Project Summary: 
 
1. 
The applicant is seeking to establish a Plan of Development (PD) for boats, RVs, and trucks as an 
outdoor storage facility.  The site straddles two zoning districts:  Rural-43 MAAMF (65 Ldn) WHSC 
(Class I) on the western two-thirds and Rural–43 WHSC (Class I) on the eastern third.  The site 
has proper entitlements in place via Military Compatibility Permit MCP2010001 and Special Use 
Permit Z2008021. The PD will allow for long term outdoor vehicle storage along with an office 
with caretaker’s quarters.  The proposed PD requires legislative approval per ordinance because 
a portion of it is within the MAAMF which is a high noise and accident potential zone of a military 
airbase ancillary facility.

The site gained initial zoning entitlement and PD approval about fifteen years ago.  On April 28, 
2010, the Board of Supervisors approved a Military Compatibility Permit with PD (MCP2010001) 
over the western portion of the site and a Special Use Permit (Z2008021) over the eastern portion 
of the site.  The approved plans included a self-storage facility along with outdoor vehicle storage.  
On May 14, 2024, staff held preapplication meeting PA2024076 with the applicant.  Since PDs are 
only valid from two years after initial approval (MCZO article 1010.7.22) and the site design no 
longer included the mini-storage component new PD approval is required.  While the new site plan 
could have been subject to two separate cases – a PD over the portion of the site within the 
MAAMF and a SUP amendment over the SUP portion of the site – staff offered the applicant to 
submit a singular PD over the entire site.  This simplified and streamlined the process, avoiding 
an awkward situation where a portion of the site was subject to an administrative approval and a 
portion required legislative approval.  Additionally, staff informed the applicant that condition “o” 
of Z2008021 imposed a 20-year time limit on the approved SUP, which expires on April 28, 2030.  
Staff recommended that this condition be amended to allow the site to operate beyond 2030.  
The applicant has not yet applied for a SUP modification of conditions for Z2008021.  Unless 
such a request is approved by the BOS all operations on the SUP portion of the site will need to 
cease on April 28, 2030.  On July 1, 2024, the applicant formally submitted the subject PD.  A 
Technical Advisory Committee meeting was held on September 3, 2024.

The site will consist of 498 storage stalls with direct access to both Jomax Rd. and 191st Ave.  
The site will be screened via an eight-foot-tall block wall.  The site will be open for self-service 
seven days a week 6:00 am to 9:00 PM.  The facility will have an employee on site Monday through 
Friday 10:00 am to 12:00 am (14 hours per day).  There will be one two story structure on the site.  
800 sq. ft. will be dedicated to an office and other 800 sq. ft. will serve as a caretaker’s quarters. 
This building is located within the SUP portion of the site and is not within the MAAMF overlay.  
The site includes five personal vehicle parking stalls, including one ADA stall.

White Tank Grand Ave Area Plan (adopted December 6, 2023): The area plan calls for the subject 
site to develop in a manor compatible with Luke Air Force Base operations.  The site has a 
previously approved MCP that allows for the proposed storage operations.  Additionally, LAFB 
provided comment on the current proposed PD that there is no concern if the caretaker’s quarters 
remain outside of the MAAMF boundary, as it is depicted on the site plan.

Surprise 2040 General Plan (adopted July 30, 2024): The general plan denotes the site for 
Employment, which it describes as an area reserved for large scale phased development of 
industrial and business park type uses that support the surrounding areas. 
 
Public Participation Summary:

The applicant satisfied all statutory requirements by sending notification out to property owners 
within 300’ of the site, identified parties registered as an area of interest, and all jurisdictions, 
organizations, and agencies identified by staff, along with two site postings.  The applicant 
reported no interactions from the public.  Similarly, staff has not received any opposition as of 
the publication of this report.  Luke Air Force Base did provide comment, stating they have no 
concern over the proposed PD given the caretaker’s quarters remains outside of the MAAMF 
boundary.

The proposed PD is aligned with both the White Tank Grand Ave Area Plan and the Surprise 
General Plan and matches existing and expected land use patterns in the area.  The low frequency 
of customers on the site and limited improvements needed for the use are compatible with LAFB 
operations.  Additionally, the site is adequately screened and complies with all applicable zoning 
requirements.  As such, staff is supportive of the proposed outdoor storage facility. 
 
