Minutes of the regular public hearing of the Hearing Officer, of the City of Tempe, which was held at the Council 
Chambers, 31 East Fifth Street, Tempe, Arizona.  
 
REGULAR SESSION 5:00 PM

There were two (2) interested citizens present. 
 
Meeting convened at 5:00 PM and was called to order by Vanessa MacDonald.  Hearing Officer MacDonald 
stated anyone wishing to appeal a decision will need to file a written appeal within fourteen (14) calendar days, 
by February 3, 2026 at 3:00 PM, to the Community Development Department.

January 6, 2026 Hearing Officer Minutes 
Vanessa MacDonald, Hearing Officer, stated that the January 6, 2026 Hearing Officer Minutes had been 
reviewed and were approved. 
 
 
2. Agenda Item No. 2 
 
Request approval to abate public nuisance items at CECERE PROPERTY located at 504 East Carver Road. The 
applicant is the City of Tempe (CE252390). 
• 
Melissa Ensing, Code Inspector, gave the following overview of this case: 
o Inspector Ensing requested a 180-day open abatement for 504 East Carver Road. 
o The case was initiated on 4/23/25 for a green pool but discovered deteriorating landscape. 
o Two (2) complaints have been submitted to the Code Compliance Division. 
o A citation was also issued. The property owner did not pay the fee and it was sent to collections. 
o The inspector then presented photos taken earlier in the day showcasing the violations on site.

Shawn Daffara stated no contact has been made by the property owner or any other member of the public 
to speak on behalf of this case. 
•

Request approval to abate public nuisance items at the SCHMITT PROPERTY located at 1552 East Drake Drive. 
The applicant is the City of Tempe (CE251565). 
• 
Melissa Ensing, Code Inspector, gave the following overview of this case: 
o Inspector Ensing requested a 180-day open abatement for 1552 East Drake Drive. 
o The case was initiated on 3/12/25 for a dead tree in the rear yard. 
o After a follow up inspection, commercial pool equipment was found in the rear yard.  
o A citation was also issued. The property owner did not pay the fee and it was sent to collections. 
o The inspector then presented photos taken earlier in the day showcasing the violations on site. 
• 
Shawn Daffara stated no contact has been made by the property owner or any other member of the public 
to speak on behalf of this case. 
• 
Hearing Officer MacDonald approved the 180-day open abatement request found in CE251565. 
 
 
4. Agenda Item No. 4 
 
Request approval to abate public nuisance items at the ABBOTT TRUST PROPERTY located at 328 East Palmcroft 
Drive. The applicant is the City of Tempe (CE255612). 
• 
John Salazar, Code Inspector Supervisor, gave the following overview of this case: 
o Supervisor Salazar requested a 180-day open abatement for 328 East Palmcroft Drive. 
o The case was initiated on 9/17/25 for deteriorating landscape.  
o Two (2) complaints have been submitted to the Code Compliance Division 
o Multiple attempts were made to contact the property owner’s family due to the property owner 
being deceased. 
o The inspector then presented photos taken earlier in the day showcasing the violations on site. 
• 
Shawn Daffara stated no contact has been made by the property owner or any other member of the public 
to speak on behalf of this case. 
• 
Hearing Officer MacDonald approved the 180-day open abatement request found in CE255612. 
 
 
5. Agenda Item No. 5 
 
Request approval to abate public nuisance items at the HALE PROPERTY located at 1849 East Hayden Lane. The 
applicant is the City of Tempe (CE216657). 
• 
Andres Lara - Reyes, Code Inspector, gave the following overview of this case: 
o Inspector Lara - Reyes requested a 180-day open abatement for 1849 East Hayden Lane. 
o The case was initiated on 10/27/21 for junk and debris, storage container and utility trailer in the 
front yard.  
o Over the years some progress has been made with multiple extensions granted. 
o Additional complaints have been submitted to the Code Compliance Division 
o Four (4) citations have been issued to the property owner, and they have all been paid. 
o The inspector then presented photos taken earlier in the day showcasing the violations on site. 
o The property owner and his son were both in attendance and spoke about the progress made on 
the property and their concerns with the abatement process  
• 
Shawn Daffara stated no contact has been made by any other member of the public to speak on behalf of 
this case. 
• 
Hearing Officer MacDonald approved the 180-day open abatement request found in CE216657. 
 
 
6. Agenda Item No. 6 
 
Request approval to abate public nuisance items at the MILES PROPERTY located at 702 East Taylor Street. The 
applicant is the City of Tempe (CE253851).

• 
Michael Moreno, Code Inspector, gave the following overview of this case: 
o Inspector Moreno requested a 180-day open abatement for 702 East Taylor Street. 
o The case was initiated on 6/24/25 for deteriorating landscape in the front and rear yards. 
o Additional violations we found in the rear yard made up of junk and debris. 
o Contact was made with the property owner’s son who requested additional time. Information for 
Tempe’s CARE7 team was provided and the extension was granted. 
o A citation was also issued. The property owner did not pay the fee and it was sent to collections. 
o The inspector then presented photos taken earlier in the day showcasing the violations on site. 
• 
Shawn Daffara stated no contact has been made by the property owner or any other member of the public 
to speak on behalf of this case. 
• 
Hearing Officer MacDonald approved the 180-day open abatement request found in CE253851. 
 
 
 
 
ANNOUNCEMENTS 
 
• 
Shawn Daffara announced the next Hearing Officer meeting is scheduled to take place on February 3, 2026 
in the Tempe City Council Chambers and broadcast live through Tempe 11.
