal, as a 
physical assisted living/rehabilitation center, would not appear to be consistent with this plan; 
however, the property is also within the Sun City West Master Plan.

Sun City West Master Plan (DMP): The DMP designates this area for development of medical 
offices, hospital, and extended care facilities. The proposed SUP for a physical assisted 
living/rehabilitation center is consistent with the DMP’s designation.  
 
Public Participation Summary: 
 
14. 
The applicant complied with all the necessary public participation requirements according to 
MCZO Section 304, including notification of property owners within 300’ of the subject site and 
posting of the site. Registered areas of interest were contacted by the applicant and staff 
regarding the Special Use Permit Amendment request. To date, no opposition has been received.   
 
Outstanding Concerns from Reviewing Agencies:

Staff has not received any comments from reviewing agencies. 
 
 
Staff Analysis: 
 
16. 
The use as a physical assisted living/rehabilitation center for a Neuro Transitional Rehabilitation 
Center is compatible with the general land use pattern in the area, which consist largely of medical 
facilities and related businesses. The proposed use will operate similar to the hospice use (hours 
of operation, staffing, visitor hours, providing medical care), staff research found no open 
violations/complaints for the site. Due to the similarities of the previous use and the proposed 
use it would seem to be appropriate for the area; therefore, staff does not have any objections to 
the major amendment of SUP case Z2002133.  
 
17. 
Staff is supportive of the request and finds that the proposed use would be compatible with the 
regional medical campus nature of the surrounding area and will continue to be in conformance 
with the previously approved site plan and narrative. Staff, therefore, is recommending approval 
for the reasons noted above. 
 
18. 
The conditions recommended by staff remain identical to the conditions approved by the BOS 
under Z2002133 with some modifications outlined below, and with modified conditions relabeled: 
 
• 
Condition ‘a’ and ‘c’ would be modified based on this applications site plan and narrative and 
to create a consolidated set. 
• 
Condition ‘d’ was added to condition the varied standards under this SUP 
• 
Condition ‘e’ sets an expiration date of 30 years for the original SUP approval which is set to 
expire in 2033, staff beliefs the use is harmonious with the neighborhood and is comfortable 
with granting the SUP absent any expiration date. Therefore condition ‘e’ is no longer needed.

modified to set a 30-year expiration date for the new use of a physical assisted 
living/rehabilitation center.  
• 
Condition ‘f’ was added to provide updated conditions of approval from engineering. 
• 
Condition ‘g’ required a status report 2 years and 25 years after original approval by the BOS. 
Staff approved the 2-year status report; and finds an additional status reports are not needed. 
• 
Conditions ‘h’ and ‘i’ are no longer needed – they required additional approvals and review 
prior to the initial development of the site, which was obtained under building permit 
B200306466. 
• 
Conditions ‘j’ and ‘r’ are modified to be consistent with updated language to the amended SUP. 
• 
Condition ‘o’ requires the site to be in compliance to case Z 88-76 which was a rezone from 
Rural-43 to C-O; and seem unnecessary. The site will remain subject to regulations of the C-O 
zoning district as amended by this SUP. 
• 
Condition ‘s’ and ‘t’ have been added to be consistent with updated language to current SUP 
conditions of approval 
 
a. 
Development of the site shall be in substantial compliance with the site plan entitled “Sun 
Health Hospice Care Services & Residence on the Del E. Webb Campus BHSM 
Rehabilitation/Banner Health” consisting of two (2) one (1) full size sheets prepared by 
The stein-Cox Group Kimley Horn dated revised April 9, 2003 November 27, 2024 and 
stamped received April 10, 2003 December 13, 2024, except as modified by the following 
stipulations. 
 
b. 
Development of the site shall be in substantial compliance with the landscape plan 
entitled “Sun Health Hospice Center Sun City, Arizona” consisting of one (1) full size sheet 
prepared by Urban Graphite dated revised April 9, 2003 and stamped received April 10, 
2003, except as modified by the following stipulations. 
 
c. 
Development of the site shall be in substantial compliance with the narrative report 
entitled “Special Use Permit for Del E. Webb Hospice Facility BHSM Rehabilitation/Banner 
Health”, consisting of four (4) three (3) pages prepared by The Stein-Cox Group Kimley 
Horn, dated revised December 19, 2002 November 27, 2024, and stamped received 
February 7, 2003 December 13, 2024, except as modified by the following stipulations. 
 
d. 
The following SUP standards shall apply: 
 