 
Recommendation:

Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve PD240004 subject to the following conditions ‘a’ – ‘h’: 
 
a. 
Development of the site shall be in substantial conformance with the Site Plan entitled 
“26631 N 191st Ave – RV Resort“, consisting of 2 full-size sheets, dated December 9, 2024 
and stamped received December 9, 2024, except as modified by the following conditions. 
Staff may determine slight refinements to remain in substantial conformance with the

approved site plan.  Minor and major amendments to the site plan will be determined in 
accordance with Chapter 3 of the Maricopa County Zoning Ordinance. 
 
b. 
Development of the site shall be in substantial conformance with the Narrative Report 
entitled “191st and Jomax RV Storage”, consisting of 3 pages, dated October 3, 2024 and 
stamped received October 3, 2024, except as modified by the following conditions. 
 
c. 
All buildings subject to noise attenuation as per ARS § 28-8482(B). 
 
d. 
Overnight occupation of RVs or other vehicles on site is prohibited. 
 
e. 
The following Planning Engineering conditions shall apply:  
1. Ultimate half-width improvements along 191st Avenue including curb, gutter 
 
and sidewalk must be constructed with site building permit per RDM Figure 
 
5.11 
2. 37-feet of pavement (centerline to face of curb) shall be provided along Jomax Road. 
3. Proposed driveways shall meet commercial and industrial driveway standards per 
the latest MCDOT Roadway Design Manual (RDM) Section 7.6.3. 
4. Gated access shall provide adequate turn around area so that vehicles will not 
back onto public roads. 
5. Plans submitted for Building Permits must clearly show how all runoff is routed to the 
retention basins. Retention basins must de-water within 36-hours. 
6. Engineering review of planning and/or zoning cases is for conceptual design only. All 
development and engineering design shall be in conformance with Section 1205 of 
the Maricopa County Zoning Ordinance; Drainage Policies and Standards; 
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and 
current engineering policies, standards and best practices at the time of application 
for construction. 
7. Based on the conceptual design nature of the information submitted, changes to the 
site layout may be necessitated by the final engineering design of the drainage 
infrastructure. 
8. Detailed Grading and Drainage (Infrastructure) Plans must be submitted with the 
application for Building Permits 
 
f. 
As per Maricopa County Zoning Ordinance Article 1010.7.22 the PD is valid for two years 
after approval.  Prior to expiration, a one-time extension may be requested via a minor 
amendment for one additional year.  Upon expiration a new PD will be required to be 
submitted. 
 
g. 
Prior to issuance of a building permit, written confirmation will be required from the 
emergency fire protection jurisdiction having authority that the facility has been designed 
in accordance with their regulations and requirements, and that emergency fire protection 
service will be provided to the facility. Prior to issuance of the certificate of occupancy, 
local fire protection jurisdiction review and approval will be required. 
 
h. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, the property 
shall revert to the zoning that existed on the date of application.  It is, therefore, stipulated 
and agreed that either revocation due to the failure to comply with any conditions, does 
not reduce any rights that existed on the date of application to use, divide, sell or possess

the property and that there would be no diminution in value of the property from the value 
it held on the date of application due to such revocation of the Plan of Development.  The 
Plan of Development enhances the value of the property above its value as of the date the 
Plan of Development is granted and reverting to the prior zoning results in the same value 
of the property as if the Plan of Development had never been granted.

Applicant Introduction – My name is Michael Prefling and I am representing the 191st and 
Jomax ownership team who is wanting to develop this site into outdoor storage facility for RVs 
boats and trucks.  The site is located at the NE corner of N 191st Ave and W Jomax Rd.  I am a 
licensed civil engineer here in Phoenix and will be preparing most of the documents for the 
initial preliminary submittals as well as final permit and construction documents. 
 
Description of Business Establishment – The site is intended to be developed into an outdoor 
RV, boat, and truck storage facility.  The proposed facility access will be self-serve between 
the hours of 6AM and 9PM seven days a week.  The facility will be manned and on site 
Monday – Friday 10AM to 12PM.  The one employee will maintain the site.  Access, both 
ingress and egress is via two security coded gates.  One off of 191st and one off of Jomax.  A 
two story office building with living quarters will accommodate an overnight caretaker.  The 
property is currently vacant. 
 
The property is currently vacant with proposed paved surfacing, as MCZO Article 1102.7.1 
requires paved parking for non-residential uses. An office structure of pre-engineered steel 
will be constructed. A block wall will enclose the perimeter of the facility. An on-site septic 
system will serve the office. The site capacity will be 498 storage spaces. The entry sign will 
meet County requirements. Per the narrative, the proposal will complement the residential 
development in the surrounding areas. 
 
