Chair Keith Burke called the meeting to order at 2:01 p.m.

1. Consideration of Meeting Minutes
Motion by Christian Phillips to approve the November 6, 2025 Joint Fire & Police PSPRS Board Meeting Minutes,
November 6, 2025 Police PSPRS Board Meeting Minutes and the November 6, Police PSPRS Board Executive
Session Meeting Minutes; second by Lori Messer. Motion passed on a voice vote 3-0.

Ayes: Chair Burke; Boardmembers Messer and Phillips
Nays: None
Absent: Boardmembers Arredondo and Kidd

2. Motion to Adjourn to Executive Session, if necessary
Motion by Christian Phillips to adjourn to Executive Session for the purpose of obtaining legal advice from the
Board’s Legal Counsel and to discuss confidential records by law; second by Brian Kidd. Motion passed on a voice
vote 3-0.

The Board adjourned to Executive Session at 2:12 p.m. The Board reconvened at 3:04 p.m.

3. Hearing on the Application for Accidental Disability Benefits for Zachary Hyde (continued from
September 4, 2025 and November 6, 2025)
Chair Burke said that this is a continuation of the hearing on the application for accidental disability benefits for
Zachary Hyde. At the September 4, 2025 hearing, the Board made a motion to table the application pending receipt
of additional medical records as well as the police incident report from 6/20/2024, Mr. Hyde’s personnel file and
Internal Affairs files. At the November 6, 2025 meeting, the Board made a motion to table the application to allow for
additional time to review the records. At today’s hearing the Board must determine whether the documentation
submitted is sufficient to conclude that the statutory requirements are satisfied for the Board to direct that Mr. Hyde
be sent for an Independent Medical Exam (IME).

Chair Burke asked if anyone would like to address the board. Mr. Wisniewski, attorney for Zachary Hyde, had no
comment.

Motion by Christian Phillips to deny the application for accidental disability benefits for Zachary Hyde due to a lack of
medical evidence that states the injury or condition is total and permanently disabling, as well as evidence that the
employee terminated employment with the City of Tempe for reasons other than the stated injury or disability;
Second by Lori Messer. Motion passed on a voice vote 3-0.

The following questions from the Accidental Disability Questionnaire, Form P5-LB-A were read out loud and verbally
affirmed by the Board:

1. Did the employee file the application after the disabling incident, or within one year of ceasing to be an employee?
Yes

2. Did (or will) the employee terminate by a reason of disability? No

3. Did employment terminate based on a disciplinary action? Yes (discipline was in process)

4. If the member's period of DROP has ended, if applicable, did (or will) the employee terminate by a reason of
disability? Not Applicable

5. Is the employee still working in a position within their job classification that the Local Board considers a reasonable

range of duties position? No

6. Has the employee refused a position within their job classification that the Local Board considered a reasonable

range of duties? No

7. Did the injury or condition occur prior to the current PSPRS membership date? No

8. Was the injury or condition the result of an event incurred during the performance of the employee's duty? No

4. New Members
Motion by Chris Phillips to approve the new member applications of Chenan Chin (pre-existing condition); Second
by Lori Messer. Motion passed on a voice vote 3-0.

5. Review of Retiree Return to Work
Chair Burke asked Board Secretary Kathleen Broman to address this item. Ms. Broman said that according to the
Arizona Revised Statutes, the board is required to review retired members from any agency who are being hired by
the City of Tempe to ensure they are not in violation of the Return-to-Work statute.

Boardmember Phillips said that after having reviewed the information presented, it is recommended the Board find
that Young Chang and Matthew Buesing both retired from an employer other than City of Tempe and are not ina
position ordinarily filled by an employee of an eligible group. The alternate contribution rate is not required because
the positions of Code Inspector and Pro Tem Judge are not ordinarily filled by a contributing PSPRS member.

Motion by Christian Phillips to accept the findings as stated; Second by Lori Messer. Motion passed on a voice vote
3-0.

6. PSPRS Update
Chair Burke asked Board Secretary Kathleen Broman to address this item. Ms. Broman said that the information on
local board virtual training is included in the packet.

7. Future Meeting Date
The next meeting is scheduled for January 8, 2026.

8. Future Agenda Items
Ms. Sorensen said that PSPRS will be issuing their annual valuation, later this month. The board will need to review it
at an upcoming meeting, as well as the annual review of members receiving disability benefits.

9. Public Appearances
There were no public appearances.
