Staff has received a request from the applicant for an update of conditions ‘c.1 – c.3’ of 
the staff report for the inclusion of additional area for non-development on approximately 
18 acres and also an amendment to condition ‘b’ to include the Enhanced Setback Exhibit 
dated 12/24/24.
The requested changes are as follows:
b. A Plan of Development is approved subject to site plan entitled “Sun Basin III Solar 
Project” consisting of 12 full-size sheets, dated November 2024. The Enhanced 
Setback Exhibit dated December 27, 2024 and stamped received January 7, 2025 
identifies approximately 18 acres which this area will not allow fencing, solar or 
ancillary solar uses. The Plan of Development may be amended administratively 
under separate application as long as the amendment complies with the 
established IUPD development standards as approved by the Board of 
Supervisors. Staff may determine slight refinements to remain in substantial 
conformance with the approved site plan.  Minor and major amendments to the 
site plan will be determined in accordance with Chapter 3 of the Maricopa County 
Zoning Ordinance.
c. The following IND-2 IUPD standards shall apply: 
1. Min. Front Setback: 10’ (Except along Arlington School Road/Narramore 
Road and 339th Avenue where 100’ setback is required, except in 
locations generally depicted on the Enhanced Setback Exhibit, dated 
12/27/24. In these areas, no fencing or solar facilities are permitted.)
2. Min. Side Setback: 10' (Except along Arlington School Road/Narramore 
Road and 339th Avenue where 100’ setback is required, except in 
locations generally depicted on the Enhanced Setback Exhibit, dated 
12/27/24. In these areas, no fencing or solar facilities are permitted)
3. Min. Rear Setback: 10’ (Except along Arlington School Road/Narramore 
Road and 339th Avenue where 100’ setback is required, except in

locations generally depicted on the Enhanced Setback Exhibit, dated 
12/27/24. In these areas, no fencing or solar facilities are permitted)

Per the exchange below, we would like to request the following revisions to the Stipulations to accommodate the 
inclusion of the Enhanced Setback Area that will restrict development within it.    Please let me know if you need 
anything else. Note that the Exhibit date changed from my exchange with Rachel.  It is actually 12/31/24 and not 
12/27/24.
