I have been attempting to reach you both via telephone to discuss the variance application –
BA250076 – Gonzales Property scheduled for the upcoming December 11th Board of
Adjustment hearing. Isaac Perez is the planner working the case, but he is out the office this
week. I’m assisting him with get the report completed.
 
Upon coordination with MCDOT on the variance application, MCDOT has not signed off
on variance application. The reason is associated with Southern Avenue right-of-way
(ROW), which MCDOT has indicated that they are requiring 100-feet of half-width of
future right-of-way.  The proposed single-family residence would be located in the future
right-of-way region.  
 
MCDOT has indicated that the property owner will need to submit for a MCDOT ROW
Reservation Action Request in order for MCDOT to evaluate if the future ROW along
Southern can be reduced.

Based upon not receiving sign-off from MCDOT on the variance application, I would like to
recommend that we ask the Board of Adjustment for an indefinite continuance on the
variance application in order for the owner to file the MCDOT ROW Reservation Action
Request form for the ROW request.

Please contact me as soon as possible so we can discuss. We are scheduled to go to print
tomorrow with the variance application report.
