MALEE SPA USE PERMIT PETITION 
 
February 2nd, 2026 
Dear City of Tempe Planning Department: 
 
I am write this letter to request the use permit for a suite located at 1636 North Scottsdale Road, 
Tempe, AZ 85281. The subject building was built in 1979 as part of a small retail center located on the 
southwest corner of Scottsdale Road and Cavalier Drive.  
The business being proposed at 1646 North Scottsdale Road is a massage spa services location for 
Malee Spa. The business model of Malee Spa focuses on providing massage therapy services to clients 
who need the expertise of a massage therapist. 
Malee Spa is a first time business that will be operated by husband and wife owners. The spa is 
targeting to operate between the hours of 10am-7pm Monday-Sunday. Typically, this business will 
have low foot traffic, as it’s a small massage spa with only 4 treatment rooms. The spa will typically 
have two employees servicing clientele and it’s very normal to have 2-3 customers receiving service at 
one time. The maximum occupancy at any time will be less than 15 people in the entire suite. 
This Malee Spa location will have no negative impact on the surrounding community as their business 
model is a low-foot traffic operation, and the hours are within normal massage spa business hours for 
this type of business. There will not be a large amount of increase in traffic, and this will serve to 
economically bolster a commercial center that has recently started to see more vacant suites. Our total 
maximum occupant load is 6, which per the Owner’s estimation is well beyond the typical business 
solicited for a spa of this size.  
There are no exterior modifications proposed outside of this space and this use is compatible with all 
the similar retail business use types within this commercial plaza.  The use mirror’s Tempe General Plan 
for commercial uses in this zoning district and mirrors the Papago/North Tempe Character Plan under 
the “Commercial” Land Use Description of retail, services and medical uses.

Our proposal for this space will not be detrimental to persons residing or working in the vicinity, 
adjacent properties, to the neighborhood of the public welfare for the following reasons: 
a) Any significant vehicular or pedestrian traffic in adjacent areas; 
Response: Malee Spa is a low-traffic retail business model that does not generate any more 
traffic than a typical small scale business would in this area. The entire suite is only 1,200 SF of 
area, which is very small in size. 
b) Nuisance arising from the emission of odor, dust, gas, noise, vibration, smoke, heat or glare at a 
level exceeding that of ambient conditions; 
 
Response: Malee Spa’s business model will not create any emissions of odor, dust, gas, noise, 
vibration, smoke, heat or glare at a level exceeding that of ambient conditions;

c) Contribution to the deterioration of the neighborhood or to the downgrading of property values, 
which is conflict with the goals, objectives or policies of the city’s adopted plans for General Plan; 
 
Response: Malee Spa’s business model will NOT contribute to the deterioration of the 
neighborhood or to the downgrading of property values, which is conflict with the goals, 
objectives or policies of the city’s adopted plans for General Plan. It will in fact be the opposite 
and be an asset to the surrounding community, providing a massage services to those in the 
area looking for that type of massage therapy. 
 
d) Compatibility with existing surrounding structures and uses; and  
 
Response: Malee Spa’s massage use will not affect the exterior of the building, surrounding 
structures or uses. The use permit being requested will be inside of the subject suite. 
 
e) Adequate control of disruptive behavior both inside and outside the premises, which may create a 
nuisance to the surrounding area or general public. 
 
Response: Malee Spa’s use creates no disruptive behavior inside or outside the premises. This 
small business works to become an active and welcome participant in the community at large. 
There will not be an alarm system, but the retail center’s common security plan will cover this 
location. 
Malee Spa’s proposed Use Permit meets the intent of the City of Tempe General Plan and the 
Papago/North Tempe Character Area in terms of massage spa use within a commercial zoning district.  
The General Plan speaks of activating commercial and employment activity centers, a category in 
which this commercial plaza falls into. Malee Spa also complies with the City of Tempe’s goals to 
promote sustainable business practices by allowing small business owners an opportunity to operate 
their business.  
My client’s business promotes this goal outlined in the 2050 General Plan: 
Integrates sustainable actions in the community for a circular economy to reduce, reuse and 
recycle, such as to use water resources wisely, reduce energy consumption and greenhouse gases, 
and manage extreme heat. 
In my professional opinion this permit petition is within both the City of Tempe’s General Plan for this 
zoning district and the larger need within the community for cost-effective massage services. Massage 
therapy services are a vital service for those seeking treatment for soreness and tightness in their 
muscular system. 
We are humbly asking the Planning Department to support and approve this Use Permit request for the 
Malee Spa in Tempe at 1646 N. Scottsdale Road. 
I’ve had conversations with Planner Warner, who believes that our business model complies with the 
allowable uses in this zoning district and that the use should not be considered a nuisance within the

larger community. Malee Spa looks forward to being a good neighbor and contributing to small 
business within the greater Tempe community.
