I also left you a voicemail yesterday following up from our phone conversation on Monday and the email that was sent to you. A message was also left with your oƯice at (602) 956- 1323 this morning. If I do not hear back from you by the end of the day, staƯ will request from the Board of Adjustment an indefinite continuance until the MCDOT waiver is obtained. The application will remain open, but it will not be scheduled for another hearing until the waiver is obtained. They would need to submit a waiver yes for 103rd Drive as there is no waiver for their parcel. However, Angela’s email explains it, but the placement on Jomax is the biggest issue as it would be within the area Peoria would need to improve the south half of the roadway. Although the location is not a part of the variance application, would the location of the retaining wall be problematic for the applicant? I do not believe that the applicant has applied for a waiver through MCDOT yet? There appear to be several waivers that have been granted along this midsection line in the past.