1. 
Max. Height for parking light fixtures: 20’ -6” 
2. 
Site Enclosure & Screening: Minimum 6’ tall wrought iron-type view fence adjacent to 
rural/residential zoning boundaries. 
3. 
Parking: 51 parking spaces with 5% designated ADA

Sight Visibility Triangles: None required 
 
e. 
The Special Use Permit shall expire at the end of 30 years from the date of Board of 
Supervisors approval. Any request for extension must be received at least six months prior 
to the expiration date. 
 
f. 
The following Planning Engineering conditions shall apply:

1. 
Engineering review of planning and/or zoning cases is for conceptual design only. 
All development and engineering design shall be in conformance with Section 1205 
of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; 
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and 
current engineering policies, standards and best practices at the time of application 
for construction. 
 
2. 
Changes to the site layout shall require final engineering design of the drainage 
infrastructure. 
 
3. 
Building Permits from PND Development Services shall be obtained for construction 
of walls/fences and any internal tenant improvements. 
 
g. 
The property owner shall submit a written report outlining the status of this development 
at the end of two (2) years from the date of approval by the Board of Supervisors, and at 
the end of the twenty-five (25) years of the date of approval by the Board of Supervisors. 
These status reports shall be reviewed by staff, which may accept the report, require 
additional information, or schedule the report for review by the Planning and Zoning 
Commission. 
 
h. 
Prior to any construction, the Drainage Regulations for Maricopa County require that a 
drainage clearance be obtained from the Flood Control District. A final grading and 
drainage plan will need to be submitted for review and approval, along with hydrologic and 
hydraulic calculations, prepared by an Arizona Registered Civil Engineer, documenting the 
design of the storm drain system.  
 
i. 
Prior to completing the final grading and drainage plan, the volume calculations provided 
on the previously submitted grading and drainage plan need to be revised. Refer to Section 
3.5.2 Volume Calculations of the Drainage Design Manual for Maricopa County, Arizona, 
Vol. I – Hydrology.  
 
j. 
Concurrent with the application for building permit for the hospice care facility, the 
property owner shall also submit construction plans to the Sun City West Fire District for 
review. Any revisions to the construction plans required by the fire district shall be 
presented to the Planning and Development Department for additional review prior to 
permit issue. Prior to issuance of a building permit, written confirmation will be required 
from the emergency fire protection jurisdiction that emergency fire protection service 
will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire 
protection jurisdiction review and approval will be required. 
 
k. 
There shall be no construction work on the site prior to 6:00 a.m. or after 6:00 p.m. 
 
l. 
All roof mounted equipment shall be screened from view by a continuous parapet. 
 
m. 
The trash dumpster enclosure shall be completely screened using a solid masonry wall of 
a style to match the architecture of the primary building. Said enclosure shall be equipped 
with a view-obstructing gate(s).

n. 
All transformers, backflow prevention devices, utility boxes and all other utility-related, 
ground-mounted equipment are to be painted to complement the development and shall 
be screened with landscape material where possible. 
 
o. 
All applicable stipulations of case Z 88-76 shall remain in effect as may be applicable.  
 
p. 
All habitable buildings constructed upon this property shall be constructed to attain a 
noise reduction level as per A.R.S. § 28-8482(B). 
 
q. 
Major changes to this Plan of Development (site plan and narrative report) shall be 
processed in the same manner as the original application, with final determination made 
by the Board of Supervisors following recommendation by staff and the Planning and 
Zoning Commission. Minor changes may be administratively approved by staff of the 
Planning and Development Department. Alterations to the site plan pertaining to the fire 
access areas that arise out of the Sun City West Fire District permitting review process 
shall be considered minor. 
 
r. 
Non-compliance with the Plan of Development (site plan and narrative report) or the 
conditions of approval will be treated as a violation in accordance with the provisions of 
the Maricopa County Zoning Ordinance. Non-Compliance with any Maricopa regulations 
will be grounds for possible revocation of this special use permit pursuant to the process 
set forth in the Maricopa County Zoning Ordinance.  
 
s. 
 The property owner/s and their successors waive claim for diminution in value if the 
County takes action to rescind approval due to noncompliance with conditions.  
 
t. 
The granting of this change in use of the property has been at the request of the 
applicant, with the consent of the landowner. The granting of this approval allows the 
property to enjoy uses in excess of those permitted by the zoning exiting on the date of 
application, subject to conditions. In the event of the failure to comply with any condition, 
and at the time of expiration of the special use permit, the property shall revert to the 
zoning that existed on the date of application. It is, therefore, stipulated and agreed that 
either revocation due to the failure to comply with conditions, or the expiration of the 
special use permit, does not reduce any rights that existed on the date of application to 
use, divide, sell or possess the property and that there would be no diminution in value 
of the property from the value it held on the date of application due to such revocation 
or expiration of the special use permit. The special use permit enhances the value of the 
property above its value as of the date the special use permit is granted and reverting to 
the prior zoning results in the same value of the property as if the special use permit had 
never been granted.

