Variance Requests:

The applicant proposes to disturb hillside slopes of 15% or greater outside the lot’s building
envelope for both primary residence construction and the septic system with the primary and
reserve systems. The hillside disturbance for the proposed location of the primary residence will
encroach within the southern and northern 30-foot interior side setbacks and within the front 40-
foot front yard setback. Additionally, the septic systems spill materials are also proposed within
the northern 30-foot interior side setback. The lot is 52,902 sq ft and the approximate area of the
hillside designation within the lot is 45,806 sq ft. leaving only 7,096 sq ft of non-hillside area
towards the northern side of the property. The total amount of hillside disturbance proposed is
10,476 sq ft.

Site Analysis:

The lot is within a lot-split area located along the 10th St. alignment south of Circle Mountain Rd.
at the foot of Pyramid Peak, a notable geographical feature in New River with a peak elevation of
2,612 ft. at its highest, westernmost peak. The property lies just north of the third highest peak of
Pyramid Peak that rises 2,445 ft high. Due to the location, the majority of the lot features hillside
slopes of 15% and hosts a major wash bisecting the property north to south. Neighboring
properties have been developed with hillside conditions. The site is currently undisturbed desert
foothills scrub vegetation. Development of the site would be nearly impossible without significant
disturbance of the hillside slopes. The proposed location of the single-family residence is the
most feasible position of the lot that provides the most direct connection to the 10th St. frontage
access for the site.

State Statute / County Zoning Ordinance Tests - ARS § 11-816.B.2 and MCZO Article 303.2.2 states the
Board of Adjustment may, “Allow a variance from the terms of the ordinance if, owing to peculiar
conditions, a strict interpretation would work an unnecessary hardship and if in granting the variance the
general intent and purposes of the zoning ordinance will be preserved.”

Statutory Test -1 Does the applicant’s property contain any peculiar condition– Discuss and
explain what is/are the peculiar conditions facing the property and include reference to the
Maricopa County Zoning Ordinance Regulations or Development Standards to be varied.
“The property faces several peculiar conditions which would create unnecessary hardship when
following a strict interpretation of the Ordinance:
•
Topography – Presence of a wash that runs across the entire length of the property from south
to north, bisecting the land into two separate sections. The easternmost of which is so narrow
it is entirely non-buildable for a primary structure; and the westernmost of which is narrow
enough to severely limit development in conformance with the Zoning District. The wash also
created a 50’ setback for the on-site wastewater treatment facility (septic system including
reserve). The slope of the property and location of the wash restrict the placement of the
system, leaving little option.
•
Topography – Natural slopes in excess of 15% covering more than 73% of the property’s total
area (hillside).
•
Easement – 30’ easement for ingress and egress (per Docket 12047, Page 1003, M.C.R.
(Recording Number 1977-0036097)) on the entire length of the property’s western perimeter.
The west border of the property is considered the “front” and, as such, is also subject to a 40’
front yard setback per MCZO Chapter 5 – Rural Zoning Districts, Article 503.4. Yard Regulations.
Requested Variance: MCZO Chapter 12 – Development Regulations, Section 1201 Hillside, Grading
and Drainage Requirements, Articles 1201.6.1.1.,2., and 6: allow disturbance and placement of the
septic system beyond the building envelope.

Statutory Test 2 – Does applying the requirements of the Ordinance to the applicant’s property
create an Unnecessary Hardship – Explain how the peculiar condition identified in #1 causes an
unnecessary hardship to the property when the requirements of the Maricopa County Zoning
Ordinance are applied. Explain how the that the peculiar condition of the property came to be and
whether the condition was created by the applicant or someone in the property’s line of title.
Explain the proposed use of the property with the variance request. Identify and explain all
peculiar conditions on your property in regard to the following areas: slope, narrowness,
shallowness, irregular shape, location, washes, vegetation, and easements, etc. Explain how
enforcement of the Zoning Regulations or Development Standards would impose a hardship on
the property.
“MCZO Chapter 12 – Development Regulations, Section 1201 Hillside, Article 1201.6.1. Grading and
Drainage Requirements indicates that any disturbance shall be located entirely within the buildable
area of the lot. The presence of the wash on the eastern 30-40% of the property, combined with the

