opposition. There are no outstanding concerns from reviewing

On 1/25/24, the Commission voted 7-0 to adopt a motion 
recommending the Board of Supervisors approve Z2023142 
subject to conditions ‘a’ – ‘j’:  
 
a. 
Development of the site shall be in substantial conformance with the narrative report 
entitled “Zone Change with Overlay – White Tank Energy Storage”, consisting of 12 
pages, dated 12/21/2023, and stamped received 12/26/2023, except as modified by the 
following conditions. 
 
b. 
Development of the site shall be in substantial conformance with the zoning exhibit 
entitled “White Tank Energy Storage Zone Change with Overlay Site Plan“, consisting of 6 
full-size sheets, dated 12/26/202, except as modified by the following conditions. 
 
c. 
Prior to issuance of initial building permits, the applicant must provide a report to 
Maricopa County Planning & Development and Arizona Game & Fish Department 
regarding the existence of any animals covered under the Migratory Bird Treaty Act. If 
such animals are detected on-site, the applicant must contact the Arizona Game & Fish

Department and the U.S. Fish and Wildlife Service and provide a further report to the 
County regarding the results of such consultation. 
 
d. 
The following IND-2 IUPD standards shall apply:  
 
Additional Regulations (MCZO Section 902.9.1)- The activities and operations associated 
with the BESS staging area use and activities are not required to be conducted within a 
completely enclosed building. 
 
Parking ( MCZO Section 1102) - Office: 1 space per 750 sf., Industrial: 1 space per 1,200 
sf. 
 
Perimeter Screening (Side & Rear abutting a rural or residential zoning district) – Min. 6’ 
chain link fencing. 
 
e. 
Prior to issuance of initial building permits, written confirmation will be required from the 
emergency fire protection jurisdiction having authority that the facility has been designed 
in accordance with their regulations and requirements, and that emergency fire protection 
service will be provided to the facility. Prior to issuance of the certificate of occupancy, 
local fire protection jurisdiction review and approval will be required. 
 
f. 
Prior to issuance of initial building permits, a lot split shall be processed to create a 
single, separate parcel matching the zone change area. 
 
g. 
The following Planning Engineering conditions shall apply: 
 
1. Without the submittal of a precise plan of development, no development approval is 
inferred by this review, including, but not limited to number of proposed building 
lots/units, drainage design, access and roadway alignments. These items will be 
addressed as development plans progress and are submitted to the County for further 
review and/or entitlement. 
 
2. A Preliminary Grading and Drainage Plan and Drainage Report are required with the 
Plan of Development. The Maricopa County Zoning Ordinance (MCZO) required that 
all commercial submittals be prepared by a Civil Engineer registered in the State of 
Arizona. (MCZO 1205.7.2) 
 
3. For retention volumes required, please see section 6.10.5 of the Maricopa County 
Drainage Policies and Standards Manual for the equation, V=C*(P/12)*A. The 100-
year, 2-hour rainfall depth (P) in inches can be taken from NOAA Atlas 14. The 
volumes, using this equation, vary slightly compared to the drainage report and does 
not affect the overall volume provided. This can be addressed during the Plan of 
Development.

interactive Engineering Plan Review checklist. (Please be sure to check commercial 
and all related grading matters so the checklist expands properly). 
 
5. This site contains Special Flood Hazard Areas (FEMA Zone AH) along the proposed 
access route and within the site.

6. Any development in the floodplain will require a floodplain use permit issued 
concurrent with building permit(s) required for site development. Structures in the 
floodplain must be elevated to the regulatory flood elevation determined by the 
engineer. 
 
7. The site is adjacent to lands owned or encumbered by the Flood Control District. In 
addition to floodplain use permitting, ROW permitting may be required by the District. 
 
8. Please see MCDOT TIS approval attached. A traffic impact study must also be 
submitted with future entitlement (POD) application(s). 
 
9. Gated access(es) must provide an adequate turnaround area so that vehicles will not 
back onto public roads. 
 
10. The City of Phoenix maintains a +/- 45’ strip annexation north of Indian School Road. 
The applicant will be responsible for coordinating with the City to review any permitting 
requirements for work in their jurisdiction. 
 
11. The subject site is located within the County’s Urbanized Area and thus will require a 
Storm Water Pollution Prevention Permit (SWPPP) from the County for any 
disturbance one (1) acre or more. The SWPPP is issued by the County (PND) and will 
be required prior to issuance of any building permits required for site development. 
 
12. Engineering review of re-zone cases is conceptual in nature. All development and 
engineering design shall be in conformance with Section 1205 of the Maricopa County 
Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for 
Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, 
standards and best practices at the time of application for construction. 
 
 
h. 
Noncompliance with any Maricopa County regulation shall be grounds for initiating a 
revocation of this zone change per the process set forth in the Maricopa County Zoning 
Ordinance. Any action by Maricopa County to revoke this zone change shall only occur 
following any and all required notices (including identification of the specific 
noncompliance issue) and cure periods and shall be subject to required public hearings 
before the Planning & Zoning Commission and Board of Supervisors, as set forth in the 
Maricopa County Zoning Ordinance. 
 
i. 
The property owner/s and their successors waive claim for diminution in value if 
Maricopa County takes action to rescind approval due to noncompliance with 
conditions. Any action by Maricopa County to rescind approval shall only occur following 
any and all required notices (including identification of the specific noncompliance 
issue) and cure periods and shall be subject to required public hearings before the 
Planning & Zoning Commission and Board of Supervisors, as set forth in the Maricopa 
County Zoning Ordinance. 
 
j. 
The granting of this change in use of the property has been at the request of the 
applicant, with the consent of the landowner. The granting of this approval allows the 
property to enjoy uses in excess of those permitted by the zoning existing on the date of 
application, subject to conditions. Failure to comply with any condition may be grounds 
for consideration of initiating the process to revert the zoning back to the previous Rural-
43, in accordance with Maricopa County requirements and procedures. Any action by

Maricopa County to revert the zoning shall only occur following any and all required 
notices (including identification of the specific noncompliance issue) and cure periods 
and shall be subject to required public hearings before the Planning & Zoning 
Commission and Board of Supervisors, as set forth in the Maricopa County Zoning 
Ordinance. It is, therefore, stipulated and agreed that either revocation due to the failure 
to comply with any conditions, does not reduce any rights that existed on the date of 
application to use, divide, sell or possess the property and that there would be no 
diminution in value of the property from the value it held on the date of application due 
to such revocation of the zone change. The zone change enhances the value of the 
property above its value as of the date the zone change is granted and reverting to the 
prior zoning results in the same value of the property as if the zone change had never 
been granted.

Project Summary: 
 
1. 
The applicant, Chris Webb with Rose Law Group, representing Strata Energy, is requesting a zone 
change from Rural-43 to IND-2 IUPD with a plan of development to allow for development of an 
up-to 100 megawatt utility-scale battery energy storage system (BESS) on a 9-acre portion of a 
35 acre site located at the northeast corner of El Mirage Rd. and Indian School Rd. bordering 
Phoenix and Avondale. The project’s intention is to store and release generated power within 
battery systems to be used in times of excess service demand.  The project would contain its 
own site power substation as well as project offices and associated work and maintenance 
buildings. The project would include up to three employees overseeing the operations at any one 
time.  
 
2. 
The site is currently part of a mining exemption, entitled under LU20180024, for sand and gravel 
extraction. It should be noted that the front of the site along El Mirage Rd. to the west and directly 
south bordering APNs 501-63-995, 996A, and 999C have been strip annexed by the City of 
Phoenix, although there are no plans for annexation at this time. The proposed facility would be 
located on the eastern half of the parcel, adjacent to the Agua Fria River and away from any 
residential uses. 
 
3. 
The proposal involves an Industrial Unit Planed Development (IUPD) Overlay which allows 
deviation of standards to help meet project intentions. The site would provide an outdoor 
workspace for staff to maintain the battery systems, and the applicant is requesting a deviation 
in standards to allow work to occur in this outdoor space without screening measures or within 
an enclosed building as would otherwise be required. The applicant is also requesting a deviation 
from standard parking requirements from 1:250 sf office & 1:600 sf industrial to 1:750 & 1:1,200 
respectively.

Finally, the applicant is requesting a deviation for wall and screening standards. Current MCZO 
regulations require a 6’ masonry wall for separation, but the applicant is requesting to amend this 
standard to allow a wrought iron fence along with adjacent interior landscaping.

Residential’ which allows land densities over 1 du/ac. 
 
Public Participation Summary:

The applicant complied with the Maricopa County Public Participation Process with the required 
posting of the property and notification by first class mail to the adjacent property owners within 
300’ of the subject site and interested parties. No activity was reported by the applicant.

Staff received correspondence from the Arizona Game and Fish Department regarding the 
documentation of the western burrowing owl within the vicinity of the project site. They 
recommend the applicant conduct a survey of the property to determine is such a population 
exists on-site to limit potential harm to their population. Staff has added a condition preventing 
the issuance of permitting until such a survey has been conducted and provided to the County.

Staff Analysis:

Staff supports the proposed zone change as the project helps provide a unique solution to energy 
need issues within the local power grid. The specific location was chosen due to its proximity to

the Agua Fria River and the current industrial nature of the site. Staff notes limited impact to the 
local residences. Due to the 100’ fire separation setback (required by the Fire District), the 
proposed use would have extensive distance separation from such residences. The request for 
the wrought iron fence goes against conventional requirements for a block wall for separation 
purposes, but the lack of street frontage and existing industrial use on the site mitigates the need 
for stringent screening requirements. Staff recognizes the proposed use as not being a traditional 
‘industrial’ use in that it incorporates thoughtfully designed battery storage units that do not 
create the same level of intensity seen in traditional industrial zones with more intense land use. 
Staff views the wrought iron fence, landscaping, and designed utility cabinets as a viable and 
thoughtful alternative to the traditional CMU block wall screening standard.  
 
Recommendation:

Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve Z2023142 subject to the following conditions ‘a’ – ‘j’: 
 
a.

Background 
 
White Tank Energy Storage, LLC (the “Applicant”), a subsidiary of Strata Clean Energy, 
is proposing the development of the White Tank Energy Storage Project (the “Project”), an up to 
100 megawatt (MW) alternating current Battery Energy Storage System (“BESS”) on 9.00 gross 
acres located northeast of the northeast corner of Indian School Road and El Mirage Road in 
unincorporated Maricopa County, comprising the easternmost portion of Maricopa County APN 
501-63-026K (the “Site”) (see Exhibit A – Aerial Vicinity Map attached hereto). The Site is 
surrounded by an existing aggregate mining operation adjacent to the Agua Fria River, and is 
situated immediately east of the Project’s point of interconnection at the existing Arizona Public 
Service (“APS”) White Tank substation, thereby making the Site well-suited for the proposed 
Project. 
  
BESS such as the proposed Project are a necessary part of a modern and robust power 
network, they safely store abundant electricity generated by renewable energy during daylight 
hours and then feed that energy back into the power grid in the evening when it is most needed. 
The proposed facility would be capable of storing enough electricity to power up to 80,000 homes 
and businesses in the region for up to four hours. The Project would be able to support the regional 
electrical grid in multiple ways that may include immediate power for peak demand on hot days, 
back-up energy to reduce/avoid blackouts, increased grid resiliency, and storage of excess solar 
power to be used  after the sun goes down. In addition to being a necessary component of a diverse 
and resilient electrical grid, the Project would constitute an approximately $167 million investment 
in Arizona and is anticipated to generate approximately $9.2 million in new property taxes over 
20 years. 
 
Purpose of Request 
 
The Site is currently zoned RU-43 and is located within Maricopa County’s White 
Tank/Grand Avenue Area Plan which designates the Site as “Large Lot Residential”. The Site is 
also located within the General Plan planning area of the City of Phoenix, which designates the 
Site as “0 – 1 DU/Acre – Large Lot”. 
 
The purpose of this request is to pursue approval of a Zone Change with Overlay from RU-
43 to “IND-2 (Light Industrial)” with a corresponding Industrial Unit Plan of Development 
(“IUPD”) to allow for the development of the proposed BESS on the Site. It should be noted that 
because of the relatively small size of the Site (9.00 acres), a corresponding amendment of the 
White Tank/Grand Avenue Area Plan is not required. 
 
Description of Proposal  
 
BESS Use & Equipment 
 
 
The requested Zone Change would specifically provide for the development of a new BESS 
on the Site.  The proposed IUPD will therefore restrict the permitted uses on the Site to only those 
that provide for the proposed BESS use as indicated in Table 1: Permitted Uses below. The use 
types described in Section 902.2.17 of the Maricopa County Zoning Ordinance (“MCZO”) have 
been determined by the County to include a BESS. Restricting the Site to these uses will prevent 
other uses that may be considered incompatible with the surrounding area from being constructed

on the Site. Any uses not specifically allowed pursuant to MCZO Section 902.2.17 shall not be 
permitted.

ancillary offices. Attendant facilities and appurtenances to the above 
uses as well as uses associated with service to the public of water, gas, 
telephone and cable television. Where an electrical generating plant is 
in operation, evaporation ponds and other appurtenances may be 
permitted provided such evaporation ponds or appurtenances are 
associated within the facility being served. 
 
Because the Site doesn’t have any actual frontage on Indian School Road or El Mirage Road, 
access to the Site is anticipated to occur from Indian School Road via a private access road that 
would be improved with the Project within an easement granted to the Applicant by the property 
owner. This private access road would utilize an existing driveway located approximately ¼-mile 
east of El Mirage Road. A new, access controlled gated entrance would be provided at the north 
end of the private access road at the Project boundary. The Project would consist of battery storage 
units located within enclosed cabinets mounted on outdoor concrete pads situated in rows (see 
Exhibit B – Example Battery Cabinets attached hereto). Internal drives and fire lanes would 
provide maintenance and emergency response access to the entire Site, including the operations 
areas (explained below), the battery storage units, and the on-site Project substation in the southern 
portion of the Site (see Exhibit C– Site Plan attached hereto).   
 
The new on-site Project substation would interconnect to the existing APS White Tank 
substation adjacent to El Mirage Road, just west of the Site on APN 501-63-995. The proximity 
of the Site to the existing APS substation minimizes the length of the Project’s generation intertie 
transmission line (“gen-tie”) and thus the amount of new transmission infrastructure associated 
with the Project in this area. The Project is a critical one for the regional electrical grid in multiple 
ways, potentially including immediate power for ‘peak’ demand on hot days, back-up energy to 
reduce/avoid blackouts, increased grid resiliency, near-instantaneous response to changes in 
renewable energy generation that help integrate and balance intermittent renewable sources, and 
storage of excess energy available to be discharged to the grid after the sun goes down.  It should 
be noted that the Applicant has completed the necessary system impact study process and has 
executed a Generator Interconnection Agreement (“GIA”) with APS. 
 
On-Site Operations Areas 
 
 
A maximum of three (3) employees are anticipated to work on-site once the Project is 
operational, but no public access to the Site will be permitted. These employees will continuously 
monitor the safety and operations of the Project and perform routine Project maintenance, as 
necessary. An approximately 10’ x 36’ (360 SF) manufactured office building (which includes 
restroom facilities) would be provided at the south end of the Site for use by the Applicant’s on-
site employees. The manufactured office building would be connected to a new septic system and

a new water line from an existing potable well located just south of the Project boundaries on APN 
501-63-028L. Additionally, two (2) approximately 8’ x 48’ (384 SF) storage containers arranged 
around an approximately 51’ x 58’ (2,958 SF) shaded staging area would be provided at the south 
end of the Site for use by the on-site employees. The shade structure would be approximately 11’-
14’ in height and constructed of a polyethylene or vinyl polyester covering attached to steel frame 
posts (see Exhibit D – Office Building & Operations Staging Area Renderings attached 
hereto). This “outdoor” staging area will require a deviation to the IND-2 development standards 
as noted in Table 2: IND-2 Development Standards Comparison below. It should be noted that 
the Applicant may elect to replace the manufactured office building at a future date with a more 
permanent office building structure. Four (4) parking stalls for the Applicant’s on-site employees 
(including one ADA accessible stall) would be provided near the manufactured office building. 
The proposed parking for the Project will require a deviation to the IND-2 development standards 
as noted in Table 2: IND-2 Development Standards Comparison below. 
 
Perimeter Screening 
 
 
The Site would be enclosed with a 6-foot tall perimeter chain link fence. Given that the 
Site is set back significantly (approximately 1,600 feet) from both Indian School Road and El 
Mirage Road, is situated adjacent to the Agua Fria River corridor, and surrounded by existing 
aggregate mining and industrial uses, additional perimeter screening would not be warranted. No 
perimeter landscaping is proposed.  The proposed perimeter screening will require a deviation to 
the IND-2 development standards as noted in Table 2: IND-2 Development Standards 
Comparison below. 
 
On-Site Lighting 
 
Lighting would be limited to bollard lights at the Project entrance/exit and pole mounted 
lights around the on-site Project substation, manufactured office building, and the storage staging 
area in order to satisfy security needs. All lighting would meet MCZO requirements. 
 
Fire & Hazard Mitigation 
 
The Applicant is working closely with Rural Metro to ensure that all fire suppression and 
other public safety measures and concerns are addressed for the Project, including providing an 
onsite water storage tank for fire suppression (as may be required by Rural Metro). Because the 
Project’s operations and staging areas would be located at the south end of the Site, south of the 
battery storage units and near the private access road, Rural Metro will not require a second point 
of access for the Project. The Project design may be updated as necessary prior to permitting per 
direction from Rural Metro, though Rural Metro has already reviewed the Site Plan included with 
this request and confirmed that it meets their requirements. Additionally, at the request of Rural 
Metro, a formal Hazard Mitigation Analysis for the Project will also be prepared and submitted 
for their review. 
 
Proposed Development Standards 
 
 
 
The Site would comply with all the general IND-2 base zoning district regulations. The 
proposed development standards for the Project, including three minor deviations to the IND-2

development standards are outlined in Table 2: IND-2 Development Standards Comparison 
(deviations shown in bold) and described below.  
 
 
The first development standard deviation proposed for the Site is to provide for the above-
referenced BESS staging area activities to be conducted “outdoors”, outside of a completely 
enclosed building. MCZO Section 902.9.1 requires that all IND-2 uses except for parking, loading, 
unloading or storage be conducted within a completely enclosed building. While we believe the 
proposed BESS staging area use and activities are already very similar in nature to these 
exceptions, a specific deviation to allow the BESS staging area use and activities to be conducted 
outdoors is requested. 
 
 
 
The second development standard deviation proposed for the Site is a reduction in the 
amount of required parking. As noted above, the Site would include 360 SF of “office” use and 
approximately 2,958 SF “industrial” use between the 2 storage containers and the covered staging 
area. At a parking ratio of 1 space per 250 SF for “office” and 1 space per 600 SF for “industrial” 
(per MCZO Section 1102), the Site would require a total of 7 parking spaces. However, the Site is 
not open or accessible to the public and the Applicant anticipates a maximum of three (3) on-site 
employees. The Applicant is therefore proposing to provide a total of 4 parking spaces (including 
one ADA accessible space), based on a ratio of 1 space per 750 SF for “office” and 1 space per 
1,200 SF for “industrial”, which is more than sufficient for their on-site employees and operational 
needs. 
 
 
 
The third development standard deviation proposed for the Site is to allow for a 
modification of the perimeter screening requirements. As noted above, the Site would be enclosed 
with a 6-foot tall perimeter chain link fence rather than a 6-foot masonry wall.  No perimeter 
landscaping is proposed. The Site is set back significantly (approximately 1,600 feet) from both 
Indian School Road and El Mirage Road, is situated adjacent to the Agua Fria River corridor, and 
surrounded by existing aggregate mining and industrial uses. The level of screening provided by a 
6-foot masonry wall and perimeter landscaping should not be required from these uses.

The requested Zone Change is compatible with the surrounding land uses. The Site is 
bordered on the north and east by the Agua Fria River corridor and associated Flood Control 
District of Maricopa County (“FCDMC”) facilities, and existing aggregate mining operations 
zoned “RU-43”. The Site is also bordered on the west by existing aggregate mining operations 
zoned “RU-43”. Finally, the Site is bordered on the south by existing aggregate mining operations 
zoned “RU-43” and an existing storage facility zoned “A-1” in the City of Avondale. 
Consequently, approval of this request is not expected to alter the current feel of the area for the 
surrounding properties given the complete lack of traffic anticipated to be generated by the Project, 
the minimal on-site employees associated with the Project once operational, as well as the existing 
surrounding aggregate mining operations in the immediate area. Table 3: Surrounding Uses,

Location & Accessibility 
 
 
As noted above, the Site is located northeast of the northeast corner of Indian School Road 
and El Mirage Road. The Site can easily be accessed by taking the Indian School Road exit off of 
the Loop 101 freeway and then heading west toward the Site. Indian School Road is an existing 
five-lane paved roadway adjacent to the Site.  Because the Site doesn’t have any actual frontage 
on Indian School Road or El Mirage Road, access to the Site would occur from Indian School 
Road via a private access road to be improved with the Project within an easement granted to the 
Applicant by the property owner. This private access road would utilize an existing driveway 
located approximately ¼-mile east of El Mirage Road. Indian School Road has an existing two-
way left-turn lane at this location. A new access controlled gated entrance would be provided at 
the north end of the private access road at the Project boundary. The Project’s access and its 
location have been analyzed in the Traffic Statement for the Project and found to be acceptable. 
 
 
 The proposed BESS use is expected to generate minimal additional traffic, and relatively 
low traffic volumes exist today on Indian School Road in this area. Because the Project has no 
frontage on Indian School Road, right-of-way dedications and half-street improvements are not 
necessary and not required with this Project. 
 
Circulation System 
 
 
As noted above, access to the Site would occur from Indian School Road via an existing 
driveway that would connect to a private access road that would be improved with the Project and 
would connect to an access controlled gated entrance at the Project boundary. Internal drives would 
then allow employees and maintenance and emergency vehicles to access all areas of the Site, 
including the battery storage cabinets and the on-site electrical substation. The internal drives 
would allow for these vehicles to be moved around the site in a circular pattern, meeting all fire 
access width and turning radii requirements. 
 
Development Schedule 
 
 
The proposed improvements for the BESS are expected to be constructed in a single phase, 
commencing after the County’s approval of the Zone Change and issuance of required building 
permits. Construction will most likely begin in early 2026 and last for a period of approximately 
12 months.

As noted above, the proposed BESS use is anticipated to have a maximum of three (3) on-
site employees. Consequently, the proposed BESS use would have no impact whatsoever on 
community facilities and services in the area such as schools, parks, libraries, etc.

The Site is located within the City of Phoenix’s planning area and is designated “0 – 1 
DU/Acre – Large Lot” under the City’s General Plan, as is much of the surrounding area along the 
Agua Fria River. So technically the Project is not compatible with the City’s General Plan in terms 
of land uses anticipated within the “0 – 1 DU/Acre – Large Lot” designation. That said, given that 
the Site is essentially surrounded by existing aggregate mining uses and flood control facilities 
associated with the Agua Fria River, we don’t believe the City will have any significant concerns 
with the Project or its location. The Project has been discussed with the City’s Village Planner for 
this area (Maryvale Village) who didn’t express any significant concerns with the BESS use at this 
location. We understand that this application will be formally routed to the City for review and the 
City reserves the right for future comments as it goes through the review process. Additionally, to 
ensure compatibility with the surrounding land uses (both existing and planned), the IUPD 
associated with this Zone Change request proposes to limit the permitted uses on the Site to those 
related to the BESS (see Table 1 above). 
 
Conclusion 
 
 
The proposed Project and this Zone Change request are in compliance with the Maricopa 
County Comprehensive Plan (White Tank/Grand Avenue Area Plan). The Project is situated near 
an existing APS electrical substation, surrounded by existing aggregate mining operations, and set 
back approximately 1,600 feet from both Indian School Road and El Mirage Road. As noted above, 
the Applicant has also taken extra measures to maximize the compatibility of the Zone Change 
and the BESS use with the surrounding area. The proposed BESS would enhance the regional 
electrical grid by safely storing abundant electricity generated by renewable energy during daylight 
hours and then feeding that energy back into the grid in the evening when it is most needed.

engineering design shall be in conformance with Section 1205 of the Maricopa

El Mirage Road approximately 1/4 mile north of Indian School Rd and west of 
Indian School Rd/ El Mirage Rd intersection is within the city of Avondale’s

of El Mirage Rd through an existing road and easement currently served by

The Arizona Game and Fish Department (Department) appreciates the opportunity to review the
proposed White Tanks Energy Storage project. The Department understands that Strata Clean
Energy LLC proposes to construct a Battery Energy Storage System (BESS) and associated
infrastructure on approximately 9 acres of private lands near Peoria in Maricopa County,
Arizona. BESSs safely store abundant electricity generated by renewable energy during daylight
hours and then feed that energy back into the power grid in the evening when it is most needed.
The proposed facility is capable of storing enough electricity to power 80,000 homes and
businesses in the valley for four hours. The facility will be located on unincorporated land
surrounded by an existing aggregate mining operation along the Agua Fria River and east of the
APS electrical substation for generation intertie (gen-tie) connection. The private access road
would be improved and gated. The habitat is dominated by sonoran desertscrub and xeric
riparian within the Agua Fria River.
Under Title 17 of the Arizona Revised Statutes, the Department, by and through the Arizona
Game and Fish Commission, has jurisdictional authority and public trust responsibilities to
conserve and protect the state fish and wildlife resources. In addition, the Department manages
threatened and endangered species through authorities of Section 6 of the Endangered Species
Act and the Department’s Section 10(a)(1)(A) permit. It is the mission of the Department to
conserve and protect Arizona's diverse fish and wildlife resources and manage for safe,
compatible outdoor recreation opportunities for current and future generations.
The Department recognizes the importance of planning efforts to develop and storage for
renewable energy locations that contribute to regional and state economic growth needs and
would like to work closely with Strata Clean Energy LLC and Rose Law Group during the
planning and development of this facility. The Department recognizes that appropriate
coordination, proper planning, and voluntary implementation of best management practices
allow projects to be developed that avoid, minimize, or offset potential negative impacts to

wildlife and recreational access during development and operation of the facilities. For your
consideration, the Department provides the following comments based on the agency's statutory
authorities, public trust responsibilities, and special expertise related to wildlife resources and
recreation.
Attached for your review is a report from the Department’s Environmental Review Tool,
HGIS-20795, identifying general best management practices for the BESS. In addition, the
Department offers the following general recommendations to further reduce potential impacts to
wildlife and habitat during construction and operation of the BESS facility:

The western burrowing owl, a special status species that is regulated under the Migratory
Bird Treaty Act (MBTA), has been documented within 2.5 miles of the project area. The
Department recommends conducting occupancy surveys for this species in advance of the
design phase to understand distribution of burrowing owls in the project site; avoidance
of a large burrowing owl population may be advisable over removal or other conservation
measures. Guidelines for conducting this survey are found in Burrowing Owl Project
Clearance Guidance for Landowners . Please note that the survey should be conducted

by a surveyor who is certified by the Department or has similar training and
qualifications. If an active burrowing owl burrow is detected, please contact the
Department and the U.S. Fish and Wildlife Service
(USFWS) for direction, in

accordance with the guidelines.
●
If trenching or digging of large holes is necessary, the Department recommends
trenching/digging and backfilling crews be close together to minimize the amount of
open holes at any given time. Where trenches or holes cannot be back-filled immediately,
the Department recommends escape ramps be constructed in each hole and at least every
90 meters in trenches. Escape ramps can be short lateral trenches or wooden planks
sloping to the surface. The Department recommends that slopes be less than 45 degrees
(1:1) and trenches and holes that have been left open be inspected to remove animals
prior to backfilling.

(SGCN), represent potential species distribution models for the State of Arizona which are subject to
ongoing change, modification and refinement. The status of a wildlife resource can change quickly, and
the availability of new data will necessitate a refined assessment.

Project Type Recommendations:
Fence recommendations will be dependent upon the goals of the fence project and the wildlife species expected to be
impacted by the project. General guidelines for ensuring wildlife-friendly fences include: barbless wire on the top and
bottom with the maximum fence height 42", minimum height for bottom 16". Modifications to this design may be
considered for fencing anticipated to be routinely encountered by elk, bighorn sheep or pronghorn (e.g., Pronghorn
fencing would require 18" minimum height on the bottom). Please refer to the Department's Fencing Guidelines located
on Wildlife Friendly Guidelines page, which is part of the Wildlife Planning
button at  https://www.azgfd.com/wildlife-conservation/planning-for-wildlife/planning-for-wildlife-wildlife-friendly-
guidelines/.
Consider impacts of outdoor lighting on wildlife and develop measures or alternatives that can be taken to increase
human safety while minimizing potential impacts to wildlife. Conduct wildlife surveys to determine species within project
area, and evaluate proposed activities based on species biology and natural history to determine if artificial lighting may
disrupt behavior patterns or habitat use. Use only the minimum amount of light needed for safety. Narrow spectrum bulbs
should be used as often as possible to lower the range of species affected by lighting. All lighting should be shielded,
canted, or cut to ensure that light reaches only areas needing illumination.
Minimize the potential introduction or spread of exotic invasive species, including aquatic and terrestrial plants, animals,
insects and pathogens. Precautions should be taken to wash and/or decontaminate all equipment utilized in the project
activities before entering and leaving the site. See the Arizona Department of Agriculture website for a list of prohibited
and restricted noxious weeds at https://www.invasivespeciesinfo.gov/unitedstates/az.shtml and the Arizona Native Plant
Society https://aznps.com/invas for recommendations on how to control. To view a list of documented invasive species or
to report invasive species in or near your project area visit iMapInvasives - a national cloud-based application for tracking
and managing invasive species at https://imap.natureserve.org/imap/services/page/map.html. 
To build a list: zoom to your area of interest, use the identify/measure tool to draw a polygon around your area of
interest, and select “See What’s Here” for a list of reported species. To export the list, you must have an
account and be logged in. You can then use the export tool to draw a boundary and export the records in a csv
file. 
 
Follow manufacturer's recommended application guidelines for all chemical treatments. The U.S. Fish and Wildlife
Service, Integrated Pest Management Group has a reference document that serves as their pesticide recommendations
for protecting wildlife and fisheries resources, titled "Reducing Risks to Pollinators from Pest
Control",

Department recommends that direct or indirect impacts to sensitive species and their forage base from the application of
chemical pesticides or herbicides be considered carefully.
The Department recommends that wildlife surveys are conducted to determine if noise-sensitive species occur within the
project area. Avoidance or minimization measures could include conducting project activities outside of breeding
seasons.

For any powerlines built, proper design and construction of the transmission line is necessary to prevent or minimize risk
of electrocution of raptors, owls, vultures, and golden or bald eagles, which are protected under state and federal laws.
Limit project activities during the breeding season for birds, generally March through late August, depending on species
in the local area (raptors breed in early February through May). Conduct avian surveys to determine bird species that
may be utilizing the area and develop a plan to avoid disturbance during the nesting season. For underground
powerlines, trenches should be covered or back-filled as soon as possible. Incorporate escape ramps in ditches or
fencing along the perimeter to deter small mammals and herpetofauna (snakes, lizards, tortoise) from entering ditches. In
addition, indirect affects to wildlife due to construction (timing of activity, clearing of rights-of-way, associated bridges and
culverts, affects to wetlands, fences) should also be considered and mitigated.

Trenches should be covered or back-filled as soon as possible. Incorporate escape ramps in ditches or fencing along the
perimeter to deter small mammals and herpetofauna (snakes, lizards, tortoise) from entering ditches.
Vegetation restoration projects (including treatments of invasive or exotic species) should have a completed site-
evaluation plan (identifying environmental conditions necessary to re-establish native vegetation), a revegetation plan
(species, density, method of establishment), a short and long-term monitoring plan, including adaptive management
guidelines to address needs for replacement vegetation.
Project Location and/or Species Recommendations:
Analysis indicates that your project is located in the vicinity of an identified wildlife habitat connectivity feature. The 
County-level Stakeholder Assessments contain five categories of data (Barrier/Development, Wildlife Crossing Area,
Wildlife Movement Area- Diffuse, Wildlife movement Area- Landscape, Wildlife Movement Area- Riparian/Washes) that
provide a context of select anthropogenic barriers, and potential connectivity. The reports provide recommendations for
opportunities to preserve or enhance permeability. Project planning and implementation efforts should focus on
maintaining and improving opportunities for wildlife permeability. For information pertaining to the linkage assessment

During publication of the staff report, staff was in communications with the applicant regarding 
the language of several of the proposed conditions. It has been agreed through these 
communications that staff allows for changes to conditions ‘a’, ‘f’, ‘h’, i’ and ‘j’.  Additionally, staff 
has changed the subheadings of condition ‘g’ to contain numerals rather than letters. The 
conditions will now read as follows (changes in bold and underlined): 
 
a. 
Development of the site shall be in substantial conformance with the narrative report 
entitled “Zone Change with Overlay – White Tank Energy Storage”, consisting of 12 
pages, dated 12/21/2023, and stamped received 12/26/2023, except as modified 
by the following conditions. 
 
f. 
Prior to issuance of initial building permits, a lot split shall be processed to create a 
single, separate parcel matching the zone change area. 
 
g. 
The following Planning Engineering conditions shall apply: 
 
1. Without the submittal of a precise plan of development, no development approval 
is inferred by this review, including, but not limited to number of proposed building 
lots/units, drainage design, access and roadway alignments. These items will be 
addressed as development plans progress and are submitted to the County for 
further review and/or entitlement. 
 
2. A Preliminary Grading and Drainage Plan and Drainage Report are required with 
the Plan of Development. The Maricopa County Zoning Ordinance (MCZO) 
required that all commercial submittals be prepared by a Civil Engineer registered 
in the State of Arizona. (MCZO 1205.7.2) 
 
3. For retention volumes required, please see section 6.10.5 of the Maricopa County 
Drainage Policies and Standards Manual for the equation, V=C*(P/12)*A. The 
100-year, 2-hour rainfall depth (P) in inches can be taken from NOAA Atlas 14. 
The volumes, using this equation, vary slightly compared to the drainage report 
and does not affect the overall volume provided. This can be addressed during 
the Plan of Development.

date interactive Engineering Plan Review checklist. (Please be sure to check 
commercial and all related grading matters so the checklist expands properly). 
 
5. This site contains Special Flood Hazard Areas (FEMA Zone AH) along the 
proposed access route and within the site. 
 
6. Any development in the floodplain will require a floodplain use permit issued 
concurrent with building permit(s) required for site development. Structures in the 
floodplain must be elevated to the regulatory flood elevation determined by the 
engineer. 
 
7. The site is adjacent to lands owned or encumbered by the Flood Control District. 
In addition to floodplain use permitting, ROW permitting may be required by the 
District. 
 
8. Please see MCDOT TIS approval attached. A traffic impact study must also be 
submitted with future entitlement (POD) application(s). 
 
9. Gated access(es) must provide an adequate turnaround area so that vehicles will 
not back onto public roads. 
 
10. The City of Phoenix maintains a +/- 45’ strip annexation north of Indian School 
Road. The applicant will be responsible for coordinating with the City to review 
any permitting requirements for work in their jurisdiction. 
 
11. The subject site is located within the County’s Urbanized Area and thus will 
require a Storm Water Pollution Prevention Permit (SWPPP) from the County for 
any disturbance one (1) acre or more. The SWPPP is issued by the County (PND) 
and will be required prior to issuance of any building permits required for site 
development. 
 
12. Engineering review of re-zone cases is conceptual in nature. All development and 
engineering design shall be in conformance with Section 1205 of the Maricopa 
County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of application for 
construction. 
 
h. 
Noncompliance with any Maricopa County regulation shall be grounds for initiating 
a revocation of this zone change per the process set forth in the Maricopa County 
Zoning Ordinance. Any action by Maricopa County to revoke this zone change shall 
only occur following any and all required notices (including identification of the 
specific noncompliance issue) and cure periods and shall be subject to required

public hearings before the Planning & Zoning Commission and Board of 
Supervisors, as set forth in the Maricopa County Zoning Ordinance. 
 
i. 
The property owner/s and their successors waive claim for diminution in value if 
Maricopa County takes action to rescind approval due to noncompliance with 
conditions. Any action by Maricopa County to rescind approval shall only occur 
following any and all required notices (including identification of the specific 
noncompliance issue) and cure periods and shall be subject to required public 
hearings before the Planning & Zoning Commission and Board of Supervisors, as 
set forth in the Maricopa County Zoning Ordinance. 
 
j. 
The granting of this change in use of the property has been at the request of the 
applicant, with the consent of the landowner. The granting of this approval allows 
the property to enjoy uses in excess of those permitted by the zoning existing on the 
date of application, subject to conditions. Failure to comply with any condition may 
be grounds for consideration of initiating the process to revert the zoning back to 
the previous Rural-43, in accordance with Maricopa County requirements and 
procedures. Any action by Maricopa County to revert the zoning shall only occur 
following any and all required notices (including identification of the specific 
noncompliance issue) and cure periods and shall be subject to required public 
hearings before the Planning & Zoning Commission and Board of Supervisors, as 
set forth in the Maricopa County Zoning Ordinance. It is, therefore, stipulated and 
agreed that either revocation due to the failure to comply with any conditions, does 
not reduce any rights that existed on the date of application to use, divide, sell or 
possess the property and that there would be no diminution in value of the property 
from the value it held on the date of application due to such revocation of the zone 
change. The zone change enhances the value of the property above its value as of 
the date the zone change is granted and reverting to the prior zoning results in the 
same value of the property as if the zone change had never been granted.

conformance with the permitted uses and development standards for the IND-2 IUPD, not specifics of
site planning. That’s why I edited it the way I did.
 
And it’s really the same concern with ‘b’. Even though we are calling it a zoning exhibit, it is in fact a site
plan that shows a very specific layout and design that is not being approved here so saying that a future
POD has to be in substantial conformance with that doesn’t make sense to me. That’s why I was
suggesting to remove it. Though I suppose we could keep it and just add the same language like I added
in ‘a’.
 
And finally on ‘f’, it doesn’t make sense to keep the language as-is because there will never be a parcel
combination done. We are rezoning a portion of an existing parcel so the action that needs to happen in
the future is a lot split, not a combination.

Thanks Joel. We’ll definitely have some changes to request. I think I had emailed you previously that we
worked on some modified language on some of these stipulations with Darren Gerard on Strata’s other
BESS rezoning case that’s going through right now (Z2023028) and we’ll want to use the same
language on this one. I’ll redline something up and get it to you by Tuesday.
