RESOLUTION NO. R2026.18
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPE, 
ARIZONA, TO AUTHORIZE THE MAYOR OR DESIGNEE TO 
EXECUTE AN INTERGOVERNMENTAL AGREEMENT WITH THE 
CITY OF PHOENIX IN SUPPORT OF A FOREIGN TRADE ZONE 
APPLICATION BY ARIZONA CUSTOM BLENDS LOCATED AT 2130 
SOUTH INDUSTRIAL PARK AVENUE AND 1222 WEST 23RD 
STREET, TEMPE, AZ.
WHEREAS, Arizona Custom Blends is an important component of Tempe, Arizona and
its continued growth is in the best interests of the City of Tempe; and,
WHEREAS, Arizona Custom Blends is applying to the U.S. Department of Commerce for 
Foreign Trade Sub-Zone Status for its current manufacturing facility located 2130 South Industrial 
Avenue in Tempe, Arizona; and
WHEREAS, Arizona Custom Blends has stated that its intent in applying for Foreign Trade 
Sub-Zone Status is related to tariff treatment under federal law and Arizona Custom Blends has 
agreed that it will not seek reclassification of its status in relation to real property taxes at the state 
and local level;
WHEREAS, Arizona Custom Blends is a source of manufacturing employment in the City 
of Tempe; and
WHEREAS, Foreign Trade Sub-Zone status will be an important aspect of Arizona Custom 
Blends’ operations, which enhances the opportunity for local economic activity that will benefit 
the City of Tempe; 
WHEREAS, the City of Phoenix has established Foreign Trade Zone No. 75 with the 
United States Department of Commerce which encompasses substantial portions of Maricopa 
County including the City of Tempe; and
WHEREAS, the City of Phoenix has indicated its willingness to accept Arizona Custom 
Blends as a subzone within Foreign Trade Zone No. 75;  
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF 
TEMPE, ARIZONA, as follows:
Section 1.  The City hereby expresses its support of the Foreign Trade Sub-Zone 
Application by Arizona Custom Blends to the Federal Government for Foreign Trade Zone Status 
Designation, and the City requests that the Arizona Custom Blends application be duly considered 
and expeditiously approved by the Foreign Trade Zones Board of the Department of Commerce.
Section 2.  The Mayor of the City of Tempe is authorized and directed to execute an 
Intergovernmental Agreement with the City of Phoenix in support of designation of Arizona 
Custom Blends as a subzone within Foreign Trade Zone No. 75.

Section 3.  The City Manager or designee is authorized to execute such further documents 
and take such further actions as may be necessary to carry out the purposes of this Resolution.
Section 4.  In the event that Arizona Custom Blends should seek real property tax 
reclassification under state or local law as a result of designation as a Foreign Trade subzone, the 
City of Tempe’s support as expressed in this resolution shall be deemed withdrawn and the City 
shall take all necessary further actions to terminate the Intergovernmental Agreement with 
Phoenix.
PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF TEMPE, 
ARIZONA, this 5th day of March, 2026.