Purpose of Request – Special use permit to develop the 8.3 acre site into an outdoor RV, boat, 
and truck storage facility.  
 
Existing/Past Zoning Cases – A preliminary application was submitted and is referenced by 
PA2024076 
 
Owner Information – The owners of this development and business will be Curt Lyon and Josh 
Gowan.  Mr. Lyon and Mr. Gowan are family members and have been working development of 
this site since 2010. 
 
Relationship to Adjacent Properties – This site is bordered by 191st Ave on the west, and W 
Jomax Rd on the south.  There is are existing mostly vacant RU-43 properties to the east and 
north.  
 
Benefit to community/area – Reviewing historical assessor site images this site has been vacant 
for over 20 years.  This RV storage development will be a low impact to this relatively non-
developed area of Maricopa/Wittman. 
 
Location and Accessibility – This site is at the NW corner of 191st Ave and Jomax.  There is 
accessibility off both Jomax and 191st.  The site is also 3000 feet west of Grand Avenue 
accessible from Jomax Road.

Circulation System – Two new gated access drive entrances are being proposed.  One off of 
191st and one off of Jomax Rd. 
 
Community Facilities and Services –  
 
Schools: This site is within the “Nadaburg Unified” public school district.  There are no 
schools within 5 miles of this site. 
Parks: There are no parks within 10 miles of this site. 
Amenities: The site and the area are mostly undeveloped.  There are no amenities in 
the area. 
 
Development Schedule –This Plan of Development process is estimated to take 5 months.  
 
The goal for final design and permit document submittals to the County and City of Phoenix is 
scheduled for early January 2025, with construction starting in March of 2025.

A permanent restroom facility will be provided for patrons of the business.  Potable water will

by MCESD.  The office and care taker’s residence will have sanitary service via an onsite septic 
system.   
 
There is no County or City sanitary service available to this site.  The office and care taker’s 
residence will have sanitary service via a new onsite septic system.   
 
Citizen Participation Summary – The applicant will comply with the Maricopa County Citizen 
Review Process with the required posting of the site and notification by first class mail to 
adjacent property owners within 300’ of the subject parcel and interested parties.

8.32 acres undeveloped land. The RV storage facility will consist of 498 parking spots and will be accessed by two proposed full access driveways.  A Mini-Warehouse land use code 
is assumed to be the best-fit for the proposed development. The site is estimated to generate 90 daily trips, 5 AM peak hour trips, and 8 PM peak hour trips per day.

The Maricopa County Environmental Services Department (MCESD) has completed review 
for the  191st and Jomax – RV Storage planning case(s). Please note the following MCESD 
requirements for site development: 
Drinking Water –  
Per the Safe Drinking Water Act, any water system that supplies more than 25 people or 15 
service connections per day for at least 60 days per year is classified as a Public Water 
System (PWS).  
• 
If the proposed restroom is open to the customers and the above criteria are met, a 
Public Water System application and a New Source Approval application are 
required and must be submitted to the MCESD’s Drinking Water Program. A water 
quality analysis report will be required with submittal and is good within one-year of 
testing. 
 
An Approval to Construct application is required to be submitted to the MCESD’s Treatment 
Program for all water treatment facilities.

A Notice of Intent to Discharge application for an onsite wastewater treatment (septic) 
system is required for any construction. Application must be submitted to the MCESD 
Onsite Wastewater Program.

Wastewater is not permitted to discharge to an adjacent parcel’s septic system.

Setback requirements must be maintained per Arizona Administrative Code, Title

Engineering Review has reviewed the 3rd plan and report routed for review on 
12/09/2024, for the subject application and has no objections provided the following 
stipulations are part of any approval.
1.
Ultimate half-width improvements along 191st Avenue including curb, gutter 
and sidewalk must be constructed with site building permit per RDM Figure 
5.11
2.
37-feet of pavement (centerline to face of curb) shall be provided along Jomax 
Road.
3.
Proposed driveways shall meet commercial and industrial driveway standards 
per the latest MCDOT Roadway Design Manual (RDM) Section 7.6.3. 
4.
Gated access shall provide adequate turn around area so that vehicles will not 
back onto public roads.
5.
Plans submitted for Building Permits must clearly show how all runoff is routed 
to the retention basins. Retention basins must de-water within 36-hours.
 
6.
Engineering review of planning and/or zoning cases is for conceptual design 
only. All development and engineering design shall be in conformance with 
Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and 
Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway 
Design Manual; and current engineering policies, standards and best practices 
at the time of application for construction.
7.
Based on the conceptual design nature of the information submitted, changes 
to the site layout may be necessitated by the final engineering design of the 
drainage infrastructure.