PURPOSE OF REQUEST 
BHSM Rehabilitation LLC (Property Owner) & Select Medical (Developer) and Kimley-Horn 
(applicant) has prepared this submittal for the Maricopa County Planning & Development Department 
to apply for a Special Use Permit (SUP) for the BHSM Rehabilitation/ Banner Health project which 
proposes an amendment to SUP Case No. Z02-133 to allow for the reutilization of an existing hospice 
center to a physical assisted living / rehabilitation center (i.e. Neuro Transitional Center).    
DESCRIPTION OF PROPOSAL 
BHSM Rehabilitation LLC & Select Medical are submitting this application to amend SUP Z02-133 
which proposes changing the existing use of the site from a Hospice Home Group facility to a Neuro 
Transitional Rehabilitation Center that is tailored to individuals with traumatic brain (TBI) or spinal 
cord injuries, stroke or other neurological diseases. Neuro Transitional Centers provide a unique, 
comfortable environment designed to feel like home. It gives patients with physical, behavioral and 
cognitive impairments access to comprehensive therapy in multiple settings. Specialized therapists 
help transitional patients regain their independent living skills with the goal of safely functioning in 
their home and community. 
 
This Center will operate according to the Assisted Living Facility licensure requirements with a staff of 
healthcare professional consisting of administrators, managers, specialized therapists, speech-
language pathologists, nurses, counselors, case managers, neuropsychologists, dieticians, direct 
care staff, and behavior analysts. The facility will operate 24/7 with a 10-patient capacity, a daytime 
staff of up to 18 and a nighttime staff of 4-6. Visitors will be permitted from 8 a.m. ± 8 p.m. and on 
other times by special request.  
 
With the SUP and the associated Plan of Development, the proposed interior renovations will be 
designed in such a way to provide an optimal environment for care and recovery with exterior fencing 
to provide security and screening to the adjacent properties and uses, matching the existing site plan.   
 
 
SITE DESCRIPTION 
The 76,223 sq ft site is currently not in use, but it previously served as a hospice center. The building 
itself is 13,975 sq ft., is single story of concrete block construction built in 2004. It was initially built 
and owned by Sun Health Corp/Sun Health Services and sold to Banner Health in 2019. The existing 
landscape is low water use, native plants but is in need of maintenance.  
 
 
PARKING AMENDMENT 
There are currently 51 existing parking spots including 4 ADA spots on the site. Based on the building 
square footage, county requirements call for 54 parking spots. Along with the special use permit, an 
amendment reducing the required parking to 38 spots is requested based on the how this specific 
proposed rehabilitation center will operate. Though the requested amendment calls for 38 parking 
spots, the site would remain unchanged, utilize the existing 51 parking spots.    
 
 
RELATIONSHIP TO SURROUNDING PROPERTIES 
The areas immediately to the east, west and south of the proposed center are zoned C-O SUP and 
are used for medical office purposes. The Banner Del Webb Medical Center is located approximately 
1/4 mile to the south-west. The proposed Neuro Transitional Center site is currently and will continue

The property is located at 19702 North Routzahn Way, Sun City West which is accessible off W 
Granite Valley Dr and is close to major transportation corridors. Access to W Grand Ave/60 is a half 
mile to the southwest which feeds into to AZ Loop 303 two miles to the northwest.     
 
 
CIRCULATION SYSTEM 
No other proposed circulation improvements or dedications are included as part of this Special Use 
Permit request. 
 
 
DEVELOPMENT SCHEDULE 
The development of the project will proceed upon approval of the Special Use Permit and the 
Construction documents for the interior modifications. 
 
 
COMMUNITY FACILITIES AND SERVICES 
The facility will continue to operate as an assisted living center optimized to provide services for 
patients recovering from neurological injuries. The proposed patient capacity is ten (10) private rooms 
with ten (10) beds. The interior space will be upgraded/modified for the planned inpatient service 
treatments. This Neuro Transitional Center will provide patients with access to an atmosphere similar 
to their home environments with daily indoor/outdoor living activities to ensure an eventual safe and 
effective return to the patient¶s own home. Administrative support space will be included in the interior 
of the facility.
