This is great news. I spoke with the homeowners, and we would like to withdraw the variance request.
Do we need to submit anything new to initiate the planning and building review process? Also, how
long will it take for the homeowners to receive the refund?

Good morning, Diego,
I have some news, actually – you will no longer be required to proceed with your variance request. During my
review, I discovered that the subdivision plat for the property (Holly Acres) requires a side setback of only 5’ (not
30’ as normally required in the Rural-43 zoning district). Likewise, the plat requires a front setback of only 20’ and a
rear setback of only 25’. I’ve notified the zoning plans examiner assigned to the owners’ building permit, so the
setbacks will not be an issue going forward with the permit.

What we’re going to do is publish a memo confirming that the property’s area and width were both created by
government action. The variance will no longer be necessary, so we can withdraw it and issue a refund. All I need
from you is confirmation that you would like to withdraw your variance request, and if so, we will issue a refund,
and you will no longer be required to attend the BOA hearing.

Good morning, Diego,
Yes, I do recommend coming prepared to provide just a summary of why you’re requesting the variance. You won’t
need to prepare much. What’ll happen is, when our case comes up on the agenda, I will begin with a brief
presentation summarizing our analysis of the case. This will last about 2 or 3 minutes. The Board will then invite
you to the podium to speak as well. You are welcome to send me a PowerPoint presentation to go with your
remarks (I would need it by Tuesday, May 13th at noon), but this is totally optional. All you really need is to provide a
few brief remarks summarizing your request and why the variance is necessary, and it doesn’t need to be more
than a minute or two.
And yes, the property owners and contractor are certainly welcome to attend as well!

Good morning, Diego,
This is Nick with Maricopa County Planning. I wanted to let you know that I have placed your variance request (per Case
BA250018) on the next agenda of the Board of Adjustment (BOA), which has been set for Thursday, May 15th. The BOA
hearing starts at 10:00 a.m. and will be held at the Board of Supervisors’ Auditorium at 205 W. Jefferson Street in
Phoenix.
With all BOA cases on the regular agenda, your attendance will be required. Otherwise, the BOA will continue the case
to the next month’s agenda on June 19th. However, you may choose whether to attend virtually or in-person. If you wish
to attend virtually, please let me know, and I will send you a virtual registration link the Friday before the hearing.
The BOA agenda and staff report will be available on the on the Agenda Center webpage
(https://www.maricopa.gov/AgendaCenter/Board-of-Adjustment-3) for downloading on Friday, May 9th.
On Tuesday, May 13th, I will follow up with you to verify that you received the agenda and staff report.
After the Board determination (approval/denial/split decision) of the case, Planning staff will prepare a determination
letter to send to you within three (3) business days of the hearing.
