Variance Requests:

The applicant proposes to exceed the maximum retaining wall height and the maximum height
for the overall combined retaining wall and screening wall along the rear parcel boundary line to
help facilitate the design of a future RV condo facility. The Carefree Mancave facility is currently
under preliminary plat review with case S2024016. During review, design items were identified
that do not meet Maricopa County Zoning Ordnance (MCZO) standards for a portion of the
retaining wall system designed at the southeast corner of the property.

The applicant is requesting to amend the maximum height of a retaining wall to 10-feet where 6-
feet is permitted by ordinance. The wall height is being requested to facilitate a drainage channel
that will route offsite water flows though the site. Due to the drainage channel design being at a
lower grade than the surrounding land and the specific topography of the site, portions of the
retaining wall will be required to be at 10-feet in height.

Per zoning district standards all commercial uses require CMU wall screening of at least 6’ from
neighboring residential uses. The applicant is requesting to place the required 6’ wall on top of
the portion of retaining wall that is requesting the height adjustment. A combined 16-foot
retaining/screen wall combination exceeds the 14-foot maximum per the MCZO.

Site Analysis:

The site is an undeveloped rectangular lot that fronts onto Carefree Hwy. The lot slopes down
south from the roadway into a natural shallow wash that runs parallel to the roadway. The wash
carries water flows from the west to east with the high point on the parcel located in the southeast
corner and gradually sloping downward to the west and north. The Carefree Highway Scenic
Corridor plan is silent on retaining wall requirements, though it does mention a limited height for
screening walls to a maximum of 6’.

conditions, a strict interpretation would work an unnecessary hardship and if in granting the variance the
general intent and purposes of the zoning ordinance will be preserved.”

Statutory Test -1 Does the applicant’s property contain any peculiar condition– Discuss and
explain what is/are the peculiar conditions facing the property and include reference to the
Maricopa County Zoning Ordinance Regulations or Development Standards to be varied.
“The site topography along the southeast portion of the property requires a grading plan that
exceeds the retaining wall height limitations set forth in MZO section 1111.5.2.4. The request
would be to allow an increase of retaining wall (retaining portion) from 6'-0" to 10'-0". This wall
design would have a 6'-0" non-retaining wall on top of the retaining wall such that the (southerly)
neighboring residential properties privacy is maintained and appears (outwardly) no different than
a privacy / screen wall. The property was rezoned from Rural 43 to C2-CUPD to allow for 48 for-
sale self-storage garage condominium units (reference Z2023089). As part of the approval, the
site must maintain the following: 120-foot setback from Carefree Highway, 10-foot perimeter
landscape setback, and a 10' wide multi-use path with easement for public use in front of the site.
The site configuration consists of (4) buildings across the site. Due to the 3rd street alignment
required for site ingress and egress and a site circulation design that minimizes reversing with
trailers and equipment by condominium unit owners, the site design required the building designs
to be oriented in a north / south layout. The site's natural topography is largely gently sloped
across much of the property. However, the topography slopes much steeper towards the
southeast portion of the site. The site must also convey off-site water flows through the site from
the southwest, towards the northeast portions of the site.”

Statutory Test 2 – Does applying the requirements of the Ordinance to the applicant’s property
create an Unnecessary Hardship – Explain how the peculiar condition identified in #1 causes an
unnecessary hardship to the property when the requirements of the Maricopa County Zoning
Ordinance are applied. Explain how the that the peculiar condition of the property came to be and
whether the condition was created by the applicant or someone in the property’s line of title.
Explain the proposed use of the property with the variance request. Identify and explain all
peculiar conditions on your property in regard to the following areas: slope, narrowness,
shallowness, irregular shape, location, washes, vegetation, and easements, etc. Explain how
enforcement of the Zoning Regulations or Development Standards would impose a hardship on
the property.
“The site's resultant grading design faces hardships in meeting MZO 1111.5.2.4 which requires a
variance. Due to the design criteria that were developed as part of Z2023089 listed above,
maintaining the required setbacks and easements and the need to convey off-site water flows at
their same inflow and outflow points, the resultant grading design requires a portion of the site to
require approximately 10 feet of retaining. A meeting was held between the design team and
Maricopa County Planning & Development Staff (Mark Sipes, Andrew Lorentzen) on March 21,
2025. Initially, a potential solution to avoid requiring a variance if the 10-foot southern landscape
setback was used to step down the grades in this area. Upon further review, this appears doubtful
in accomplishing due to the off-site drainage design that also needs to be accommodated to ensure
foundation wash-away issues are addressed.”

Statutory Test 3 – General Intent and Purpose of the Zoning Ordinance – Discuss the purpose
of the zoning requirement from which the variance is being sought. Then, discuss and explain
how, provided statutory tests #1 and #2 are satisfied, the granting of the requested variance
would preserve the general intent and purpose of the Zoning Ordinance.
“As previously mentioned, granting this variance request will not cause any negative impact on the
general intent and purpose of the zoning intent as the variance:
1. Applies only to a minimal (south / eastern) portion of the site / screen walls.
2. Does not have any visibility to the public - only interface is with adjacent residential access road.
3. Will have not have any outward facing appearance of increased retaining wall area.

4. Will provide necessary structural detailing to meet endorsed code (weeps, reinforcement
foundation) compliance.
5. Will provide a wall design that is consistent in appearance with adjacent site screen walls.
6. Will allow for a better landscape planting solution than a stepped wall design as it allows greater
usable planting area to allow for
trees and shrubs to be planted on a larger plane which provides greater (interior facing) wall
screening, see Civil site wall section D/3 for current proposed wall profile and adjacent landscape
planting area.”
Findings:

The applicant has the burden of proving to the Board that, in accordance with the standard set
forth in ARS §11-816.B.2 and MCZO Article 303.2.2, the property requires a variance. To grant the
relief, the applicant must prove, and the Board must find and identify, a physical condition of the
applicant’s property that is peculiar and not common to the area or the universe of the zoning
district. Also, any such peculiarity must not have been created either by the applicant or anyone
in the chain of title. If the Board determines that there is no such peculiar physical condition, its
inquiry stops, and the application must be denied.
If the Board identifies a peculiar physical condition of the applicant’s property which is not self-
imposed, then the applicant must prove, and the Board must find and identify, an unnecessary
hardship imposed upon the property due to the strict application of the requirements of the zoning
ordinance which the applicant wishes to have varied such that there is no viable use of the
property without the variance.
If the Board identifies a peculiar physical condition of the property which is not self-imposed, and
that in applying the requirements of the zoning ordinance to the property, because of the peculiar
physical condition, an unnecessary hardship exists, the applicant must prove, and the Board must
find and identify, how the granting of the variance will preserve the general intent and purpose of
the zoning ordinance.
In order to approve the variance the Board must make findings and articulate them in motion
memorializing the above.

Based upon what the applicant has submitted and the staff analysis in this report, staff offers the
following positive and/or negative observations the Board may consider in its findings:

The on-site topography creates unique drainage challenges for site design.
16.
And further, if the Board finds the applicant has satisfied the statutory test, and has stated its
findings on the record, the grant of this variance will memorialize the following:
a)
Variance approval establishes a retaining wall height of 10’ for APN 211-24-137A along
the southern and eastern perimeter boundary.
b)
Variance approval establishes a screening wall and retaining wall combination height of
16’ for APN 211-24-137A along the southern and eastern perimeter boundary.