Thank you for the opportunity to comment on the plan of development application for the 
RV, Boat and Truck Storage at 191st and Jomax Rd.  In addition to the outdoor storage space, 
there is a proposed 2-story building designed for an office and living quarters which will 
accommodate an overnight caretaker.
 
The site sits on approximately 8.3 acres and is located at the northeast corner of 191st
Avenue and Jomax Road in unincorporated Maricopa County, AZ.  The site is located partially 
inside the Luke AFB Aux-1 2004 JLUS 65 DNL, “high noise or accident potential zone,” as 
identified by A.R.S. § 28-8461, and is within the “territory in the vicinity of a military airport,” 
also defined by A.R.S. § 28-8461.   
 
Luke AFB follows A.R.S. § 28-8481 when evaluating compatible land use within the 
“territory in the vicinity of a military airport” and we consider the proposed RV, Boat and Truck 
Storage on APN 503-51-080M to be compatible and consistent with the high noise or accident 
potential of the military airport or ancillary military facility, subject to the following condition:

The 2-story building which will contain the living quarters remains outside of the 
Aux-1 2004 JLUS 65 DNL, “high noise or accident potential zone” (please see parcel 
map).
Since the development will be located within the “territory in the vicinity of a military 
airport,” it will be subjected to approximately 170 over flights a day.  We recommend you 
review the sound attenuation requirements found in A.R.S. § 28-8482.  A strong notification 
program on the part of the applicant is essential to inform potential occupant(s) about Luke AFB 
operations.

If applicable, it should be noted that certain investments and real estate transactions 
within the military installation footprint of Luke AFB may be subject to review by the 
Committee on Foreign Investment in the United States (CFIUS) to determine the effect of such 
transactions on the national security of the United States.  The CFIUS regulations, Foreign 
Investment Risk Review Modernization Act of 2018 (FIRRMA) provisions, and related

The Arizona Game and Fish Department (Department) reviewed your Project Evaluation 
Request dated July 24, 2024, regarding the construction of a new RV, boat, and truck storage 
facility on 8.32 acres of Sonoran desert scrub near Wittman, Arizona. Based on the information 
provided, the Department offers the following general recommendations:

Suitable habitat for the western burrowing owl, a special status species that is regulated
under the Migratory Bird Treaty Act (MBTA), may be present within the vicinity of the
project. If an active burrowing owl burrow is detected, please contact the Department and
the U.S. Fish and Wildlife Service for direction, in accordance with the Burrowing Owl

Minimize the potential introduction or spread of exotic invasive species, including
aquatic and terrestrial plants, animals, insects and pathogens. Precautions should be taken
to wash and/or decontaminate all equipment utilized in the project activities before
entering and leaving the site. Please review the Arizona Department of Agriculture’s
website for a list of prohibited and restricted noxious weeds and the Arizona Native

Plant Society for recommendations on control methods. To view a list of documented

invasive species or to report invasive species in or near your project area visit

If trenching will occur, trenching and backfilling crews should be close together to
minimize the amount of open trenches at any given time. Avoid leaving trenches open
overnight. Where trenches cannot be back-filled immediately, escape ramps should be

wooden planks sloping to the surface. The slope should be less than 45 degrees (1:1).
Trenches that have been left open overnight should be inspected and animals removed
prior to backfilling.

All new commercial construction within the boundaries of the North County Fire & Medical 
District is required to have a fire suppression system with a reporting alarm (Local amendments to 
IFC 2018) 
o Deferred submittals will be required for the fire alarm and the fire suppression systems. 
 
The project will require a water source with an approved flow rate (NFPA minimum 1500gpm) for 
fire protection and suppression. 
 
Entry and exit gates (if powered) will require a knox key switch and pre-emption.  Manual gates will 
require a knox lock. 
 
A knox box will be required at the entry to the property

We received a request of a plan of development for a proposed RV, Boat, and Truck storage over 8.32 acres in the 
Wittmann area.  The property is partially within the LDN 65 noise contour and subject to the MAAMF zoning overlay, 
which requires legislative approval of the Plan of Development.  The subject property has proper entitlement to allow 
the proposed uses via Military Compatibility Permit MCP2010001 and Special Use Permit Z2008021.  The proposed POD 
covers both entitlement portions of the site and will supersede the POD established by these cases.   
  
The TAC for the case will be held on 9/3/24.