30’ easement on the west, 40’ front yard setback on the west (70’ total), 30’ side yard setbacks, and
septic setbacks, creates a very limited buildable area in which to construct a typical residential
structure with attached garage and septic system. We have designed all above-ground
improvements to comply with the existing setbacks, but need relief to install portions of the on-
site septic system underground per the County’s On-Site Wastewater Treatment Facility Setback
Distance Chart without adding hillside restrictions (30’ from side property line) as there is no space
to push the system another 25’ inward while maintaining the 10’ minimum distance required
between the home and the system. Also, there is a certain amount of disturbance involved when
constructing any structure (space for equipment and workers to operate). Relief is required to allow
temporary disturbance beyond the building envelope for construction operations and drainage.”
10.
Statutory Test 3 – General Intent and Purpose of the Zoning Ordinance – Discuss the purpose
of the zoning requirement from which the variance is being sought. Then, discuss and explain
how, provided statutory tests #1 and #2 are satisfied, the granting of the requested variance
would preserve the general intent and purpose of the Zoning Ordinance.
“We have designed all above-ground improvements to comply with the existing setbacks., The
relief we seek is for temporary disturbance and underground improvements (septic system).
We do not request setback relief for above-ground improvements. We do not wish to encroach o
the setbacks or negatively impact views. (Note: Surrounding properties are significantly elevated
above this parcel). Our design keeps the building tucked in close to the established setbacks,
consolidates the disturbance, and keeps the structure away from the site’s natural drainage
conveyance. Any disturbed areas will be reestablished with a mixture of indigenous grasses,
shrubs, trees or cacti to provide a basic ground cover which will prevent erosion and permit natural
revegetation. This approach ensures maintenance of the character, identity, and image of the
hillside area on this property, supports the preservation of natural topographic features, and
minimizes scarring from hillside construction. Furthermore, the requested variance is consistent
with the existing development of surrounding properties, both those adjacent to an near this
property. Major grading and drainage improvements, including retaining walls have been
constructed beyond the standard building envelopes, indicating variance for yard setbacks or for
hillside grading and drainage requirements (See attached photos.)”
Findings:

The applicant has the burden of proving to the Board that, in accordance with the standard set
forth in ARS §11-816.B.2 and MCZO Article 303.2.2, the property requires a variance. To grant the
relief, the applicant must prove, and the Board must find and identify, a physical condition of the
applicant’s property that is peculiar and not common to the area or the universe of the zoning
district. Also, any such peculiarity must not have been created either by the applicant or anyone
in the chain of title. If the Board determines that there is no such peculiar physical condition, its
inquiry stops, and the application must be denied.
If the Board identifies a peculiar physical condition of the applicant’s property which is not self-
imposed, then the applicant must prove, and the Board must find and identify, an unnecessary
hardship imposed upon the property due to the strict application of the requirements of the zoning
ordinance which the applicant wishes to have varied such that there is no viable use of the
property without the variance.
If the Board identifies a peculiar physical condition of the property which is not self-imposed, and
that in applying the requirements of the zoning ordinance to the property, because of the peculiar
physical condition, an unnecessary hardship exists, the applicant must prove, and the Board must
find and identify, how the granting of the variance will preserve the general intent and purpose of
the zoning ordinance.

In order to approve the variance the Board must make findings and articulate them in motion
memorializing the above.
12.
Based upon what the applicant has submitted and the staff analysis in this report, staff offers the
following positive and/or negative observations the Board may consider in its findings:
•
The applicant has demonstrated that the presence of hillside slopes greater than 15%
encompassing the majority (87%) of the lot along with a major wash bisecting the property
create peculiar conditions preventing reasonable development of the lot and placement
of the septic system within the buildable area of the lot.
•
The applicant has demonstrated applying the requirements of the MCZO to this property
that has this peculiar condition causes an undue physical hardship that prevents the
installation of the septic system on the property. Due to physical and geotechnical
limitations created by the existing horizontal slopes and the existing wash that runs
through the middle of the site, feasible installation of the septic system is limited to the
northwestern / northern portion of the property, extending outside of the building
envelope.
•
The applicant has demonstrated that the general intent and purpose of the MCZO will be
preserved despite the variance. The development of the single-family residence meets the
Rural-43 development standards. Approval of the variance will allow for the installation of
the septic system outside of the building envelope and minimal hillside disturbance
outside the building envelope, owing to the peculiar condition of the property, that would
otherwise not be possible without a variance.
13.
And further, if the Board finds the applicant has satisfied the statutory test, and has stated its
findings on the record, the grant of this variance will memorialize the following:
a)
Variance approval establishes total hillside disturbance allowance of 10,476 sq. ft.,
including disturbance outside the lot’s buildable area within the west front yard and the
north and south interior side yard for APN 202-20-437C.
b)
Variance approval establishes sewage disposal system spill materials outside the
buildable area within the west front yard and north interior side yard setback for APN 202-
20-437C.
c)
Variance approval is not related to driveway or utility connection outside of the principal
building envelope for APN 202-20-437C.

PROPOSED USE OF THE PROPERTY: single-family residential (consistent with existing uses in this Zoning District (Rural-43)).
PECULIAR CONDITIONS & HARDSHIP: This property faces several peculiar conditions which would create unnecessary hardship
when following a strict interpretation of the Ordinance:
• Topography - Presence of a wash that runs across the entire length of the property from south to north, bisecting the land
into two separate sections. The easternmost of which is so narrow it is entirely non-buildable for a primary structure; and the
westernmost of which is narrow enough to severely limit development in conformance with the Zoning District. The wash
also creates a 50’ setback for the on-site wastewater treatment facility (septic system including reserve). The slope of the

GRANTING THE REQUESTED VARIANCE WOULD NOT CAUSE A NEGATIVE IMPACT ON THE GENERAL INTENT AND PURPOSE OF THE
ZONING ORDINANCE:
