1) CALL TO ORDER: Hearing convened at 5:31 p.m. and was called to order by Chair Morrow
2) CHAIR/STAFF UPDATES/ANNOUNCMENTS:
Chair Morrow stated that this is his last meeting as Chair. This is Board Member’s Keagy’s last meeting serving on the
Board of Adjustment. For transparency, Chair Morrow stated that he and the appellant, Ms. Dawn Sinclair, served on
the same criminal case but not at the same time. Chair Morrow also shared that he and Judge Donahoe are on a state
bar committee but have never met in person. In both cases there is no conflict with his role on the Board. Chair Morrow
stated that he had emailed Mr. Ryan Levesque today and asked zoning history questions:

When the Use Permit for second story developments was implemented
•
Why there were no two-story buildings in the Broadmor Neighborhood built?
•
In this neighborhood, is a 30-foot height restriction currently?
Mr. Levesque stated that R-16 zoning restricts maximum heights for single family zoning to 30 feet in height.
Chair Morrow asked, has it always been 30 feet, or did that change?
Mr. Levesque stated that the ordinance that was effective during 1958-1962 was Ordinance 268 and at that time the
code specifically stated that maximum height shall be two-story and maximum 30-feet in height and no building could
be less than 1-story. The developer of this neighborhood had some deed restrictions that limited the properties to be
only 1-story. Mr. Levesque stated that the other question asked was when did the Use Permit for second stories come
into play, that was in February 1987. Chair Morrow stated that it does not apply to new builds, did it previously apply to
new builds? Mr. Levesque stated that primarily it had to do with additions of a single-story home that triggered the need
for a Use Permit and public hearing.
Board Member McCarley asked, in the CC&R’s does it restrict buildings to 30-feet? Mr. Levesque stated that he believes
it references stories. The City of Tempe has no regulatory review or power over administrating CC&R’s or private deed
restrictions. Those are handled by the HOA’s or property owners.
Ms. Diana Kaminski stated that there will be a BOA meeting in January. We will also have a new Board Member joining,
Mr. Richard Dalton. We will also elect a new Chair at the January meeting.
